The U.S. Fish and Wildlife Service has given the OK for an American Indian tribe to kill two bald eagles for religious purposes.

The decision comes after the Northern Arapaho Tribe in Wyoming filed a federal lawsuit alleging that the agency‘s refusal to allow them to do so was a violation of tribal members’ religious freedom, the Associated Press reported.

While no longer on the federal list of endangered or threatened species, federal law prohibits the killing of bald eagles under the Bald and Golden Eagle Protection Act. American Indians are able to apply for eagle feathers or carcases to use in their ceremonies from a federal repository. They can apply for permits to kill bald eagles as well, though such permission is incredibly rare.

According to the Associated Press, it’s been almost three years since the Arapaho tribe applied for such a permit, and a lawyer for the tribe said they believed it necessary to go to court in order to get one. The U.S. Fish and Wildlife Service granted the permit Friday.

Under the terms of the permit, the Northern Arapaho will be allowed to kill up to two bald eagles off their reservation. A neighboring tribe, the Eastern Shoshone Tribe, opposed the killing of eagles on their shared reservation.

The Arapaho’s lawsuit, filed late last year, stems from a legal battle after tribal member Winslow Friday killed a bald eagle without a permit in 2005 to use in the tribe’s Sun Dance, the AP reported. A federal judge dismissed the charges, saying it would have been pointless for Friday to apply for a permit since they’re generally refused anyway. Federal prosecutors appealed the decision and had Friday’s criminal charge reinstated, to which he pleaded guilty and paid a fine.

“One of the goals of the current suit is to prevent any young men like Winslow Friday from being prosecuted in the future for practicing their traditional religious ceremonies,” Andy Baldwin, lawyer for the tribe, told the AP.

In late 2007, senior tribe members appeared at a court hearing in support of Friday. Nelson P. White Sr. — then a member of the Northern Arapaho Business Council — said the birds American Indians have been forced to get from repositories were rotten.

“That’s unacceptable,” White said at the time. “How would a non-Indian feel if they had to get their Bible from a repository?”

    Peyote and mescaline can be used legally by certain Native Americans, but if you aren’t in that group, you’re breaking the law when you use them.

      I’m sick of Indians. They want to live off the US taxpayer on their “sovereign” land and then also have a vote in how we run our government. One of two things needs to happen.

      1) We give all people the RIGHT to opt out of our system of gov‘t and live on land held in an actual allodial title for which they will not owe any taxes and gov’t will not have the privilege of imminent domain.

      2) We abolish the idea that Indian tribes are sovereign nations and and make them all American citizens. No one is saying that they cannot keep their heritage or culture alive, but they will not have privileges and rights above those of the rest of the citizens.

      I can see why they’d want to be sovereign and not answer to the fed, really I can; but they are a continual drain on the American taxpayer.

      As a human being I have always been disgusted with cultures that for what ever justification have this need to destroy some poor un-suspecting animal & in extreme cases offer up people as a sacrifice for some stupid gods placation!
      I personally do not believe that any humane god that may exist with any sense of right & wrong would not require you to destroy any of his creatures for his pleasure.
      If you believe life is special then you have to believe that any individual life is special.
      People that think it is necessary to go thru some ritual that requires the sacrifice of any life form are wrong. Rituals that require life’s blood to be spilt are barbaric stupidity that should be looked upon as heathenish or devil worship.
      I’m sorry but Indians do not get a pass on this as far as I am concerned they should be allowed to destroy 2 beautiful eagles just because of its traditional Sun Dance ritual!
      No I don’t care what kind of justification you put on it!
      I say, if your god requires a display of heathenism like this then you need to get a better god period!

      @USAmedic…. Eagles killed by powerlines (at my co.) are shipped to Colorado for use by Indian groups. It was funny the first time I asked a local mailing co if they could wrap and send a frozen bald eagle.

He’s waged a war on every other tradition that Americans hold dear, why should this magnificent bird, which is the symbol of greatness for our nation be an exception. He holds the constitution in contempt,along with our economic system, our Juedo-Christian values and faith, and everything that made this the good and decent nation that it was until he came along.       this already happened nearly 100 years ago. the 1924 “indian citizenship act”. which is little more than a genocidal aspect of the ‘termination’ era of federal indian policy.

      also, if you are so concerned with the ‘privileges and rights’ of native peoples then take it up with the founding fathers. they are the ones who signed treaties with these native nations.

