Black GA Legislators Sue to Dissolve ‘Super-Majority White Cities’

Looks like California’s Marin County is not the only U.S. community that’s too white.
The Atlanta Journal-Constitution reports:
The Georgia Legislative Black Caucus filed a lawsuit Monday against the state of Georgia seeking to dissolve the city charters of Dunwoody, Sandy Springs, Johns Creek, Milton and Chattahoochee Hills. Further, the lawmakers, joined by civil rights leader the Rev. Joseph Lowery, aim to dash any hopes of a Milton County.
The lawsuit, filed in a North Georgia U.S. District Court Monday, claims that the state circumvented the normal legislative process and set aside its own criteria when creating the “super-majority white ” cities within Fulton and DeKalb counties. The result, it argues, is to dilute minority votes in those areas, violating the Voting Rights Act of 1965 and the Fourteenth and Fifteenth Amendments to the Constitution….
Lead attorney Jerome Lee, of Taylor Lee & Associates, said the suit is novel.
“The Voting Rights Act forbids a state from doing anything that affects the voting rights of minorities, except with a permissible purpose,” he said, citing the redistricting that takes place when the census documents population shifts. “In this case, it’s different because the state actually went outside the normal redistricting process and created these cities that have no meaningful state purpose.”
According to the 2010 census, Fulton County is 44.5 percent white and 44.1 percent black. About 54 percent of DeKalb County residents are black, and 33.3 percent are white.
Sandy Springs, created in 2005, is 65 percent white and 20 percent black. Milton, formed a year later, is 76.6 percent white and 9 percent black. Johns Creek, also formed that year, is 63.5 percent white and 9.2 percent black. Chattahoochee Hills, formed in 2007, is 68.6 percent white and 28 percent black, while Dunwoody, created in 2008, is 69.8 percent white and 12.6 percent black.

America has passed many good laws that ensure and protect the rights of minorities including women, blacks, gays, etc. Why on earth is America allowing those who do not own property to dictate demands to those who do?? If we are all equal under the law then everyone has equal right to pursue the American dream legally speaking and if “some” decide to waste that same life then why would we give them equal voting rights to take from those who have worked hard and made sacrafices to get what they have in life? That applies to all races, genders, and sexual orientation does it not?

As a carpenter I’ve worked in some pretty rough areas around the country, and if i felt the situation warranted it, I wore a pistol, in a holster for all the world to see. Areas like downtown D.C., and south Philly. Never once have i had to use it, and never once was i given any grief about it.

Posted on March 29, 2011 at 7:04pmWhat the lady says is right, despite laws to the contrary, Realtors are requested to sell to whites or blacks by neighborhood and the banks refuse to finance otherwise. Despite all the federally required “training” and stiff penalties including jail time, this is all done on the QT, is still quite rampant especially in cities like Houston and Atlanta and can force you out of business pretty darn quick.. Now the question remains whether a group, by race, can be granted city status. And the answer is probably yes since there is no often little racial concern involved. The only way I know to combat the real estate racism would be with undercover real estate agents, and tragically, because most of the agents are at the whim of the loan people, you would be mainly catching a lot of fairly innocent victims, both white and black. Still ought to be done however.

Posted on March 29, 2011 at 7:21pm@ Varptr – While I agree that realtors do that, John’s Creek is home to Country Club of the South…a place where all the uber rich live (a lot of the Atlanta Braves, Falcons & Hawks live there), so their main thing is having the money to afford million dollar homes…not much about race, but money. I’m not sure of this, but I imagine some of the “Real housewives of Atlanta” live in that area as well.

There are many areas where the geographic area has a local name, yet it has no post office by that name or legal standing as its own town or city. Dunwoody and Sandy Springs are good examples of this in that they’ve always been called by those names, yet they never had the legal status. Dunwoody’s major zip code is 30338 which was always an Atlanta zip code, yet if you wrote Dunwoody or Atlanta, the mail still arrived. Now Dunwoody has its own post office with that zip code.
Dunwoody is in DeKalb County and Sandy Springs is in Fulton County — both very Democrat-leaning counties, although both these towns tend to be Republican. Property taxes were paid to the county who then used that relatively substantial amount and filtered it to pet projects in the lower-income areas of the county. It was true redistribution of wealth — legally done. Residents balked at the lack of equal distribution of funds and finally created their own cities.

I can think of a few recent examples here in MI.
The city of Auburn Hills until the late 80s was unincorporated, and was mostly farmland and woods.
Then the developers built subdivisions, which were naturally accompanied by retailers and so on, eventually the area reached critical mass and they applied for a city charter.
Remember, most of America was “wild” when those CT towns were being chartered.

