AZ Gov. Brewer Decides to Take Immigration Appeal to Supreme Court

PHOENIX (AP) — Arizona Gov. Jan Brewer announced Monday she will ask the U.S. Supreme Court to overturn a ruling that put the most controversial parts of the state’s immigration enforcement law on hold.
The planned appeal to the high court comes after Brewer lost an appeal April 11, when a three-judge panel of the 9th Circuit Court of Appeals refused to reverse a lower court’s order that prevented key parts of the law from being enforced.
The panel said federal officials were likely to prove the law is unconstitutional and succeed in their argument that Congress has given the federal government sole authority to enforce immigration laws.
Brewer‘s lawyers argued the federal government hasn’t effectively enforced immigration law at the border and in Arizona‘s interior and that the state’s intent in passing the law was to assist federal authorities as Congress has encouraged.
They also argued U.S. District Court Judge Susan Bolton erred by accepting speculation by the federal government that the law might burden legal immigrants and by concluding the federal government would likely prevail.
The U.S. Justice Department urged the appeals court to uphold the order that blocked enforcement of parts of the law.
The federal government argued the law intrudes on its exclusive authority to regulate immigration, disrupts relations between the United States and Mexico, hinders cooperation between state and federal officials, and burdens legal immigrants.
Less than a day before the law was to take effect in July, Bolton blocked key provisions from being enforced, including requirements that immigrants get and carry immigration registration papers and that police – in enforcing other laws – question the immigration status of those they suspect are in the country illegally. But Bolton let other parts take effect, such as a ban on obstructing traffic while seeking or offering day-labor services on streets.
The law was passed in April 2010 amid years of complaints that the federal government hasn‘t done enough to lessen the state’s role as the nation’s busiest illegal entry point. Its passage inspired protests and led to lawsuits seeking to overturn the law and a debate about whether the law would lead to racial profiling.
The Arizona law isn’t the only one that has challenged federal primacy in immigration.
The U.S. Supreme Court is mulling arguments in an appeal by groups that are trying to overturn a 2007 Arizona law that prohibits employers from knowingly hiring illegal immigrants.
Civil rights groups have filed a lawsuit aimed at halting a new immigration law in Utah, saying it is too much like portions of Arizona’s immigration law.

Are you actually so racist that you believe that only white people have creator granted rights and that all other colors only have “Granted” privileges under the bogus 14th amendment?
The 14th amendment only affects those under the complete jurisdiction of Congress.
Illegals are under the Jurisdiction of the country of their nationality. By this quite simple fact, we can establish that NO illegal is covered. No illegals child is granted citizenship. No person within the exterior boundary of ANY state of the Union is NOT subject to Congress. Even they say so.

Check your local community college, even there you would get more knowledgeable insight than what Beck would have to offer. The Constitution is the law of the land and applies to all residence inside the borders. Non-citizens have the right to be heard and fair due process. You dont like it, too bad. As residence of the country they enjoy all other rights we citizens do.

San Francisco is about to up the anti on their sanctuary status, going so far as to give illegal alien criminals priority release if the crime is less than a felony. They will also stop sharing fingerprints with DHS (including FBI) in total violation of the law. Where’s the lawsuit against San Francisco?
Precedent *is* part of our Common Law system, and there is clear precedent of only going after enforcement which is in symmetry with the federal law, but not suing those illegally thwarting the federal laws.

I think the unsettling truth about this issue, and ultimately where I always end up when debating it is; that a sub-wage labor force is a necessity for capitalism. We are not the only capitalist country with this problem, immigration is a sensitive topic all over the world, yet I can’t find a solution that would keep our country running economically without it. perhaps its a “social tax” we have to pay for having such high standards of life.

Everyone always forgets that LEGAL immigrants are required by law to have their green card with them at all times and produce it upon request. My wife and sons are legal immigrants, and don’t ever leave the house without them.
It’s not about dark skinned people, it’s about obeying the law. EVERYONE who is an immigrant is held to this law, why not illegals? There is already a path to citizenship for people who want to emigrate to the USA. It’s time people enforced the law.
BTW, my sons get asked for their green card at every traffic stop. They are white. The fact they are immigrants is in the DMV database. This is why they need to card someone who can’t speak the language and has no license.

It’s a government ploy. Sue – sue – sue. If they sue each state, it robs money from the already way too taxed people. It could be called legalized theft. It also consumes legal time that would be more benefit to the people of that state. This administration is destroying this country and using our methodology of law against us. This administration is purposely forcing states to spend money in order to ‘break the bank’. It’s all a previousely conceived plan to aid in the taking tax money from the people – thus TAXING them more to fight the fight – mean while causing a little more hurt in the wallet of the working people.

Article 1:8:4 plains says:“To establish a uniform rule of naturalization”
They are granted absolutely NO POWER of enforcement. It clearly says they establish a Uniform RULE of Naturalization which ONLY the states may use to naturalize anyone.
Courts say so:”The object then to be attained, by the exercise of the power of naturalization, was to make citizens of the respective States.”

Illegal immigration has nothing to do with naturalization – this is an equivocation.
Illegal immigrants aren’t applying for citizenship – they’re TRESPASSING. It’s not the same thing as a naturalization process. Therefore naturalization laws don’t apply.
Further, the purpose of the Constitution being to secure the inalienable rights of citizens, simply having naturalization laws that are uniform are not enough. If the naturalization laws are uniform, yet contrary to the purpose of the Constitution, the laws have no authority.

Posted on May 9, 2011 at 9:01pmIf SCOTUS accepts this case anytime before the 2012 elections, I’d be surprised. But IF they do, this issue will a good “litmus” test question for any potetntial Republican challenger.

The federal government has become too strong and is on the verge of being despotic.Our duty as citizens is to protect the country from the government. If our government, when petitioned, refuses to fulfill its Constitutional duty, then it is necessary for We the People to do the job! The time to alter or abolish is upon us. When the Constitution was being ratified the main fear of the people was that the federal government would become too powerful. We were warned of this by many of our founders and we ignored it. Our apathy has brought us to this “Big Brother” country. As citizens we must rise up and tell them that enough is enough! Let us work together to restore our great nation that was built by the people not the government. God Bless America.

You do not have to be a resident of Arizona. It is our country that these illegals are invading and its time that they are stopped. The 2nd Amendment gives us the right to defend our country and to hell with Obama and Holder! God Bless America.
