Calif. Republican Loses to Dead Democrat

Death has no political sting in California.

Exhibit A: even though Jenny Oropez died last month, the Democrat easily won re-election to California’s State Senate, defeating John Stammerich, her Republican challenger, by a 58-35 margin.

Oropeza died from complications due to a blood clot on October 20, which was too late to replace her on the ballot.

As one might expect in an election where a deceased candidate wins, controversy abounds. According to the Daily Breeze, Sammerich has filed charges against the state‘s Democratic Party and Secretary of State because of a questionable mailer sent in the election’s twilight:

The tone of the campaign for the 28th District turned sour on its final day, with Stammreich and the California Republican Party filing complaints accusing the Democratic Party and Secretary of State Debra Bowen of using a late-hour campaign mailing to “illegally influence” voters to cast a ballot for Oropeza.

The correspondence, titled “Election Information,” was sent via mail to Democratic and decline-to-state voters and outlined what would happen if Oropeza won.

The mailing closed with Bowen’s name and title.

Republicans allege that the mailing purports to be an official document and thus violates a section of the California Penal Code prohibiting publishing a campaign advertisement that falsely depicts official documents.

“The Republicans are trying to take unfair advantage of Jenny’s tragedy,” the mailer said. “They suggest that voting for Jenny will only result in a costly Special Election. I am asking you to vote for Jenny Oropeza. If a Special Election is called in a few months, you’ll have the chance to thoughtfully elect your Senator for a new four-year term.”

Sammerich pointed out the mailer‘s careful attempt to frame Oropeza’s death only as a tragedy, which he says is misleading. A special election will not be held to fill the seat, which means Sammerich still has a chance.

However, Daily Breeze reports, “The process could cost [taxpayers] millions of dollars.”

    Apparently, the people in California and Colorado don’t feel like the U.S. has suffered enough and must be punished even more. Glenn said yesterday that people like this are basically just uniformed. Absolutely not.

    Liberals are collective functioners, which is an easily diagnosed mental illness. People who harbor socialist tendencies can not change unless they really want to. And “rock bottom”, as Glenn rightly described, will hurt us all.

      Yep. Makes me want to out of the beautiful state of Colorado. I know we have a lot of blue spruce, but did not know there were this many blue people.

    Judging by the votes for Boxer and Brown last night, most Californicators would still vote for a dead person as long as there was a D in front of their name. I cant wait for that State to go friggin bankrupt and into receivership, Maybeeeee they will wake up. If the new Congress votes to bail them out this time, they should be fired in 2012.

      Expect nothing less from the state of California. Ranks right up there with the district that voted barney frank to another term. People who vote for criminals have some form of stockholm syndrome. Then again with all the handouts in California and their sterling representation in gov’t, how could you not vote for the people that bring home “the bacon.” Personall, I will fight tooth and nail to prevent any of my tax dollars going to the dumbest state in the union.

Looking at the elections in California, it appears that California is happy with the Democrats and SEIU destroying them……of course, they believe that the rest of the states will bail them out and not let them go bankrupt economically….it seems they are already bankrupt ethically.

      I’d almost be willing to throw a huge rally like the ones in DC recently… we all go to CA, put on floats, and start jumping up and down really hard at the same time, it might just break off and fall into the ocean, never to be seen again. Us wearing the floats would be fine… nuf said. :)

      Speaking of “illegally influencing” voters, does anyone know if it is legal for a representative from a campaign to stand in front of a voting location and try to get last minute votes? Someone from the democratic state representative campaign for ZJ Hafeez was doing just that when I went to vote yesterday. He was standing right in front of the doors. I could be wrong, but I thought that wasn’t allowed.

      …and Who said the post election night Nov.2010-Jan.2011 “LAME DUCK” session would be meek for fear of retribution in 2012?
