Atheist Sues Florida Sheriff, Claims Harassment Because of Her ‘Non-Religious, Atheist Viewpoint’

TAMPA, Fla. (The Blaze/AP) – A Florida atheist says Polk County Sheriff Grady Judd keeps having her arrested because she’s not a Christian.

EllenBeth Wachs, the legal coordinator for a group called “Atheists of Florida,” sued Judd Friday in federal court in Tampa, claiming her two recent arrests were retaliation for “assertion of (her) non-religious, atheist viewpoint in the predominantly Christian-oriented Polk County.”

Wachs first tangled with Judd last winter after he uprooted the Polk County jail’s basketball hoops and donated them to local churches. Her group claimed that was an unconstitutional use of public property.

Since then Judd’s agency has charged her with minor crimes, including illegally posing as a lawyer, possession of marijuana and simulating sex sounds from inside her home within earshot of a neighbor’s 10-year-old son.

As for the latter accusation, WTVT reported the following back in May:

According to investigators, here’s what happened: the boy was playing basketball one morning. Wachs asked him to stop because she was sick and the noise was bothering her. The boy did stop, but a few minutes later, he began shooting hoops with his dad.

In late May, Wachs found herself in trouble with the law once again. TheLedger.com has more:

Ellenbeth Wachs, 48, of Lakeland, had about 2 grams of marijuana and a pipe in a safe at her home, the Polk County Sheriff’s Office said. Both charges are misdemeanors.

Deputies found the safe when they served a search warrant at Wachs’ home on March 3, the day she was booked on a charge of engaging in unauthorized practice of law.

Interestingly, Wachs purportedly appears in a video called, “Secular and Sober: Beating Alcoholism Without AA.” This video was posted to YouTube on May 1, 2011. You can watch it here:

Judd’s spokeswoman declined to comment on pending litigation.

    Evidently she used the “Marijuana Maintenance” program to stay sober.

    Now I’m not condoning what the Sheriff did, but he probably figured those basketball hoops would serve a better purpose keeping the younger ones off the streets and out of his jail.

    This is another case where the police have overreacted. The sex sounds charge is ridiculous and will get tossed at some point. It could even make a judge sympathetic to assertions that she’s being picked on. The sum total of this could bring in higher profile attorneys to champion her complaints about donating basketball hoops to a church and prayers before public meetings. I believe this will all backfire on the Sheriff.

    I think we should be able to live in a society where local government operating under community approval can donate used equipment to a house of worship. I think elected officials should be able to say a prayer before meetings. But I believe the Sheriff chose a bad way of defending it.

      the police did not overreact this womans behavior is surfacing as very abnormal behavior & enchantments of unusual behavior. she may become dangerous to herself or others. This root problem she has is very sick like cancer eating in her heart & can become full blown into more serious types of crime. The sheriffs dept. has a hard job dealing wuth the devil every day.

    beth has replaced one alcohol demon for another. This is actually a very sad story! Whatever happened to her is very sad. She does need the gift of God to change her anger & rebellion or otherwise her demons will destroy her life. They already have put her in jail. My father battled alcohol for almost a lifetime. He too said too much religion was very painful for him. He became sober on his own for 15 yrs. Sobriety with overwhelming religion makes sense. We are fighting against principalities & powers greater than our strength. Ephesians 6:12 Beth is wrestling with these powers! My father is passed today & he started drinking before he died after 15 yrs. of sobriety. He spent 50 yrs in pain with alcohol & caused so many heartaches for our family . Ellenbeth Wach has a beatiful name & was born a very b-t-ful woman. She needs to see her anger & deal with it & ask God to give her love in the place of all that anger, hate, & hostility b/c it is ruining her life & going up against city hall , the sheriff etc. is a bad behavior that doesn’t represent athists very well. Atheists like to think of themselves of good & nice people above the law & golden rule. I will say a prayer that God will reveal himself to ellenbeth in his pain & suffering on the cross & give her peace from her demons that we all have that wrestle with us in life. ellenbeth if you read this please know this is the truth & meant in love having suffered as a child of an alcoholic. You aren’t the only one hurting!!!

      I, actually, agree with you on this.

      But let me expound on your statement.

      The coming “darkness” will be a holy war waged by unenlightened and violent American Christians seeking to purge and purify America along intangible metaphysical lines of religious faith of all they deem a threat. Essentially saying: “If you‘re not a Christian then you’re not an American.” PLEASE BEWARE OF THIS SOLIPSISTIC FASCISM!! It is the very definition of “terrorism.”

      Just watch how the 2012 GOP Presidential nomination plays out…every Christian nutjob (just the “nutjobs”, mind you, which are multiplying) is waiting in the wings to pounce and proclaim their perceived “truth” or personal revelation. All of which is sanctioned by the Bible.

      The Religious Right is by far more of a threat to our Republic than the Progressives could ever wish to be. And don‘t think the far left doesn’t know and understand this very well. They do. Moreso than you. And don‘t think you aren’t being goaded…

      My fellow Americans who subscribe to the Christian faith, please be careful in the coming months and try to think rationally. You are painting yourself into a corner of ignorance, fear and reactionism. Which is exactly where the DNC wants you positioned.

