Calif. Police Respond to Woman’s 911 Call…And Then Accidentally Shoot Her

San Diego police are under close scrutiny after accidentally shooting a homeowner who called 911 after allegedly seeing a man in a ski mask prowling the neighborhood.

While searching for the man, police entered the backyard of the woman’s home, San Diego County sheriff’s homicide Lt. Larry Nesbit explained.  There, they made contact with the homeowner and, horrifyingly, shot her.

While police say Jennifer Orey was struck in the arm, her family maintains otherwise.

“You know what, you guys need to get your story straight,” Dennis Morgan, the woman’s father, admonished. “She wasn’t shot in the arm she was shot in the chest.”

Her sister-in-law added: “Part of a bullet ricocheted off and hit her in the pinky, and they also had to do a little bit of repair to her pinky as well.”

Orey successfully underwent surgery Monday, and is expected to be okay.

[San Diego County Sheriff Bill Gore] said the deputies thought Orey’s open gate looked suspicious, so they went into her backyard. The deputies ran into Orey, and one of them had a “spontaneous reaction.”

Authorities said they did not know exactly what prompted the shooting. They said the woman did not have anything in her hands and was not armed at the time.

Morgan said Orey told him she heard something in her backyard so she went to check it out.

“She saw a flashlight and identified herself as the homeowner and he shot her,” said Orey’s father, Dennis Morgan.

Orey told relatives the deputy told her to lay on her back until paramedics arrived.

Her father said Orey was the first woman accepted in the Navy’s Air and Sea Rescue team and she knew if she stayed on her back she would die, so she turned on her side and waited.

Morgan said he believes the sheriff’s department is downplaying the shooting. “I told them I’m really pissed off,” he said. “I’m pissed off as hell. A cop could have very easily killed my daughter.”

Before she was rushed to the hospital, Orey had one question for the deputy. “After he shot her, she looked at him and said, ‘Why did you shoot me?’” said Morgan. [Emphasis added]

Apparently the officers never responded, and the matter is under investigation.

      Hi MONK, I’ve seen some accidental discharges in my time, but gladly nothing that close. Although three of us were standing next to an armored car when one of our idiots bounced around off of it’s side while clearing his weapon. I would venture to say that we all had tiger striped underwear.

      SHIROI RAION, I can’t speak for all departments, but the last Psych Eval that I went through about 14 years ago was very thorough. At least in my humble opinion. There were about 15 to 20 people that showed up, and the next time we got together to jump through the next hoop, there were only six of us. It’s not like I was unaccustomed to taking these batteries, had go go through a number of them in my military career. One at Bragg took three days.
      I did notice that some of the training in the civilian police academy would easily make some of the new guys jumpy. Further training on the department through the FTO program was mostly just a hazing. I am glad that I left that department many years ago now. LE today is nothing like was I was originally trained to do back in the ’70s. Or for that matter, any of my follow on training back then too.

      We should have an option as citizens:

      1. Call 911 if you do not have the ability to handle an intruder and hope for the best (99.9 percent of the time you will be safe from the police, but not from the intruder)
      2. You are tactically proficient with firearms: DO NOT CALL 911 until after you deal with the situation and describe yourself and where you will be. Disarm yourself once the threat is no longer a threat. Go to neighbor’s house to make the 911 call from their phone or your cell phone. You do not want to be in the house with the intruder once you have dealt with them. The police cannot shoot you if you are near but not on the scene. Only volunteer the following:
      Identify yourself as the victim. This is important should the intruder survive and slip out the back door, call the police stating a crazy person shot them when they innocently knocked on your door. There is much debate on what to say next, but here in California, criminals have rights and most DA’s and politicians do not like you killing their constituents, so invoke your right to remain silent and state that you will be happy to cooperate in questioning when your attorney is present. Identify an attorney that specializes in defending armed citizens when you buy the firearm. Set aside $40K-50K to defend yourself from the unrelenting crusade of the DA to prosecute you.

