Earlier today, 26-year-old former U.S. Marine Brandon Raub was released from a psychiatric facility via a judge’s order, who ruled that the government had no legal grounds to hold him.

Tonight on Glenn Beck’s show on GBTV, soon-to-become TheBlazeTV, John Whitehead, Raub’s lead attorney and president of the Rutherford Institute, gave his first interview following his client’s release to discuss the case.

Whitehead told Beck that he and his organization are planning to sue over a provision in Virginia state law that allows authorities to place a person in emergency custody and hold them for four hours unless a magistrate enters a temporary detention order (TDO). Raub was held under this law, specifically Va. Code § 37.2-808, for days.

“We are getting ready to file a civil lawsuit…because [Raub] has been put through hell for a week,” said Whitehead. But, he explained, “Under the civil commitment law in Virginia, the police can do this.”

On August 20, Raub was sentenced to up to 30 days in a psychiatric facility after he was detained by federal law enforcement on August 16 over some Facebook posts that criticized the U.S. government and questioned the official story behind the 9/11 terrorist attacks. He also referred to “starting a revolution.”

Whitehead said that veterans have since been contacting him from across the country claiming they too were victims of wrongful detention in psychiatric institutes like Raub. Apparently, there are civil commitment laws in other states as well, he said.

“It happens. There’s about 20,000 civil commitments alone in Virginia each year,” he added.

It was actually Raub’s mother, who took to Facebook in a rage after he son was taken by federal and local law enforcement officers, that sounded the alarm and made the entire country aware of his situation.

“Did they have a warrant for his arrest?” Beck asked.

“No warrant for his arrest and no search warrant,” Whitehead replied. “They haven’t [charged him with a crime] and they’re not going to.”

Stunned, Beck asked how this could take place in the United States of America, where the Constitution provides protections from such things, most notably the First Amendment.

“Is this America,” the attorney said. “That’s what I keep asking.”

To be clear, Raub is a 9/11 “truther” and harbors some pretty questionable beliefs. However, as Beck explains, Americans should defend the free speech of even the people they disagree with. “I will stand with anyone on the left for their right to express themselves in a non-violent way… especially if I find it offensive, I will stand for their right to say it,” Beck said.

Further, in a surprising twist, Whitehead revealed a startling allegation that his client made regarding an incident that occurred before his release. Raub complained to his attorney that one of the psychiatrists that he was seeing threatened to “brainwash” him and force him to take medication.

“That really scared him,” he said.

After soaking in all that Whitehead had shared with him, Beck reflected:

“From what I know of this story, this is an outrage. There were some things that stick out to me — as flares of caution. But the one thing we should be reckless with is our defense of people who have opinions that we don’t agree with. I’ve never asked for a boycott, I’ve never asked for someone to be fired.”

He continued: “If we can’t meet on the battlefield of ideas, as George Washington said, If we can’t speak to each other openly, if we are paranoid and watching over our shoulder, we lose the essence of who we are and we will never be a great nation again… Buckle up, I have a feeling that this is going to be an interesting ride.”

      The First Amendment right to free speech does not apply in situations where you are on private property, whether a guest or not. This site is not a city street or government building, it is a private forum where you are subject to the rules of the host.

      You fail to understand the First Amendment. STELEX — you have a First Amendment right to express yourself but not necessarily on this privately owned media forum. Additionally, there are limits on speech as imposed by the federal government so content may have to be formed in a civil manner of discourse.
      If you have an idea that you wish to express your views on — you can find another forum to express it. You are not entitled to use this specific forum for your expression. You can stand on your local street corner, open up a social network page, all — of course — conforming to the community conditions or the agreed upon usage terms of a social network page.

      As for the article, I wonder if this Marine will have his 2nd Amendment rights revoked because he now has on record that he was under mental evaluation? If this guy is held for days & mentally evaluated, how come the violent hate speech by those in the New Black Panthers are allowed to stay on the streets?

      Stelex, all these guys are right. The Constitution prevents the government from restricting your freedom of speech. The posters here are right, this website can post your comments or not or ban you altogether. Sorry, you’re wrong.

      I’m glad that some conservatives understand this, although it’s mostly situational.

