American Amanda Knox Acquitted of Murder in Italian Court

PERUGIA, Italy (AP) — An Italian appeals court threw out Amanda Knox’s murder conviction Monday and ordered the young American freed, a stunning reversal four years after she was jailed for the sexual assault and stabbing death of her British roommate.

Knox, 24, collapsed in tears after the verdict overturning her 2009 conviction was read out, her lawyers draping their arms around her in support. Her co-defendant, Italian Raffaele Sollecito, also was cleared of killing 21-year-old Meredith Kercher in 2007.

The ruling clears the way for Knox to leave Italy, and about 90 minutes after the verdict was handed down a convoy of cars was seen leaving the prison. Nothing in Italian law would prevent her from returning home to Seattle, even if prosecutors appeal the acquittal to Italy’s highest court, legal experts say.

One of Knox’s lawyers, Carlo della Vedova said he didn’t know when Knox would leave the country. Knox needed to renew her passport, but it’s not clear how quickly that could be done or if the paperwork was already completed.

“We‘re thankful that Amanda’s nightmare is over,” her little sister Deanna Knox told reporters outside the courthouse. “She suffered for four years for a crime she did not commit.”

She then asked for privacy for the family so they could “recover from this horrible” ordeal.

The eight-member jury acquitted both Knox and Sollecito of murder after a court-ordered review of the DNA evidence cast serious doubts over the main DNA evidence linking the two to the crime.

The jury had two options to acquit: determining there wasn‘t enough evidence to uphold the conviction or that they simply didn’t commit the crime. The jury determined the latter, clearing them completely.

The jury upheld Knox’s conviction on a charge of slander for accusing bar owner Diya “Patrick” Lumumba of carrying out the killing. But he set the sentence at three years, meaning for time served. Knox has been in prison since Nov. 6, 2007.

The Kercher family looked on grimly and a bit dazed as the verdict was read out by the judge after 11 hours of deliberations. Outside the courthouse, some of the hundreds of observers shouted “Shame, shame!”

“We respect the decision of the judges but we do not understand how the decision of the first trial could be so radically overturned,” the Kerchers said in a statement. “We still trust the Italian justice system and hope that the truth will eventually emerge.”

The victim’s sister, Stephanie Kercher, who was in Perugia with her mother and brother for the verdict, lamented that her sister “has been nearly forgotten.”

“We want to keep her memory alive,” she said after the verdict.

Yet inside the frescoed courtroom, Knox’s parents, who have regularly traveled from their home in Seattle to Perugia to visit Knox over the past four years, hugged their lawyers and cried with joy. Knox herself was so overwhelmed with tears that two guards tugged on her arms to escort her out of the courtroom.

The trial has captivated audiences worldwide: Knox and Sollecito, who had just begun dating, had been convicted of murdering Meredith in what the lower court said had begun as a drug-fueled sexual assault.

The U.S. State Department said it appreciated the “careful consideration” the Italian justice system gave to the case. “Our Embassy in Rome will continue to provide appropriate consular assistance to Ms. Knox and her family,” spokeswoman Victoria Nuland said after the verdict.

Also convicted in separate proceedings was Rudy Hermann Guede, a small-time drug dealer and drifter who spent most of his life in Italy after arriving here from his native Ivory Coast. Guede was convicted in a separate fast-track procedure and saw his sentence cut to 16 years in his final appeal.

Lawyers for Knox and Sollecito charged that Guede was the sole killer, but the prosecution and a lawyer for the Kercher family said that bruises and a lack of defensive wounds on Kercher’s body prove that there was more than one aggressor holding her into submission.

In Seattle, about a dozen Knox supporters were overjoyed that she has been cleared of the murder conviction.

“She’s free!“ and ”We did it!” they shouted at a hotel where they watched the court proceedings on TV.

Prosecutors can appeal the acquittal to Italy’s highest court. There was no word late Monday if they planned to do so.

Earlier Monday, Knox tearfully told the court she did not kill her roommate. Knox frequently paused for breath and fought back tears as she spoke in Italian to the eight members of the jury in a packed courtroom, but managed to maintain her composure during the 10-minute address.

