CA Judge Deems Case in Which Jewish Woman Was Rammed with Shopping Cart ‘Free Speech’

Judge Richard Seeborg Rules Against Jessica Felber in University of Berkeley Anti Semitism Case

Back in June of 2010 a leader of a pro-Palestinian student group at University of Berkeley allegedly rammed a Jewish woman with a shopping cart as she staged a counter-protest to an anti-Israel “Apartheid Week” rally conducted by the Muslim Student Association and Students for Justice in Palestine. The counter-protest was dubbed “Israel Wants Peace Week.”

Now, U.S. District Court Judge Richard Seeborg has deemed that the Muslim students who harassed Jessica Felber and other Jewish students were simply engaging in protected political speech.

The Greeley Gazette reports:

On Thursday U.S. District Judge Richard Seeborg said the harassment, even if true, constituted protected political speech and dismissed the case against the university.

Seeborg said the university did not have any obligation to intervene in any dispute where a private individual on campus was allegedly interfering with another’s constitutional rights. He instead appeared to indicate that the incident was an outcome of Felber’s counter protest.

Felber and another Jewish student claimed the University did not do enough to prevent the harassment which included the Muslim group conducting checkpoints around the campus. Students were asked if they were Jewish while passing the checkpoints.

“The incident in which Felber was assaulted with a shopping cart, for example, did not occur in the context of her educational pursuit,” Seeborg stated. “Rather, that event occurred when she, as one person attempting to exercise free speech rights in a public forum, was allegedly attacked by another person who likewise was participating in a public protest in a public forum.”

According to the San Francisco Chronicle, Seeborg said that much of the conduct involved “pure political speech” that is constitutionally protected even if it “contained language that plaintiffs believe was inflammatory, offensive or untrue.”

Seeborg said some courts have allowed public colleges to outlaw harassing speech and conduct that interferes with students’ rights, but schools have no legal duty to do so. The Muslim organizations receive campus funding on the same basis as other groups, the judge said, and any attempt to withdraw it would raise “serious First Amendment issues.”

The Huffington Post adds:

The suit also alleged this attack was part of a pattern of behavior during Apartheid Week, during which Jewish students were spit on and Israel’s government was equated to that of Nazi Germany.

While the university has previously disciplined some of the event’s participants and even had Husam Zakharia, the student who hit Felber with the shopping cart, arrested in connection with the incident, Felber (who graduated last year) has accused university President Mark Yudof, who is Jewish, of allowing an anti-Semitic environment to flourish on campus.

“SJP and Zakharia have been involved in other incidents on campus to incite violence against and intimidate Jewish and other students,” stated the lawsuit. “Defendants knew of this history of incitement and intimidation yet took no reasonable step to adequately control Zakharia or other student members of the SPJ.”

Jihad Watch founder Robert Spencer said the judge’s decision affirms that Muslims assaulting Jewish students is now protected speech.

“This is an outrageous decision. The Muslim students were trying to silence the freedom of speech of the Jewish students. The judge says this is a ruling in favor of free speech, but actually the freedom of speech was being infringed and the judge is saying that is ok to protect the freedom of speech of the Muslim students. Don’t the Jewish students have freedom of speech as well?”

      Now that the judge has effectively ruled that Sharia Law is legally justifiable when assaulting a Jew, then the precedence is set to exonerate muslims when they assault YOU and YOUR family.

      Our country is long overdue for an activist judge impeach-a-thon.
      I pray our next president appoints a judicial impeachment czar.

      THE JUDGE is dead wrong. therefore; High crimes and misdemeanors is a phrase from Section 4 of Article Two of the United States Constitution: “The President, Vice President and all civil officers of the United States, shall be removed from office on impeachment for, and conviction of, treason, bribery, or other high crimes and misdemeanors.”
      “High” in the legal parlance of the 18th century means “against the State”. A high crime is one which seeks the overthrow of the country, which gives aid or comfort to its enemies, or which injures the country to the profit of an individual or group. In democracies and similar societies it also includes crimes which attempt to alter the outcome of elections.
      This Judge should be removed from the Bench. Charges pressed. violation of the Constitutional rights ofJessica Felber. This has to be stopped.

