California Bans Open Carry of Handguns

California became the fifth state to prohibit openly carrying handguns in public after Gov. Jerry Brown announced Monday that he had signed the ban into law late Sunday night amid heavy opposition from gun enthusiasts.
AB144 by state Assemblyman Anthony Portantino, D-Pasadena, makes it a misdemeanor to carry an exposed and unloaded gun in public or in vehicles, with violators facing up to a year in prison or a potential fine of $1,000 when the law takes effect on Jan 1.
The bill exempts hunting and shooting events and does not apply to those who are given permits to carry a concealed weapon by law enforcement authorities. The Blaze reported in early September on the bill’s passage in the California State Senate.
Portantino said the bill is an opportunity to prevent tragedy before it happens.
“It’s not if somebody is going be shot, it’s when somebody is going to be shot,” he said. “We have the opportunity to avoid that, and that’s why this is so critical.”
He said law enforcement officials have been concerned about the proliferation of guns in public and the tense situations that arise when someone sees another person carrying a firearm in public. He said the encounters can escalate quickly because others don’t know whether the gun is loaded or unloaded.
“Main Street California is not the Old West, and you don’t need a gun to buy a cheeseburger,” Portantino said. Top California law enforcement groups, including the California Police Chiefs Association and the Los Angeles Sheriff’s Department, supported the legislation.
“By prohibiting the open carry of guns, we can now take our families to the park or out to eat without the worry of getting shot by some untrained, unscreened, self-appointed vigilante,” Dallas Stout, president of the California chapters of the Brady Campaign to Prevent Gun Violence, said in a statement.
Gun owners protested the legislation in April when they began carrying unloaded handguns in public places and restaurants as a political statement in Pasadena. The Blaze previously reported on footage of an calm encounter between Oceanside Police and an open carry advocate released in November 2010:
The Brady Campaign, which sponsored the legislation, said California joins Florida, Illinois, Oklahoma and Texas as the only states to ban the open carry of handguns. It said 33 states, including Pennsylvania, Michigan, Louisiana and Colorado, do no prohibit open carry. Twelve states, including South Carolina, Tennessee, Minnesota and Massachusetts require permits for open carry.
Gun advocates and most Republican lawmakers have criticized the law, saying it targets law-abiding citizens. State Assemblyman Tim Donnelly, R-Hesperia, said Brown sent the message that he has no respect for the Constitution.
“There are risks to living in a free state, and for the governor to take away and chisel away at the Second Amendment right when he claimed to respect it, it just kind of shows his true colors,” Donnelly said.
“It’s really a form of tyranny,” he said of the ban.
In addition to the ban on open-carry handguns, the San Francisco Chronicle reports that Brown signed into law a bill that will require that the information from purchasers of long guns, such as rifles and shotguns, be retained by the state Department of Justice in the same way information about handgun purchasers is retained.
Sam Paredes, executive director of Gun Owners of California, said sheriff’s departments in most major cities in California, including Los Angeles, San Francisco and San Diego, make it difficult for citizens to get concealed carry permits.
C.D. Michel, a civil rights attorney for the National Rifle Association, said the group has a lawsuit challenging the concealed carry licensing system in San Diego. He said the federal judge in the case ruled the system wasn’t a violation of the Second Amendment because residents still had the option of unloaded open carry.
“This strengthens our lawsuit because that option has been eliminated,” he said.

I am so angry over this Im almost without words. Let me make it clear for any who dont understand what was already in place. In CA you could open carry and UNLOADED firearm, with a loaded mag on your opposite side. The legislature and Moonbeam just took that away from us…. to carry a gun that isnt even load!
Worst off with this they have made it next to impossible to get a CCW here. This wasnt the only anti-gun law put into works today by Gov Moonbeam. Along with AB 144 (Ban open carry) these were also signed:
SB 819 (DROS funds can be used by DOJ)
AB 809 (Registration of long guns, that means shotguns too)
SB 610 (Standardization of CCW application process) some claim this is a good move but Im not holding my breath.
I pray Alan Gura, attorney for DC vs Heller, can step in and help us. We are being systematically disarmed while criminals and radicals continue to gun up… oh and lets not forget the school gun free zones which are magnets for crime! Posted on October 10, 2011 at 7:53pmWell, the way open carry was legal there before the ban (you had to carry your magazine separate from the gun, which had to remain unloaded), the guns weren’t much use anyway.
What do you call that, anyway? Condition five? You’ve gotta draw your weapon, then draw your magazine, then insert the magazine (now you’re in condition three), then rack the slide, THEN you’re finally ready to use the gun.
It appears to me that California wants to kill off as many taxpayers as possible…what a dumb move.

