‘An Unforgivable Insult’: Supporters Appeal to Supreme Court to Save ‘Unconstitutional’ War Memorial Cross

Last year, the Blaze first told you about a controversial cross atop the Mt. Soledad War Memorial in San Diego, Calif. As we reported, the religious symbol was deemed unconstitutional by the the 9th Circuit Court of Appeals. But, despite this ruling, the fight is far from over. Supporters, led by the non-profit, conservative legal firm, Liberty Institute, have appealed to the U.S. Supreme Court to save what they see as an important memorial that commemorates U.S. soldiers. Additionally, the federal government, which has defended the cross’ presence thus far, may also appeal the decision.

The legal battle has been going on for two decades and shows no signs of waning. Despite the cross serving as a commemorative monument, critics may point to the fact that it was also used in Easter celebrations back in the early 1900s. However, it was in the 1950s that it became a memorial to Korean War veterans. Our previous report provides insight regarding why atheists are continuing to push so adamantly against the cross:

The Mount Soledad war memorial currently sits on land that’s been under the control of the U.S. Defense Department since 2006. Though the city had owned the land for decades prior, the federal government’s acquisition of the land meant the city was forced to remove the cross or face daily fines. After the Defense Department acquired the land, a lawsuit was filed by a group of Jewish war veterans and the American Civil Liberties Union (ACLU).

Liberty Institute has now filed a petition on behalf of the Mount Soledad Memorial Association to allow the 29-foot cross to remain where it is, overlooking the Pacific Ocean in suburban La Jolla, California. In addition to its plea to the Supreme Court, the group has also been trying to save the cross through its “Don’t Tear Me Down Campaign.”

“If the ACLU gets its way and this veterans memorial cross is torn down, what will happen to the 20-foot Canadian Cross of Sacrifice in Arlington Memorial Cemetery and the countless others like it in nearly every community nationwide?,” the group asks on the “Don’t Tear Me Down” web site.

Supporters contend that the cross, in itself, isn’t “religious,” but that it commemorates soldiers who have served in battles as far back as World War I and as recent as Iraq. Mount Soledad Memorial Association head William J. Kellogg said that removing the cross would constitute ”an unforgivable insult” and he defended it, saying that similar crosses exist without incident in other cities.

“Why shouldn’t there be a military cross in San Diego, too?” Kellogg protested. “This is a military city whose veterans deserve to be remembered.”

But atheists couldn’t disagree more regarding its presence on federal land.

“This cross is unconstitutional in a multitude of courts and every time that happens they’ve upped the ante,” said Bruce Gleason, the founder of the Backyard Skeptics, a local atheist group (last year, Gleason organized an event during which atheists publicly ripped up Bible verses and, in a separate incident, he posted a billboard with an inaccurate Thomas Jefferson quote).

The ACLU, which won the 9th District lawsuit, obviously agrees with Gleason. The group takes particular issue with a bill that the U.S. House of Representatives passed last month that would allow for religious symbols to be displayed at war memorials; this cross was the key catalyst behind the congressional effort. Currently, supporters are pushing the Senate to approve the same measure. UT San Diego has more:

House Resolution 290, introduced by Rep. Duncan Hunter, R-Alpine, and co-sponsored by Republican Reps. Brian Bilbray of Solana Beach and Darrell Issa of Vista would not resolve the constitutionality of the cross. However, it would for the first time give statutory protection to religious symbols in all war memorials.

Critics of the legislation said it was unnecessary and inappropriate because determining the constitutionality of religious symbols rests with the courts.

Here’s Rep. Brian Bilbray (R-Calif.) defending HR 290 on the House floor last month:

“Congress cannot, by definition, authorize the government to violate the Constitution,” said David Loy, who works as the ACLU’s legal director in San Diego. “It’s unconstitutional for the government to sponsor and maintain this particular cross that is visible for miles. The point of a war memorial or veterans’ memorial is to remember all veterans.”

While atheists, the ACLU and other church-state separatists are pushing the issue, the Supreme Court has become more friendly to religious symbols being present on government property. In 2010, the high court refused to order the removal of a war-memorial cross from California’s Mojave Desert (the cross was later stolen).

This issue is far from resolved, as are other related religious freedom cases. In a separate incident, atheists have targeted a cross that was erected on the Marine Corps base of Camp Pendleton to honor fellow fallen troops. As atheists have continued to push for its removal, the military is now investigating the matter.

      The same reasoning could be used by these ACLU goons to start removing crosses from churches. They could claim that because they are seeing a cross from a public highway it is offensive and it is the state’s responsibility to keep us wussy-ACLU-freak-boy-God-haters from seeing crosses via public highways therefore, it needs to be removed.

      I hope I didn’t just give some pointy headed spectacled ACLU boy a good idea. You freaks!