      When there’s backlash against a conservative speaking his or her mind, suddenly that backlash is a violation of the person’s freedom of speech. When people boycotted Chick-fil-A Sarha Palin said that would have a “chilling effect on freedom of speech.” When all the companies stopped advertising on Beck’s former FOX show that was violating his “freedom of speech.” When Dr. Laura got dropped from her show that was violating her “freedom of speech.” Hank dropped from Monday night football? A violation of his “freedom of speech.” Michael Savage can’t travel to England for his hate talk? Another violation of First Amendment Rights. Limbaugh losing advertisers (still)? The same, violation of the First Amendment.

      So the Constitution says that the government can’t restrict your speech. But conservatives, because they don’t understand the Constitution, think that a conservative speaker can say whatever he or she wants, and if people protest or their advertisers kick them off the air, they’re violating “freedom of speech.” Conservatives don’t understand the Constitution.

      I agree with your indignation over Ron Paul.

      The problem is that, if Mr Paul has 20% of the vote, then Mr Obama wins the contest. It really is that simple.

      What the republicans should be doing is persuading the Paul supporters of this simple fact, rather than this sleazy attempt to eject him by changing or misapplying the rules.

      The Romney campaign might adopt some of Mr Paul’s ideas (many of which make a lot of sense) in return for consolidating the vote behind Mr Romney. Mr Paul has previously said that his run is as much about getting his philosophy accepted as it is about the presidency.

      The RNC has behaved badly. That is a given. But isn’t a bit of compromise better than allowing Mr Obama a second term in which, make no mistake, he will do some real damage to your nation?

      @WESTCOASTPATRIOT- Well I did my homework, and you were right about the story being very damaging to Romney. Be that as it may, we are STUCK with Romney now regardless. Its a big old crap sandwich and we ALL have to take a bite! I am a Ron Paul delegate from Nevada. I would love NOTHING more then a Ron Paul Presidency. I agree with you that commen sense tells us that there is NOTHING that suggest Romney will be better then Obama. We do KNOW Obama will be horrible, and we don’t YET know how bad Romney will be. Sites such as sntp(dot)net tell the scary details. Drug company ads for doctors will say “this drug causes a subtle reorganizing of thought patterns”. If that is not brainwashing then what is it? People really need to wake up. You don’t hear of most of these events because – once successfully brainwashed – people taken away are never heard from again.

      Is it just me, or does something just sound real strange on this one?

      Hey, I am as anti big government as anyone you will find. I do not like the big unions, high taxes, multicultural education, socialist healthcare…….

      Something just smells fishy on this one. The lawyer is throwing some pretty big claims about conspiracy stuff against service members getting held in the nut house. I would think other military members would know a little about this if it was happening.

      His client the orange haired, sword owning, revolutionary looks like a all out moon bat, that might just go on a shooting rampage. He looks more OWS than Tea Party. I hate to pass judgement from a few pics, but once again, I just get some bad vibes on this one.

      Remember, the left is always trying to find someone that is an NRA member, veteran, Christian…. that goes on a rampage, so they can point their finger at the rest of us, and have a legit reason to take guns, and implement more gov restrictions.

I was censored because of a link to a report, from The Hill of all places, that is damaging to Romney that the Dems will use against him. I thought all of you should be aware of what is coming.       You do know that all editors have the right to censor and edit any written word that any of us
      write. It is probably one of those rights editors get because they are editors.
      My problem is that some editors are tricky in that they know how to put words in an order to make things sound like …..but not be the real words that tell the whole truth. It is easy when you are a master at the English language to put your thoughts into someone else’s words. That is where Americans must be watchful. Do not ever let someone tell you what they think you said or wrote or what it means. Only you know what you think or what you said or what you wrote and what it’s meaing is. Don’t be tricked by false editing. It has been going one for a very long time.

      I exchanged some interesting emails with one of the mods on here.Seems their policy states the usual,no profanity or attacks on other posters,etc.

      With regard to censorship…

      Some time ago I became so frustrated with the censorship at the Blaze that I delivered a rather pointed post (which was not pulled) and cast unseemly aspersions on Blaze CEO Betsy Morgan (for which I again apologise) and left in a huff.

      I also attempted to contact Glenn Beck, as he is a staunch supporter of free speech, but I don’t know if he received my email.

      One is invited to “speak your mind” so it is a little disappointing when comments are pulled.