“I’ve lost a friend in the worst, most brutal, most inexplicable way possible,” she said of the 2007 murder of Kercher, who shared an apartment with Knox when they were both students in Perugia. “I‘m paying with my life for things that I didn’t do.”

Knox and Sollecito, Knox’s former boyfriend from Italy, were convicted in 2009 of sexually assaulting and murdering Kercher, who was stabbed to death in her bedroom. Knox was sentenced to 26 years in prison, Sollecito to 25. They both deny wrongdoing.

“I never hurt anyone, never in my life,” Sollecito said Monday in his own speech to the jury.

The prosecution’s case was fatally set back during the appeal when two court-ordered independent experts reviewed the DNA evidence that had been used to link the two to the crime during the first trial.

Prosecutors maintain that Knox’s DNA was found on the handle of a kitchen knife believed to be the murder weapon, and that Kercher’s DNA was found on the blade. They said Sollecito‘s DNA was on the clasp of Kercher’s bra as part of a mix of evidence that also included the victim’s genetic profile.

But the independent review – ordered at the request of the defense, which had always disputed those findings – reached a different conclusion.

The two experts found that police conducting the investigation had made glaring errors in evidence-collecting and that below-standard testing and possible contamination raised doubts over the attribution of DNA traces, both on the blade and on the bra clasp, which was collected from the crime scene 46 days after the murder.

The review was crucial in the case because no motive has emerged and witness testimony was contradictory. The prosecutors refuted the review and stood by their original conclusions.

Hundreds of eager observers gathered outside the courthouse ahead of the announcement, joining television vans that have been camped out for more than a week. One hundred reporters were allowed into the subterranean courtroom.

Observers lined the street leading to the courthouse, taking pictures as the two vans carrying Knox and Sollecito from the prison to the court passed by.

Kercher’s mother, sister and a brother traveled to Perugia for the verdict. They had expressed worry over the possibility of an acquittal but told reporters as deliberations were under way that they hoped the jury would do the right thing and not be influenced by the media’s focus on the case.

The family, however, said it could understand the Knox family’s media campaign.

“They fully believe in her innocence. You can’t blame them for that,” said Lyle Kercher, the victim’s brother. “But it’s obviously hard for us.”

As the verdict was broadcast live, hundreds of reporters and camera crews filled the underground, frescoed courtroom before Knox’s address, while police outside cordoned off the entrance to the tribunal.

Knox insisted Monday that she had nothing to do with the murder and that Kercher was a friend who was always nice to her. Gesticulating, at times clasping her hands together, the American said she has always wanted justice for Kercher.

“She had her bedroom next to mine, she was killed in our own apartment. If I had been there that night, I would be dead,” Knox said. “But I was not there.”

“I did not kill. I did not rape. I did not steal. I wasn’t there,” Knox said.

Sollecito was anxious as he addressed the court, shifting as he spoke and stopping to sip water. He said prior to the Nov. 1, 2007 murder was a happy time for him, he was close to defending his thesis to graduate from university and had just met Knox.

The weekend Kercher was murdered was the first the pair planned to spend together “in tenderness and cuddles,” he said.

At the end of his 17-minute address, Sollecito took off a white rubber bracelet emblazoned with “Free Amanda and Raffaele” that he said he has been wearing for four years.

“I have never taken it off. Many emotions are concentrated in this bracelet,” he said. “Now I want to pay homage to the court. The moment to take it off has arrived.”

      Question is, why is she innocent? Insufficient evidence? Or evidence pointing to her innocence? After initially stonewalling the authorities, she still seems to have an attitude problem, like the world owes her, when she owes the world some humility. Verdict right or wrong, the appeals jury could have ruled otherwise. Some gratitude, please, Amanda.

      It’s real simple. The Italian courts have a 95% conviction rate and a 95% overturn rate on the same charges. That‘s what the Italians call a balanced diet after being ruled by Nazi’s and Socialist after so many years. Great cars, fast motorcycles and one screwed up justice system. Get out ASAP and don’t look back. And don’t stop over in Egypt or New York any other Muslim controlled Countries unless you want to die. Hurry home.