      If the cop had shot himself in the foot, we could say“ accident with a Glock” but not when a cop shoots someone in the chest

      @RJJ:

      There’s no such thing as an “accidental discharge”. It’s a “negligent discharge”.

      Any time a round if fired from a weapon unintentionally it’s because someone was being negligent.

      There’s no other way to say it. If that person had been following proper gun safety procedures that weapon would NOT have gone off. Therefore they failed to properly handle the weapon and are therefore negligent.

      If they work for law enforcement they should be fired immediately. No excuses, no second chances.

      Affirmative action and other such legislation ruined the police departments. They made the entrance exams so easy that a person with the IQ of 10 could pass them. They got rid of weight and height requirements so anyone could become policemen and that brought in people who are either so unsure of themselves that they want to shoot rather than take a chance; or people who have fake bravado and love the power the office brings. Probably 50 to 60% of officers working today would have never made the grade in the 50‘s and 60’s and part of the 70′s.

    The SD County Sheriff’s Department is not out just shooting people at first contact. This was an unfortunate mistake, but being humans, the Department does have imperfect people in an imperfect world. I come from a law enforcement family and I for one would rather have the deputy shoot first and chance that they hit an innocent person than risk being attacked, but I am positive that they are not taught that as a policy, that‘s just my selfish preference for my family members’ safety when they are on duty. I hope this woman heals well and the investigation brings about the appropriate decisions and changes deemed necessary to ensure that both the public‘ and the deputies’ safety is served in matters of law enforcement.

A police officer has a job to do and understand the risks involved. They are there to “PROTECT and to serve”. If they’re attitude is “I’d rather shoot at anything that moves then risk my own life” they are in the WRONG line of work! As a civilian I don’t really want my cops too overly trigger happy.

You should not be going into Law Enforcement unless you are willing to take the risk to your life in any and every situation… The say “To Serve and Protect” does not mean to Serve and Protect your own… Its to Serve and Protect the public that you are being payed to protect….The problem with Law Enforcement agencies now is they are being pushed to hire veterans who have just gotten out of the military. That in and of itself is not a problem but when you are hiring guys that were infantry soldiers who have done upward of 6 combat tours in Iraq and A-Stan its almost impossible to turn off what you have conditioned yourself to do in combat situations…At least that is what I am seeing in my work in Law Enforcement.

      Are you one of those scary libs who think that the citizenry should not be armed and that just calling the police is better than defending one’s self via the 2nd Amendment? I really have to ask this question, that is if you really think a law enforcement officer should shoot first and accidentally shoot an innocent person than risk being attacked, an the question for you is, what is it that makes your life of more value than mine, or the lady who was shot, or anyone else for that matter? Want to know what it would be like if we had all the guns taken away from law abiding citizens, this story is what; moreover, we would be saying that the police and the government (and for that matter, as well as thugs and gangsters), are the only ones who have a right to defend their own lives, thus we would be saying that their lives are of more value than the rest of society. So much for equality under eyes of the law!

      You couldn’t be more wrong. I’ve been a cop for almost 25 years. It is our job to protect those that cannot protect themselves. And you protect the lives of those that you are tasked with protecting even at the cost of your own life. That means that you don’t accidentally shoot the homeowner. You DO NOT shoot someone unless it is a last resort. I don‘t like second guessing another cop’s shooting because I’ve seen media reports that have been vastly different than what actually occurred, but this does sound as if the cop just fired out of fear, accidental discharge or incompetency. Regardless, this incident is a clear indication why not everyone should be a cop. It is a very dangerous, highly demanding job that requires intelligent, calm, physically fit individuals.
      I don’t know what happened here, but my guess is that some cop who probably should never have been a cop shot this woman accidentally. And I feel bad for the cop, but I feel worse for the poor woman who was just trying to protect her property.

    Firstly, she shouldn’t have been in the back yard if she knew police were in the area searching for a suspect. She knew. She had called them.
    Having said that, I can’t imagine a veteran cop making that kind of mistake. It must have been a nervous rookie. I know, I know that’s no excuse.
    She’s gonna be OK and will get a big, fat settlement.
    End of story.

