Senate Passes 4-Year Patriot Act Extension

WASHINGTON (AP) — Over fervent but scattered objections, the Senate voted by a wide margin Thursday to extend the government’s Patriot Act powers to search records and conduct roving wiretaps in pursuit of terrorists, acting just a month after intelligence and military forces hunted down Osama bin Laden.

Facing a midnight deadline when three terror-fighting tools would expire, the 72-23 Senate vote came after three days of stubborn resistance from a single senator, Republican freshman Rand Paul of Kentucky, who saw the terrorist-hunting powers as an abuse of privacy rights. With the Senate vote, the bill was whisked to the House for an evening vote and transmission to President Barack Obama for his signature.

The measure would add four years to the legal life of roving wiretaps – those authorized for a person rather than a communications line or device – of court-ordered searches of business records and of surveillance of non-American “lone wolf” suspects without confirmed ties to terrorist groups.

The White House gave assurances that the provisions would not expire even though Obama is now in Europe.

“Failure to sign this legislation poses a significant risk to U.S. national security,” White House spokesman Nick Shapiro said.

“As long as Congress approves the extension, the president will direct the use of the autopen to sign it,” Shapiro said in reference to an automatic signature machine used at the White House.

Obama will be woken up at 5:45 a.m. so he can review and approve the bill and then authorize his signature.

A short-term expiration would not interrupt ongoing operations but would bar the government from seeking warrants for new investigations.

The roving wiretaps and access to business records are small parts of the USA Patriot Act enacted after the Sept. 11 attacks in 2001. But unlike most of the act, which is permanent law, those provisions must be periodically renewed because of concerns that they could be used to violate privacy rights. The same applies to the “lone wolf” provision, which was part of a 2004 intelligence act.

Renewal this time was pushed up against the midnight deadline by Paul, who argued that in the rush to meet the terrorist threat in 2001 Congress enacted a Patriot Act that tramples on individual liberties. He had some backing from liberal Democrats and civil liberties groups who have long contended the law gives the government authority to spy on innocent citizens.

Sen. Mark Udall, D-Colo., said the provision on collecting business records can expose law-abiding citizens to government scrutiny. “If we cannot limit investigations to terrorism or other nefarious activities, where do they end?” he asked.

“The Patriot Act has been used improperly again and again by law enforcement to invade Americans’ privacy and violate their constitutional rights,” said Laura W. Murphy, director of the ACLU Washington legislative office.

But intelligence officials have denied improper use of surveillance tools, and this week both FBI Director Robert Mueller and Director of National Intelligence James Clapper sent letters to congressional leaders warning of serious national security consequences if the provisions were allowed to lapse.

The Obama administration says that without the three authorities the FBI might not be able to obtain information on terrorist plotting inside the U.S. and that a terrorist who communicates using different cell phones and email accounts could escape timely surveillance.

“When the clock strikes midnight tomorrow, we would be giving terrorists the opportunity to plot attacks against our country, undetected,” Senate Majority Leader Harry Reid said on the Senate floor Wednesday. In unusually personal criticism of a fellow senator, he warned that Paul, by blocking swift passage of the bill, “is threatening to take away the best tools we have for stopping them.”

The nation itself is divided over the Patriot Act, as reflected in a Pew Research Center poll last February, before the killing of bin Laden, that found that 34 percent felt the law “goes too far and poses a threat to civil liberties. Some 42 percent considered it “a necessary tool that helps the government find terrorists.” That was a slight turnaround from 2004 when 39 percent thought it went too far and 33 percent said it was necessary.

Paul, after complaining that Reid’s remarks were “personally insulting,“ asked whether the nation ”should have some rules that say before they come into your house, before they go into your banking records, that a judge should be asked for permission, that there should be judicial review? Do we want a lawless land?”

Paul agreed to let the bill go forward after he was given a vote on two amendments to rein in government surveillance powers. Both were soundly defeated. The more controversial, an amendment that would have restricted powers to obtain gun records in terrorist investigations, was defeated 85-10 after lawmakers received a letter from the National Rifle Association stating that it was not taking a position on the measure.

In practice, law enforcement has used the three provisions sparingly. According to a senior Justice Department national security official testifying to Congress last March, the government has sought roving wiretap authority in about 20 cases a year between 2001 and 2010 and has sought warrants for business records less than 40 times a year, on average. The government has yet to use the lone wolf authority.

But the ACLU also points out that court approvals for business record access jumped from 21 in 2009 to 96 last year, and the organization contends the Patriot Act has blurred the line between investigations of actual terrorists and those not suspected of doing anything wrong.

Two Democratic critics of the Patriot Act, Sen. Ron Wyden of Oregon and Udall of Colorado, on Thursday extracted a promise from Senate Intelligence Committee chairman Dianne Feinstein, D-Calif., that she would hold hearings with intelligence and law enforcement officials on how the law is being carried out.

Wyden says that while there are numerous interpretations of how the Patriot Act works, the official government interpretation of the law remains classified. “A significant gap has developed now between what the public thinks the law says and what the government secretly claims it says,” Wyden said.

Senate Judiciary Committee Chairman Patrick Leahy, D-Vt., while supporting extension of the Patriot Act measures, also pushed for changes to make the law more transparent, including requiring the Justice Department to periodically report to Congress on whether the powers in the law were being used properly.