      I understand the frustration you both share. My wife is a full blooded American Indian. The history is as current as your parents early childhood (post WW2) . Many of the court battles are continuing now from that time period. At the same time the fed has been shoving “aid” down the throats of many Indian Nations. Once again the fed is all about power. These cases draw out for another couple of decades and the descendants will no linger care and the cases will fade away. The Indians stay on top of them? God help the fed!

      I live in South Dakota, and you know the very second you drive into a reservation, everything around to looks like a landfill. Broken down trailer homes, 15 cars parked around the house & parked on top of the 2 foot high lawn. They have no pride of ownership because it was all given to them,
      They didn’t earn it, so they don’t respect & appreciate it.

      However I would give them your second choice, and if they don’t want to live in the US anymore, then we will pay for their relocation….and that will be the last free thing they would ever get form me.

      It is now and has been (regardless of the Endangered Species Act) Ilegal to kill ANY raptor (predatory bird; eagles qualify) and many migratory birds for MANY YEARS! With the NOTED EXCEPTION of Native Americans for the purposes of RESPECTING THEIR RELIGIOUS TRADITIONS AND BELIEFS and this has been the case since I was in high school waayyyyyy back in the 70′s……………

      I understand that you know nothing about the history of this country – BUT – you mention ‘anyone who wants to take down America’. EXACTLY who might that be?

      Didn‘t the white man ALREADY take down ’America’ when they landed on this side of the Atlantic, slaughtered the ‘red man’ and took his lands, killed his bison, hearded the survivors onto lands which could grow nothing in places that these people knew nothing about, and delivered unto the red man diseases which killed hundreds of thousands.? And, of course, the ‘red’ man has been minimalized ever since. So WHO took down America – and rebuilt it in his own design??

      Oh, and if the Catholic church can claim ‘religious’ ideals when referring to contraception for women, then WHY should the American Indian NOT have the rights to their own religious rights??? After all, the Indians have always believed that NO ONE can own property or land. They can ONLY be caretakers of that land and it’s bounty! Can the white man make that same claim??

    y cant native americans preform their ttaditions that were in place long before eutopeans came to this country. i know the bald eagle is one of our national symbols but thomas jefferson thaught that it should be the turkey. the federal govt has long since stood in the way of native tribes practicing their religous freedoms. i may not beleive in their practices however they should still have all rights garuanteed to everyone by the constitution

      Are you a Christian? Your religion is founded upon sacrifice, with the Hebrew sacrifices and then the once-for-all sacrifice, not that of an animal but of Jesus. Don’t forget what the blood of Jesus has done. Him shedding blood was very important, as the old testament has a lot to say about sacrificial blood as does the new. It was necessary for the Hebrews to escape Egypt, it was used in animal sacrifices and read about when Solomon dedicated the temple. Blood was everywhere.

      Even though Jesus was the last sacrifice necessary, you have to admit that throughout history blood sacrifice has been an important part of many religions.

      I want freedom of religion here. As long as people aren‘t killed and nothing is tortured I don’t care if they shoot a bald eagle.

      I understand why most here post negatively. It is out of ignorance of native religious beliefs and practices. In working in the past with a Catholic Church formed for the Objibwe tribe for 5 years, I came to understand some of their historical (but mostly present) religious practices. It would’ve taken at least 12 years to really understand, but I wasn’t afforded that time. The Eagle is considered extremely sacred, and the feathers are used in purification rituals and much more. They do not take the killing of these Eagles lightly, and more than likely will spend a day in contemplation to be of pure heart and give thanks to the Great Spirit for the life of the Eagle. That being said, there was a holy man named Black Elk that became a catechist for the Catholic Church. He saw a great symmetry between the Lakota religious beliefs and the Catholic Church. Some of the People now opt to focus solely on Black Elk’s Native religious beliefs since so much has been lost do to a myriad of reasons, and some bigotry (understandably so) to the White religion. A good read (if anyone is interested and enjoys reading) about Black Elk is “Black Elk Speaks: being the life story of a holy man of the Oglala Sioux (as told to John G. Neihardt)”Bison Books, 2004 (originally published in 1932″.

