Blogger Could Be Thrown in Jail for…Writing About His Diet?

This is the sort of story you expect to come from a third world superstitious kleptopcracy – yet it happened here on American soil, in North Carolina, thanks to good old fashioned state-level bureaucracy. Reason Magazine brings us the bizarre and senseless story of Steve Cooksey, a former diabetic who put himself on the popular “Paleo” diet and decided to tell the world about his experiences only to have the North Carolina Board of Dietetics and Nutrition (yes, that exists) come down on him:
This past January the state diatetics and nutrition board decided Cooksey’s blog — Diabetes-Warrior.net — violated state law. The nutritional advice Cooksey provides on the site amounts to “practicing nutrition,” the board’s director says, and in North Carolina that’s something you need a license to do.
Unless Cooksey completely rewrites his 3-year-old blog, he could be sued by the licensing board. If he loses the lawsuit and refuses to take down the blog, he could face up to 120 days in jail.
The board’s director says Cooksey has a First Amendment right to blog about his diet, but he can’t encourage others to adopt it unless the state has certified him as a dietitian or nutritionist.
Just for clarification, these are some examples of the supposed “expert nutritional advice” Cooksey is offering (directly from his website):

So essentially, Cooksey was your typical opinionated blogger, who decided to let his enthusiasm for a particular dietary approach motivated him to dig up information his readers (presumably other diabetics like him) might find interesting, and debunk false claims by self-interested parties (like his post above about the American Diabetics’ Association).
He probably could have gone on doing this, if he hadn’t been so devoted to asking questions of the wrong powerful people. From the Carolina Journal:
Jan. 12, Cooksey attended a nutrition seminar at a church in Charlotte. The speaker was the director of diabetes services for a local hospital.
“She was giving all the wrong information, just like everyone always does — carbs are OK to eat, we must eat carbs to live, promoting low-fat, etc.,” Cooksey said. “So I spoke up.”
After the meeting he handed out a couple of business cards pointing people to his website.
Three days later, he got a call from the director of the nutrition board.
“Basically, she told me I could not give out nutritional advice without a license,” Cooksey said.
He said she also told him that his website was being investigated and gave him some suggestions about how to bring it into compliance.
If he does not go along, the board could file an injunction and “essentially shut the website down,” Cooksey said.
For those of you wondering how exactly Cooksey was “giving out nutritional advice,” it’s a distinction only an embittered bureaucrat could come up with. Fortunately, Mr. Cooksey has uploaded the full complaint on behalf of the board to his website, which includes some remarkably official looking Sharpie scrawls in the margins detailing their complaints. Some of the more absurd examples follow.

Now, in the interests of fairness, it should be noted that Cooksey’s site does include various suggested diet plans lifted directly from the Paleo diet, which he encourages users to try. However, this fact shows precisely why the distinction is so arbitrary: so long as you just say a particular diet is wonderful, or worked for you, you’re fine, but if you actually tell people to use it, you’re supplying nutritional advice. Never mind that the implication of any positive review of a product is that someone should use it.
And as if that weren’t enough, it seems Cooksey anticipated this objection and made sure to put a disclaimer at the bottom of every page of his website that says the following:
“I am not a doctor, dietitian, nor nutritionist … in fact I have no medical training of any kind.”
But says the bureaucrat responsible, that doesn‘t matter because he’s still trying to get people to trust him. One wonders when they will press charges against Amazon diet reviewers.
Nor is the diet in question – the “Paleo” diet – somehow revolutionary. In fact, it is a popular one with many people, nor is Cooksey the first to speak highly of it. He just happened to be the one who did it most comprehensively in North Carolina. And getting anyone to trust you without the Government’s say so down there is apparently a crime.

It’s CORPORATIONS that LOBBY for laws that govern rules affecting marketing, sales, research, and developement. 4. It’s a STATE matter, not a GOVERNMENT matter. 5. If you are a recon marine, then you swore an oath to serve your country and to obey the orders of your commander in chief, presidemt Obama. 5. Ever since Obammy got elected he’s spent way too much time down here, drawing unneeded attention. Now, with the help of Bev Perdue and the constant Democratic legislature my state has turned into some sort of socialist/communist testing ground. With crap like this and all the regulation and taxes we have in our state someone could easily mistaken it for a New England state or something. Getting really tired of it. My roots are very deep here and I don‘t won’t to leave it but its getting to a point where none of this crap makes much sense, just control and tax more. Why does this state need an office of diet and nutrition or whatever? I think back to that 4 year old several weeks ago that had to eat cafeteria crap food instead of their lunch from home. Ridiculous.

