AT&T Ordered to Pay Muslim Woman $5 Million in Workplace Harassment Suit

KANSAS CITY, Mo. (AP) — A former Kansas City woman who converted to Islam in 2005 said she was harassed for years at AT&T, and that the abuse boiled over in 2008 when her boss snatched her head scarf and exposed her hair.

A Jackson County jury on Thursday awarded Susann Bashir $5 million in punitive damages in her discrimination lawsuit, along with $120,000 in lost wages and other actual damages.

The Kansas City Star reported Saturday the award appears to be the largest jury verdict for a workplace discrimination case in Missouri history.

Bashir said in court documents that her work environment became hostile immediately after she converted, with her co-workers making harassing comments about her religion and referring to her hijab as “that thing on her head.”

“I was shocked. I thought, `What is going on?’” she told the newspaper. “Nobody ever cared what I wore before. Nobody ever cared what religion I was before.”

Bashir worked at AT&T’s office in Kansas City for 10 years as a fiber optics network builder before being fired from her $70,000-a-year job. She claimed she endured religious discrimination nearly every day of the final three years she worked there, including being asked if she was going to blow up the building and being called a “towelhead” and a terrorist. Bible verses were also left on her desk, she said.

AT&T said Friday it disagrees with the verdict and plans to appeal.

Despite the jury’s award, Bashir stands to receive much less than $5 million because Missouri law caps such awards at five times the actual damage amount, plus attorney fees.

Amy Coopman, Bashir’s lawyer, said attorney fees will be determined later by the judge.

The previous largest such verdict came in 2009, when Mohamed Alhalabi, an Arab-American Muslim, was awarded $811,949 in St. Louis County Circuit Court in a case against the Missouri Department of Natural Resources.

That same year, a Jonesboro, Ark., jury ordered AT&T to pay $1.3 million to two former employees fired for attending a Jehovah’s Witnesses convention.

Bashir said she called an employee help line in March 2005 and asked the company to provide sensitivity training for her co-workers.

“It was a worthless call,” she said. “Nothing ever changed.”

The harassment continued and in March 2008, the Equal Employment Opportunity Commission launched an investigation after she filed a complaint.

She said that made some workers angry and led to the final encounter with her boss.

Bashir said she became so stressed out that she couldn’t return to work. She asked that her boss be removed or that she be transferred, but neither happened.

She was fired after not returning to work for nine months.

“By firing me, they stole my ability to work at a job I liked,” Bashir said.

She said the incident was hard on her mentally and physically and tore her family apart. She is going through a divorce, and in October she and her daughter moved to Anchorage, Alaska, where she works as an apartment manager.

“I have mixed feelings,” Bashir said. “I’m happy not to be reporting to that management structure. But it’s hard in this economy to find a job with that level of compensation. I didn’t want to lose my job, because I felt I was doing good work.”

      I bet this woman has no actual clue or complete knowledge or history of the Islamic faith. Sounds to me she was a disgrunteled employee and found a way to strike back at them. I hope in the end if AT&T actually pays out the Feds are watching her bank account to see if large amounts will be moved overseas etc…just a thought. What a abuse of our justice system.       She said it was hard on her mentally, she was already mentally short a full load. I miss the time when companies could hire and fire as they saw fit, and could set whatever standards of dress and behavior they chose. More people were employed, more people acted respectfully of others, more people were happy, and having to associate with willful misfits of every kind and variety was not a work requirement.

      Medical malpractice suits where they cut off the wrong foor do not even get awarded this much money. This is tantamount to these vermin using our own justice system against us. I would like to see the video and audio of said harrassment. If there is a dress code she was in violation of and had agreed to before working and then converted, she is still bound by the dress code with only the exceptions of religious attire as required by her beliefs and allowed under the code she agreed to with her employment. The claims here seem to me to be hard to believe at best. CAIR being involved certainly decreases the ligitimacy of her claims. I have worked for AT&T in the past and knowing how the CWA union is, this kind of thing would never have gone that far as a craft technician or any other unionized worker. If her job was not considered to be craft, the fact she was making 70,000 per year says she must have been considered management level or in engineering as they define it and I can attest to the fact that such behaviour is not tolerated at all. The union there is especially oversensitive to the plight of anyone who is not caucasian or Christian. CWA could really care even less about those who do not pursue communism or socialism. Fat people are discriminated against there more than she EVER was. They get no protection, just as older employees do not. Only thing that matters is time in title and time in location.

    The conduct of the AT&T manager was way off base in his treatmant of this woman, and the company’s failure to act on her complaint is unconsionable.

    I do not agree with Islam for exactly the same treatment of other faiths in Islamic countries. You cannot claim the moral high ground over Islam if you condone conduct against them while condemning the same conduct against others.

