Arizona Lawmakers Seek to Block Westboro Protestors

As the families of the victims of Saturday’s shooting in Tucson prepare to say their final goodbyes to their loved ones, the Westboro Baptist Church is getting ready to deploy protesters to picket funerals, including that of Saturday’s youngest victim, 9-year-old Christina Green. But according to the latest reports, the Arizona state legislature is seeking to limit the infamous group‘s ability to disrupt the victims’ funerals, once again raising conflicting questions over the grieving families’ right to privacy vs. an individuals right to protest.
According to TPM, a bipartisan group of state legislators is working to push through a bill this week that would deny Fred Phelps and his Westboro Baptists followers access to the victims’ funerals.
“We’re going to try to protect the families from undue harassment,” Rep. Daniel Patterson, D, told TPM.
Another state House Democratic Caucus aide told TPM that as soon as Westboro’s plans became public, leaders from both parties “got together to work on a way to prevent the church from harassing mourners.”
As you might remember, a federal appeals court last year ruled that picketing was an expression of free speech protected by the U.S. Constitution. Up until this point, Westboro’s funeral pickets have focused mainly on the funerals of American soldiers.
Citing their First Amendment right to free speech, Westboro followers say they use funerals as an “available public platform” to “deliver the message that there is a consequence for sin.”
Though many denounce the church’s actions, the debate over the group’s right to protest has divided the country. Glenn and Pat got into a heated discussion on the issue last October:

This is the report that Pima County Sheriff Clarence Dupnik has been dreading since the tragic event on Saturday January 8.
The sheriff has been editorializing and politicizing the event since he took the podium to report on the incident. His blaming of radio personalities and bloggers is a pre-emptive strike because Mr. Dupnik knows this tragedy lays at his feet and his office. Six people died on his watch and he could have prevented it. He needs to step up and start apologizing to the families of the victims instead of spinning this event to serve his own political agenda.
Jared Loughner, pronounced by the Sheriff as Lock-ner, saying it was the Polish pronunciation. Of course he meant Scott or Irish but that isn’t the point. The point is he and his office have had previous contact with the alleged assailant in the past and that is how he knows how to pronounce the name.
Jared Loughner has been making death threats by phone to many people in Pima County including staff of Pima Community College, radio personalities and local bloggers. When Pima County Sheriff’s Office was informed, his deputies assured the victims that he was being well managed by the mental health system. It was also suggested that further pressing of charges would be unnecessary and probably cause more problems than it solved as Jared Loughner has a family member that works for Pima County. Amy Loughner is a Natural Resource specialist for the Pima County Parks and Recreation. My sympathies and my heart goes out to her and the rest of Mr. Loughner’s family. This tragedy must be tearing them up inside wondering if they had done the right things in trying to manage Jared’s obvious mental instability.
Every victim of his threats previously must also be wondering if this tragedy could have been prevented if they had been more aggressive in pursuing charges against Mr. Loughner. Perhaps with a felony conviction he would never have been able to lawfully by the Glock 9mm Model 19 that he used to strike down the lives of six people and decimate 14 more.
This was not an act of politics. This was an act of a mentally disturbed young man hell bent on getting his 15 minutes of infamy. The Pima County Sheriff’s Department was aware of his violent nature and they failed to act appropriately. This tragedy leads right back to Sherriff Dupnik and all the spin in the world is not going to change that fact.

Why have a press conference so quickly? What was even known at that point to even have a press conference.
I have also been wondering why it took until today for anyone to go to the parents’ house where he lived? Very interesting to me. If they were so worried about whether there were other people involved, wouldn’t they have made a bee line to that house?

