Boehner Issues Ultimatum to Obama: Present Libya Plan By Friday or Else…

WASHINGTON (The Blaze/AP) — House Speaker John Boehner urged President Barack Obama on Tuesday to explain the legal grounds for the continued U.S. military involvement in Libya and set a Friday deadline for the commander in chief’s response.

Ratcheting up the pressure, the Ohio Republican said in a letter to the White House that the administration clearly will be in violation of the 1973 War Powers Act this weekend. Obama did not seek congressional consent for the operation within 60 days of the March 19 U.S. airstrikes against Moammar Gadhafi’s forces.

“Given the mission you have ordered to the U.S. Armed Forces with respect to Libya and the text of the War Powers Resolution, the House is left to conclude that you have made one of two determinations: either you have concluded the War Powers Resolution does not apply to the mission in Libya or you have determined the War Powers Resolution is contrary to the Constitution,” Boehner wrote. “The House and the American people whom we represent deserve to know the determination you have made.”

Boehner complained that the administration has provided briefings for lawmakers but has not sought formal authorization. Seeking an explanation, he asked Obama for answers to constitutional and statutory questions by Friday.

Earlier this month, the House voted to rebuke Obama for failing to pursue congressional approval and accused the president of not providing a “compelling rationale” for the Libyan operation. The House measure also required a report from the administration, due by Friday, on the scope of the Libyan operation, its costs and its impact on the wars in Iraq and Afghanistan.

“The ongoing, deeply divisive debate originated with a lack of genuine consultation prior to commencement of operations and has been further exacerbated by the lack of visibility and leadership from you and your administration,” Boehner wrote.

He added: �The Constitution requires the president to �take care that the laws be faithfully executed,�and one of those laws is the War Powers Resolution, which requires an approving action by Congress or withdrawal within 90 days from the notification of a military operation.”

The White House maintains that it has been in compliance with the War Powers Act and has called the resolutions unhelpful and unnecessary.

Initially the White House brushed off the nonbinding House measure, saying it had provided answers at various briefings. But last week it said it will respond to detailed questions on the U.S. mission in Libya within the deadline.

NATO commands the operation, but the United States still plays a significant support role that includes aerial refueling of warplanes and intelligence, surveillance and reconnaissance work.

In the Senate, the fate of a resolution signaling support for the operation was in limbo.

Sen. John Kerry, D-Mass., chairman of the Foreign Relations Committee, said plans for the panel to meet Thursday and write a resolution would be delayed to allow lawmakers to review the White House report. He left open the possibility of action on a resolution next week.

“We just want everybody to see the information and see how it impacts their thinking,” Kerry said.

Among the backers of the resolution is Sen. John McCain of Arizona, a leading proponent of military action against Gadhafi, the top Republican on the Armed Services Committee and Obama’s presidential rival in the 2008 election. McCain warned his GOP colleagues against any steps that would send a positive signal to Gadhafi.

“I caution my friends, both here in the Senate and in the House of Representatives, that we don’t want to do anything or pass legislation which would encourage Gadhafi to remain in power,” McCain told reporters.

Sens. Jim Webb, D-Va., and Bob Corker, R-Tenn., introduced a separate resolution last week that presses Obama to seek congressional consent for continued U.S. military involvement in Libya and requires the administration to provide a detailed justification for the decision to go to war.

McCain said there are continued signs of deterioration for Gadhafi’s hold on power, including high-level defections from his regime.

“I would say to my Republican friends: If this were a Republican president, would you be trying to impose these same conditions?” McCain asked.

On Monday, the House essentially voted to prohibit money for the Libya operation, backing an amendment barring the use of any funds in contravention of the War Powers Act. The vote was 248-163 on a spending bill that still must be reconciled with the Senate.

      Arabic yes; otherwise Santorum is SPOT ON.

      You may not like it but Gingrich is right. We don’t have to wait for Sharia to infiltrate American courts, there are multiple examples where it already has. In America, we have equal justice under the law, no Sharia required. There is nothing “Islamaphobic” about passing a law to reject Sharia in the U.S.

    Obama will present a half-ass reason to congress, Ron and Rand Paul and one or two other true patriots will oppose but ultimately, Obama will get his way and we will probably have ground troops in Libya by Sunday.

The new authorization wouldn’t even require the president to show any threat to the national security of the United States. The American military could become the world’s cop, and could be sent into harm’s way almost anywhere and everywhere around the globe.

      Boehner is really starting to grow strength against Obama, unlike a few months ago with the 2011 budget. Hopefully he will stay strong for the debt ceiling and spending cuts.       What everyone is missing is the separation of powers clause. The several branches can not “delegate” powers enumerated to them specifically to others agencies.

      For example. Only Congress has the power to declare war (Legislative Branch) and thus can NOT delegate that authority (combine it) with the authority of the Executive Branch). It is WE, the PEOPLE that are supposed to make them obey. If they ignore it and you don’t do anything, you have nothing to cry about. The War Powers act has no force since it is repugnant to the Constitution. Peace

      Boehner’s not being tough – Obama violated the Constitution with regard to Libya (as well as with regard to other occasions) because he didn‘t get Congress’ approval before making war against another country without our own country being in imminent threat by them.

      I’m glad to hear that House Speaker Boehner is actually doing what he swore to do when he was elected. Here is what they promised us to do.

      “I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter: So help me God.”

      My opinion either way DOES NOT MATTER. Consent for war must be approved by CONGRESS according to the Constitution. If congress does approve the war in Lybia….fine (although I don’t agree). Consent however, MUST be given by Congress. So…back to the oath. If congress fails to do their duty to defend the constitution, the American people had better defend it themselves …………..So help US God !!!!!!!! This IS a huge issue with far reaching implications. If this admin. thinks they can get away with this……they must be licking their chops at what they could get away with in order to control YOU !!!!!!!       I heard Ratigan make a perfect analogy of the “Left versus Right” garbage.

      He basically compared it to pro wrestling. Which is exactly right, no side is going to do anything, because ultimately they are pushing the same agenda. Now however, all I can think about when I see Boehner make statements is Boehner jumping off the ropes and giving Obama the elbow.

      Makes me laugh every time.
