INDIANAPOLIS (TheBlaze/AP) — An American-born Taliban fighter is heading to trial in Indianapolis in a lawsuit over prison prayer that will examine how far officials can go to ensure security in an age of terrorism.

Thirty-one-year-old John Walker Lindh is expected to testify in federal court Monday in the lawsuit that challenges limits placed on group prayer among Muslims housed in a closely monitored unit at the federal prison in Terre Haute, Ind.

In Jan. 2011, The Blaze first brought you Lindh’s story. Over the past few years, he has joined other prisoners in a fight to secure the right to hold a daily prayer group. The men, who live in a highly-restricted cell block, claim that restrictions on their prayer violate their religious rights. Currently, inmates in the unit are allowed to have group prayers once a week.

The government, though, has argued that these regulations are necessary to ensure safety and that the inmates can, at the least, hear one another as they pray in their individual cells. Now, with the American Civil Liberties Union (ACLU) on his side, Lindh — who continues to fight for more regular group prayer – is going to have his day in court. Pending the result in court, the Taliban fighter may end up receiving the permission he has sought so diligently.

The lawsuit was originally filed back in 2009 by two inmates who live in the prison’s Communications Management Unit (CMU). This unit holds mostly Muslim inmates who have limited communications with the outside world. While the other prisoners have since bowed out of the lawsuit, having been released or transferred to other locations, Lindh, who joined the legal effort in 2010, continues the fight.

The ACLU is arguing that the U.S. government cannot restrict religious activities unless there is a compelling need. Thus, officials will need to prove that such a situation exists in court.

Lindh is serving 20 years for supplying services to the now-defunct Taliban government of Afghanistan and carrying explosives for them.

    Okay, I admit it, I missed the news announcement (how many years ago?) that said people in prison for treason and other lawlessness are to be given segregated facilities based upon their religious beliefs. So, those who are members of the religion (Islam) which exists for one purpose – to slaughter all Jews and all Americans – get their segregated worship facility. Those who are Jewish, get their own segregated worship facility, right? Those who are indigenous (Native American Indians) are accorded a segregated worship facility, right? Likewise, those who are believers (in God and Christ Jesus) receive asegregated worship facility? I think I just heard a “no way” coming from the direction of the White House.

      The part that bothers me the most is that some in the USA still consider ISLAM as a RELIGION. ISLAM is an IDEOLOGY at best…or otherwise AKA : a CULT.
      OUR CONSTITUTION does not call for us to honor CULTS, especially those that deem to throw us over and destroy…out… CONSTITUTION.

    I have friend that was in county jail for about six months he was telling me just yesterday about how much better the Muslims are treated and they get feed better get to go outside more off ten and that right across the street from the jail is a group that checks on them daily to make sure all their needs are being ment they are treated different then the other inmates. He said it took him a couple weeks to get a bible. Right when the Muslims check in they get a Koran and a prayer rug. What’s wrong with this picture. Love/pray

    Now, follow me here folks: If Timmy Taliban wins his lawsuit, does that not set a precedent that the government cannot force cities, counties, schools, courts, et al to remove Christian symbols, etc. from the public square? Won’t it crush the ban on school prayer?

    After all, how could they successfully argue on one hand that the government can’t regulate religious activities, and then continue their Nazi-like efforts to stamp out all public expressions of Christian faith? What “compelling need” is there to restrict a manger scene on the public square or a prayer at a high school graduation?

    Can’t have it both ways…

    As far as I am concerned, it is a security concern with these terrorists, not a violation of their religious rights. If they commit such a heinous crime that requires them to be locked up away from others, then so be it. Mike Spann can no longer even pray with his family.

      John Walker Lindh had a rough childhood He grew up in Marin country just north of San-Fran-Sicko. His parents divorced. His father left is mother for some guy’s bunghole.

      With all that of his parents are nominally Christian (in name only), Johny looks at it & says that Christianity or atheism doesn’t work, so he tries Islam.

      Still needs to be hung. He sees the problems in Pakistan & Afghanistan & it doesn‘t open his eyes that Islam doesn’t work? He needs to be hung

      P.S. That is about it atheists making Christianity look bad.

      MOMRULES, WALKABOUT, CIA Operative Mike Spann was from Alabama, and a graduate of Auburn University. Yeah, I poke fun at Auburn fans just as I expect Auburn fans to poke fun at us Bama fans. But, when it comes to serious business like this, I take it seriously too. I’m not for revenge in this, and this Walker-Lindh is in jail for good reason. He needs no special treatment. He got to live this far.

      I knew Mike at Auburn. He was a pretty nice guy and loved his country. I visited his grave at Arlington last November. With the number of stones placed on top of his marker, there have been a lot of people paying their respects to him. I’m glad to see that.

      In regards to this issue, Jihad Johnny gave up his citizenship when he fought against this country with the Taliban in Afghanistan. I’m convinced that he, at the very least, had a part in killing Mike in that prison. For him to use the rights that Mike and other soldiers died for offends me and for the courts to even allow this traitor to do this shows how far left this country has gone.

      Yeah, Rjjingadsden. We do poke fun at each other, especially during this time of year. We love our football teams. This sort of thing brings it all into perspective, though.

    Let them pray to their evil god but make no special arrangement for them. If they have room in their cell to lay a rug and put their smartest end up in the air to allah, that is enough.
