Boy Suspended for Bringing Bible To School Files Suit

A San Diego-area teen suspended for bringing his Bible to school and talking about his faith has filed a lawsuit against the school district, the superintendent, an assistant principal, and a teacher.
In January 2010, 16-year-old Kenneth Dominguez was suspended for two days from Gateway East High School for violating a teacher’s order not to bring his Bible to school and not to discuss his faith with others. Dominguez’s Bible was even confiscated by that teacher, who said Dominguez’s actions violated “separation of church and state:”
“He didn’t give any sermons or yell or scream… just sharing his faith with other students. That was it,” Brad Dacus, Dominguez’s attorney, told KGTV, adding that we don’t live in communist China.
Even the ACLU is calling the case a “clear” free-speech violation.
But a spokeswoman for the Grossmont Union High School District — the district named in the suit — contends there’s much more to the story. She couldn’t elaborate, however, to KGTV because of federal privacy laws.

The teacher is an Anti- American, communist, Obama supporter, the school system hates Hispanics, the A.C.L.U. is worthless, And there might be a Bible, Torah, or Quran in a school teacher’s desk. Posted on March 31, 2011 at 12:10pm40 years ago (when I was just a kid) I had an aunt that use to talk about how the Christians would be prosecuted and you would be forced to decide to stand up for your religion or face terrible consequences. I always thought she was “crazy” because NEVER in this country would that every happen. We are an enlightened, free country. It is so hard to believe where our country has gone in that 40 years. We have lost our freedom of religion and our freedom of speech and the “American Dream”, which is the opportunity to improve your standing in life.

I knew in my heart and soul then that this would happen in my lifetime, and it I am astounded that it HAS happened and in AMERICA. DEAR, DEAR GOD, we did fall asleep at the wheel. I also learned years ago to pray through an event, so I keep on praying for our recovery now, but also THROUGH this mess to the other side of it whether that be what others and I call THE RAPTURE, or later THE SECOND COMING.
JESUS IS ON HIS WAY BACK “in the twinkling of an eye”. Until HE calls us or gets here, we’ve got some heavy-duty work to do! And, backing up this kid is part of it.

It’s basically case law bastardization based on a letter written by Thomas Jefferson prior to the constitution. Number two, if there was it wouldn’t be applicable here…as he is a student and she is a teacher, meaning she would be representing the state. An individual can do as they please, the state…and it’s representatives (the teacher in this case) cannot. How come a dumb cowboy like me can understand this and a teacher cannot?

At this point there may be some need of legal and financial assitance. You may want to do some research regarding the family and the Atty. who is representing the family. They may have a fund and web site set up already. Giving the school and district a piece of your mind at this point would be a waste of your time and energy.

No, it wasn‘t Muslims bringing ’religious knives’ to school. It is the ‘Sikh’ religion (not sick) that makes a requirement of carrying a ‘religious knife’. However the practice of wearing a necklace pendant of a stylized ‘religious knife’ has been accepted in place of an actual one.
This story just proves more and more why my wife and I are sending our kids to a Catholic School – not that there aren’t any issues within catholic school systems – we all have to stay on top of what our kids are being taught. Also – we need to teach our own children – values, faith, and a desire to learn about our world and affect its outcome for the better. Not to allow others to mold our childrens’ brains and hearts for a world-view of their own.

Since our country has been run by Christians for a very long time, that part of the constitution has been occasionally violated. The cases where government has promoted christianity, or religion in general, needs to be fixed. But sometimes people who are vehimently anti-Christian use the need to fix the issues as an excuse to abuse the system in the other direction.

Why is Christianity under attack?
Because they couldn‘t get people with religious beliefs to go along with what they’re doing, they have to get as many as they can to not beleive in God so their plans can be fully enacted without question. People of God have character, people of character will never go along with most of what they say is right. For some reason the extremely silent majority has no one who will stand up with people like Glen Beck and openly say what he says about religion and how it directly shaped and made this the greatest country on earth.

I monitor what my grandkids learn in school & I’m not too happy with what they tell me. Can we give the ACLU to a more deserving country? Perhaps a country that would appreciate them more than we do? Even if the school districted believed there is a separation of church and state, how can they think that would mean that the government can keep private citizens from talking among themselves about their religious beliefs? It’s become more of an excuse to take away rights than anything else.
And to those who complain the school wouldn’t stop a student from bringing a Koran and trying to convert other students to Islam. The constitution protects that right as well.

however, I used my bible for reference material more than once while completing my Masters, perhaps he was using his in much the same way? maybe it was a science teacher trying to convince this kid that he evolved from an ape! If I knew what I know now… I too would have brought a bible to class! but again, we need to wait and hear the rest of the story, my being, a bible can be very appropriate, even in class

It does not exist anywhere in our founding documents and should not be allowed to abuse kids who feel their faith deeply. Now, when I was in high school, I was made very uncomfortable by friends who were being over-missionary in their Christian faith and were trying to save me. But that was easy enough to handle and was never a matter that interfered with the school.

More Christian parents need to follow the lead of the Dominguez family and send their children to public schools with Bibles, then sue if their child is harassed. We also need Christian parents to start bringing suits against public schools for showing favoritism to the religion of Secular Humanism [Torcaso v. Watkins, 367 U.S. 488 (1961)] by teaching its doctrine of Evolution.

