Judge Blocks Wisconsin Collective Bargaining Law…Again

MADISON, Wis. (AP) — A Wisconsin judge has ruled that there should be no further implementation of a law taking away nearly all collective bargaining rights for public workers.
Dane County Circuit Judge Maryann Sumi said Tuesday that her earlier restraining order saying the law shouldn’t be enacted had either been ignored or misinterpreted.
Sumi stopped short of saying the law was not already in effect. She says she will take more testimony on that issue.
The Legislative Reference Bureau posted the law on a legislative website Friday, leading Gov. Scott Walker’s administration to declare the law was in effect.
Sumi revised her original March temporary restraining order blocking the secretary of state from publishing the law, which is typically the last step before it becomes effective.
A Wisconsin judge weighed arguments Tuesday about whether an order she issued intended to temporarily block the state’s divisive new collective bargaining law was still in place, or whether Republican leaders had again outmaneuvered their opponents by using a legal loophole to achieve their goals.
During a hearing into one of several lawsuits challenging the legitimacy of Republican Gov. Scott Walker’s law, Dane County Circuit Judge Maryann Sumi listened to attorneys for the state argue that it took effect on Saturday because a state office unexpectedly published it online Friday despite Sumi‘s order barring the secretary of state from publishing it in the state’s official newspaper – typically the last step before a law takes effect.
Democratic Secretary of State Doug La Follette, Dane County Democratic District Attorney Ismael Ozanne – the plaintiff in the lawsuit being heard Tuesday – and the head of the office that posted the story contend that it did not become law because La Follette had not had it published.
Sumi had blocked off the rest of Tuesday and all day Friday to hear arguments, and was expected to rule afterward. Whether she decides it did or didn’t become law on Saturday, the law’s legitimacy will likely be decided by the state Supreme Court, which has not indicated whether it would take up an appeals court’s request to hear the case.
If Sumi sides with the Republican attorney general’s office, it would mark the second time the Republican lawmakers used a loophole to advance the law, which would strip most public workers of collective bargaining rights and which inspired large pro-union protests in and around the state Capitol. After weeks of stalemate, Republican senators passed the law after finding a way to vote on it without their Democratic colleagues, who had fled the state to deny a quorum.
Walker, whose refusal to bend on the collective bargaining issue earned him accolades among many conservatives and condemnation from Democrats and labor unions, was moving forward as if the law took effect. In addition to the collective bargaining issue, the law would require all public workers except police and firefighters to pay more for their health and pension plans, in what would amount to an 8 percent pay cut, on average.
The governor’s top aide, Mike Huebsch, said Monday that the administration was preparing a computer program that would account for the new deductions and halt deductions of union dues from state workers’ paychecks, starting April 21. He said the Department of Administration would stop that work if a court determined the law didn’t take effect Saturday.
In a court filing Monday night, Ozanne asked Sumi to declare the statute had not become law by being posted online. He wrote that the secretary of state and the reference bureau must work in tandem to publish laws, and that one can’t act alone.
“Mere electronic posting, absent the other steps, particularly the involvement of the secretary of state … is itself meaningless and has no legal effect,” wrote Ozanne, whose lawsuit contends that the Senate violated Wisconsin‘s open meetings statute because it didn’t give the public enough prior notice before voting on the reconfigured law.
The attorney general‘s office had asked an appeals court to overturn Sumi’s restraining order, but asked that court on Monday to withdraw the appeal and asked Sumi to cancel Tuesday’s hearing because it believes the law took effect, making it a moot point. The appeals court denied the state’s request Tuesday, saying it had already asked the Wisconsin Supreme Court to take the case, and is waiting to hear back.
Steve Miller, the head of the Legislative Reference Bureau, which posted the law online, testified Tuesday that as far as he knew, his office had never published a law without first getting a specific date from the secretary of state in his 12 years there. He said he doesn‘t think his office’s posting of the statute made it law, saying that only happens once the secretary of state publishes a public notice in the state’s official newspaper.
But he said he believes his office is legally required to publish laws within 10 days, even without a hard date, and that he doesn’t believe the restraining order extended to his agency.
“I still think the duty (to publish within 10 days) is independent,” Miller said.
Given the difference of opinions, the Wisconsin Association of School Boards told districts that are still negotiating with teachers not to take any official action until the courts resolve the dispute.
Walker has proposed more than $1 billion in cuts to schools, counties and local governments in his budget that would take effect in July. He has argued that the union concessions are needed to help make up for his proposed aid cuts.
Democrats and the unions contend that Walker’s attack on collective bargaining was politically motivated attempt to severely weaken the unions, which tend to vote Democrat.

