Amazon.com Pedophile Author Arrested for Mailing Book to Florida

ST. PETERSBURG, Fla. (AP) — Florida officials filed an obscenity charge Monday against the author of a self-published how-to guide for pedophiles that was yanked from Amazon.com last month after it generated online outrage.

Polk County sheriff’s deputies arrested Philip Ray Greaves II at his home in Pueblo, Colo., and charged him with violating Florida’s obscenity law.

Polk Sheriff Grady Judd said his office was able to arrest Greaves on Florida charges because Greaves sold and mailed his book, “The Pedophile’s Guide to Love and Pleasure: a Child-lover’s Code of Conduct,” directly to undercover Polk deputies. Judd says Greaves even signed the book.

“He very proudly sold us his personal copy,” Judd told the Associated Press. “I was outraged by the content. It was clearly a manifesto on how to sexually batter children … You just can’t believe how absolutely disgusting it was.”

Laurie Shorter, spokeswoman for the Pueblo County Sheriff’s Department, said Greaves would be held in the county jail on the Florida charge. He was being booked Monday morning and it was unclear if he has an attorney. Judd said Greaves could be in Florida as early as Monday night.

“If he will waive extradition, it’s my goal for him to eat processed turkey on Christmas Day in the Polk County Jail,” Judd said.

Denver attorney David Lane, who has handled several high-profile First Amendment cases, said Florida could have a hard time extraditing Greaves. He is entitled to a hearing where he can argue he should not be sent there to face charges.

“The main question is whether what he’s accused of in Florida would be a crime in Colorado,” Lane said. “Obviously, it‘s not a crime in Colorado because he hasn’t been arrested here.”

Writs of extradition – the paperwork necessary to send somebody to another state – are routinely signed by Colorado Gov. Bill Ritter, a former Denver district attorney. But Lane, who is not affiliated with this case, said it involves a different set of issues.

“Most of other extradition cases present clear-cut cases, the defendant was dealing drugs in that other state or some other crime that is also illegal here,” Lane said.

Ritter’s spokesman, Evan Dreyer, did not immediately return a message.

Greaves has no criminal record, but his self-published book of advice on how to make sexual encounters with children safe caused a flap when it showed up on Amazon in November. The book was later removed from the site.

Judd, known throughout Florida as a crusader against child predators, said he was incensed when he heard about the book and that no one had arrested Greaves for selling it.

“What‘s wrong with a society that has gotten to the point that we can’t arrest child pornographers and child molesters who write a book about how to rape a child?” Judd said.

The book included first-person descriptions of sexual encounters, purportedly written from a child’s point of view.

Greaves argues in the book that pedophiles are misunderstood, as the word literally means to love a child. He adds that it is only a crime to act on sexual impulses toward children, and offers advice that purportedly allows pedophiles to abide by the law.

Judd said he and his detectives got Greaves to sell the book to them for $50; he sent it through the mail and told officers it was his last copy.

“If we can get jurisdiction … we’re coming after you,” Judd said. “There’s nothing in the world more important than our children.”

Greaves is being charged with distribution of obscene material depicting minors engaged in conduct harmful to minors.

    It is, in large part, a true story and it will both facinate and frighten you and leave you questioning everything you morally believe. It will enrage many while others will be standing and crying and cheering her on.

    If this guy is so stupid that he is not aware that this task force has been in action in Polk County for a very long time, in spite of the fact that they have been in the news many times for their stings. Well, he needs to do his homework. Who said that?
    I for one am very proud of bravehearted Sheriffs.
    About thirty years ago I mailed liquor filled chocolates from Europe to my Father-in-law, a postal carrier in the USA. I thought he would have a heart attack. Oops
    There are just some things you are not allowed to mail.