      In the end I ate humble pie and came back because the conversations here are more intelligent and informative than at most other sites. And, to be fair, the censorship is not as bad now as it was.

      It is, of course, their site but it can be irritating, and, at the end of the day, principles matter.

      @WestcoastPatriot- VERY, VERY GOOD LINK MY FRIEND!!! It just so happens that I am a HUGE fan Of Mahatma and the movie of his struggle and life is simply AMAZING! Gandhi in my humble opinion is a modern day Jesus Christ. Now as far as going to Tampa to fight for Ron Paul, I ADMIRE your grit and determination. I hope and pray that more Americans will wake up! I am a county Delegate, NOT a state Delegate, so I have no seat, or place at this convention. Our victory here in Nevada was winning the 23 of 25 county commission seats, and defeating the Romney strong hold on local politics. We adapted new rules that force ANY and ALL laws here HAVE to comply with the Constitution. We have done some GREAT things for the cause of LIBERTY in this state, all thanks to hardworking PATRIOTS like yourself and the LIBERTY message. As far as beating the status quo, I am skeptical. Have you studied Bernays as Mr. Beck suggested?? If you have you would have seen the marriage of BOTH political parties and Media a hundred years ago. For 100 years these men have created a power structure to control the public, something I believe you FULLY understand. Now I ask you- Do you really think any ELECTION would make they hand over the power?? Do you see the powers that be saying-” You ran a great campaign, you won, heres the mantle of power.       The first amendment doesn’t give We The People Carte Blanche when it comes to what we say Stelex. For instance, we cannot threaten to kill or harm another person or his property and we can’ yell out fire in a crowded venue to start a panic, and in forums such as The Blaze we agree to their policies before we could make comments, and when we violate those policies we could be censored.
      I am a firm believer in our Constitution but I also follow the laws that pertain to the Constitution and I do know what I could say and what I can’t say, and the same is true when we make comments in these kind of forums, and although I also don’t always adhere to their policies, I don’t complain when I go beyond their policies and then am censored for doing so.

      Stelex. I can understand your frustration, but as many posters have stated, this is a private site. It appears employees and/or partners of this site have responded back appropriately to your comment. This is my first post on this site. I will state this; I have seen on many other sites the censorship of opinions that do not coincide with the site owners. That is sad. That means those sites only want their opinion expressed and will SUPPRESS others posters opinions. This in turn will keep their opinion as the only valid one. But, my guess from your post, you may tend to use inflammatory language. I could be wrong, just my perception. But, a real site that looks for truth, will NOT suppress ideas different than their own. This would show the sites willingness to be open minded for all views and the discussions progress. Again, this is their choice.

    20,000 “civil” commitments (gov’t sanctioned kidnapping) each year in Virginia alone? And Mr. Whitehead is receiving reports now from vets all over the country that they’ve undergone the same kidnappings? This is insane.

    This needs to be addressed not just through litigation, but some serious jail time and fines for the perps involved. This appears to be less about laws needing to be changed than about individuals drunk on power and obviously feeling very protected by the current government to conduct crimes against American citizens, particularly veterans.

    Prosecute, prosecute, prosecute!

      I think he could have spoken up about it. This happened right next to D.C. no doubt it made the DC news. Campaign for Liberty had to know about the case. These guys should have said something in public about Brandon’s abduction and illegal commitment to a hospital psych ward. RP is now a true lame duck with his retirement just a few months from now, so I guess I shouldn’t expect too much from him at this point.

      Daily Paul is not a press conference from Ron Paul or Rand Paul. I too have been on this story since the beginning posting it all over the place and emailing info to many youtube commentators. The silence from ALL politicians (left, right) was deafening. I expected something from the few who warned of the NDAA. Something from the man who started the Campaign for Liberty.

    Wanna see what Government meds do……look at the Colorado shooter. He’s been medicated from day one. He was doped up and just sitting next to his car after a supposed shooting spree. Don’t you think if you just went on a shooting spree your adrenalin would be off the chart. Yet this guy is sitting next to his car ……dazed. Not to mention the gas mask they found on the other side of the parking lot and in an amazing coincidense the nurse who treated most of the patients ( and probably heard most of their stories) mysteriously drowns last week I’m not a tinfoil hat guy but I do recognize patterns. .