Obviously this guy was presenting his opinions of how diet should work as recommendations and fact. That doesn’t change the fact that this is an over-reach of any government, but then again someone could post a 3 year blog on the benefits of ingesting drano, so there comes in the licensing scheme.

A license is something required for something that is otherwise illegal. Is recommending nutrition illegal? Who gives this ‘board’ an ounce of authority? Under these guidelines you might be required to be licensed to live (slavery) by an unaccountable and universally authoritative fictional bureaucracy (slave master).

Carbs like potatoes and bread were bad. Protien like meat were good. She almost made it to age 83 without losing any of her fingers and toes, or her eyesight. She took care of herself. I remember her drinking alcholol ONCE in her life. The Socialist governent of Obame MUST GO in November! Let’s return the USA to the greatness it once was.

In my state I‘m fairly certain you only need to be a registered dietician if you’re working in specific fields where you are literally responsible for choosing what people will eat. Because it is so potent on its own, it is often mixed with milder greens to produce a nice balanced salad. It can also be sautéed in olive oil. The states are given the rights to pass laws that are not already numerated in the constitution and bill of rights. It’s an important distinction. A state just can’t pass any law wily-nilly, they have to first adhere to the constitution and bill of rights.

The main concern is the slow and deliberate creep of liberalism in to every facet of our lives, whether it be by the fed, or by the state. And it is running rampant in both. I do not care who is imposing it, just that it is being imposed…….period.
Bev Perdue is a liberal hack, through and through. Remember when she offered up the suggestion that congressional elections might be best suspended for a couple of years so that representatives would feel free to vote on important issues without having to “worry” about reelection?

That website has ONE page, and only one page. It is about this Steve guy and the complaint letter. Strangely enough, we all know the guys first and last name, but the name at the top of the letter is blotted out. Strange, huh?
And…in the about section, there is no name of the person who made the blog, just a “wordpress” standard blurb. The blog simply attacks this Steve guy’s character, while making it clear that the author does not care whether the info is good or not. It is a simple assassination of character.
In fact, it seems that Traveler19 is posting here under false pretenses, and is, in an ironic twist, *trying to promote his own blog* by saying someone else is shamelessly self promoting!

Either way, someone tried to silence this guy, and he fought back. Good for him. If he is trying to bring light to this topic, then he is 100% correct.
And, he can’t practice nutrition without a license? Here is a funny fact: MD’s get 1 class on Nutrition. And… In dietician school, you go to school for 6 years, and yet you don’t take one cooking class. Dieticians are the clowns that promote the USDA food guide, which is a colossal failure.
The last people you should trust for nutrition advice are dieticians. They are, without a doubt, the biggest wastes of tax-payer funded schooling in history. They are mere sales people

The person is doing EXACTLY what he clams Mr. Cooksey to be doing, and my guess is that he is doing it on behalf of an interested party. I have no proof, but I would ask Mr Ressler (a North Carolina resident) to come clean and admit who he is working for in this one-man attempt via social media to make the story go away nice and clean for an agency that tried to remove the civil rights of an individual.

Posted on April 27, 2012 at 11:16pmYes. Traveler919 (aka Jonathan Ressler) is CEO of a PR firm that represents Pepsi. Pepsi also happens to be a corporate sponsor of….wait for it….The American Dietetic Association. Coincidence? I’m sure he will say so.
He has also posted messages across the internet trying to discredit Steve Cooksey using the names “Traveler212213” and “WanderingTraveler”
He also is the creator of the website he keeps linking to.

Posted on April 28, 2012 at 2:01amI answered this already, but i will answer it again. I am the one posting this stuff and I have not hidden my name anywhere except where people use handles. If you look around you will see that I am posting with my name where it is allowed. I am not working for anyone other than myself and at this point it is a one man crusade, but it is not against what Cooksey is saying, but rather about what he is not saying – all the facts. Kind of like you guys are distorting them here.
Let‘s look at SoundOf Truth’s comment where he says: “Strangely enough, we all know the guys first and last name, but the name at the top of the letter is blotted out. Strange, huh?”
If you took the time to actually look at it, what I did was blurred his address, not his name. I don’t think it is right for me to give out his address on the internet so I blurred it. I did that out of respect for Mr. Cooksey’s privacy.
I think you will also find that I clearly stated I was outraged when I though that they had tried to silence him but again, with some research, I found that was also not true. If you take the time to read the comments from the board that Cooksey posted, you will see that they never tried to silence him or violate any of his rights. They said he could express his opinion but could not advise people on what they should do specifically. I know you know all this already, so rather than continue on a rant without any real basis, I ask you to show me where they tried to sile

You can provide information… means you can provide information. How can that be construed any other way?