      Your reading comprehension is about what i would expect from a progressive. It wasnt that Greaves didnt get caught it was that the ACT of writing in one locale (Colorado) a book, pamplet, article, oped piece, stating opinion as opinion, regardless of subject matter (cannibalism and necrophilia are arguably as disgusting as pedophilia) is not considered a CRIME. In Florida it IS considered a CRIME. There is a legal term known as Reciprocity that applies in cases such as these. State A and State B have similar laws and for the purposes of regulating and promoting better trade and commerce between the two states State A and State B enter into a legal Reciprocity agreement. One that says that if (for example) drivers insurance can be obtained in a multistate jurisdiction that DWI offenders first offense is a mandatory revocation or suspension of license for 1 year Then if a citizen of State B commits DWI in State A the offense and its punishment will pass to State B without question. The corrolary is also true. If the DWI happens in State B and the citizen is a resident of State A then so the offense passes to State A. However if the two states do NOT enjoy such a Reciprocity agreement then The law in the state of citizenship holds unless extradition from said state is waived by the citizen, or by the states AG Office or by its Governor (depending on whos pen must sign) with duty of custody. In this particular case it appears that no crime has been committed in the state of Colorado. (i.e. There exists no statute of relevance under Colorado’s penal code that is applicable in the opinion of the States Attorney General) If that is the case then Sorry but good ole Grady Judd might as well go pound sand because any even partially competent fresh out of lawschool and doing his stint as a PD would argue that Colorado Law trumps every other states law where a Reciprocity agreement does not settle and that any such criminal charge in any other state against a citizen of the state of Colorado mut be found incestous and against the best interest of the citizen of the state of Colorado so charged and against the indirect interests of the state of Colorado as a whole. At which point Extradition would not be granted and Mr. Greaves goes free, with apologies from the court to Mr. Greaves, double jeopardy then attaches in the state of Colorado (but ONLY in Colorado so if our Pedophilia Author makes a sudden trip to Disney World nothing would bar Sherrif Judd from arresting Mr. Greaves at that point and prosecuting him) and even if a law were changed or a Reciprocity Agreement is later signed Mr. Greaves could not then be arrested in Colorado on that charge or a materially similar charge as the United States Constitution then comes in to play with Articl I Section 10 (States) and Article I Section 9 Clause 3 federal government). Those are the clauses that prevents Bills of Attainder or ex post facto laws from being enacted.

      Is it outrageous that a suspected pedophile might be allowed to wander freely because of the above? I submit that while his existence is an appaling travesty for the words he has written (my opinion and yes I am judging a book by its cover as I have never read this author’s littany) that anyone who truly does cherish their liberty to speak act think worship as they will (or not!) will understand that prosecuting ANY individual for his tongue or his thought, no matter how vile they seem to us, and depriving that individual of Liberty based soley on his tongue or thought is a step toward slavery.

      We must not defend Mr. Greaves for his opinions but we must defend Mr. Greaves for his liberty to express his opinion so long as it remains opinion and cannot be demonstrated to have already directly incitement to a criminal act or lawlessness in the populace at large.

      Cross that line and say that Mr. Greaves should be deprived of Life Liberty or the Pursuit of Happiness based solely on the perception of immorality (and not necessarily demonstrable criminality) and how long before the thought police come knocking at YOUR door to haul you off to a Gulag?

      If we are not willing to do this for all speech that does not directly cross an already established criminal boundary, and some of those criminal boundaries ARE debateable, Then eventually we will narrow the definition of freedom of speech until the very thoughts you are thinking are regulated. I for one do not relish the Idea of a world with a Diana Moon Glampers and her 226th, 227th, and 228th Amendments to the Constitution in place.

I hope he wasn’t lying when he said it was his last copy and I hope they confiscated his computer because he probably has a copy there too. Why would Amazon.com purchase the book to begin with? Also, if he can publish a how-to book, that tells me he has been doing the crime. Maybe someone will come forward and see that he get the maximum sentence. May God Bless.

      I think most of us will agree with you once we think it through…

      But not all speech is free. Go into an airport and loudly proclaim anti-Israeli sentiments and see what will happen. There are also laws in most places against speaking obscene vulgarities in public places.

