Another NYC Tourist Arrested on Gun Charges Despite Having Permit

New York Tourist from Ohio Caught With Three Guns in Hotel RoomThe list of New York City tourists facing gun-possession charges keeps growing. Not only was a Tenn. nurse arrested for trying to check her gun at the 9/11 Memorial, but an Indiana jeweler was taken into custody when he tried to check his firearm at the Empire State Building. And now, an Ohio man who brought his three guns to his hotel room for protection, and had a permit in his home state, has been arrested on similar charges.

The New York Post reports Fred Vankirk, 59, of Columbus, was arrested at about 11 a.m. Saturday after cops found two .357 Magnum pistols and a .45 semiautomatic in his room at a Midtown-area hotel.

Police were notified of the guns‘ presence by a maid who came in to clean the man’s room. She spotted one of the revolvers sitting on a table and notified security, who notified police.

Ankirk, however, does have a permit for his guns — in Ohio. But in New York City — where gun laws are some of the strictest in the country — it’s doubtful that will be a valid defense.

The Post reports more details:

Vankirk had been receiving room service at about 7 a.m. Saturday when a hotel employee spotted the loaded .357 Magnum on the nightstand, police sources said.

She reported it to security, who contacted police, according to the sources.

Detectives obtained a search warrant and recovered two more guns from the room — a .357 six-shot Magnum revolver and a .45 semiautomatic — as well as at least one box of ammo, a court complaint charges.

Police learned that Vankirk had a valid Franklin County handgun permit, sources said.

The other two people arrested recently also had permits issued in their respective states.

Vankirk was charged with three counts of second-degree gun possession and being held on $50,000 bond, the Post reports. If convicted, he could face a sentence of five to 15 years for each count, which would be served concurrently.

    when is enough enough…..if you look at NY and home invasions..and then you look at most other states…you will se a big diference….the bad guys know this,..and can freely kick in doors and do as they please…these laws need to be challanged….and we need to abide by the constitution~~~!!!
    everyone should be allowed to have a gun for proctection!!!

      Encinom…there is no safer place around than my little estate in Texas that is loaded with guns. Just ask the little t@rd I shot a few years ago who was trying to steal my tractor…He only got birdshot. He did not get the .45 in my holster. Yes…I feel very safe.I sometimes wonder how safe he feels sitting in prison.

      Stats or no stats, it is still NYC law. It is the responsibility of these people to make sure that they are in compliance with local law whenever they visit someplace outside of wherever their permits are written for. Any responsible gun owner will no that gun laws are not the same everywhere in the United States and will make sure that their firearms are legal wherever they take them.

      And this is coming from a strong proponent of the 2nd Amendment, btw.

      Agreed, but that is for the Supreme Court to decide, not some Joe-Blow tourist. Until the law is overturned, it is our responsibility to comply with the law or face the consequences.

    What a joke. I guess you shouldn‘t have a maid come into your room unannounced or you need to know the different state’s gun laws before you carry your firearm with you. Why even have a concealed weapon‘s permit to protect yourself when you have to keep up with all the nonsense of government telling you what you can and can’t do? I have the word of GOD to protect me. I don’t need my gun anymore!

      I always put the “Do not disturb” sign on the door. I don‘t trust anyone and I don’t care if I sleep on sheets for two or three days and the towels will dry. If my wife has the maid come in, I pack all my stuff up so I know if someone got into it. I paid for the room, which means I paid for the privacy, too.

      Hopefully this man will be able to use the “castle” rule to get out of this frivolous arrest. If he in fact paid for the room he should have the expectation that the room is now his home and as such should offer him some reasonable expectation of privacy. The hotel could obstensively be accused of breaching his expectation of privacy in this instance. There are cases where the “home is castle” defense has been used to protect a citizen from unlawful searchs and seizures. A person has the right to privacy in his home and papers.

      You are wrong. The hotel is not a state actor so Constitutional protections don’t apply. Furthermore, when you stay at a hotel, unless you put the “do not disturb sign up,” you should expect that a hotel worker may enter. Even if the sign was up and they went in anyways, there would still be no Constitutional protection because it is the hotel, not the state.

He promises that He knows the state of every creature but his creatures still have the instinct to fight or flight. God also promises to supply your every need but I am sure He does not want you to quit your job and wait on the couch for food and money. I would guess that you may not have children or a spouse since the word of God does require you to protect your family the way He would protect the church.

