Can the ‘Indefinite Detention’ Bill Send Americans to Military Prison Without Trial?

U.S. Citizens suspected of terrorism and caught on U.S. soil forfeit their rights to due process and the presumption of innocence underlying the Constitution.
That appears to be the current position of the Senate, according to many legal analysts and some in Congress, unless President Obama vetoes the National Defense Authorization Act (NDAA) passed on Tuesday.
Two provisions that have survived heated debate in the massive NDAA, also called Senate Bill 1867, are causing these concerns. Once the House and Senate bills are reconciled, they will head to the President’s desk to be signed into law, or struck down with the veto pen.
The NDAA bill, which passed 97-3 in the Senate, would fund a huge swathe of military operations for 2012. But tucked into the bill are provisions dealing with detention of terrorism suspects that cut deeply into the Constitutionally-guaranteed rights of U.S. citizens in the post-9/11 era. Now referred to by some as the “indefinite detention bill,” it has caused a firestorm of controversy from disparate corners of government and American society.
The controversial components of the bill can be broken down into two parts. The first questionable portion of the bill (section 1031) explicitly exempts U.S. citizens, and according to Slate, states that the government would be mandated to place into military custody:
“any suspected member of Al Qaeda or one of its allies connected to a plot against the United States or its allies.. [and] would otherwise extend to arrests on United States soil. The executive branch could issue a waiver and keep such a prisoner in the civilian system.”
The second provision (section 1032), however, does not include an exemption for U.S. citizens, and would give the government “the legal authority to keep people suspected of terrorism in military custody, indefinitely and without trial.”
Outside of Congress, there has been widespread outrage that due process rights of U.S. citizens and the presumption of innocence before trial could become official casualties of “the war on terror.” The bipartisan eruption at the language in the bill, according to the Hill, is so severe and sweeping that even:
“The Obama administration has threatened to veto the Pentagon policy bill because it argues that the legislation places burdensome restrictions on federal law enforcement. [FBI Director] Mueller, Defense Secretary Leon Panetta and Director of National Intelligence James Clapper all publicly opposed the provisions in the Senate bill last month before it passed.”
On top of that, libertarian and Tea Party favorite Rand Paul has come out strongly against the bill, and even protestors of Occupy Wall Street and the Hacker collective known as “Anonymous” have expressed outrage under the assumption the NDAA could be used against them.

The President, on the other hand, explained that his opposition to the bill comes from his fear that it could constrain his executive authority to deal with terrorists, which as Commander-in-Chief, currently allows him to determine whether a civilian or military trial will be held.
But the language in the NDAA would take that discretion out of the Executive’s hands, and does appear to open the door to indefinite military detention of anyone suspected by the U.S. government of being a member of Al Qaeda, the Taliban, its affiliates, or assisting any of those groups, until the end of hostilities.
As Senator Paul stated, the likely timeframe covered by this bill may threaten due process even more than previous suspensions of Constitutional protections (such as Lincoln’s suspension of habeus corpus during the Civil War) because the country is engaged in a decade-long war that is unlikely to end at any point soon.
If the NDAA is allowed to eliminate a Constitutional right as part of the “war on terror,” it may never be returned as the struggle against extremism will be a never-ending battle.
To placate critics of the bill, Senator Diane Feinstein added an Amendment to the NDAA that leaves it even more open-ended. The Feinstein amendment, according to the Lawfare blog:
“Offered a fall-back… altering section 1031 so as to say that it should not be construed as taking a position on the US citizen question one way or the other. That amendment was adopted…the sponsors can read Hamdi [v. Rumsfeld] and other authorities broadly, and opponents can read it more narrowly, and this bill does not endorse either side’s interpretation, but leaves it to the courts to decide.”
So even with the Feinstein Amendment, there appears to be much left undecided. When the next terrorist attack occurs, if a U.S. citizen is captured on U.S. soil, the courts will have to revisit this problem and issue an entirely new ruling. But if the NDAA is passed as is, the right to due process will have been overridden by Washington’s stated desire to fight terrorism.
As the federal government struggles to balance liberty and security in an era of grave and asymmetric terrorist threats, many Americans are forced to consider the question:
Has the “war on terror” finally put one tear too many in the Constitution?