      With literature we need to be careful. How about a fiction writer that has his main character successfully assassinate the President, describing a real world way to do this?

      But in this case I am not going to lose any sleep over this. I do not think this can be used as an attack against the first amendment. I hope they can successfully prosecute this pervert, but I doubt they can make anything stick…

      If that airport was in the USA I would expect nothing would happen, the KKK, and skinheads flies all of the time and most people just ignore them as they should. Giving them attention is what they seek. as far as obscene vulgarities laws, most of them have never been tested in court to if they pass constitutional challenge because most of them, if they are even enforced, are a minor fine, and people submit and pay, just like Red Cam and SpeedCams, which many times have failed under constitutional challenge however they continue to be installed because most people dont have the time, money and are unwilling to challenge a $50 – $500 dollar fine.

    With the way things are going, there is going to come a time where we can no longer decry this book or its contents. Already people who dare to suggest that there are sexual norms and sexual deviance are being called “bigots” and “religious nutjobs.” While the act of pedophilia is still considered wrong because a child cannot consent to a sexual relationship, I guarantee you there will come a time where those of us who consider sexual attraction to a child as deviant will be considered bigoted and making a “value judgement” we have to right to make.

      The law says children cannot consent, but studies of the effects of sexual relationships on children find that when children THINK they have consented, there is little to no harm done them, whereas when the child’s opinion was that they did NOT consent, there IS evidence of considerable harm.

    Amazon and all bookstores should not carry the book, but you can not stifle free speech because you find the works extremely offensive. What is next, Bomb making books, then Gunsmith books, then Survivist books because the information they contain may cause someone to commit a crime?

    Will we go down the path of Australia next and Bann “Small Breasted” pron actors because they coud be perceived as underage as well

    This is a very slippery slop that I am sure I will be on the losing end of in this comments, but if we allow the government to set what is ok to write a book about and what is not ok, then by definition they can regulate ALL speech.

      While I think the revulsion towards pedophilia is natural, you do make a point. Where should the line be drawn when it comes to the government and free speech? While I would never, ever support this sort of publication or anything I consider obscene, perhaps it is better that we respond to such filth by not buying it (or publishing it) rather than expecting the government to shut it down via obscenity laws. Then again, perhaps the endangement of children – or others who do not have a voice – is a legitimate reason for the government to step in. Hmmm, I don’t know. It’s something worth pondering, that’s for sure.

      Will according to the US Legal System, it is not the governments job to protect anyone. However I understand your point. There is a fine line there, but the government should pass and enforce laws that put people or children in DIRECT harm, not indirect harm as it the case with a book, Unless your throwing the book at someone there is no DIRECT threat from the words. People may use the information, but people may use the governments own pamphlets on the subject as well as the governments publishes it own defacto manuals to law enforcement and parents so they know what to look for.

      You make a very valid point. That being said, a line has to be drawn somewhere. If this book talked about seducing young boys above the age of consent, it would be sickening but free speech. Since this encourages the “seduction” of someone not of legal age of consent, that becomes victimization of our most vulnerable. Still, you may be able to say it….but there will be consequences. All speech has consequences, some good and some bad. This guy pushed a really really borderline subject, and if he isn’t expecting this he is,in addition to being sick,stupid. I am all for free speech,period. The speech maker needs to understand that his speech may have some consequences. He may go free for the very reason you site. But his speech may still have consequences for him in life. His actions will certainly have consequences when his life is done.

If I worked for a hard core liberal organization and then starting praising Bush, I would be fired, that is a consequence of my speech and perfectly with in the rights of the organization to choose whom they employ, the could not however call the cops and have me arrested, that is the difference. The public can impose non-criminal consequences, employers can refuse to hire him, sell or do business with him and otherwise make is life miserable (as long as they do not cross the line to physical or other natural rights), however the GOVERNMENT should be be allowed to punish him for writing a book even if that book offends EVERYONE on the planet..