      I have been following this case closely and all I can say is that Amanda Knox was innocent and wrongly convicted. The corrupt prosecutor has a quite a shady history and was jailed himself at one time. Not long ago he tried to charge another American of murder. I have no doubt that Amanda was wrongly convicted and anyone who has doubts should read the court transcripts and flawed evidence. For all the doubters look at the evidence before making moronic comments. I am happy for Amanda and her family and I hope she will recover from the hell she went through.

      Save the ad hominems, dude. Knox changed her “story” multiple times and tried to pin the blame on her former boss, a local bar owner who was arrested before immediately producing an iron-clad alibi. She has been fined AND sued for that exemplary show of character.

      She testified that she was at her boyfriend’s until mid-morning, when in actuality they found the receipt and eyewitnesses that placed her in a store at 0800L purchasing a bottle of bleach. She claims to have been focused on justice for Kercher, but her cartwheels in custody, courtroom conduct, and multiple lies to investigators indicate something very different. And the list goes on…

      NONE of that makes Knox a murderer, but Knox has never been honest with anyone from Day 1. Donald‘s point above was directed at the court’s reasoning for overturning the previous conviction and at Knox’s statement that was arguably more “I” centric, filled with denials while short on substance.

      She was convicted of the only legitimate thing you brought up which was pointing the finger at an innocent party. The other stuff is just stupid. She was in a foreign country, accused of murder, being interrogated for eighteen hours in a language she understood very little of and spoke even less, by a prosecutor who is now appealing his third conviction for prosecutorial misconduct.

    So happy that she is free. She can’t get back here fast enough. I never knew much about the evidence until recently. They had nothing and as others have stated it was nothing but a witch hunt. Who killed her? Why didn’t they start with the guy who raped her. The prosecutor should be prosecuted. Can you imagine what a nightmare this has been for her and the ex.

      Tried because of aggressive cops & prosecutors who want promotions and celebrity more than they want justice. It happens a lot here too and IMO, ALL public officials who go against justice for fame, money or out of pure laziness, almost deserve a rope. After all, they are jeopardizing the principals and morals that America is suppose to stand for. It’s akin to treason IMO. So glad she’s free.

    An innocent victim of this murder has finally been freed, and lets not forget about Amanda’s Italian Boyfriend also wrongly convicted, thank God for this justice. The murderer is in jail and he confessed and said that those two were not involved.

    There are a lot of ignorant people making comments. If you know little to nothing about this trial, then your comments are irrelevant. She was wrongly convicted, they have the killer (he confessed) in jail. She never should have been in jail in the first place, she does not need to “clean up her act” – she was a young woman studying overseas, doing what kids that age do and was wrongly accused and convicted of a crime she did not commit. I am grateful she’s free.

      I completely agree with your statement. This has been an interesting case to follow, and “in my opinion” the right verdict was rendered today. Although, I’m still not convinced (at least by American standards) that the verdict for defamation should have been upheld. But their standards in Italy are not quite as rigid as they are in America, so I can live with that. The only thing I wonder is if they didn‘t uphold that portion to belay the time already served and the 20G Euro’s fine imposed.

      All in all, I believe the Court in Perugia did an excellent job. My congrats to Knox and her family and Attorneys, and to the Justices presiding.

      Did you miss the independant review of the evidence in the case by a judge appointed expert that found ALL of the evidence supposedly linking knox to the crime unreliable at best and quite likely manufactured? Did you miss the part where the prosecutor in the case has been convicted of prosecutorial misconduct, and various crimes associated with intimidating and extorting witnesses and suspects? Were you unaware that he was actually arguing the prosecutions case in the appeal while out of prison on bail pending his own appeal? Or are you just a complete and utter moron?