On the one hand people have the right to live where they damn well choose and some places will be mostly white and others mostly black.
On the other hand, both parties are guilty of gerrymandering and this may be a clear cut case.

The citizens of these areas did not feel they were being heard on matters such as zoning and county services. When the republicans took control of the sate legislature the citizens got a chance to form a city government where they could deploy their resources and have representation for their backyard issues instead of resources being deployed into the sinkhole of the general Fulton County fund. Fulton County still gets their tax dollars just not as much as in the past. The remainder stays in local coffers where it can be used on local issues. What’s wrong with that? Didn’t we fight a revolution over taxation without representation?

Well maybe I can shed some light since I live in metro Atlanta and have worked in one of the counties that is mentioned. I’ll give one example of fact. DeKalb County contains the City of Dunwoody. Dunwoody incorporated approximately 2 years ago and took 15 million dollars out of the county budget. You might ask, why would these county residents want to incorporate? Well the county BOC is as corrupt as the Chicago enterprise. It’s nothing more than wealth redistribution. The north side of DeKalb County is by far the wealthiest portion of the county. They also pay approx 75% of the tax revenue due to the remainder of the county being like a third world country. The county BOC would take that money and build parks, build libraries, senior citizen centers, recreation centers in the south and east end of the county, which is predominantly black and not invest any monies in the North end of the county. So Dunwoody residents said fine, and incorporated and now reinvest that tax revenue back into their own community. I don’t blame them one bit

This is my turf. When I moved to Atlanta in 1990 I moved to Dunwoody. I moved to another county, but my son is a first-responder in the new city of Sandy Springs.
For decades, the county councilmen and women in both Fulton and DeKalb counties siphoned off the high property taxes of the wealthier neighborhoods and used those $$$$ to builld libraries and parks in the lower-income areas of the counties. The city of Atlanta is in Fulton County, so you can imagine the $$$$ that went to rebuild the older infastructures of the city. The dollar return on their taxes was abysmal and they fought to annex out of the respective counties to form their own cities of Sandy Springs, Johns Creek and Milton in Fulton County and Dunwoody in DeKalb County.
These areas are predominently Republican suburbs of Atlanta and until very recently, Georgia had been led by Democratic Governors and county government — particularly in Fulton and DeKalb. For decades the residents of these towns complained about the lopsided way that tax dollars were spent. They got nowhere and each time they talked about starting their own city, the counties threatened to sue and prevented any real movement.
The very moment that a Republican Governor came into town 8 years ago, there were Bills put forth to create the cities of Sandy Springs, Milton and Johns Creek. The counties fought hard and sued, but they lost. Dunwoody and Peachtree Hills created their own cities a couple of years later.
This is just the newest twist. It seems that since Marin County has kow-towed to the P.C. police, the race baiters like Joseph Lowry feel empowered. I doubt it will go anywhere — these cities are accustomed to that mantra and have fought it for decades.

Those are nicer areas and are predominately white, but that is how they’ve always been. If anything, the minority population is increasing. But, of course the Rev Joseph Lowery won’t clue you in to that huge nugget of information.

OMG, you REALLY believe that? Show me ANY proof of that! No one is telling anyone where to live. In their foolishness these city councils might force the building of lower rent housing in wealthier areas, but no one is forcing anyone to move anywhere.
The issue has to do with redistricting so the money stays with the people paying it.

As far as blacks not wanting to live in these areas….they are very affluent & the blacks that do live there are well off professionals….these areas have always been known as more affluent areas…In plain speak…there are no projects there….I guess that’s the problem according to Lowery. He’s such a joke.

Posted on March 29, 2011 at 6:34pmI am form this area. For years under a democratic cotrolled state legislature these areas of North Fulton County sent their tax dollars to South Fulton. The citizens of these areas did not feel they were being heard on matters such as zoning and county services. When the republicans took control of the sate legislature the citizens got a chance to form a city government where they could deploy their resources and have representation for their backyard issues instead of resources being deployed into the sinkhole of the general Fulton County fund. Fulton County still gets their tax dollars just not as much as in the past. The remainder stays in local coffers where it can be used on local issues. What’s wrong with that? Didn’t we fight a revolution over taxation without representation?