    Looks like about a million CWP citizens need to occupy a lil part of NYC to shut the system down… nah, not enough Purell to go around. GoToMeeting instead of giving them a wooden nickel, let them have it. No reason to visit NY, Mass, CT, MD, DC or CA in person or even order a thing from their states. Been there, they don’t recognize our 2nd, screw em and their lemming citizens. They reserve rights for criminals, and expect our taxes to keep floating them. Little changes bring about huge money issues for the toads. Fund it/city/state with the taxes you can get from the criminals, illegals, and Cair/La Raza/LGBT groups. Have at it. How soon before the map of the US is blue all aound the coasts and are no travel areas, and the inner/fly over areas are red and have to support the toads in the blue periphery…?
    Like CA limitting magazine capacity to it’s citizens… how does that work in Watts and Oakland? Morons leading morons. Everybody has a few choices…

      You ought to try living here. Experiencing this first hand is breathtaking. (sarcasm) My wife, daughter, & myself can’t leave due to income & housing bubble burst.

      But, yes, what you say is absolutely true about this state & it’s citizenry. Idiots enmasse. I like to think that we should follow the dinosaurs in their “mass extinction”.

      It’s disgusting to realize that my votes have never counted here. To see gang guys walking & driving proudly on the streets. To see drug deals done in the open at mini-marts, gas stations, & grocery store lots. To see graffiti expanding to once nice areas. To see the ratings of all the local schools go down as the non-English speaking students increase. To see we don’t have enough police to fight crime. To see that while being an upstanding citizen I can’t get a CCP. To see laws where we can’t have a 30, 20, & soon 10 round magazine enacted. (doesn’t affect criminals though) To see cities spending money on center divider projects and hiring lazy union workers. To see huge sections of every single town have non-English signage. (i don‘t think that’s what freedom of speech was covering) To seeing what just plain (insert explitive) everybody seems be like here.

      I got to go calm down & get off this site. I get pissed off everyday when I read it. Forgive me for caring and being frustrated.

      Why anyone would BE a tourist in NYC in the first place is beyond me. It wasn’t a bad place with Guiliani running the police but Bloomberg is a disaster. Here is another place to boycott. Take the money out and there is a slim hope of change prompted by business interests. Without hitting them in the pocketbook, the City will remain unchanged.

      Ironically, the OWS movement has cost them millions, has bankrupted many businesses in
      downtown, and the response? Crickets.

      Texas DPS has a sight that lists all the states that honor a Texas CHL. It just takes a few minutes to look up the states where your permit is not valid.
      My wife has family in Maryland where the only permit holders are those with political pull, I have to take my pistol off and put it in my suitcase before I cross th Potomac river bridge. The national repricocity act would solve the problem. These people should have checked their state police web site before traveling out of their home state.
      All the ridiculous laws that contradict the 2nd Amendment need to be challenged up to the Supreme Court. And it needs to be done before Obumbler and Holder regulate the 2nd Amendment out of existance.

    I live in NY and have a permit and I still can’t carry in NYC. They have their own seperate set of rules, which is ridiculous and should be illegal. I’d love to see National reciprocity. Heck, it would be nice to at least have NYC follow the same regulations at the rest of NY. That said, there is no way these people shouldn‘t know that they aren’t allowed to have firearms there. They were either trying to make a point of they just weren’t thinking at all. You’ve got to undestand the laws when you travel. I hope they sue and win. But I doubt it.

      I am going with failure to check the laws.
      i have been a gun enthusiast since i was 8 and back in those days fathers still taught their children how to shoot. i have a valid carry permit for my state and i carry most every day. it is hypocritical that i can go through the same federal BATF background check and be considered legal by the US federal government but not by the city of NY or state fo california. perhaps these incidents will be fuel for the reciprocity law working its way through congress. heck if it works for drivers licences why not CPLs?

      Every state has its own licencing requirements for operating motor vehicles but they honor each others so long as you obey the posted rules of the state your in. it should be no difference in this case.

      the arguent for what is “reasonable” is a joke considering that the people who usually use the term(all the anti-gun groups) would think that having only a picture of a gun is about as reasonable as they would like.

      When I went through mandatory CCW training, it was made very clear that my permit was covered under state law and I shouldn’t consider my permit legal in any other state. You have to wonder if the CCW training that these folks took covered that aspect.

      Well said. Then there is the funds each state gets for doing background checks-doubt they will ever get on one sheet of music. Like NY and NYC having different rules and regs. Money and power, money and power. NCIC does a national check, but that doesn’t bring in funds to the local municipality that grants your “permit”… many, many places are considering a constitutional clause, where as if you are a citizien without a criminal history, you don’t need the permission of a commission on your actual rights. sickening to think we need to pay a toadly clerk in an office for a permit, for what is in actuality a right. That is where we are. Paying a fee to breath and paying more fees to legally defend oneself and paying even greater fees to keep these toads in office.