Posted on December 8, 2011 at 5:46pmUnderstand one thing. There was a bill passed in 2006 (Santorum voted for it) It was also a ‘defense’ bill. In that bill, which they passed, it took away the Geneva Convention rights of ‘terrorists.’
For those who were saying “You guys should stop with the tin-foil hats” whenever FEMA camps were mentioned. Do you really think they don’t exist now? How about the fact that KBR is advertising for contractors to man it and supply it with food, medical, sanitation, laundry, etc, saying the winner needs to be able to fulfill their contract at a moments notice.
Remember how you all cheered whenever the police went after the OWS people? Well, now they are going to come for YOU. It is being taught (a question on a test for poilice, or is it military.. I’ll have to look that up again) that ‘protesting’ is a form of ‘minor terrorism.’
It’s sad to see this country coming down to this, but we spent too much time pointing the finger of blame at each other and not at the real culprits. They divided us, turned us against each other, blinded us with bread and circus, then slipped behind us to hamstring the Constitution and the people of this once great country.
Michelle said it was the first time she was ever really proud of her country? Well, this is the first time I’ve ever been ashamed of it!

We all know, only too well, that government has no problem killing its own citizens. As was very horrifically demonstrated by B.J.Clinton and his “Attorney General”, head of the “justice” department, J.Reno, at both Ruby Ridge Idaho and at the Branch Davidians compound in Waco Texas.
Frankly, if you think this ‘is’ America, you are mistaken. Actions speak louder than words. And there isn’t a single act by government that demonstrates that assumption.

US Army food is different than Chinese Army food. Russian army food is different than Chinese Army food. Knowing that US military people may not follow orders to arrest American for nothing, Obama could rely on foreign troops. Dress them up in US Army Uniforms and who will notice?

Most people have, at most, 3-4 days worth of food in their homes. People panic these days when they see a storm coming and run to the store to “stock-up” on food (usually junk and a gallon of milk). Gingrich – at CNN National Security debate Nov 2011 said he would extend the Patriot Act “and build an honest understanding that all of us will be in danger for the rest of our lives.” He also said he is looking to STRENGTHEN IT!
In 2007, Newt said he wants to “establish a nationwide ID card with biometrics so you can actually track everybody in the country.”
It is apparent Gingrich is preparing for eternal war.
Romney, Santorum both support Patriot Act.
Perry said that it was “unprincipled” for Republicans to vote in favor of creating the Department of Homeland Security. Said Patriot Act needs strengthening.
Ron Paul would abolish TSA and leave airport security to the airports, would not sign an extension of the Patriot Act and has ALWAYS voted against it, voted AGAINST the creation of the Dept of Homeland Security, voted AGAINST the Military Commissions Act, and, though I can’t find any commemt about the NDAA, I‘m sure he’s just as against it as his son is.

then he said the ACLU analysis was that the military would be used against Americans.
But since, because of political correctness, he can’t agree with anything the ACLU says he said it was the department of justice that would be going after the citizenry.
As if a bunch of US assistant attorneys would be out on the streets swinging their briefcases at bad guys.
So now he has flip flopped.

Here’s the text: Section 3 -Defines an “unlawful enemy combatant” as a person who has: (1) engaged in or supported hostilities against the United States or its co-belligerents who is not a lawful enemy combatant; or (2) been determined to be an unlawful enemy combatant by a Combatant Status Review Tribunal or other tribunal established under the authority of the President or the Secretary of Defense (Secretary). Defines a “lawful enemy combatant” as a person who is a member of: (1) the regular forces of a State party engaged in hostilities against the United States; (2) a militia, volunteer corps, or organized resistance movement belonging to a State party engaged in such hostilities, which are under responsible command, wear a fixed distinctive sign recognizable at a distance, carry their arms openly, and abide by the law of war; or (3) a regular armed force who professes allegiance to a government engaged in such hostilities, but not recognized by the United States…….Prohibits a combatant subject to trial by commission from invoking the Geneva Conventions as a source of rights.
Trouble is, they want to treat a person like they are military “War on Terror” using military commission yet they cannot invoke the GC as rights.

This does not sound as if GBs rocket gets off the pad, its more of a manmade attempt at doing so. I’m truly troubled by those who really believe in their manmade works. Theres no difference in them and their counterparts the progressives, socialists, marxists, Utopians, Greenies, Lefties, Liberals, Demigods, etc.
The path to destruction my friends is wide and many will go there, the path to salvation is narrow and FEW find it. There is an inner reality at work here and most are missing it for the manmade one. If lets say 80% of the country is lost and I believe it is, then how does 20% turn it around? Lets say we do! Does that put off what the book of revelations says will happen? No it does not. If you believe in God as I do then you must accept his word as the ultimate truth and none can compare…thats NONE can Compare. We can minister to those who will accept the Lord and thats the best we can do. God does not implore us to conquer the world because he knows the world is already rejecting him like it did Jesus. You can no more say Just do Quality than you can say just do Love. Period.

Section 1032 of Senate Bill S.1867 most certainly does have an exemption to military detention for Citizens of the United States…as well as Legal Resident Aliens.
Our Community Organizer O‘Bomber doesn’t want this legislation because he wants to continue to read American Constitutional Rights to terrorists captured on the battlefield…and hold them…and try them in US Criminal Courts.