Posted on March 31, 2011 at 1:24pmThis is not a “Free Speech” issue (at least not primarily) this is the 1st Amendment right for “prohibiting the free exercise thereof” religion. The school is prohibiting this child’s right to freely excorcise his religion. He was not being sponsored by the school, he wasn’t using the public address systems to do it, he was discussing his beliefs with other classmates.
To say, as CAPTGREGG did that there is not enough information is misleading. The child was not suspended/punished for disrupting class, it was for bringing his bible to school and talking with other students about it. It was stated that he was violating the “church and state” issue, not that he was violating school conduct policies.
There may indeed be more to the story, but based on the information we have, and the actions being taken by the student, it seems pretty clear that it was not for “disrupting the class.” If it were, then why take the Bible away from the student?

This is the case to be put into the court. The Teacher should be pursued through the Superintendent, the School Board, and finally (because you know they will not give in) through a lawsuit to have the Teacher released for breaking human rights laws in the United States.

Dominguez’s Bible was even confiscated by that teacher, who said Dominguez’s actions violated “separation of church and state:”
So, how is the boy (a citizen of the United States, protected by the First Amendment of the Constitution of the United States) bringing a Bible to school a violation of the separation of Chrch and state?
How is it the teacher demanding the boy not bring his Bible and confiscating the Bible not a clear violation of the civil liberty of a citizen of the United States (the boy) by the intrusion of the State (the law laid down by the the teacher, an employee of the state)?

Separation of church and state are for the organizations, people have the right to free speech AND religion! As long as the young man was not evangelellical he has a right to the freedom to talk about it – bunch of hypocrits we have teaching kids these days!

If a child brought a copy of the Dungeons and Dragons Player’s Handbook, and then wanted to do nothing but talk about it and the game with fellow students, it would be disruptive!
I can see a teacher for getting him from bringing it back to school! The kids are in school to learn language and science and history and so on — not religion! if the kid was so eager to share his religion, invite people over to his house after school. How about that?

As an adult who has just recently returned to college I have seen first hand that a lot of our college professors place more emphasis on ideology than they do on hard facts. As far as most college professors are concerned, our freedom of speech and religion are merely privileges that can be revoked if they don’t agree. This is one of the many reasons our educational system is on a downward spiral. Our universities are training teachers to indoctrinate students instead of teaching them how to read, write, and solve mathematical problems. In all probability this teacher is doing what he or she was trained to do.

What rules did he break? You seem to be making an awful lot of assumptions. Where does it say he was being disruptive in class? Do you know for sure that the school districts policies prohibit the posession of religious materials? Was he talking during class? The report says the teacher said he shouldn’t talk about his faith “at school” not “during class”. He was being punished for freely exorcising his religious beliefs. Nothing was said anywhere in the story about class disruptions. Could be that he kept his Bible with him to read after a test, or between classes, or at lunch. Maybe those discussions were in the cafeteria, not the classroom. This is prohibition of this students rights plain and simple.

There is a lot more to this case when you look. It appears to be another case of a Christian stopped in the act of forcing their faith on others and then crying that they are the poor pitiful victim.

There is one teacher in this “school” which has 24 students whose first language is not English.
Here is a statement from the 2009-2010 School Accountibility Report Card found on the school district site.

“Gateway Community Day Schools provide an education for those students who are on a suspended expulsion order from the district, an involuntary transfer from one of the comprehensive sites, a SARB student, or a student on probation. They offer an extended school year. Gateway Community Day Schools are located at 2 store front locations in the East County.”
In other words, this is a small, single teacher environment with one teacher and 24 students who have been sent there because of problems in other places. A student who insists “on sharing his faith” might indeed be more than just a minor disruption, especially given the challenging situtation the students are already in. The teacher took away the source of disruption, just as he/she would take away a cell phone or a camera or a game. It isn’t a violation of his freedom of religion, it’s a violation of his ability to disrupt other students. Do your research first before you get outraged.

And the separation of Church and State in the first Amendment is against the “STATE/GOV’T” Forcing you to believe in one religion over another. In the Founders time that was the new Anglican Church founded by the King of England vs the Roman Catholic Church vs the fledgling Protestant Religious Movement of the day. Go read it in the context of the History of the day.

You are right. Those links so clearly point out exactly what was going on. If only you had been there to do the research for these news reporters and this attorney. But wait. There still has been no evidence of actual disruption. Again, you are claiming this student was being disruptive. But the story does not claim that was why he was told not to bring the Bible to school. The report says he was told not to bring it to school, not because it was disruptive, but rather it was a Separation of Church and State issue.
Here‘s the actual quote from the report so you don’t have to watch the video again:
“…the lawsuit describes how a teacher told Dominguez that he shouldn’t talk about his Christian faith at school, because of the separation of Church and State…”
Please note, the lawsuit doesn‘t say that he shouldn’t talk about his Christian faith at school because of the disruptions it has been causing. If was made absolutely clear that the disruptions were why she was asking him not to share his faith then you would have a solid case and the rest would just be foolishness. But that is not why we are told he was asked not to share his faith at school.
Now, again, the court case may bear out additional details that are not included in this report. However, based on the reasoning given in the report there is absolutely no evidence of disruptive behavior. You’re simply making that part up. You have absolutely no evidence that the student was disruptive. There is simply an assumption being made that the sharing of this kid’s faith is automatically disruptive.
I do have to go back and say that I now agree with CAPTGREGG. There is not enough information in the report. But based on the information given, and the specific words used, it seems pretty straightforward to me. But obviously since I don’t have the ability magically know what happened behind the closed doors, and am unable to definitively know exactly what happened based on a description of the school I’m just an ignorant thick-headed fool. If only I wasn’t basing my opinion on what was actually reported, and not what I was guessing happened. Stupid me.

The state cannot start a “state religion” and they can’t keep people from following their religion however and where ever they want to.
