Wisc. Senate Passes Collective Bargaining Ban Without Democrats

In a quick turn of events, Republican state senators in Wisconsin have successfully pushed through a provision stripping public employees of their collective bargaining rights by separating it from Gov. Scott Walker’s controversial budget bill.
The stand-alone measure passed Wednesday evening by a vote of 18-1. No Democrats were present.
In effect, the vote renders Democrats attempts to withhold the provision from the budget bill moot.
With the bill’s most controversial provision removed, Republicans hope Democrats will now return to continue the debate of the rest of the budget proposal.
As you’ll recall, all 14 state Senate Democrats fled the state in an attempt to prevent passage of the budget bill. With the collective bargaining provision included in the budget bill, the GOP needed at least one Democrat to be present for a quorum to allow a vote. But with the provision voted on as a stand-alone measure, the GOP successfully passed the policy with no Democrats present.
The collective bargaining provision was put into its own bill hastily created during a joint conference committee Wednesday. Senate Majority Leader Scott Fitzgerald shepherded the bill through the process as Democratic Rep. Peter Barca objected, claiming the committee‘s meeting was in violation of the state’s open meetings law.
At press time, Senate Democrats were reportedly meeting to decide how best to respond to the GOP’s decisive action.
The Senate-passed stand-alone provision now heads to the state Assembly for approval.
As the Senate voted Wednesday evening, demonstrators gathered at the state capitol building erupted in a roar of protest. Spectators in the Senate gallery screamed “You are cowards.”
Before the sudden votes, Democratic Sens. Bob Jauch said if Republicans “chose to ram this bill through in this fashion, it will be to their political peril. They’re changing the rules. They will inflame a very frustrated public.”
Senate Democrats have been absent from the state for three weeks. Sen. Matt Miller, leader of the Senate Democrats, quickly issued the following statement after the vote:
In thirty minutes, 18 State Senators undid fifty years of civil rights in Wisconsin. Their disrespect for the people of Wisconsin and their rights is an outrage that will never be forgotten. Tonight, 18 Senate Republicans conspired to take government away from the people. Tomorrow we will join the people of Wisconsin in taking back their government.
Senate GOP leader Fitzgerald issued his own statement:
“Enough is enough.“ ”The people of Wisconsin elected us to do a job. They elected us to stand up to the broken status quo, stop the constant expansion of government, balance the budget, create jobs and improve the economy. The longer the Democrats keep up this childish stunt, the longer the majority can’t act on our agenda. [...]
“We have confirmed with the Legislative Fiscal Bureau, the Legislative Council and the Legislative Reference Bureau that every item in tonight’s bill follows the letter of the law.
“The people of Wisconsin elected us to come to Madison and do a job. Just because the Senate Democrats won’t do theirs, doesn‘t mean we won’t do ours.”
UPDATE:
Gov. Scott Walker is praising Republicans for moving forward with his proposed budget provisions. Democrats were offered repeated opportunities to come home and negotiate, Walker said, but they refused.
“In order to move the state forward, I applaud the Legislature’s action today to stand up to the status quo and take a step in the right direction to balance the budget and reform government,” Walker said.
The AP is reporting that Democrats are planning their return to the state, but Democratic Sen. Jon Erpenbach tells local affiliate NBC15 that despite reports, the Senate Democrats do not plan to return to the state tonight or tomorrow.
Meanwhile, Democratic Sen. Chris Larson told MSNBC‘s Lawrence O’Donnell: “If [the GOP] wanted us back, they could have had us back. We’re getting together to see what legal action can be taken. They’ve been sloppy in their haste trying to get this done. But the story is where the Republicans are…[not with] the people. They’ve proved themselves to be deceptive. Special interests over people. Shutting down public debate, public hearings, the phone lines, the capitol, our offices, and now this. There’s no low they won’t go to to kill workers’ rights. Untrustworthy, can’t keep their word. We asked for negotiations. They used the letter as a prop in a press conference… shows where they are, where they’re at. They’re passing things w/o the public being aware of them. I doubt if many in WI have heard what happened. A lot of people will step out to the streets to recall…“

Scott Walker would of had a the normal procedural vote had the Dems not gone AWOL. Walker figured out a way to make the vote happen without them….three weeks later! The Dems again are the ones making a mockery of the democratic system.

They didn’t teach us in civics class about public servant unions. If you have dems and reps in the same union, how on earth can they honestly teach that there are two separate parties?
A public servant implies public servitude. A supposed noble sacrifice for the greater good of our society. That isn’t what we have now. The servants have become our masters, and we are now the servants. We only exist for THEIR greater good apparently.
The government that has failed us? Their leaders are MIA, and they are practically rioting in the capitols. All of those false things that the Tea Party was accused of (by these very same people), are actually being done every day, by these unionized government workers.
At some point in time, the adults will have to step in and put a stop to this foolishness. Thats us, the majority of hard working Americans who live in reality. The west coast and New England seem to forget that there is a whole nation of people living between them, and we far outnumber them.