There were 10 people convicted under the Alien & Sedition laws of 1798. The law was NOT declared unconstitutional by the courts, when Jefferson resided as President he believed the law was unconstitutional. He then freed all those that were persecuted by the laws.
Jefferson said in response to a critic “You seem to think it devolved on the judges to decide on the validity of the sedition law. But nothing in the constitution has given them the right to decide for the executive more than to the executive to decide for them. Both magistrates are equally independent in the sphere of action assigned to them. The judges, believing the law constitutional, had a right to pass a sentence of fine and imprisonment because the power was placed in their hands by the constitution. But the executive, believing the law to be unconstitutional, were bound to remit the execution of it because that power has been confided to them by the constitution”.
The Constitutional Convention delegate Martin Luther said – “A knowledge of mankind and of legislative affairs cannot be presumed to belong in a higher degree to the judges than to the legislature.”
James Madison in 1789 -

Just as a state executive (Mini versions of our republican form of government) can do so.

The courts in WIsconsin, particularly Dane county, are practically a hold over from Soviet Russia. Judge Sumi, for instance, despite Madison teachers having staged an illegal strike through a sick out in violation of state law and their contracts, and endangering children by frong marching students from Kindergarten to High School down there to protest with them, would not order them back to work. And she’s considered a Moderate in Dane County!
We have an assistant attorney general running for the State Supreme Court, whose only reason for even still being in the race against the very experienced and respected sitting judge, David Prosser, is that she’s a safe Union vote on the court… Equality before the bar of justice being a very subjective thing to her. The Chief Justice of the Court has tried to have two Republican Justices thrown off the court on ethics violations since losing her bullet proof majority, which is one of the reasons that the establishment is so hot to throw Prosser off the bench and replace him with someone who understands that justice is what the Unions tell her it is.
This case before Sumi, which was started not to challenge the constitutionality of the Budget Fix Law, but on the grounds of legislative procedure of whether the GOP acted fairly, while of course the Fugitive Fourteen were conducting an illegal filibuster and negotiating hin bad faith while trying to undo the 2010 election results, in giving only two hours notice – the term is reasonable notice, though Union Protesters and the Press had no trouble getting there and filling the galleries before the vote… even stormed the capital – was sufficient, will have farther reaching consequences.
In a state that virtually defines judicial activism, they have now changed what in any other year would be a no brainer reelection for Prosser into first a election between Prosser, who is conservative though also notoriously independent and honorable, and the Democratic Establishment Safe Union vote on the court in Kloppenburg, who planned on stopping all of Walker’s legislation through the courts, to now whether the people of Wisconsin believe that the Legislature should legislate the laws, or whether they and the Governor should just give up the pretense and surrender power and the separation of powers to the Courts, who plan on legislating from the bench anyway – the Wiscosnin court system virtually defines the phrase, Judicial Activism.
I’m not so sure it was such a smart idea to push this and give it the constitutional overtones they have.

As far as I am concerned these people are at war with ME and every other taxpayer that pays their salaries and benefits. I for one am sick and tired of it. I just heard a woman on the radio, from Wisconsin, bitching about Walker saying she can get a job opaying twice as much in the private sector. I say COME ON DOWN and have at it if you think so.

Back in 1992 we were sick and tired of these people taking our dues, letting us have 25 % to keep at our local and sending the rest back to New York so they could line their pockets and spend OUR money on things we didn’t agree with. We were able to kick the punks out and we formed our own Association, hired a lawyer to represent us, and we are much better off now than we were back then. They fought us tooth and nail, put out hate mail, tried bribery by taking a bunch of local “yes men” on a trip to Vegas … and even had a mock trial with representatives from New York ( we are in Oregon) and they kicked the nine of us who started the movement to decertify AFSCME out of the union. Six weeks later we booted them out. How did we do it? It started out with just nine of us. We met after work and on weekends, did our research, talked to a lot of people and came up with a plan. We went to our local Labor Relations Board, got a stack of cards from them which asked a simple question: Are you interested in voting on whether to keep AFSCME as your union … YES or NO. All we had to do was get a certain percentage of the workforce to sign in the affirmative, and the LRB held a vote, and THEY counted them. When it was over, AFSCME was voted out, we were able to keep our own dues money, opened our own office, and hired a set of lawyers. It CAN BE DONE! We are the proof! If you are really tired of what the unions have done in this country, then boot the punks out!

If I can get enough people to pass this around, I truly believe it will make a huge dent in the labor unions ability fund anything political. Unions were meant to represent their members, not political action committees. Get the unions OUT of politics!

Posted on March 31, 2011 at 1:28ami’m hurt. encinom didn’t respond to my post. and i was so looking forward to schooling him/her on the law and the way the justice system works. as far as justice thomas is concerned he should not recuse himself nor should judge sumi. the only difference i would point out to the left is justice thomas never has to care about anything you say, yet judge sumi is beholden to a constituency. she may be fine in the end, who knows, but she also may have to pay (politically) for intervening where she has no authority.