      Secularism is on the rise and becoming more and more militant. There is a dark force behind it all. All evil needs to succeed is for good men/women to do nothing. Be proactive not reactive in your communities/families and take the fight to them. And make no mistake it is a fight. It’s a battle for the hearts and souls of future generations.       Watchtheotherhand, the dark force is identifiable if you look. It is the ACLU and its supporters. Here are some names to start your search: Susan N. Herman, Nadine Strossen, Steven Shapiro, Dorothy M. Ehrlich, Geri E. Rozanski, Michael German… . Next look at their financial support.

      You will find the high up in the ACLU, and you will also find the all too common thread of them being Jewish. Jews have, from the beginning, opposed Christianity. Nothing’s changed, except that they’ve gone more covert, in the shadows.

      ACLU is behind this? NO surprise there. This is just another hijacking of ‘the separation of church and state’ In it’s true context, the separation of church and state doesn’t apply. The Church is not dictating to the State on law here and the state is not dictating to the Church on doctrine.The members of ACLU obviously missed that lesson back in school.

      Just think what Arlington cemetery will look like when all the crosses are gone. In fact all the cemeteries. It is most definitely the cross that is feared, not it’s location. It would seem the law allows for anyone to request a memorial of their liking be added for their faith or non-faith, and I doubt that would be objectionable.

      Cross at cemeteries and churches are on private property and/or paid for by individuals. This cross is on federal land and more than likely funded by tax dollars. That is the difference. Public funds/property versus private funds/property.

      The military should sell this land to a non-profit private trust. As private property, the memorial would be fully protected by the 1st Amendment and atheists would have no basis for a lawsuit.

      Wholeheartedly agree with you. If they don’t like it LEAVE! This is a Judeo-Christian country. The cross is a common marker used to show respect to the fallen. If I lived in Israel, I would expect to see more Stars of David vs. crosses, etc If you don’t like where you live, MOVE! Try the middle east, I hear their religious rights are so well protected.

      Yes it does, just between the lines. The constitution was written by Christians, and if you read the old testament, you understand that Judaism is the “father” of Christianity, in fact Christ was a Rabbi. So the two are inseparable. That is why we call America a Judeo-Christian Nation.

      It’s one thing to look the other way and another when federal property (owned by every tax payer) and tax payer funds (everyone pays their taxes) is used to create and install the cross/symbol. I have no problem, as an Agnostic, for you to have a cross on your lawn or on your place of business. It‘s another when it’s created and installed on public property using public funds. Just like how you don’t want tax dollars used to fund abortions, I don’t want tax dollars to fund anything that supports various groups while excluding others.

      And this nation is founded on FREEDOM. Had they decided to create this nation as a Christian nation, they would have been no better than the theocracies they moved to the New World for. Why would they escape persecutions just to establish a new nation that would perform similar persecutions themselves? No, they wanted a nation of freedom and liberty.

      To further clarify, Sir William Blackstone, author of Commentaries, was widely quoted by our Founding Fathers in the drafting and language of the Declaration of Independence, by our jurists in the later 1700′s, 1800′s and beyond, including Supreme Court Justices Marshal, Wilson and others, and studied in our law schools.

      It is quite clear and acknowledged that the Framers of our Constitution took their instructions from Blackstone’s Commentary on the Law, most particularly with respect to “Of the Nature of Laws in General”

      The ninth district has too much area to cover and the variety of citizens whom have to use it are too diverse. It needs to be broken up and two more districts formed. California, Oregon, and Washington should all be in their own little district. The ninth district keeps trying to reflect the ideology that is so common to that part of the country! Per their percentage of reversals the entire should be impeached and the court be re-assembled.

      Thomas Jefferson (1743-1826), third U.S. President, chosen to write the Declaration of Independence, said: “I have little doubt that the whole country will soon be rallied to the unity of our Creator, and, I hope, to the pure doctrines of Jesus also.” He proclaimed that it was the God of the Bible who founded America in his 1805 inaugural address: “I shall need, too, the favor of that Being in whose hands we are, who led our forefathers, as Israel of old, from their native land and planted them in this country.”

      At the founding of this Nation, it was Protestant Christians who were most influential and proactive in its creation. Muslims had their time to create a Nation, as did the Buddhists, Roman Catholics, Jewish communities, Arab nations, Hindus, etc. None were even remotely close to representing what the Protestant Christians were able to achieve in the 1700-1800′s. To think that any other people or faith can accomplish or maintain the same is a display of ignorance and denial of history.

      You’re wrong. The Constitution says, “done in Convention by the Unanimous Consent of the States present the Seventeenth Day of September in the Year of our Lord one thousand seven hundred”.

      News flash: “In the Year of Lord” does not mean in the year of our Lord Satan, but, in the Year of our Lord and Savior Christ Jesus.

      There are those who say such use of the word Lord was only used for dating purposes, and not in reverence to any deity. But this notion dismisses the many proclamations made by our early Congress, and early Presidents, recognizing and acknowledging God in national days of prayer, fast or thanksgiving.