      Obama is just trying to score points with the Native Americans and bypass the system that is in place for Natives to legally obtain eagle parts. Not every Native is eligible to obtain or possess eagle parts. As a Native American, I don’t agree with the killing of an eagle. I doubt Natives were capable of killing an eagle prior to European settlement due to the weaponry at the time. Obama is using this for another opportunity to divide America by race.

    Why does their ceremony have to use Eagle feathers? Isn’t there someone who makes faux feathers they can use? I mean the fur people insist on fake fur, why not fake feathers.

    Considering the Bald Eagle is our National bird, why do the Arapahoe feel the need to kill our National Bird unless they do not feel they are American also.

    Where is PETA when you need them? Thank goodness for the Eastern Shoshone tribe for wanting to stop this. I stand with the Shoshone.

      The Government funds and installs a wind farm on tribal land.
      .
      As we have seen from other stories on birds of pray falling victim to the moving blades of the Wind Generators.
      .
      So the Tribe Gathers the Royalties and the jobs associated with the Wind Farm and Can just pick up the now dead Eagles for the Ground.

      They aren’t American, they’re Arapaho. And they use real feathers rather than fake ones for the same reason you use a real Bible rather than a blank book with a Bible cover. This permit allows for the killing of two birds, from a species that isn’t even endangered anymore. To think that it’ll significantly affect the bald eagle population is ludicrous.

      why don”t you notify Peta about the wind mills killing these birds . The eagle is sacred to the Indians & they show it much more respect then those idiots in WA who atr killing hundreds evday. leave the Indians alone they have suffered worse then the blacks & they do not teach hate of the white people. Many serve in our arm services

    I just listened to Beck’s radio show where he went off on this decision. No, Glenn, the Bald Eagle is no longer on the Endangered Species List. It still is listed as “threatened”, however. In fact, the Bald Eagle population in the lower 48 has been a success story.

    No, Glenn… the decision does not allow “native Americans” to kill eagles at will. It only allows the killing for two Bald Eagles by one tribe in Montana. I am more concerned about the estimated 70 Golden Eagles killed annually by one wind generator in some pass in California!

      Whether it is endangered or not endangered is not the issue. The Bald Eagle is America’s National Bird; you just can’t go kill it, hence the permit. I question the need for the Arapahoe in using “real” Eagle feathers. Why not fake feathers?

      Cofemale – look. We have freedom of religion in America, even if you don’t like that religion or it makes no logical sense to you. Saying the trive should use fake feathers may be just as bad as saying the Catholic church should use fake wine. Both religions want the real thing.

      I don’t understand how Glenn Beck constitutional freedom of religion fans are getting so upset over this. It’s two eagles. So what if it’s our national bird? It’s not endangered. It’s just a symbol, it has no real value in and of itself. That would be idol worship.

      The notion that it’s just a symbol and thus has no real value is frankly toxic. After all, what is the Constitution but words on paper? What is the American flag but a piece of colored cloth? What is the crucifix but a piece of wood? For that matter, what is the swastika but a collection of lines?

      I could give a rip about a couple birds, but it’s what these birds symbolize that give them value and power. If we, as a people, decide that the bald eagle is just a bird, then we’re one step closer to saying that the Constitution is just words on paper and of no value to anyone. You just don’t want to go there.

      Surprise Lumbar, I see little issue with this. We have an abundance of Bald Eagles in Alaska, even in cities. I thought though, that the plains Indians valued the golden eagle. What I find STUPID is the fact that if you pick up a feather (naturally shed) off the ground you are breaking the law. I also see a bit of bias in who can harvest some wildlife which is off limits to all others.

    Well so what. I guess that why the Bible said to make no graven image of things in Heaven or in the earth. That’s why the eagle was placed in protection, and that’s why there is now a permit to kill two eagles. The people who view it as a sacred national symbol are just as guilty as the Native Americans, and the President is jerking your chains.

      Did you even bother to read the article or do you just read the headlines? The tribe is able to obtain eagle feathers and carcases from a federal depository to use in their religious ceremonies. However, according to the tribe, those carcases are “rotten”.

      Lumbar Spine did you read the article, it says“ REPOSITORY” not depository. But hey why sweat the small stuff. Why would the repository have rotting carcasses of Eagles. Would not the feathers be plucked and preserved if removed from the dead Eagle? Something about their reason‘s don’t jive with me.