      Newt’s line about making judges explain their anti-constitutional rulings isn’t sounding too wrong anymore, is it?

      The university is fully responsible for what goes on on its campus. That is why they have university police rather than the regular police. If the university president is going to allow an atmosphere of violence and harassment to continue, he has got to be removed. College is supposed to be a place for the furtherance of education.

      Also, the first amendment was intended so that ordinary people could tell the truth about their government. It wasn’t intended for hate speech or lies, or porn. With it, we became the only nation on earth that didn’t arrest and punish people for speaking the truth.

      You now have legal standing and precedent/case law to prove your assault is protected as a Constitutional right!

      Why is ever one always persecuting God’s most precious chosen people? For the life of me I don’t udnerstand the hate. I bet if a Jewish man bumped a Muslim they‘d be put in prison for life because the system is so obviously biased against God’s chosen. Ughhhh!

      For the record, Gingrich is right about the Federal Judges. The Judicial was intended by the Founders to be the weakest of the 3 branches and the Congress should absolutely be prepared to bring them before a pannel and have them explain some of these most egregious decisions. Notice how the Media smears Newt on this issue.. They realize that the Judicial has become their Goose that lays the golden eggs and that is why they are stacking it to such a degree.

This judge better define the line really quick or she just made it legally protected speech to attack another person. i say we ALL show up at her house with shopping carts and wait for her to come out. It’s out free speech rights to sandwich her between a couple of carts and drive her down the street until our rightful (as legally defined by her) is satiated.

People were not “getting along.” Two sides were excercising their 1st Amendment rights to free speech. One side was also engaged in various acts of battery. A U.S. District Court judge has decided that such acts of violence are permitted. I suppose if Jihad Watch were to sponsor an event at a college campus, then you would be O.K. with Muslim students being PHYSICALLY attacked for any counter-protest, right?

      This reminds of me of Kristallnacht 1939… Those awful days and nights, where the Jews were subjected to special laws and were treated less than any other human beings. It began very slowly with racial laws and end almost half of the world Jewry exterminated by the most advanced society in the world then. This lady exemplifies what my mother and grandmother had to endure in Berlin during 1930’s. Shame on this Judge , shame on those who stood by and let this lady endure the hatred and shame on this court that denied her rights. I will never forget this. May god have mercy on us all and especially the liberal Jews, and may they wake up and see this evil for what it is.

      So, let me get this straight…..Based on this decision, I can go run down that irritating, rude Muslim that owns the convenience store down the street and it’s legal and I would be in the clear?…..Hurray for free speech!!…..I have to drive down and fill up the tank of my free speech-mobile, because I will have some speaking to do with it later.

      Actually, no. If you carefully read the whole story and not just what the headline says it’s about, you’ll find out that the school did actually punish the student who committed that assault. The lawsuit claimed that the assault was the fault of the school because they allowed the nonviolent political activities that preceded it.

      Its beyond time for open season.It isn’t lost on me that there were check points.I also don’t believe that its long before the yellow stars, either.For us all too, I might add.They are starting with the jews they actually hate all of us just as much.Thats why all the pigeon holing and baiting is going on.Its been simmering a goat heads soup behind the scenes for decades.Some of us know more about that than others.Unfortunately we have the scars to prove the same.I can assure you with 100 percent certainty we are truly tired of it.As soon as the true revolution starts and or our own military will give immunity to private citizens you will see us coming out of every corner.God help the enemy then.Nasty isn’t even close to whats going to occur.

      I beg to differ. Based on the ruling, I don’t think you could shoot him. However… I think if you ran him over with a large truck, you would stay in the spirit of the law!