Posted on March 29, 2011 at 6:40pmWell maybe I can shed some light since I live in metro Atlanta and have worked in one of the counties that is mentioned. I’ll give one example of fact. DeKalb County contains the City of Dunwoody. Dunwoody incorporated approximately 2 years ago and took 15 million dollars out of the county budget. You might ask, why would these county residents want to incorporate? Well the county BOC is as corrupt as the Chicago enterprise. It’s nothing more than wealth redistribution. The north side of DeKalb County is by far the wealthiest portion of the county. They also pay approx 75% of the tax revenue due to the remainder of the county being like a third world country. The county BOC would take that money and build parks, build libraries, senior citizen centers, recreation centers in the south and east end of the county, which is predominantly black and not invest any monies in the North end of the county. So Dunwoody residents said fine, and incorporated and now reinvest that tax revenue back into their own community. I don’t blame them one bit

Posted on March 29, 2011 at 7:18pmThis is my turf. When I moved to Atlanta in 1990 I moved to Dunwoody. I moved to another county, but my son is a first-responder in the new city of Sandy Springs.
For decades, the county councilmen and women in both Fulton and DeKalb counties siphoned off the high property taxes of the wealthier neighborhoods and used those $$$$ to builld libraries and parks in the lower-income areas of the counties. The city of Atlanta is in Fulton County, so you can imagine the $$$$ that went to rebuild the older infastructures of the city. The dollar return on their taxes was abysmal and they fought to annex out of the respective counties to form their own cities of Sandy Springs, Johns Creek and Milton in Fulton County and Dunwoody in DeKalb County.
These areas are predominently Republican suburbs of Atlanta and until very recently, Georgia had been led by Democratic Governors and county government — particularly in Fulton and DeKalb. For decades the residents of these towns complained about the lopsided way that tax dollars were spent. They got nowhere and each time they talked about starting their own city, the counties threatened to sue and prevented any real movement.
The very moment that a Republican Governor came into town 8 years ago, there were Bills put forth to create the cities of Sandy Springs, Milton and Johns Creek. The counties fought hard and sued, but they lost. Dunwoody and Peachtree Hills created their own cities a couple of years later.
This is just the newest twist. It seems that since Marin County has kow-towed to the P.C. police, the race baiters like Joseph Lowry feel empowered. I doubt it will go anywhere — these cities are accustomed to that mantra and have fought it for decades.

Report Post »You have covered it really well. I am a native Georgian and have seen all the changes. The majority of the taxes were not even being used in the Northern sections as west said. We were going lacking while the built things with tax money that was promptly destroyed, spray painted etc. Or the crooks in Atlanta stole from the cofers like a well organized band of thieves. The new cities have seen a wonderful improvement and they actually know where their taxes go and for what. Of course Fulton Co. still gets some. But these are more affluent neighborhoods and there are no restrictions on who can live there if you have enough money. I think it is a wonderful idea. Others from Atlanta wrote about this also I just couldn’t remember all their names. But all of us that live here know what it is and we also know that Rev. Lowery is a fool. I don’t know of any neighborhood that is just black and white we have minories of every kind as we should.Lowery and his friends along with Jimmy Carter should shut up and be turned out to pasturel.

Most of the communities listed are in or near Fulton County, which is “downtown” Atlanta, which is SO horribly mishandled and poorly led. They want their massive tax dollars to go for programs that each community wants for it’s residents instead of being wasted. In short their tax dollars have been so mis-managed by Fulton County that these places want to be independent so that they are able to say what their tax dollars are used for, they want control of it themselves. No one in Atlanta blames them. Most of the folks in the metro area hate it when new arena’s etc. are built downtown because we all hate going downtown!! The only time the people of Georgia go downtown is when they have to.

I graduated from Dunwoody HS in ‘78, am a 5th generation Atlantan, and have watched Fulton County ‘south’ continue to suck the life out of the ‘north’, if you get my drift. For those who have depended on the north to continue to fund the lifestyles of the south is, in effect, quite parallel-ish to the course those in power currently are trying to take our country.
It is very simple…the have-nots (ie, those that don’t take responsibility) are using the ‘legal system’ (ROTFL) to somehow regain the influx of $’s those of us have worked hard to gain.

The rub here is that these communities have a high percentage of home ownership and were paying taxes…a lot of taxes, The tax dollars were redistributed all throughout the city of Atlanta (Fulton county). Once these cities were allowed to incorporate, the tax dollars stayed here in the community where the taxes are being paid. Our streets are improving we have more police presence now and the city of Atlanta apparently wants the money back. Classic redistribution of wealth scenario here.

I seriously doubt that many black residents in the Atlanta area could even afford to make a down payment on those properties no less make the monthly payments and pay the city and county taxes charged based on the property values. Furthermore, If a black family is in the high income bracket and can afford the payments, there is absolutely no reasons or restrictions to keep that family from purchasing a home in those cities.
This whole idea is beyond rediculous. No judge in his or her right mind would ever consider allowing such a frivilous lawsuit in a court of law.