    Activist judges are trampling the constitution. The founding fathers were overwhelmingly Christian. Atheists love to point at Thomas Jefferson and Benjamin Franklin (out of over 200 founding fathers). One of Jefferson’s first acts concerning the new capitol building in 1800 was to approve church services in the capitol. He even brought in the Marine Corp band to play for worship services. He authorized federal funds for missionary work. Benjamin Franklin recommended that Christianity be taught in schools. We’ve forgotten about people like Benjamin Rush, John Witherspoon, Charles Thompson, and Francis Hopkinson. John Hancock is just a signature in today’s history while in truth he was a strong Christian who had many proclamations calling for prayer and fasting while serving as governor. We have allowed secular people to actually rewrite history and then we’ve allowed activist judges to solidify their perversion. The founders had a lot to say about activitst judges too. We need to seek the truth historically and spiritually.

      @ Encinom; They may have professed to be non-Christians, but when the napalm hit the fan and they were knee deep in it. They sure prayed to God that we Christians who were piloting the slicks and gunships coming into a “Hot” LZ to pick them up weren’t atheists like them. I can’t count the number of times I heard, Thank you God for answering my prayers from a so-called non beliver.
      So, man up, Encinom.

      The Cross has no place at a war memorial other than a grave marker. If wasn’t just Christians who died in battle. Additionally, this is a clear violation of the Constitution that those men died protecting. The greatness of our country is that it is secular, where men of all creeds can feel represented, this cross is an affront to that notion and a disgrace.

    How is displaying a symbol unconstitutional? All that is written is that congress shall not establish a religion nor prohibit the expression thereof. The symbol does not force anyone to pray, worship or even acknowledge a religion. If I were to display the swastika openly I would be labled a racist, but the swastika is a valid religous symbol. I do preach religion to anyone and when someone tries to preach to me I ask them to stop or I walk away; something to do with freedom of choice and RESPECT. The last is something we no longer have here in the US and it is time to bring it back. The falsely named ACLU cares less about your rights and more about whether or not they can make a buck. So as far as I am concerned whatever the ACLU says is the treated as garbage.

      When Will People WAKE UP. This isn’t about being “fair” it’s about removing Christians from public view.
      In some cities in the UNITED STATES Christians that have been Kicked out of renting Schools, (like NYC), have met in their own homes. The Anti-Christians followed them and are sueing them for zone violations.
      They are telling them they can’t assemble inside their own houses, with people that think like they do. You know love thy neighbor, don’t steal, lie, etc….

      I have been told that if I Discuss my faith at work I could lose my job.

    They will never be satisfied. They will keep coming until all Christians are removed from public sight.
    This is a War on Judeo/Christian values and the people that believe in them.

    Two groups of people are in a large park. The Grp A tells Grp B it’s values. Some in Grp B are insulted and drive Grp A from the square, go to Grp A‘s meeting house and burn A’s symbol in front of it. Whenever Grp A members try to talk to anyone about this Grp B is there to beat them into silence.

    The only Difference is the Anti-Christians use the courts some of which they have stacked.

    While reading this article I am reminded of all the uproar over the Taliban destroying the giant Budda’s in Afganistan, the argument being that they were destroying history. Atheists are out to destroy the history of our country one monument at a time. I am a Christian and love the idea of a cross that can be seen for miles and miles, but that is not why we need to win this battle. We need to win this battle before the history of our country is rewritten by those who don’t believe in it.

      You realize the point of the 1st Amendment’s establishment clause is that there is to be no state religion. No American should ever have to assimilate to any religion. Nor should any religion be held out as being more American. The Foundes gave us a secular nation to avoid the religious strife of Europe.

    As an atheist, I just want to say that this has always been a ridiculous arguement. The Constitution simply states that the government cannot establish a state religion, and that it cannot choose to favor one religion over another.

    As long as the government is fair in allowing any religion or atheist group to build memorials, I see no basis for this sort of hype. Personally, I would be happy to donate money for an atheist organization to buils a giant Darwin Fish memorial to the right of the cross for atheist veterans, and might even float a few dollars to a Jewish group to build a Star of David memorial on the left side for the Jewish vets.

    One person is offended by it being there but 1 million are offended by taking it down. Do the Math.

    They don’t believe in god, so there symbol is nothing. I look in a lot of places and I see nothing. I’m offended. We need to put something everywhere to eliminate the offensiveness of nothing.

    What better than a cross to replace nothing everywhere. Put one everywhere.

      Well then fight Christian of America quit paying taxes to a government that continues to strip away your rights. Remove your children from public schools and demand that you state and local taxes be cut to reflect the percentage which the state and local government use in public schools. March on the Capital barge into the hall of Congress and occupy D.C.
      I for one am sick and tired of paying for government programs that I don’t use,will never use and will never benefit me or my family. The only I need from Washington is the close and protect the borders and defend the country.
      I recently saw a navy commerical refering to our navy as a GLOBAL PEACE KEEPER.
      our navy’s job is to protect our country not police the oceans.

      Probably a little of both. The progressive toads have sure come out into the light, and it is now cool in a San Fran bath house kind of way to be socialist. Some of us used to shoot at targets representing socialist, now, they are in congress. Odd times.