Anytime a guy comes out swinging like this sheriff did, make me wonder.. Sounds like he had a run in with the shooter before and I bet you instead of accepting this shooter was mentally ill and dealing with him appropriately , also I am sure the sheriff was friends with the shooters sister who worked for the county, so he didn’t want to have to put her in jail( maybe it is his mother) or put him away, instead, he got angry because he blamed it on who he blames his own life on, because of his liberal blinders, he refused to see the reality of the situation… I bet this why he came out blaming them right away, as if, this is what he probably told the shooters sister or mother , whoever it is that works for the county. I bet this sheriff has blood on his hands and I bet you that he is so LEFT WING that he won’t even accept responsibility for his lack of puttng this shooter away long before. That is the huge divide between liberals and conservative, liberals always want to blame everybody else for their miserable lives, it is never enough for these people. Conservative take life as it is handed to them and take responsibility for it. Liberals seek happiness from outside of themselves, so they blame factors outside of themselves for their miserable state of being, where as conservative find happiness with in, which is the only place it exists anyways, and take responsibility for their life it they make the wrong choices… Sick really sick people… I will do my thesis on this for my doctorate, the intellect has destroyed the earth since Eve partook of the tree of knowledge, to be like God, to know good from bad.. I choose the tree of life, which is of wisdom, not knowledge… May the spirit come into those who we are paying to protect us and move them to understand they have a job to do and that they are doing nobody any justice by letting them off the hook or dropping charges, they believe they are keeping the piece when mean while they are destroying order in our society. This stupid sheriff mentioned the old days when there wasn’t radio stations and tv talking as the right does, this is because we all believed that way, and a sheriff could take a kid home and the parents would deal with the kid appropriately, not like today… to many irresponsible adults , supported by the left, who don’t have time to look after their kids or find it too difficult to discipline them… this has been going on since the 80′s. Could they have charged him with a felony? Well it can’t be legal to make terroristic threats to people. If true, he should have been charged and he wouldn’t have been able to purchase a gun. Maybe Sheriff Dupnik should step down until all this can be sorted out. At the very least Dupnik has some explaining to do. How much do you want to bet that the first time he starts getting questioned about his own competency, he gets tight lipped?

If you a resident of Pima County, you have lot of political weight in this dog fight. If you are not a resident of AZ, please admit it, but know your letter probably won’t count as much. However, if they start getting sacks of mail about this idiot Sheriff, they will pay attention.
Be polite in the letter, don’t threaten. We want a serious investigation of the Sheriff, not the rest of us. State your objections and be sure to send a copy to Governor Brewer. My letter is written and I am just waiting to be plowed out so I can wade over to the mailbox. If you have access to a fax machine, well, have fun.

It is finally time for there to be consequences for their actions. In the future, cities need to deny them permits and fine them exhorbitant amounts of money if they gather – they have been getting away with this for too long and it needs to stop. He and the Democrat hate group Westboro Baptist come from the same ilk. Both are Democrats and both are attention seeking hate mongers. Sheriff Dupnik and Fred Phelps have a lot in common. This Sheriff has admitted that Loughner had a violent record and that they had been to see him multiple times. Why didn’t he do his job? If he had this tragedy might not have happened. I’d say the Sheriff in CYA mode. We need to hear from some of the Pima county Deputies about the Sheriff’s competency.

Posted on January 11, 2011 at 11:00amI hope and pray the families will be allowed to bury the dead in peace and dignity for the departed; the protesters of this church enrage me – I just wish now I could get down there to join the counter rally who will work to stop them from interfering with the families.
Also, has this matter not already gone to the US Supreme Court already?

Posted on January 11, 2011 at 3:21pmAs must as I detest the activities of the Westboro protesters, I do not wish to see legislature to prevent their actions. If I weren’t so far away, I’d go down there myself to volunteer to be counter protesters but I do not want to legislate this issue. They can’t just make legislature to say “The westboro church is not allowed to protest at funerals anymore” it will be a law that will be ambiguous and allowed to apply to more than just these protesters, whether it’ll apply sooner or later is for us to find out. As outrageous as they are, I will not advocate for legislature against them. Counter protest all the way, show the power of American’s resolve.
As long as they are not on private property, I cannot justify restricting them.

Posted on January 11, 2011 at 10:07pmI am total against the legislative branch prohibiting the picketing at funerals. I think that the private citizens have been doing a great job. And I am also waiting for the day that Fred Phelps or any of his followers dies.
Then if I have the means to, I’ll be there, with bells on.
I’ll be there with a nice, big sign.
I’ll be there just like they are there for the grieving families.
And I hope hundreds if not thousands of my fellow Americans who despise these people for their lack of human compassion, for their disrespect of the families of our soldiers and now the families of our citizens who have died in tragic circumstances or the families of those who have other high profile funerals will be standing right next to me.
Maybe we can have a party. Maybe we can sing a song like “Ding Dong the fool is dead” or something equally reverent.
So, no, I hope they don’t pass the legislation. I believe in free speech.