      I won’t ask you to “love thy enemy” like Jesus is reported to have postulated because that is a stupid expression. But I will ask you to understand your enemy and, most importantly, yourselves.

      Religious faith IS inherently solipsistic. To express such a belief is to deny reality in order to take personal comfort in self (or, if you prefere, selfless) collusion with unseen forces.

      As for the Fabian Society, that’s England. There are no Fabian’s in the United States. There are socialists but so what? To reject religion is not to embrace socialism. You make a strawman conclusion. It’s not an either or conflict between Jesus and socialism (two equally appalling forms of tyranny) It IS Totalitarianism vs Freedom. And the lynch-mob like hatred coming from certain Christian conservitives is more threatening than anything

      I agree that a war is coming, and I do believe people of all religious and political persuasions should be wary. Specifically on MrButcher’s note about believing that “loving your enemy” is in essence stupid, I pose this. What definition of love are you using? Personally, I believe it is possible to love all men, even the woman in this article. She is a child of God as are you, as am I. That says absolutely NOTHING about her beliefs or actions, which I find frankly reprehensible, usurping due process and complaining that she has been violated when in fact she’s been arrested for actually breaking the laws before this.
      As for remaining wary, it is blind fanaticism on anyone’s part that is the issue. To be so certain of a cause – true or not – that one is blind to all other possible views is a really bad idea. It leaves too much room for contention, needless argument, and the growing chaos and disorder we are seeing day after day.

    Well, if all is as she says it is, she has a valid point to make. However, my only objection is the apparent “throwing the baby out with the bathwater”, in this case the ‘baby’ being the belief in a higher power which is what AA promotes. In her case as stated that higher power was herself. Too often Christianity has produced it worst enemies from within its own ranks as it were. This is, I believe, because most people do not discern the difference between the soul of Man and his spirit. I have known far too many good people who were raised in religious homes that have rejected the good of Christ along with the bad of the religion that calls itself ‘christian’. Life is too short and prescious to be constantly haranguing one another about religiousity that is neither correct nor loving in its presentation. Religion of any type is in my opinion, witchcraft in the least common denominator, whereas what Christ taught is ‘the way of a Father with His family’.

      Yep another one. Im curious with all these frivolous suits how come we never hear someone turn the tables and sue atheists or whomever that gets offended when something that is a staple point in American life offends them?

      I mean like the ones that sue over XMas, how come no one comes along and files suit that their holiday has been ruined by that one whiny person or group? They could argue they are emotionally damaged b/c their desire to express their holiday cheer etc is being restricted?! Or how about the ACLU ,which I am sure will be along, how come no one ever sues them b/c their involvement in peoples lives uprooting things they are accustomed to do?

      After 17+ years of sobriety I can attest to knowing only ONE atheist who’s been sober longer that two years, and I know sober people from almost every state in America and 16 foreign countries.
      Altogether I’ve had to try to memorize @ 5000 first names, believe you me, that alone combined with God can keep you sober, lol.
      In AA we call her program of sobriety, the “ marijuana maintenance program”, and that ain’t sober sweetheart, that’s just denial.
      We don’t h8 you because your an atheist, you judge yourself in that matter.

      I DO think many people can deal with alcoholism without AA.
      I also know of people who go to aa and are atheist or agnostic.

      She just needs help. I think this is just another of her many cries for help.

      Yeah, he had to give them to the churches because of the NO PLAYGROUND Equipment policy at almost every school in the nation. Kids cannot “play” at school because they might get hurt. Districts all over the nation are clamping down on the rights of our kids to exercise and have fun. Check it out in your area. Prisoners are free to get more exercise and have more fun than elementary kids these days. And by the way, what does this woman have against hoops?

      Sounds like she is getting everything she asked for. If she can hear a basketball through her windows, I suggest she get rid of the cheap windows and get some double/triple paned windows. The world doesn’t revolve around her! As for Grady Judd, he is the Arpaio of FL.

      Moonbat. Why is it that some atheists make a religion out of destroying religion? She was arrested for legitimate reasons. And has anyone ever been to Polk County? Scary. Very scary.

      Uh, she was arrested for posing as a lawyer and it was only considered a misdemenor????? RFLOL!!!

      I wonder what the Florida Bar Association thought of that!!!! And of course, only atheists would misrepresent themselves as lawyers when they were not, right??? So, it’s clearly a case of Christians persecuting atheists.

      Atheists have been in the news alot lately, for objecting to street signs, for objecting to religious holidays, for objecting to valedictorians making reference to God, and now this. It always surprises me that they insist that we “accomodate” them.

      This isn’t the whole story. There is so much more to this. Give the local law enforcement the benefit of the doubt. People aren’t arrested for doing nothing. She may claim sobriety, but didn’t the police find drugs in her home? Hmmm…

      Just watching and listening to this woman makes one question her sanity. How does she end up in the news? SHE calls the stations. She can’t stand NOT to be in the news! Here’s some more of the truth, but still not all of it. She is part of a larger plan, you can be sure of that.