TEACHERS and OTHER public employees.. please know that this is NOT an attack on you, but on the UNIONS that abuse you and the tax payers. Collective bargaining produces things like TENURE and rubber rooms, making it near impossible to fire bad teachers. Most teachers I know would LOVE to have a merit pay system. We appreciate all GOOD public employees and want to pay YOU well! We all want to bargain in good faith and make sure the ones who care for us and our children are justly rewarded.. MINUS THE UNIONS with their hands out and in your pockets. THANK YOU for all you do.

I appreciate our public servants but know that Walker and Kasich and Christie among others are doing the right thing and what they have to do to help their states survive. If you want the gov’t holidays off, you need to speak to your employer and ask why you do not get them. I have liberal friends though who think that this is just the most awful injustice ever…But anytime you have Unions supporting candidates who end up negotiating the contracts of workers who paid dues to organizers that put the politicians in office, the tax payer is the one who looses. My liberal friend in CA said she was so afraid that Scott was bought off by the Koch brothers…My answer to her was that “That’s sort of like the pot calling the Kettle black”. Look at all the money the Unions pay in to elect their corrupt politicians to keep them in their pockets and George Soros pumping his money in there. Is that not the same thing? You can’t play “fair” with these people. They don’t know what the word means. I am also proud of our federal republicans who put up a valiant fight against Obamacare and DID NOT ABANDON THEIR POSTS. The Democrats and Unions have shown their true colors—and they are bullies of the first magnitude. Public Unions need to be abolished immediately throughout the entire United States. I am wondering now about private Unions—looking at what they did the car industry, maybe they have outlived their usefulness too! We can’t afford products made by the companies with Unions because it has driven up the prices. Food for thought.

Second, If you want to play games and consider “posessions” as states (although they don’t have the representation of a state in the federal government, etc.), so be it, but for then-candidate Obama to have made a truthful statement, based on your “posession” = “state” principle, he would have had to have visited Puerto Rico, Guam, America Samoa, etc. (I’ll concede he visited the District of Columbia ;^)

Actually I never read that in the Constitution of the United States of America, and still do not see it there. First – I am a CA teacher, have been for 14 years…my father is a CA teacher of 33 years, both of us are Mathematic high school teachers. I grew up with my dad saying how the Unions were a joke and nothing more than political hacks. He didn‘t join the union until CA passed a law that says even if you don’t join, you have to pay the portion of the dues that deal with local collective bargaining, which is about 1/3 of the monthly dues, the rest go to the state CTA and the national NEA. So he joined and actually became a union rep on his campus. I have joined for the same reason as my dad but I tend to be a LOT more Conservative, Constitutionalist, and Libertarian than my father who grew up a Kennedy Democrat and still is.
So I heard that the WI teachers and state employees, minus the cops and firefighters, are going to now have to kick in more money towards pension and health. I heard that 99.8% of the pension contribution is from the state of WI and .2%…YES POINT 2 Percent is paid by the employee. I heard that 99.5% of the health benefits are paid by the state of WI and only 4.5% is paid by the employee. The new bill would INCREASE the pension by the employee to 5%, 95% paid by the state of WI and 12% health benefit paid by the employee and 88% paid by the state of WI.
WTF!!!! TOTALLY!!! WTF!!!
Here in CA…what most people think of as close to the former USSR as the USA has ever become… sitting on top of a 25 Billion deficit….an economy that is 8th in the world….most districts make you pay 40-50% of your health benefit and the pension breakdown is 51% employee, 49% district. Now the district gets state tax money…so replace district with state and compare to WI….
WTF!! these whiners, these crybabies, this little B O I T C H E S….WTF!!! try coming to CA where you have to PAY HALF of your own retirement and healthcare and even that is bankrupting most districts and the state…

From example the code you site;
“The Federal percentage for each State (other than Puerto Rico, the Virgin Islands, and Guam) shall be promulgated by the Secretary between October 1 and November 30 of each year, on the basis of the average per capita income of each State and of the United States for the three most recent calendar years for which satisfactory data are available from the Department of Commerce”
“The term “United States” means (but only for purposes of subparagraphs (A) and (B) of this paragraph) the fifty States and the District of Columbia. ”
“The “Federal percentage” for any State (other than Puerto Rico, the Virgin Islands, and Guam) shall be 100 per centum less the State percentage; and the State percentage shall be that percentage which bears the same ratio to 50 per centum as the square of the per capita income of such State bears to the square of the per capita income of the United States;”
“Other than” also helps define the difference between the ‘United States’ and ‘State’.

Posted on March 10, 2011 at 10:56am@Realindependent: How does giving employees the ability to make more based on merit, keep more of their own money (by not deducting union dues), and live in other districts, stick it to the little man? I don’t get it? I mean in the end jacking taxes as they have in the past, has cost us jobs, and businesses……..when those leave, taxes leave. When businesses leave, people leave, and MORE taxes leave. When people leave there is no NEED for public employees. Biting the hand that feeds you is NEVER a wise. We‘ve taken Doyle’s BOGA (bend over and grab your ankles) methodology for too long. Thanks to his grab of stimulus we have a bugdet we can’t support on our own. I say take it or leave it……sometimes you have to shut the whole factory down, fumigate and start again.

Now, those same cowards are outraged because the GOP didn’t just sit back and take it, they moved forward, now let’s see how Wisconsin prospers under this kind of unashamed, forward-moving Government.