      This was not a normal level of attentiveness to security,but harassment; And it seems little to nothing was done to address her concerns. And the actions of the boss, (snatching her head-scarf from her head) is assault! That boss should have been fired, AND had charges filed against them!

      My thoughts exactly. The law that is their to protect you must go for everyone. Not to the extent of unreasonable changes (such as stopping work to pray 15 minutes 5 times a day, or whatever) …but this lawsuit and award was brought about by AT&T…all she did was file the paperwork for them.

      This is why for the last decade, I have had a complete non-fraternization policy with my co-workers. I don‘t want to know anything about them and I don’t want them knowing anything about me. I am friend-ly with them, but not friends. My friends are those I choose to be around after work, not those I am forced to be around while at work. I have zero interest in discussing work when I get off, so I avoid co-workers after hours.

      True, you can never have enough friends…but there are more than enough people on this planet to be friends with, that you don’t have to pick from people at work.

      My thoughts as well. While I have absolutely zero appreciation for Islam, either people with certain beliefs are allowed to work for your company or they are not. A bad joke here or there is one thing but persistent harassment cannot be tolerated. If you can’t maintain at least a semi-professional work environment, then you deserve to be sued. Perhaps $5M is a little large of a settlement but the company did need a wake up.

      Um…because they didn‘t tell her she couldn’t wear it. They made jokes, left pamplets/tracts from another religion in her work space, made physical contact (grabbing it off her head) and then they never responded to her complaints until she sued.

      I’d have no problem if they said she could not wear it due to safety (machinery she may have worked around), a dress code, etc…but they didn’t…they just harassed her.

      This has nothing to do with religion beyond using it as a tool for dominance and control.

      Islam is one of the three branches of Abrahamic religion, the other two being Judaism and Christianity. There are many similarities between the three religions. As far as being anti-woman all three religions (as well as many non-Abrahamic religions) are anti-woman when you look closely. Woman can‘t be priests and they can’t sit with men in Orthodox synagogues. Most religions hold women to be nothing more inferior beings and unclean temptresses.       When I went to work for the phone company in the late 60′s we were told that “we hired you to be a good employee, not a good anything else”. We had to make our outside life coinside with our committment to our job. Everyone understands that. What if nurses refused to wear uniforms or work certain hours, or prayer times, when dying patients need them? As far as the harrassment, who hasn’t felt harrassed a time or two in their life. Get over it and quit complaining when it fits your purpose. I am a practicing Christian and don’t go around demanding special treatment.

      I could see it getting out of hand and excessive when it’s a union workplace and the leadership failed to act and as the union thugs thought they could never be fired continued harassment all with the approval of their supervisors.       I know a lady who had evidence that her boss was stealing every day from the store he managed…she was his secretary. She contacted the proper people and told them that she loved her job but would not return to work until he was fired and replaced. She was out 3 months before they fired him.

      Now, they could have easily fired her as well for “not going to work” but they didn’t. She got her old job back and back pay.

      This lady has a mountain of evidence showing she was harrassed, that she reported it, that she gave them options –fire the man responsible for stopping it, or transfer her– it’s not that she was out 9 months, it’s that they failed to act on an OBVIOUS problem for 9 months.

      They knew there was a problem, they knew she had evidence of the problem, they refused to act on the problem…and ultimately they retaliated against her by firing her. I’m sure they thought they had their “ducks in a row” to prevail in court…but they were wrong.

      AT&T did everything but get on their knees and beg for a lawsuit and a large judgement against them…their wish was granted.

    Surprisingly we need to follow France’s lead. Ban burquas, ban calls to prayer that interfere with public movement, ban Sharia, make them comply with the law of the land, no religious exemptions or separate laws.     I have personal experience with JW;s. They are required to convert you. If they cannot do that, they are forbidden to associate with you. Tell me how this could work in the workplace?? I am a Christian. If I did that I would be booted in a heartbeat and there would be no rewards in court. I used to be tolerant of others and their religion. The great divider has changed all that for everybody. Especially Christians.

      Being that she is already a Christian she shouldn’t need for JW to try an convert her to what she already has accepted… that Jesus Christ is her Lord and Savior.
      I find it to be a form of harassment after telling the same JW‘s that come to my door that I’m Catholic and enjoy being so. Yet they return every 3 months or so… the same fracken people who look at me like they never met me at my own door. I politely say, “No thank you.”, and that “I’m practicing Catholic and will remain so till my last breath and please once again do not come to try to convert me. Have a good day.” Sure enough, 3 or 4 months latter the same friggen JW people return to my door step. On top of that, I live on a private 1/4 mile road. *Sigh* ENOUGH already!

      We already have one, it’s in the New York City school system. They have dozens and dozens of teachers who can’t go back into a classroom, but their UNION contracts say they can’t be fired either.
