Are Cell Phones a Civil Right? In Penn., Apparently Yes

The state of Pennsylvania says having a cell phone is a civil right.

That’s according to an obviously opinionated report from the New York Post:

Recently, a federal government program called the Universal Service Fund came to the Keystone State and some residents are thrilled because it means they can enjoy 250 minutes a month and a handset for free, just because they don’t have the money to pay for it. Through Assurance Wireless and SafeLink from Tracfone Wireless these folks get to reach out and touch someone while the cost of their service is paid for by everyone else. You see, the telecommunications companies are funding the Universal Service Fund to the tune of $4 billion a year because the feds said they have to and in order to recoup their money, the companies turn around and hike their fees to paying customers. But those of use paying for the free service for the poor, should be happy about this infuriating situation, says Gary Carter, manager of national partnerships for Assurance, because “the program is about peace of mind.“ Free cell service means ”one less bill that someone has to pay, so they can pay their rent or for day care…it is a right to have peace of mind,” Cater explained.

But phone companies may not be exactly on board with providing these services. An article from the San Francisco Chronicle says providers just want the government to reduce fees they pay to make phone services work in remote, especially rural, areas.

Some, naturally, like the idea. One Pennsylvania website devoted to the free cell phone agreements explains who could benefit from the new phone plan and how to find out if you’re eligible:

The fact is, a lot of Pennsylvania residents could use a little help right now. As of May 2011 the unemployment rate is a disappointing 7.4%. The fact that that is lower than the national average is of little solace to those Keystone Staters who find themselves without a steady income.

Fear not, Pennsylvanians. The Lifeline phone service program can help you get a free cell phone and free monthly minutes, from the government. At least that is one less bill to pay.

You are eligible if you receive benefits from any of these programs in Pennsylvania:

  • Federal Public Housing Assistance / Section 8
  • Food Stamps
  • Low Income Home Energy Assistance Program (LIHEAP)
  • Supplemental Security Income (SSI)
  • National School Lunch (free program only)
  • Temporary Assistance for Needy Families (TANF)
  • Medicaid
  • State Blind Pension

You may also qualify if your Total Household Income is at or under 135% of the Federal Poverty Guidelines.

    Look, many people are out of work in this horrible economy, and a cell phone helps people stay in contact with potential employers. They only get 250 minutes (and only 68 minutes in some states), and if anyone tries to text message with them, it eats into the 250 minutes. They are not made for casual users. Anyone abusing the program would run out of minutes in a day. The program is designed for people that really need it.

      I once worked as a foreman at a place where my subordinates would have been considered to be “working poor” and qualified for these phones. All of them had high-end phones from the big cell phone companies. When the free cell phone program started, they got these IN ADDITION to their other phones, and gave the free phone to their kids to use.

      Amen Smithclar! I also worked with a girl who had a very similar situation, except she lived in OH and claimed to live in PA under a friends address. Cost of living in OH is much cheaper, but PA has better benefits. Her kids were on PA Chip (children’s health insurance program) even tho our company offered benefits. She got food stamps, WIC, housing benefits etc. Her boyfriend lived with her unmarried and they had 2 kids (which they got benefits for) but of course the gov’tdidbt know that. He made very good $. They both drove new cars while I got to work in a clunker that broke down often and I would have to get rides from friends or family. I volunteered for overtime, worked holidays etc just for the time and a half pay because I needed it. She refused to work a minute past her schedule because, and she said this, if she made too much money it would effect her “benefits.” her kids were in state subsidized daycare while my husband and I had to stagger shifts and rely on family because we couldn’t afford daycare even with both of us working. She openly bragged that her boyfriend asked her repeatedly to marry him but her answer was “what do you think I am, crazy? If we got married I’d lose my benefits!” It really is frustrating to be an honest worker and watch these cheaters live the life on YOUR dime!!

      Just continue to take away the need to better yourself and we will become like all those other nations that sit back and cry about their miserable lifes. Why bother to better yourself when the government will make it easy for you. Just look at all the low income people, most have no motivation to better themselves whatsoever..       Thank you for clearing that up. For some reason, I just don‘t buy what you’re selling in your comments. In my state, I pay taxes on my cell phone bill that goes towards this kind of program. I also pay taxes on my land line phone for them to have a land line phone. I also pay taxes on my phone bill and my internet bill (separate companies) to provide them with internet service. All of this on the backs of me and other people like me. I feel very lucky to have a job, but I have not had a COLA in 5 years. My insurance rates at work and for my 11 year old car have gone up every year. Every utility bill I have has gone up every year. The food and other products have gone up every year. I am just above the poverty level and if these Federal programs and Obama economy keep up, I will be at the poverty level pretty soon. So I ask you, where is my damn free cell phone? Where is my free ride on everything? Why does our Federal Government seem to think that everything is now a civil right if it’s a “poor” person. They live in a nicer house and drive a newer car than I do because my taxes are paying everything else for them.

      you still do not seem to grasp the concept that you are taking without permission from others to be able to give to the few who have not EARNED it. That is just plain socialism.       I understand the justification system you are using for this program. HOWEVER, IF people need help to this degree, than there should be a fund or an option for those who pay for their phone service to contribute to it. Perhaps companies could have the option to contribute to it with the pitch of possibly finding an employee in the future. Don’t really care how it is done..but charity is the route to go. Not through another program that is not going to be managed. We already spend as a country over 4 BILLION a year just paying people to oversee and to regulate such programs and companies…IT all has to go till we can figure out who is truly worthy of help. There are way too many people who will take anything for free even if it means taking out of the hands of a handicapped child (because they don’t see, therefore don’t care how their actions are hurting others and this country).