      The american media and the defense is simply making the charge that the evidence was tainted- creating doubt by being doubtful creates doubt. that‘s all that’s happening here. The judges sleaziness had nothing to do with this case. The US railroads people, and now the italian jury and jury system is being railroaded just like it railroads anyone who opposes it on any level. The defense also created doubt in the troy davis case. That is the job of the appeal process -to create doubt and you gulls- believe whatever anyone in a position of power says if they say it often enough. Notice the media never harped on the prosecutions points or the jury who convicted her. They just harped on the defenses’points [the evidence was tainted is their claim] and you never ask where are the prosecutions points here!The fact that she confessed is dismissed as a trivial point as is the fact her and her boyfriend bought tons of bleach where they cleaned up the murder scene.She pontrd a finger at someone with an alibi.And she had none and dna was found on the weapon-of course that was challenged as being tainted-what else can you do when you find dna evidence?Pressure by the US on the italian government led them to aquit. We are the worlds dictators and only american life is of value to us.

    I could be wrong and I freely admit it, but from all that I have heard her acquittal was and is justified. After hearing the evidence from this new trial I wonder if the prosecution will be going on trial.

      He has actually been convicted of several crimes, and this wasn’t the first time. He argued the appeal for the knox case while free on bail pending his own appeal of a sixteen month sentence.

    I haven’t been following this case or know anything about it. But if she killed someone then she deserves to go to prison. If she didn’t then she deserves to go free. Anyone else know about the case or if she did anything?

      Johnny–the news has been out there for a LONG time, many a Dateline and 48 Hours Mystery dedicated to it, and a made for tv movie. This prosecutor had been convicted of concocting b.s. and abuse of power DURING her trial and was allowed to move forward. Their screwy system still allows it. This was nothing more than a prosecutor trying to clean up his name with manufactured sensationalism. The actual killer is in prison and the ONLY person who did it.

    that plane that has been on stand by should be getting the hell off the ground, i am glad that she is free and heading home back to the only free country left in the world, i just hope she recognizes it. 4 years is a long time,and a lot has changed, now just maybe they can start to find and convict the real murderer,

      I think the judge was afraid we would send a drone on hin if they didn’t aquit. The media here-the entire US media has been clamoring that she be freed. They have been disparaging the italian justice system and the italian press and italian public. They rarely mention the victims name even. No pictures of the victim-plenty of Amanda[the ones where she looks sweet].. They never walk us through the facts of the case. Only in the last day or so have they even told us that she confessed to the crime but of course they trot out the old -she -confessed- but -didn’t- mean- what- she said.it’s unbelievable the way the wall to wall media -every pundit and reporter and everyone and anyone in media is clamoring that she is innocent without telling us anything.We control the world ,this overtturned virdict tells me. The judge was afraaid of the wrath the US would bring on italy-already they were bringing up the medieveal inquisition in denounching this trialand italy.No one interviewed the jury who convicted her to get their take on why they believed she was guilty. No one is free when america dictates even how crimes should go down! Shameful.. All they do is brainwash us that she was unjustly convicted because of those nasty non americans[italians ,this time].I’m not surprised you blaze gulls just swallow whatever your media tells you .

    She was found guilty of one of the counts, sentenced to time served, acquitted of the rest. Apparently the prosecutor is corrupt and this is the only way the jury could make sure she wasn’t arrested on the spot for the same thing.

    Just get her home. Maybe the truth will come out but at the hands of someone else, not the prosecutor.

      Hmmm . . interesting. Have you ever read the book The Ugly American published by Eugene Burdick and William Lederer published in 1958? I read it as a teenager at the encouragement of the adults in my well-traveled, patriotic MILITARY family. You might find it instructive.

      Being stationed in Germany twice for a total of 7 years most European countries are your typical socialist hellholes. I traveled extensively while over there to France, Italy, Cyprus, Greece, Spain, Prague, to mention a few and was never so glad as when I was back in the U.S. If it wasn’t for the U.S. Military presence there they would all be speaking Russian by now. That said their Healthcare facilities may be what they think are free but they are also filthy, dark, and a good place to stay out of. I never saw a moped gang before I was in Europe or a grungy ****** in a lawn chair on almost every corner. Bilorites is close on the assessment of European Countries. Just a bunch of socialists living in their false utopia.

      Hey I would support that idea. We pull out of Europe and sit back to watch them fold like Greece is doing right now. Without the billions we spend in Europe through our military it wouldn’t take long for them to outspend their GDP. They are getting real close to that right now.