Well from that video the officer was very nice. However as for the story itself, this is the reason if China ever calls on their debt we should just give them California. It’s already almost a completely socialist state and this just brings it one step closer to that.
There are many good people in California, but for what their government is doing those people should start to be worried about their ever expanding debt and the freedom their rights which dwindles every day.
I have been to California and I didn’t like it. From the warning signs on everything including plates, to the growing illegal immigration, their state is the first to be set up to fail. Which of course they always beg the US government for bail outs which is already in debt and is just asinine.

Posted on October 10, 2011 at 9:25pmCalifornians should know that in States like Pennsylvania, honest citizens can open carry a loaded handgun, no paperwork, no problem. We can get a carry permit, no problem. (About 7% have them.)
Do we have the mayhem in the streets? Not one single event caused by the above comes to mind, and I’ve been around for over six decades. Illicit guns, bad guys, yes. But law abiding citizens with concealed or open carry, no.
If their government is correct that this is the right thing to do, can someone explain to me how Californians became so irresponsible that they have to be treated like children? I actually feel safer in Pennsylvania.

The state constitution says the right of the people to keep and bear arms is ok, but “the legislature may regulate the wearing of same with a view toward reducing crime”. Wording never was changed from that time period. Frankly, with current CHL ( Concealed Handgun License) laws on the books, I don’t worry much about open carry here.

This is actually more of a First Amendment than a Second Amendment one. Folks that the establishment disagreed with were making a political statement they did not like.

Carrying a gun unloaded makes the carrier a target for someone who wants the gun, and the carrier is useless if a crime occurs. I always carried loaded. One night, on the way to make a bank deposit, someone followed me. He followed me even though I drove at 100 MPH plus. In my state, carrying a gun is a big crime, but I’d rather the police catch me with a gun than that guy catch me without one.

If every state had an equal share, it would be 2%, but California has nearly 8 times that. This ban JUST went into effect, yet the bans on “large” magazines have been banned, removable magazines, pistol grips, muzzle brakes, folding/telescoping stocks, etc. The next state below California is Illinois (Department of Justice [BJS], 2011). Also gun crime is a CRIME, which is already illegal, yet that lil‘ ole’ law on the books didn’t stop them did it? California is also a “may-issue” state, that is you cannot conceal carry a weapon unless you’re a “morally upstanding citizen with a reason to carry (i.e. security guard)”. The judge, the cops. Since they‘re the ones who don’t want guns, how many CCW permits do you think they issued in 2010? 718. That seems like a lot, but there were 12,050 applications submitted (CLEO, 2011). That’s a 6% issue! You’d be better playing the lottery.

I carried concealed for years prior to finally getting a legal permit in my home state (a shall issue state, of course), and when I visit Kalifornia, I still carry whether legal or not!

The only solution for CA in this and other cases is for people to move to “free states” until it is bled dry enough to allow law abiding, freedom loving folks back from VA, Texas and the like.

If we look at the latest report from 2009, we find the following information on CHL holders (Legal Gun Carriers):
Total Convictions in Texas – 65,561
Convictions of CHL Holders – 101
CHL Holder Percentage of Total Convictions – 0.1541%
Of all demographic segments of the Texas population measured each year, CHL (Legal Gun Carriers) have the lowest crime rate Per Capita.

The reasoning from Democrats is absurd. I tried to apply for a concealed carry years ago and when I called to ask questions I was pretty much told “most law enforcemnt shootings are from off duty cops, so even they don’t have a right to carry concealed”…..It wouldn‘t be so bad if California wasn’t spending money like heron addicts and will EXPECT the Federal Government (the other 49 states) to bail their azzes out!!!!