      I would not put anything above the Federal government. The power goes straight to their heads and they justify it with “it’s in the better interest of the United States.” No, it’s in the better interest of whomever is running the executive branch at the time. Obama just goes right around Congress and if it goes to the SCJ, well we see what happened there. We got to pray Romney has more to him than he has shown and that we can get 2 conservative judges on the SC before 2016 because even if Romney is elected and we have Republicans running the show, everything will be challenged and will go to the SC where they will vote 5-4 every time in favor of the dark side. John Roberts is just another Breyer. Sotomayer and Kagan are about as qualified as I am for the job and I am not a lawyer. PC is killing the country and continues to do so and along with the Pravda media my blood pressure is going up, I got to get off my soapbox.

      I don’t care that the man made some comments that were apparently taken out of context from the total page that this young man had. He stated he was against violence and the alleged hostile language was taken from a stupid song.

      The problem is 1) NO warrant for the arrest of this man; and 2) NO SEARCH WARRANT for his property.

      Law enforcement is supposed to function within the LAW of the land. This means that in taking action they MUST do so within the laws of the land with deep respect of protecting the constitutional rights. People who seek security over liberty will end up with neither.

      @ The-Monk. I read in one of the several articles on Brandon, that a concerned friend from Facebook, called the authorities worried about what Brandon might do. But, don’t get me wrong, I am all but positive the government monitors all internet chatter. But that is their official statement. Screw them. I have followed this story within the first hours of its inception. I may have read every single article. I have become obsessed with it, due to my fear of the NDAA Section 1021. At first glance of his posts on Facebook, I was concerned. When I read sharpen the axe… and the revolution and… I was concerned for his safety as well as others. This was my first moments perception. After I looked further into his writings on other blogs, heard explanations of the writings, I did not see the risk. I was not there for the 5150 interview. I am in the mental health field and could understand the concern the MENTAL HEALTH FIELD had. But the government. That is just crazy, nazi crap. After hearing him speak on the radio while incarcerated, I was pretty convinced his detainment had nothing to do with his mental capacity. Scary times my brothers!

      @AFISHFARTED.. The government may have some psychiatrist and mental health professionals (?) they use to incarcerate the average citizen that opposes the government or regime. However, the vast majority (98% that’s a stat a pulled out of the air) can give a crap about supporting the government in such atrocities. I for one would love a government official to try and sway me to hold someone for their political beliefs. It would be major news! I have been in trouble (law suit against me) for recording similar corporate nonsense. Funny, they dropped their case because of what was on the recording. Needless to say, they paid!     Thanks, Glenn, for taking look at controlling freedom of speech, and even thoughts, through legal incarceration and mind-altering drugs. These psychiatric meds are almost complete now, some think, at controlling moods, thoughts, altering personalities, in the name of psychiatry. It is worse than 1984. Some drugs injure memory (anti-depressants, anti-anxiety and sedatives). Some make you not care about anything; you’re no longer angry, no longer have unresolved issues from childhood or other trauma negatively affect your life or thoughts. Whatever one might see a psychiatrist for, these things are treated with drugs, not the longer talk therapy where one becomes self aware and makes free choices. Pain, anger, depression, anxiety, psychotic ideations, all this and more is now treated with meds. Perhaps the threat was to make him not depressed, under control (by the doctor), no longer to have thoughts or opinions out of the “norm,“ as a sign of his ”illness“ being ”managed.”
    Remember all the talk about the shooter in Tucson? Wasn’t there discussion about whether he was under psychiatric care or not and taking his meds? Aren’t shooter stories in the news asking questions, such as, why didn’t his campus therapist come forward and save lives? Was he on meds, and taking them? The only shooter I recall not being asked if he was taking psychiatric meds is, of course, the army psychiatrist who killed US soldiers at Ft. Hood (in a “workplace incident,” not an act of w

      I’m on Prozac, Effexor, an Klonopin. They make me a zombie but hopefully they never turn me into delusional. I went through Cognitive Behavior Therapy/Speech Therapy several times and it never worked hence the meds. Psychiatry is such a pseudo-science…..

      @V15. Meds should be a LAST choice. It appears you went through psychotherapy and it wasn’t working. There are people with chemical imbalances, psychotic thoughts, delusional thoughts, etc… Some mis-firings in the brain, have not been able to be changed with just psychotherapy. If a person is hearing voices and it is causing incredible distress, or they think they are Jesus, or as one of my patients thinks he is Hitler, there is point when taking antipsychotic medication may be a best choice for the patients safety as well as others. However, I think medications are epidemically overused and it is a business (which absolutely disgusts me). I for one, believe meds are a LAST choice!