      First of all, cops should not shoot just anything that moves, which includes people and pets. She’ll recover but it looks like the paranoid incompetent posing as a cop may have derailed her career. This is assualt with a deadly weapon; it’s a crime if you shoot your neighbor while hunting down a criminal. Shooting people is a big deal and the cop should do some time. That will help cops who have itchy trigger fingers and could care less about human life.

      The homeowner shouldn’t be in the backyard? And she’s going to get a big pay day? That’s your take on this?
      How about the homeowner should be able to call the cops for backup, head outside to protect her property and/or her family and expect to NOT BE SHOT BY THE COPS! Additionally, the fact that she is going to get a settlement via a lawsuit IS NOT justification to forget what happened here.
      I’m a cop and the cop should have better control of himself. Accidental shootings that actually strike a person are very rare and are the result of a SERIES of mistakes that should never happen.
      1st mistake: Finger on the trigger while searching.
      2nd mistake: Pointing your weapon at someone before ensuring that the person is a legitimate threat.
      3rd mistake: Failing to give verbal warnings in order to ensure that the person you are pointing your weapon at while placing your finger on the trigger is ACTUALLY a threat.

      C’mon gentlemen…….our job is to respond and save the people from the bad guys. Not screw up and do their job for them.

      Excellent point. Like the “no-knock” warrants. If someone busted my door in, I don’t care what they are yelling, I’d shoot first. & then I’d be the criminal not the home invaders with badges. A badge apparently is a license to make any number of mistakes with other people’s lives… but we can’t trust regular people to arm themselves…. cause police training makes you “better” than the average citizen?

      what is it that makes a policeman’s life of more value than mine, or the lady who was shot, or anyone else for that matter? Why should police be allowed to defend themselves, like the criminals would be if all guns were taken away from the “dangerous” citizenry, and the rest of us can just wait and hope the police protect our lives’ over his/her own life?     Another story of a person being shot by the police. Police are too trigger happy with deadly force these days. The report never said anything about the cop yelling a warning before shooting, so I‘m going to assume that she wasn’t given a warning. I‘m glad she wasn’t killed and I hope she files a lawsuit against the police department.

      This cop is either a coward, or burnt out has been, or stupid. I would like some other suggestions. Cops used to go on a call BY THEMSELVES, now if someone spits on sidewalk suddenly there are six or seven cops standing around doing nothing. There are too many cops, they are trained to be paramilitary in their dealings with citizens, and not PEACE OFFICERS!! When cops are around stay out of their way, you are taking your life in your hands if you don’t. Recover quickly and thank you for your service to our Country.

      A very close friend of mine answered a domestin disturbance call in a very small town, by himself, three years ago. He was ambushed by a mentally ill individual with a shotgun. A partner may have made the difference.

      I still miss him.

      One of them was a rookie, it was dark, he was scared.

      When the homeowner walked up on them and identified herself, she scared the crap out of the rookie, and he shot her.

      End result: Rookie gets fired and gets a job as mall security. Police Department gets sued for a couple of million. More emphasis is placed on individual police tactics at the police academy (which all departments sorely need).

      In California we shoot the intruder, call the police and wait to go to prison.
      When we get out the criminals family sues us and moves into our house.
      Justice is awesome.

      Right… Shoot intruder, call cops, tell them you would like the cops and an ambulance to your address, then hang up. Tell them nothing else.

      A Canadian friend was deeply surprised that we carry in FL. When asked what they can avail themselves for protection InYour Home, he said “nothing”. If you hurt the intruder, you will be prosecuted. “it is really bad” he said. Looks like we are heading that way in the US.

      DOM321, Canadians can and do own firearms. They cannot carry them in public but can have them in their homes. The gun laws in Canada are indeed strict, too strict, and they very much hate them. They are in the pro-cess (Canadian joke, they say the “o” in it’s long sense “0” not “ah” in that word, like the Brits) of changing their ways, but are still miles from where they came, where my family had a summer home when I was a child. What has happened in Canada saddens me deeply, and to see the USA leaning the way Canada did, saddens me even more.