Leahy had also sought to require the government to show greater evidence of a link with a terrorist threat when it asks for access to business records such as library circulation records or book seller records.

    It’s absolutely amazing that more Dems voted against the Patriot Act provisions than did Repubs. Read the last 2 paragraphs of the Fox News article (link above). Leaky Leahy is on the right side of this. I’ve fallen through the looking glass, for Pete’s sake!

    For those of you who support the 2nd amendment (all, I hope), this is really bad news. Without Rand Paul’s “no gun registration” amendment, all the BATFE needs is a sympathetic FISA judge and they could pull-in every 4473 form in the country, thereby compiling a gun registration list.

    There is the McClure-Volkmer law dating back to 1986 (which prohibits Federal gun registration), but the legal thinking I’ve read indicates that, when 2 laws are in conflict, the more recent law takes precedence. So, the safeguards of McClure-Volkmer don’t sound so safe.

    It gets scarier when you consider: 1) The BATFE already has a new proposed rule on deck that would require registration of any person purchasing more than 1 semi-auto. (I guess ATF doesn’t want competition biting into their gun trade to Mexico-see “Operation Gunrunner”; 2) the recent revelation of Zero‘s comment to Sarah Brady that they’re working on gun control “under the radar” (Cass Sunstein, call your office…) What Zero can’t get done via legislation, he’s doing by dictate (are we Venezuela yet?) I’m sure these continued Patriot Act provisions will help in their quest.

    AND, the Republicans are helping him do it.

    When first passed, right after the 9-11 attacks, there was REASON, R-E-A-S-O-N to have it in place. There is no reason any longer to have it.

    In Congress out of their minds? Now the Democrats can use this to monitor our cell phone conversations, text messages, track our internet navigation, resume pat downs by TSA, sell more automatic weapons to drug cartels and continue to give billions in foreign aid to out faithful, loyal muslim allies of Egypt, Iran, Iraq,Libya, Saudi Arabia, Pakistan and Afghanistan! Is this what the Republicans want? Just because it was George W. Bush’s original idea does not mean it was ever a good idea – it never has been. This is another Nazi tactic for Obama to force the taxpayer to be “transparent while his administration is not!” And he can legitimately blame it all on Bush!

    The taxpayers need a list of all GOP who drink this Kool-aid and they need to be voted out next election!

    I supported the original Patriot Act for the simple reason that we didn’t know who are enemy was and we needed to find out, fast. I swallowed the bitterness thanks to the provision that as soon as the smoke cleared, a clear-headed congress would have to re-visit the provisions and adjust the bill accordingly.

    …I now see that was too much to hope for.

    Paul has it right. Why this can’t be reviewed and discussed openly without the mud-slinging just goes to show how far we have slid as a people.

    Keep on searching diapers, frisking 6-year olds, tapping our conversations and enjoy reviewing our records. I‘m sure we’re much safer now.

    When do we get to stand up against the government intrusion?

    Anybody remember the story about the Marine in Arizona who was shot over 50 times by police in an illegal raid, the man was protecting his family against armed raiders. The “SWAT” team startled his wife, he grabs his rifle to protect his family, and then he is shot by the police. I think that it was around 60 or 70 shots. What ever happened there?

    There has to be a limit to the government power. I am all for stopping terrorists, but some things go way too far.

      Very well said! The Fourth Amendment of the Bill of Rights within the U.S. Constitution prohibits the police from exercising unwarranted searches and/or seizures (this also includes the searching and/or seizing of your vehicle).

      My letter to my Congressman and Senators.. If you agree with it or sympathize with it use it and let the cowards know how wrong this legislation is.. Far as I know only Rand Paul and one other Senator voted against it..

      I’m incredibly disturbed by the renewal of the Patriot Act. I find this piece of legislation absolutely inexcusable! I connect the legislation with Treason against the United States Constitution and I believe every US Senator and Congressman that supports this legislation has blood on their hands and evil in their heart. My forefathers fault for ages to secure the freedoms and liberties which they eventually bestowed upon us and to think that some spineless gutless shortsighted Representative would sign away these precious rights in the name of some conjured up all encompassing so called “War on Terrorism” is beyond comprehension!

      Is there not a person in DC with love of country and integrity in their heart any longer? How can you possibly sell us out like this? Was it a mere 30 pieces of Silver? How can you live with yourselves? You disgust me! How dare you call yourselves Patriots!

      About your Klan question, the Klan was/is so restricted to who they get as a member that since I’m a foreigner, they would put me in a body bag and send me back to Brasil.
      That’s what doomed the klan, like the Waffen SS, so few people qualify to be a member, they can’t grow.

      About what “motivates” me, 40 years ago I saw the future of America in Sao Paulo, Brasil. Since Portugal gave up on Brasil 100 years before the America Civil war, Brasil is 100 years advaned more than America in the myth “beauty of diversity” – result, we have highier crime than America, the Portuguese culture, tradition all gone, this is what we got for 250 years of multi-culturalism, Brasil looks more like Africa than Europe, in another 100 years America will also.

      About what I wrote about America, it breakes my heart to think America will one day look like Sao Paulo, and I get nauseated when I see the news about a white woman that got raped by the animals, 50+ years in America news of a black on white rape was a shock, today whites don’t care, like that rape of Anne Pressly, that was sick ! the news of her murder didn’t last long on the TV :(