      Owning a cell phone is not a right it is a privilege. Owning a house is not a right, having cable or the internet is not a right. The only right we have is life, liberty, and the pursuit of happiness. We are created equal, doesn’t necessary mean we will stay equal.

      I lived without a cell phone for plenty of years (because I couldn’t afford it) and got along just fine. I also didn’t have cable or Wii or a plasma tv for the same reason….which plenty of these families seem able to afford. I work with them so I know.

      WHO is paying for these phones? Welfare is supposed to be only for those who need it. Just like your cell phones. I can’t afford my cell phone, but I manage to squeak out the minimum (T-Mobile, pay-as-you-go, $15 at a pop and only for emergencies), so can I have one of your free phones? You say it’s not a right, and then tell us that everyone has a right to keep in touch. WTF is it?

      Now I want a free cell phone, and free cable and a Wi-Fi connection, and a free Kindle… You just don’t get it, do you? I‘m paying for someone else’s free phone because I’m not a leech.

      There have been full page ads in the newspapers for months…..who pays for that? There are radio and TV ads promoting these plans. Again, do we full- pay subscribers pay for that too?
      You forgot to mention….for an additional payment by the subscriber of only 20 dollars a month….they can get UNLIMITED minutes and texts. They can keep their phone numbers too! So obviously, they already have phone service if they can keep their phone numbers. DUH??
      I can’t afford unlimited text and minute plans myself….and I work 7 days a week.

      This should not be a Federal program, but a state program. Why should my tax money pay for a luxury like a cell phone for anyone? I am already having my tax money paying for people that don’t want to work, women with 4 kids and 3 different fathers. When do people take responsibility for their own lives and actions? I have no problem helping the infirm and elderly, but the young, capable of work (any job) people need to step up.

    What is worse is these phone companies are advertising on radio and local TV for business. It makes me want to barf….I use only about 200 minutes a month for a family plan so my 88 year old mom has a cell phone and Verizon charges me $84 a month…so some bas**** who has no shame, can talk for 6 hours a month to his drug dealer or other out of work buddies? Fine, give them a phone that can dial 911 and that is it…And, who keeps track of when these low-lifes aren’t eligible anymore? How much do you want to bet, they will have lifetime service???

    We are truly losing our minds in this country!!!!!!!!!!!!!!!

    I can remember as a young kid, we couldn’t afford a phone. Then as things got better we had a party line and we finally arrived when we were hooked up with private line. But,my dad paid for it!

      I got a flyer on my door that anyone receiving SSI or Welfare could get a free phone (but they would have to pay for the texting, not included in the package). I had to wonder if it would have a GPS chip in it so the government could tell where all the welfare recipients were. I wasn’t paranoid until this administration. and it‘s not because he’s black, but because he’s a marxist.

      I hear ya on that buddy. I’ve got 150 minutes a month on mygreatcall cell. The cost is reasonble, about $20 bucks a month. Keeping within those minutes not so reasonable as I just barely creep over the amount and charged 30 cents for every minute. The next plan up is 400 minutes at $40 a month, a plan that is more than I can use. Naturally they don’t have one in betwen, say a 200 one.
      I switched to a cell to get away from the exhorbitant fees the land line I was using was charging me.

      If these free cells were even available in my state, I did the math. I’d be ineligible simply from the yearly Social Security income I draw as my “income.”

    If cell phones are a CIVIL right that means everyone qualifies for a free cell phone. The ACLU argued and won that cable is a CIVIL RIGHT as well. Soi that means everyone is entitled to free cable…..
    Civil rights are The rights belonging to an individual by virtue of citizenship, especially the fundamental freedoms and privileges guaranteed by the 13th and 14th Amendments to the U.S. Constitution

      That’s the goal, then we can all be so “privileged”. I’ve seen the section 8 housing around here, drug dealers on every corner, gun shots ringing out through the night, little kids (even toddlers) running around dirty and barefoot with no adult in sight, a park that they can‘t even play in cause it’s full of drug dealers, urine and used condoms…. no thanks!! I would pitch a tent in the woods before I would live there!! Unfortunately if Agenda 21 continues this will be the life for everyone as they move us out of the suburbs and rural areas and close off all forests.

    You can get a free land line here in KS if you have any of the services listed. Yet, once the phone company has you listed they keep calling & trying to get you to sign up for “other” services. A young lady I know has a learning disability & doesn’t know a scam, she ended up owing over $300 for the extra services.