    THe whole NE of the country has strict gun laws. NYC and Mass. are some of the strictess and are also anti-constitutional. The 2nd amendment of the constitution is clear. Libtrash have tried to water it down for years and are doing so in NYC. Libtrash are so smug about their anti-gun stance while the walk around with body guards and live in gated communities. The constitution still stands in this country and it is time to make the libs abide by it or else. NYC is in violation of the constitution.

      SOUP, Vermont HAD it right, but the NRA backed National reciprocity law will cause Vermont to require CCW licences where they never had to before, concealed or open carry was legal to the law abiding citizens (as it should be nationwide) Since Vermont happens to also be a paifully liberal state, I can’t help but think that their state reps will shake it all up now. NRA threw them under the bus on this one.

    As a registered gun owner in Michigan, I am aware of the states with CCW reciprocity for Michigan. There are 38 of them. New York, California, and Illinois, for example, do not honor my permit. Therefore, I wouldn’t bring a firearm were I to visit. Personal responsibility.
    These states‘ anti gun laws is a topic that I’m sure we could spend a lot of time poppin’ off about…

      Once heard an old guy relate the tried by twelve or carried by six parable…Concealed should always be just that-out of sight. Sort of inviting trouble leaving hardware visible to staff at a NYC hotel. Dumb actually. If you carry a firearm, you need to have your head screwed on straight every minute of every day. Sadly, there are a lot of people carrying that shouldn’t be-not criminals, just average joe’s that feel they have been pushed too far and take up a weapon with little in the way of previous practical applications. It happens, but it shouldn‘t happen this way when we already have laws covering what we as citizens can and can’t do. But hey-if you see something say something right? Sure.

      The ironic thing is that if I wanted to go to NY, I’d DEFINITELY want my handgun with me. While personal responsibility and following the law is imperative (these people should have known reciprocity laws), I find it appalling that a state can actually prevent law abiding citizens from protecting themselves and that the penalty for defying that unconstitutional law (whether intentional or accidental) is up to 15 YEARS IN PRISON!!! Let’s put the real criminals away, please.

    No one should need a permit to carry a gun..Even convicted felons should be able to vote and have a gun..The laws have been over run by the left.. If some one is to dangerous to own a gun then they should be removed from society…Everyone has the RIGHT to own and carry a gun in this country..Remember the constitution? OK now go ahead tell me how wrong i am…You can‘t just pick parts of the constitution you like and do away with the parts you don’t like or your just like the left…….

      that would be a smith and wesson 686 .357 revolver. Just happens to be the first handgun I ever owned. Got it as a high school graduation gift, and still have it. They beefed up the frame and made the barrel lug go all the way to the end of the barrel on the 586/686. Seems that any article dealing with firearms always depicts a glock of some sort. glad to see something different

    welcome to ny state where the crimnals have more rights than law abiding people. it’s a huge blue state. maybe these people arrested should have been mexican drug runner so doj holder could have given them the guns instead…rule of law is being ignored and mob rule or gray line is new norm.

      NY problem is with Southern Gun runners. Of cause the Blaze is upset about Mayor Bloombergs affective effort to expose to scam at gun shows and their lack of enforcement of the most basc gun laws. The Gun show need to be closed down, it is clear that the private dealers are criminals willing to sell to anybody with enough green, no matter if they are permitted to or not.

      Even if Encinom had any facts he still wouldn’t be repeating the truth, just charts from the Brady campaign. Getting your “facts” from tv shows won’t cut it.

      If you look at the law that you are spouting, as a Virginia citizen, you are allowed to sell your personal gun to whoever you please – anywhere, just like a car or dryer. Know YOUR facts before you say something is illegal. New York “officers” broke FEDERAL LAW by purchasing those guns at the Virginia gun show and transporting them back to New York – so now who breaks the law? Also, in some of the most recent murders in NY where a gun was traced to a Virginia gun store – which was STOLEN and yes – it was reported way before the murder to the ATF. Keep your illegal – mob running thieves out of Virginia.

    OK, people, NY,NY does NOT want you to bring a gun. Who cares if you are licensed to carry elsewhere-in NY, NY only the criminals are allowed to carry. So, if you visit there. You need to realize that the 2nd amendement isn’t recognized.

      I wouldn’t count on the SCOTUS to rule favorably on 2nd amendment stuff. Every case like chicago, the vote should have been 9-0… TOTALLY UNANIMOUS due to judges simply using the founders own words and thoughts on it. A 5-4 vote was due to PROGRESSIVE AGENDA driven liberal activist judges who hate our forefathers and the government restrictive Republic they gave us.
