Disabled Army Vet Arrested for ‘Stalking’ Westboro Protesters

A disabled Army veteran is facing stalking and weapons charges after he was found with guns and waiting outside a recent Westboro Baptist protest gathering. The church is known for its controversial military funeral protests.

Police in Marion, Kansas have charged 26-year-old Ryan Newell, who lost both legs while serving in Afghanistan, with five misdemeanors including stalking, three weapons charges, and and false impersonation of a law enforcement officer.

The local sheriff’s department arrested Newell on Thursday after it spotted him following a van carrying church members. The department later found him camped out in a car outside City Hall where church members were meeting with detectives.

The Wichita Eagle reports:

In the vehicle, investigators found two handguns, a rifle and more than 90 rounds of ammunition, sources have said.

The stalking charge accuses Newell of actions targeted at Westboro members and putting them in fear for their safety.

The weapons charges accuse him of unlawfully carrying and concealing or possessing with “intent to use” an M4 rifle, .45-caliber Glock handgun and .38-caliber Smith and Wesson handgun.

Newell is currently being held on $500,000 bond. During his initial hearing, two lawyers showed up to represent him, and he told the judge that numerous others have offered to do the same.

“The more the merrier, I suppose,” the judge quipped.

The Eagle reports that Newell is the recipient of numerous military medals and honors, including the purple heart and the bronze star.

“I don’t particularly like them going to funerals. I can understand why he didn’t like that,” Newell’s grandmother told the paper. “Because he went to go do a job, and he lost his legs doing that job.”

“It’s kind of disappointing,” one community member told the paper.

The Westboro bunch are to smart to get on the wrong side of the law. They can not get them for stalking because they apply for permits and they are limited to protest only in the area designated by the permit. By law they have done nothing to cause a city to not issue these permits. It stinks, but that is the way it is. Until they break any laws, they will get away with this.

Those fake westboro “christians” make a mockery of what is right and the attributes exhibited by a true christian is missing in every way. But you notice that they go crying and whining to the law if they get scared. This shows 2 predominate specifics about these people:
1: They show a total and complete lack of humanity, compassion, God’s Love or even human love and maybe just barely fit into the classification of human.
2: I let what relation people have with God be between them and God. However, based on what is clearly the “fruits of their labor” these people will probably have not any more chance than the devil does of getting into heaven.

Good golly, what would have happened if he had home grown tomatoes?
The Westborough church is not idea of how a christian church should act. I personally don’t think that we should attack or harass anyone because they believe different from us. I have my Bible based beliefs, others do not, if asked I state my beliefs, If they attack me I tell them to go yell at GOD, I’m merely agree with what HE ( GOD) says. I don’t attack them, nor is it my place to pass judgment upon them.
I feel like this soldier could be my son (who is scheduled for Afghanistan in 2011), I recognize his frustration and I empathize with him, but Killing those folk is not the right way to handle them. I pray that the local authorities, let things cool off, then release him without charges.

On a side note, a local Vietnam vet flipped out got a gun and went to find his wife to kill her. Police caught wind of this and he ended up getting in a gun fight with the police. So here’s a guy shooting at the police but after the furror died down he was released without charges. He and his son were local “good guys” so he was pronounced insane and beat the rap.

Can someone explain the intent to use………..the weapons were in his vehicle, no mention was made as to if they were loaded or not, was he seen pointing a weapon at someone or did the thought police read his mind and obtain that information. Could he have been planning on going to a shooting range after confronting the cowards at Westboro? Did the Westboro people look in his vehicle and notice the weapons and thereby became afraid or was it the sight of him looking at them that scared the members? What was Ryan doing so wrong following another vehicle that the police had to stop him?

      Posted on December 3, 2010 at 2:26pm

Under Kansas law, intent to use means that the weapons were loaded and accessible to the person carrying them. Nothing more.

It does not mean that he was brandishing the weapons – which would be another offense. It also does not mean he intended to commit a crime using the weapons.

It does mean that in Kansas, having a loaded weapon within “lunging distance” – like in a glove box, or arm rest cubby, is considered intent to use.

Their case law reflects that a person with such a weapon and access had the intent to be able to use the weapon without having to perform some other step – like unlock it, or load it, or retrieve it from a case in the trunk.

I’m not saying I agree with the law, by providing what they mean here, or with any law restricting the right of the people to keep and bear arms. I have not been unarmed in many decades and resent the requirement to have to buy a carry permit. I reason that any American who chooses to own and carry firearms, will also ensure that they are well trained in their use and act with abundant responsibility at all times.

      @LKETCHUM

Thanks for explaining the law. So he was in his car with a loaded gun. Was he was breaking a law? Yes. Now is the $64000 question. Why would his bail be set at $500,000.00, that’s half a million dollars fokes. If we can’t see the real truth is he is being made an example of buy the judge who set his bond (I would be corrected if Kansas law required 500 k for this offense).

This is the whole trouble with why we are all going down the road to destruction. Out courts have lost common sense, our government has lost common sense. I could go on and on as I’M sure ea of you could as well. Anyone who dares take a stand will not only face the states legal arm but will also be called a “lunatic”. Listen, the one matter here at hand is the possibility he was going to use them on the protesters; it is one thing in usage of force in the defense of yourself and/or another when others threaten life and home. We must not be the initiators of the violence, that is what the Progressives and the admin are just waiting for to happen.

Especially if it is a ex military and/or tea partier then they will be more happy for getting the solution to cracking down completely.

I understand his side completely; and one other poster is correct of this group being a kind of cult; a cult of personality like the Branch Davidians.

Anyone watching these demonstrators, keep the means peaceful, and video tape anything they do to initiate hostile action or anyone supporting them.

@ SnowL,I usually agree with your posts, and I understand the reasoning behind your last one. Glenn would agree with you and we have to be careful what we say on the Net, but …There’s not a person reading this story who would not understand (and possibly find innocent) the actions of a Veteran-Patriot like Ryan Newell who fought and suffered along side his comrades in arms. Any action he might take, regardless of it’s severity, to defend the right for his fallen brothers to have a dignified and peaceful burial would be hard to prosecute against in a court of law. The national outcry would be be deafening! Those fallen soldiers gave the ultimate sacrifice, who will stand up for them if not a brother?

Are we to be rendered impotent by the fear of the reactions from the Left? Is there no radical position of the Progressives we will stand against? If not this story, then what, I ask?

I agree, if the church group is allowed to stalk fallen soldiers families; then it’s only fair for this soldier to stalk them. After all, don’t they also preach an eye for an eye?

Tony, clearly you don’t feel that people burying thier loved ones, who lost thier lives fighting for our country, have no right to a peaceful ceremony.
They have every right in the USA to sit in thier cave and condemn gays, or soldiers or anyone else they want. They are horrible people to say and do what they do at funerals. If you lost a loved one would you want these animals at the funeral jeering and whooping it up? You are a heartless pig if you think the WBC behavior is OK and should be allowed to continue at ANYONES funeral.

Does not a handicapped man have the right to defend himself to the best of his ability? Sounds like you and the police have a guilty concience cocerrning the Westboro’s behavior, because you guys know whatever happens to them they deserve.