    This makes me sick. I grew up poor. No free breakfast or lunch at school. I was lucky to get anything at dinner time. No free or reduced houseing or help with untilities, no food stamps, no cash, no cell phone, We didn’t even have a phone, we didn’t have gas which ment no hot water.
    Now all of a sudden cell phones are a civil right? Owning a home is a civil right? This is all crazy. If the govt. deems something a civil right that means the tax payers pay for it. These things are not a civil right. If they want a cell phone get a damn job.49% of Americans pay no federal taxes. We need to redefine poverty in this country. There is no excuse for people to be on welfaire benefits for more than 3 to 5 years. That is plenty of time to earn your GED and get certified in a job skill or a two year or four year college degree on a studen loan or pell grant. If you are liveing off of someone els and you are not doing anything for yourself. Set up house keeping under the nearest bridge. You don’t deserve my money or my help.

    You know that the majority of the poor DO have cell phones and they are paying for them themselves. Now they will drop their plans and get it for free. Come on! Enough of the “give me train”. You can get a Net10 phone for $15.00 a month. Is there no end to entitlements? Free food, free rent, free healthcare, free childcare, free education, utilities assistence. Why go to work!!

      Agree, with this addition to your comments. They are rude. It used to be, at least the people called you on them. then if they didn’t call you they at least text you on them, now they ignore the texts.

      Cell phones are a LISTENING device and a TRACKING device. The only way that you can disengage the “FOLLOW ME CELL” is to take the battery out. And if I am wrong, in the future, you will not be able to take the battery out without going to a store to have it replaced. Long live big brother!

    The title has it all wrong. If something is a civil right, that means the government must stay out of it. True with healthcare, true with cell phones. These things are indeed civil rights, and the government is unconstitutionally interfering in everyone’s rights to these desires in life. Obamacare is illegal. Free cell phones are illegal. Feeding the poor is the same as taking food away from the formerly not poor, and making them poor too, making two mouths to feed. It is cruel what big government allies do to us. They have no problem taking every liberty away from us and telling us they are doing us a favor.

    The Feds already give free cell phones. I know several people that have them. They said they got them from “Safelink” https://www.safelinkwireless.com/Safelink/ It includes 250 minutes per month.
    Why does PA have to duplicate the “free program” that already exists?

    I have the same question regarding all “free programs.” There are hundreds of programs, benefits, checks for “the needy.” It’s a quagmire of paperwork and waste. If a person is poor — they need help — period. All those give-away programs should be combined into one big ball with everyone using ID cards — toss in VA, Social Security, Medicaid, Medicare and ever other government give-away.

I worked for 45 years and paid for everything I get, along with probably your parents so think a little before you start throughing out all of that crap about us getting something we did not pay for. Quit a lot of us have paid and paid and paid some more. So leave me out of your sophmoric rant, and get it right. A lot of people get paid out of Social Security that never paid into it like SSI and others that can buy into the system, and then that moron in the White house goes and cuts the amount paid into SS by 2 1/2 % for a year that will really help if SS is in such trouble what an idiot. The amout paid in should have been raised by 2 1/2%. In Calif were 20 billion in the hole and the state admits that 11 billion is due to illegals since they admit to 11 its probably twice that, so what is the anwser? for all state and county workers to take a pay cut, and unpaid manditory days off and increases in the amounts workers pay for benefits. Maybe we could just kick the illegals out, oh yeah thats right you might have to mow your own lawn.

    Pennsylvania is not the only state this program is running in. New York and North Carolina are two others that have implement it. There is at least one other state in which free cell phones are available. New York also provides 3,000 dollars towards the purchase of a vehicle or towards repairs for a vehicle to those on social service.

    Same thing in liberal Mass for years now. I remember laughing at the AD on TV!! “Are you on welfare? Then you qualify for a free cell phone…. call this toll free number OR go ONLINE to…” HAHAHA YOU are so poor you can’t afford a phone, so go to your expensive COMPUTER with EXPENSVIE INTERNET access and get one FRE! hahahahaha

    Being able to talk to someone on a cell phone is a civil right? Please don’t try to use the “emergency” argument. You can take any functional phone that has not been activated for years, dial 911, and it will connect to a 911 operator. This is giving people free cell phones with minutes to use to talk to their friends or anyone else they want to talk to. They can use it to order pizza if they want. Cell phones are handy and I usually have one with me where ever I go, but I PAY FOR IT MYSELF. I don‘t not see how having a cell phone is anyone’s “right”, that someone else should pay for a convenience, and what I find most disturbing is that anyone in their right mind could conceive that it is some sort of civil right to have one.

      It’s the nanny state run amok,I see tv commercials all the time for FREE phones of course paid for by the few remaining taxpayers.It’s just like president Reagen said “when government expands liberty contracts”.It’s a simple concept any normal person with an average iq can comprehend,sadly we have a lot of people who are just stupid and lazy and want the government to take care of them.

    Civil right my @ss. A part of modern life & a convenience absolutely but I think you can still not only achieve your civil rights but more importantly your inalienable rights of life, liberty & the pursuit of happiness w/out a cell phone

She signed the warrant which stated that she believed there was property at Rawesome Foods that was “used as the means of committing a felony.” (What, the raw cheese?     • All membership agreements of their current members (customers); this way they can intimidate customers, too.