      This is the same prosecutor who went after ‘gonzo’ porn on the internet and lost… Real mail is actionable if the sender is stupid enough to send the product signed and sealed personally…

      Freedom of speech is absolute according to the Constitution. He did not commit a crime by writing the book. If an intent was inferred that through the book the author wished to be an accessory to a child’s rape then that is a crime. We can’t let the government tell us what is acceptable speech because of the emotional outrage. That is dangerous for all of us.

      I do agree with that, and this is the EXACT reason or rather one of the exact reason the “Commerce Clause” was put in to the constitution. There are Major Jurisdictional problems here and I have a really really big problem with being able to charge someone for violation of a state law when the person was never physically in the state that the “crime” was committed. As you have said, this guy has a real (pardon the intentional pun) hardon for all things porn and has attempted to charge people for violations based on internet activity, as have other states.

      I dont see where people dismiss the “Slipperly Slope” argument, we have seen it time and time again, from Increased power that were to take down organized crime now being used for more expansive operations, the Drug war that now allows the feds to seize property with out a criminal trial, to the most recent the “Sex” Crimes list that originally started out for only Child Molesters, then expanded to all Sex Offenders, and in many areas has been even expanded further to include things like Public Urination (actually called Public Exposure), which I am sure there are many conservative sheep that love big government when it follow their “moral standard” but oppose big government in all other cases (that is call hypocrisy BTW).

      The fact is there are many examples of the Slippery Slope, more than I have mentioned here, Medicare turns in to Obamacare, SocSec, then add SSI, small welfare turns to large welfare, I can go on and on at all levels of government, there are examples everywhere, OSHA< EPA< ATF or is it BATF or it is BATFE I get so confused on them…….

As to the endangering, I am then to assume you imply that his word are endangering Americans, if that is the standard by which we shall base the acceptance of the written word, then I am sure I can compile is list of 10,000′s of books that have been written and probably over 1,000 currently for sale on amazon that can not pass your standard for publication. Lets all get together and have us a good old fashion book burning, we cant have a free exchange of information, we must only be allow information the government deems appropriate for our consumption. Hell while we are at it lets Regulate talk radio as well, but I am sure I can get a good part of the public to agree that Glen Beck “endangers” Americans with his speech as well, thus fails your test.

      Maybe Greaves is on to something. Certainly, the FBI and other responsible law enforcement agencies have noted that there is a great difference between offenders who are attracted to children and those who target children because they are easy targets. There’s no way the public will ever find out if we cut off all means by which we can learn. I don’t understand why so many people are willing to be the agents of their own mental retardation.

      Free speech doesn’t mean a thing if it only protects popular opinions.

      right on warphead. I’m a proud resident of Polk County FL. Sheriff Judd just won my vote for life. My only question is where in the heck were the colorado authorities? And I don‘t want to hear any of this ’free speech slipper slope’ crap. So ‘free’ speech has absolutely no limits? Free speech is more important that childhood innocence? Hogwash. Free speech is regulated all the time for a host of reasons, national security, contractual, whatever. If we can’t ban a book on how to molest a child, then nothing should be illegal. I say put a bullet in the back of his head, and forget he ever existed. The same goes for all the other monsters our society allows to roam the streets, preying on innocence.

      He broke the laws, then let him be tried and if convicted given the maximum time allowed under the law for each and every charge the conviction is for. Hopefully, that would be long enough he will not be free again.

      Why can’t we as God fearing Tea Partiers just crush Amazon to show everyone we have power and are reaching for more. You know I’am right, Amazon needs to pay dearly.       I have long maintained that all pedophiles ought to be sent to Alcatraz and the “bubbas” of the worst jails sent to prey on them. Let‘s let them see what it’s like to be the victim. Each week someone can go in there, clean up the carnage and save taxpayers money and victims the fear they might return. Tigers don’t change their stripes no matter how much therapy they get.

      A death sentence may be seen as a draconian punishment, but in this case, it seems to make sense. Lock ing these creeps up is too good for them and a waste of our resources. Some of them even enjoy the experience.