      I only got through a few minutes of that 2 hour clip. I have to ask how can the federal government be so incompetent with everything it touches yet so methodical in this one incident? It can’t. Their incompetence, however, allowed Muslim terrorists to fly planes into the twin towers. Building 7 caught on fire from the debris. I went over this “911 Conspiracy” back in 2002 and it was debunked pretty easily. Here’s how I view conspiracy theories: remember the Mark Twain quote “When you have a hammer, all problems start to look like nails”?       Your mistake is to imply that the entire government was behind it when it was only a few key people using compartmentalized departments who unknowingly assisted. Free falling buildings has never happened under any conditions unless demolished period. The experts explain scientifically why that is and how that was. I’m sure the Arab patsies were used for cover but many things were going on that day and the days leading up to it. Just too many absurdities, coincidents, coverups, and ridiculousness to believe the half hearted official investigation. It would just shatter my reality. I do believe that the government has done a lot of shady and criminal things that it hides from its citizens. When Obama won the election in 2008 I can remember thinking, “Crap….well, he‘ll serve only one term and maybe he’s not such bad guy”.       To answer someone else in this thread.Buildings have fallen without intervention of anyone.Its usually old ones that didn’t have geology based models to go by.They were built on sink holes minor faults and even some while being built have collapsed due to extreme vibration[around industrial plants].Most were less than three stories and are very old.

      Those in the military who are oath keepers will be sidelined and removed, leaving only the compliant, ambitious types to do whatever the President says. Why do you think they overturned the don‘t ask don’t tell policy that was Clinton’s idea in the first place? How many in the military refuse orders when the president broke the rules in libya? How many violated the constitutional rights of the people by confiscating weapons after Katrina? A few refused, but they allowed other units to do it.       You are aware of the “Baker Act” from 1971? NDAA might not have been needed to lock Brandon up. I don’t know which States have this or if it is a Federal law now. But, I do agree with you. Due process is needed and that‘s why I don’t like the Baker Act. And under the Backer Act, drugs can be given to the “patient” without anyone’s permission but the Doctors say so. No Judge needed.

      You could be right. Just remember that it DOES exist in Florida when you visit for the RNC.

      The news here in Tampa has been saying that all the prisoners from one jail have been moved to another jail and Tampa is prepared to arrest over 1000 people a day. They have the room and are prepared. Here’s a link from today;

      I decided against going. I would have like to go to Paul Fest and Ron Paul’s even on Sunday but travel costs were not worth it. Decided to give a couple hundred dollars to Gary Johnson instead.

      I’m unemployed and can ride my bike to the RNC in about 5 minutes. I most likely won’t be going there unless I take my bike…. just to take some video clips of it. I‘m not going to drive down there in my car and I don’t feel like walking the distance.

      I listened to the audio clip and I think it’s someone doing a Glenn Beck impersonation.

      Why? Because I’ve been listening to Beck since 2005 and in this audio there are words and phases that Beck never uses and some of the words Beck does use have a slightly different “slang” to them.

    This whole thing is scaring me for my family, we are a patriotic bunch, many served and are serving, and none of us likes what this administration is doing. I think it is more though. FBI, and all the other letters are quietly taking people away, and if they don’t know who to call or have family, who knows? I want to know how long this has been going on. In Virginia it seems for while. We are noisy about how we feel, will one of us end in a ward somewhere?

      A few years ago I would have proudly answered that question. I would have said NO WAY will ANYONE ever just disappear in the U.S. for political belief (murders, organized crime, lover’s issues, drugs, insanity, greed disappearance are not sponsored by the state). Just a few years ago I would have said it was just silly to even think it, that Due Process HAD to be followed, and in the tragic cases of people being left in jail for several days who fell between the crack, those were tragic bureaucratic failings. I would have said it just won’t happen – the State doesn‘t have to protect itself like that and if it’s representative wanted to, they just couldn’t get away with it. 99.99% percent wouldn’t even attempt it, ’cause it just won’t work.
      I can’t say that today. I sure do wish I could.
