Alleged Libyan Draft Constitution: Sharia Law is ‘Principal Source of Legislation’

Although Libyan rebels only just took control over the capital city of Tripoli over the weekend, a draft version of a new constitution for the transitional state has allegedly been penned and appears online. What is perhaps most disturbing, however, is that the charter’s “principal source of legislation” will be Sharia law. Even with a new regime, “reform” still does not seem to be an operative word for a new Libya.

According to Part 1, Article 1 of the alleged draft: “Islam is the Religion of the State, and the principal source of legislation is Islamic Jurisprudence (Sharia).” Heritage points out that other phrases contained in the draft, such as “there shall be no crime or penalty except by virtue of the law” and “judges shall be independent, subject to no other authority but law and conscience” seem all the more foreboding given the basis for the country’s entire legislation will be Sharia law.

Heritage adds:

It is just a draft, mind you, and gauging its authenticity at this point is difficult. There is also no way to know whether this draft or something similar will emerge as the final governing document for a new Libyan regime.

As both the Morning Bell and Washington in a Flash noted today, Heritage Fellow Jim Phillips recently pointed out that Islamist forces “appear to make up a small but not insignificant part of the opposition coalition,” and must be prevented “from hijacking Libya’s future.” Parts of the draft Constitution allay those fears, while others exacerbate them.

Much of the document describes political institutions that will sound familiar to citizens of Western liberal democracies, including rule of law, freedom of speech and religious practice, and a multi-party electoral system.

      This is why we need to support Ron Paul, I believe that he is the true statesman we have been looking for. I am disappointed in Glenn for not at least personally talking to Ron or having a debate with him regarding the issues that divide them. I have followed Glenn since he first came on fox, but Glenn it takes courage to admit when you are wrong as well. I would suggest that you at least take the time to study Ron Paul on the issues, which as you know you can’t get in a 1 minute answer in a debate forum. It is worth at least 1hour of your time, after all it is only our republic at stake

      If it is a book of myths and fairytales, how do you explain the prophecy in said book. Specifically look at the nation of little bitty Israel. Look how it was told that it would spread to the four corners of the earth, be targeted, tortured, and hated and killed. Prophecy told us that it would return to the homeland, and would not be destroyed again. How do you explain Israel being able to hold off the entire muslim world, when most nations surrounding, want to wipe it off the face of the earth?

      Explain the prophecy concerning Jesus. Hundreds and hundreds of years before his birth, we were told where and how he would be born, where he would live, how and where he would die. Explain that? No other religion in the history of the world is able to have accurate prophecy.

    So they just went from one psycho dictator to a whole bunch of them! And all the while they were “begging” for America’s help. And we gave it, not really knowing who it was we were helping. Or did we…? Those people wanted Democracy. What they got will be a whole lot worse…for the women anyways. Israel is being surrounded by an enemy with a common goal.

      Like many conservatives have stated..we don’t know the complexion of the resistance in Libya yet we jumped right in to help them. Same mistake we made in Egypt let alone watching Tunisia and Yemen conflagrate themselves. I’m not surprised the fundamentalists are getting ready to take over. They’re the most organized in the region and have backing from Iran. Our two biggest opportunities to truly change the dynamics in the region have been Syria and Iran but Obama and the Europeans have all but ignored them in leiu of making sure Libyan oil gets to Europe. It‘s not too late but it’s certainly more difficult now.

      You are right about Iraq. It has been a GIANT waste of time, money and American blood. Since day one I have been saying that the moment we walk out of Iraq, the military will stage a coup and install a new dictator who’ll be as bad as Hussein was. And the people will actually welcome it because it is all they know. Don’t fool yourself…they have not even had a taste of democracy yet…they’ve just been “allowed” to do some new stuff that will soon be taken away from them.

      Before our “advisors” on the ground in Libya leave (yes they are there…and have been from the beginning), they should assassinate every possible rebel leader who is for this Sharia law evil.

      My dogs aren’t even surprised…they listened to Glenn when I had his show on TV and the radio. Funny how others won’t admit Glenn predicted this some time ago…just like food prices, gold prices, THE MIDDLE EAST!!! Seems like some just don’t want to open their eyes to who really has the “vision” of our future..I think Glenn holds back on what he feels would “be” if we don’t make it right. I also think he counts on us to make his vision of what “can be” come to pass…I for one plan on helping him any way I can!

      No, we need to send them Congressman (LtCol) Allen West. A man that really knows what is going on and a real leader. Why would anyone want Paul, Hukabee, Romney, Gingrich, etc. in office?     Think anyone we know might be celebrating ? The Middle East keeps collapsing and the new Islamic States governed under Sharia law increase. I am so saddened to think of the millions of people who are only asking for freedom and are going to be subjected to a worse life than they had before. Mubarak and Quadaffi would not let the Muslim Brotherhood be part of government. Guess jihad is the new buzz word for ‘democracy’ in the Arab world. There might still be a chance for Libya…let us pray that they succeed in setting up a government that will be good for the Libyan people.

      We may be indeed well into the final season of earth existence before the Second Coming occurs; yet the fact is, this is still the warm up for the end game — we have seen nothing yet.

      However, there is a true miracle going on just over in Israel though:

      Christians, Jewish AND some Muslums are coming togeather to show they stand with Israel even if their national leaders seek that nations destruction.

      everything obama is working toward is a complete Fourth Reich in the US for soros. all of this is one huge puzzle going right back to soros over and over again. soros made it clear: he worshipped hitler. democrats are easily led since they worship obama. Christianity is being almost OUTLAWED in AMERICA. soros and obama and the democrat elite aware of the agenda actually think they can ”control” the muslims and America thru THEIR version of a COMMUNIST sharia law here in America.

      Saranda – I don’t necessarily agree with the poster, but why is it stupid? Obama has done and said many things that seem to indicate our traditional American way of life is of lesser legitimacy to him than other countries. For someone who so loudly decried Bush’s meddling in the middle east, he seemed to jump very quickly at a little meddling of his own, bringing a more Sharia-friendly government to Libya.
