Cafe Owner Claims He Laid Off 21 Workers Because of Occupy Wall Street

The owner of a normally bustling downtown Manhattan cafe claims that 21 of his employees lost their jobs last week and that it is a direct result of the Occupy Wall Street protests.

Marc Epstein, owner of the Milk Street Cafe at 40 Wall St., said he was forced to lay off the members of his staff last Friday after suffering a 30 percent dip in sales in the six weeks since the protests started. He also stated that he could lose his entire business in less than a month.  To make matters worse, Milk Street just opened in June 2011.

“What are [the protesters] trying to accomplish here?” Epstein asked Monday. “The end result is that I and all the wonderful people who work for me are collateral damage.”

DNAInfo adds:

Epstein said the biggest problem is the police barricades that have lined Wall Street since Sept. 17, making it difficult for people to see his restaurant and cross the street to get to it. Epstein has also had to contend with closed subway entrances, police checkpoints and frequent Occupy Wall Street marches, which he said have dampened the Financial District’s formerly thriving street life.

“Now, Wall Street is deserted,” Epstein said. “The only people who walk down Wall Street are people who have to walk down Wall Street. It’s transformed from a beautiful pedestrian mall to a police siege.”

Epstein just opened the 23,000-square-foot Milk Street Cafe in June, marking the first expansion of the eatery and catering business with the same name that he and his wife opened in Boston 30 years ago. Using loans and private investors, Epstein poured $4 million into the project and said he was proud to be part of lower Manhattan’s revitalization.

But now, Epstein said he isn’t sure his business will be open for much longer. In addition to laying off 21 of his 97 workers, he also had to cut the restaurant’s operating hours, closing at 3:30 p.m. rather than 9 p.m.

“If we don’t get these barricades down, we will be out of business,” Epstein said Monday. “I give myself three weeks.”

Epstein said he is frustrated that he cannot get anyone at the city to return his calls, and he said he would never open another business in New York if this one fails.

On Monday, Epstein did manage to speak on the phone to Donald Trump, his landlord, and Trump said he would try to intervene with the city to get the barricades removed, Epstein said.

Marc LaVorgna, spokesman for the Mayor’s Office, said the city wants to help Epstein.

“We have been working closely with the community to address the issues caused by the Occupy Wall Street protesters and will continue to do so,” LaVorgna said in an e-mail.

And while Mayor Michael Bloomberg criticized the Occupy protesters in October for negatively impacting local business and “trying to destroy jobs,” he has yet to take any measures to protect lower Manhattan’s business community.

Meanwhile, Occupy Wall Street released a statement Tuesday saying that the NYPD is to blame for Epstein’s demise.

“The NYPD makes the decisions on the part of police barricades,” the statement said in part.

“This is not our choice and we would never want businesses to have to deal with inconveniences that may reduce their business traffic.”

Epstein, who marched in 1987 to free oppressed Jews from the Soviet Union, said he understands protests but cannot condone the Occupiers’ tactics.

“This movement is not serious,” Epstein said. “If it was, they would not want small businesses going out of business.”

If Epstein’s business is at risk, one can only imagine how many other businesses across the country are being negatively affected by the Occupy movement. How many will lose their jobs and how many doors will close?

If anyone living in cities with Occupy movements are seeing local businesses compromised, please send us your observations.

      The protesters have a point about the barricades– they should all be cleared out– along with the protesters– now infiltrated by vagrants, drug dealers and rapists. Seems to me the NYPD has ample evidence that Brookfield Properties is harboring criminals. Do they have a license to distribute food? Has the health department made their visit? How is it the health department is letting the owners of this property distribute food, long term, with no license, when someone who has jumped through all of the administrative hoops, invested $4M, and created jobs, is being put out of business? Since when do you get to ruin innocent peoples’ lives as a part of your protest? Shame on Bloomberg, shame on the NYPD for not implicating Brookefield in the crimes and illegalities which are happening on their property. Talk about corruption!

      “Bible_quotin” People are allowed to protest within the law, and without taking the rights of others. Where are their permits? Since when is camping allowed on private property without their permission, or in public places without a Conditional Use Permit? What only conservatives have to follow laws.

      Bloomberg should never have allowed this. They can protest all they want, just fill out the paperwork, and don’t block the streets and the sidewalks.

    Restaurants fail more often than probably any other business. It‘s quite an accomplishment to keep a restaurant’s doors open for 6 months. I‘m not sure the police are to blame for this restaurant’s troubles.

    Still, theblaze presents this story unfairly as a small business owner thinking he’s entitled to success. Theblaze is being very unfair.

      Here’s another problem. The “occupiers” have been entering restaurants and other local businesses in order to use the bathrooms, but they don’t buy any food or other items to help offset the cost of providing those facilities. Instead, they vandalize and befoul the bathrooms so that regular customers freak out and leave.

      The owner of Milk Street Cafe is paying substantial property taxes to the NYPD to protect himself, his restaurant, his customers, and his employees against lawbreakers of every stripe.

      Instead, it sure looks as though the NYPD is protecting the unruly “Occupy” mob from the consequences of their own behavior, while neglecting their duties to protect the law-abiding citizenry.

By working for the last 30 years & likely taking out loans in order to open up this cafe & expand. THAT is called THE AMERICAN DREAM, it’s also called personal responsibility & entrepreneurship.

    What about his 21 employees that just lost their jobs? The remaining 97 that will likely lose theirs as well? Do they not matter? Will you now offer them a job, Zap? Will the average OWS protestor offer them a job? Oh, wait…. no – because the types that are protesting are the sorts that leech off of the types who are seeing their businesses tank right now thanks to those same idiots who are railing against the system they believe is destroying people.       Zap is obviously clueless about what it takes to build something. A simple restaurant like a McDonalds franchise in the middle of Texas can take up to 1M to build just for the contractors and materials. In NYC??? Whole different ballgame, you can’t build a Lego helicopter without paying for overpriced union workers who cost twice as much as non-union and take three times as long… I know this first hand as I worked for a union contractor for five years….

      Way to go ZAP. Another one who simply just doesn’t get the constitutional values created by our founders by the Grace of God. Your views speak volumes of Marx which has and still is the enemy of my republic. As I said to BMW please keep posting so those who really dont understand what the OWS is all about can just read your posts.

      Let’s see. If you paid somebody $7/hour for 40hrs/week, that’s $280/wk. Multiply that by 97. It comes to $27,160/wk. Multiply that by 4 weeks and it’s $108,640/mo. Just in employees. Let’s face it. Is there anybody in NYC working for $7/hr? Oops. I forgot benefits. Anyways, add in building lease, electric, phones, water, cable (if they have tv), and product. He is selling a product, remember? He has to buy materials in order to make his product to sell. Then there’s dishes and laundry, not to mention pest control, liquor license and inspection fees. I’m leaving out lots of expenses. Explain to me why you should get any part of what this man BORROWED for yourself or any body else? Zap. You need to be locked in the stocks while townspeople throw rotting veggies at you. Maybe you’d learn something.

    Does that make these workers part of the 99% now? And those street brats don’t care who loses their job as long as they can hang in the street, smoke dope, bang the drums, sing badly, and chant unimaginative slogans.

    Maybe the Occupiers need to take up a collection to pay for those jobs they pushed to the street.

      Wrong, this is what Fascism looks like. A free republic, has law and order, rule of law, equity. This kind of thing is exactly how Hitler‘s Brown Shirts and Mussolini’s black shirts acted. Overcome laws by shouting and intimidation until you’re in power. “Little people” don’t matter, it’s for the cause, and “I know what’s good for them”.