Why would Republicans block bills to create jobs, improve and repair US infrastructure, give tax breaks to average American citizens (via the payroll tax cut, and eliminating the Bush tax cuts for billionaires), and yet vote in favor of bestiality and indefinite detention of US citizens?
That’s weird. Republicans in the legislature have the votes to stop any bill at all with a filibuster, yet they are voting for bestiality and FEMA camp detention of anyone they “say” is affiliated with terrorists, eliminating due process.
Why do ya reckon Republicans are blocking every other initiative by the President, including tax cuts for average Americans and helping the disadvantaged, but voting for this one? Hmmm. Is this what their constituency wants?

I am convinced that the next step is the appointment of a committee to screen the population for traitorous acts. You will be encouraged to report your neighbors. Does it remind anyone of Nazi Germany in the 30′s? Now you can be reported by E-Mail so it will be twice as fast for you to be reported and arrested.
We can only arm ourselves doe the coming conflict and pray that our military and National Guard will ignore and illegal orders coming from the Federal Government. They must remember that they swore to support an uphold the constition, not some communist in the White House.

It included the question would they fire on American citizens if asked to. He said he could not answer that question, laid down his gun and fell in behind the formation. Every single enlisted person followed suit, leaving only the officers. One of the officers got chest pains from screaming about courts martials. I think our military would refuse to detain just anyone.

I’m not really a fan of the facial identity mask because it reminded me of the Palestinian cowards that throw cocktail grenades, but then again I’m not the one standing on that street corner dealing with the collective ignorant masses either.
Like you, I buy ammo constantly and I’m trying to prepare for the day when someone comes to my home and tries to relieve me of my weapon.

We both agreed that we have sworn to defend the constitution from enemies foriegn and domestic. Honestly though I think this is a trick. They put an outrageous bill before Obama and he vetoes it proving to America that he’s looking out for our best intrest. However, if this somehow comes into law many former and current military/law enforcement have a decision to make. To uphold our sworn oath would mean to take up arms against the United States. To act with arms would mean harming our own. To not act would be to serve up our children and neighbors to mouths of oppression and slavery.

It is time for those of us who stood by and allowed the Patriot Act to be enacted because it went after those“evil terrorists”, to rethink trading freedom for security. Americans did the same crap in WW2 when good Japaneses and German citizens were rounded up, no one said boo! Old Abe in the Civil war, same crap!
As bad as things may look at times, remember, conservatism is winning, slowly. We have had setbacks like GW Bush, but overall gains are being made. People are opening their eyes to the failures of liberalism and Big Government policies. Look back to the sixties When Johnson implemented most of the programs that have done so much damage; war on poverty, banning prayer in schools, school busing, medicaid, etc; Democrats had 70 plus votes in the Senate, a 3 to 1 ratio in the House, 3/4 of State Governors. The GOP and conservatives were powerless to do anything! They do not have that stranglehold anymore. Sure there have been big setbacks and sellouts, but overall things look better, stay the course.
Now is the time to really vet our candidates and hold their feet to the fire! Tea Party principles and true Constitutional conservatism can save the day! Get involved in the process, if “they” demoralize us they will win for sure…. but keep your powder dry and reserve all options.

Nobody has fired any shots; this president and most elected officials are in danger of losing their overpaid, underworked jobs. All we really have to do is fight the “soft” war—with emails, phone calls, blogs, and, ultimately, votes. Don’t put yourself on a list that will result in you or your family being carted off to Gitmo in the middle of the night. Even if this passes into law, I doubt there’ll be any political will to use it, and the next set of apparatchiks elected to office will likely have the good sense to repeal it. Top down, bottom up. We will need to remove the legitimacy of the local police forces so that a federal police force can step in. Think of what happened in Egypt. Within the marches we will have individuals trained in subversive agitation techniques. They will agitate law enforcement just enough to chide local police forces to use violent, quite possibly deadly in a few cases, force. We will need this to be reported by the media as one of two things: either a failure or inadequacy of the local police forces, or corrupt (racist, bigoted, “macho”, inferiority complexed) members of local police enforcement. The agitators will do their job until a federal police rule (national guard, FEMA, military) comes in to stabilize the situation, and by then most of the populace will be welcoming them as it would bring some “normalcy” back.
This article just explains the prototype by which we can have laws and judgement already in place so that a legal precedent can be followed.

All we need is 33.
33% that support the cause. This doesn’t have to be 33% of us in the streets, just 33% that support the cause. We need just 1% of us to actually take to the streets. Once the local police beat us down because of our agitations, it will be all over the news. Now mind you, what we will twitter and upload will be of no agitating protesters/marchers. Once the local law enforcement boot is smacked down on our heads, public perception enlarge will be that we were unjustly treated. This publicity will get 5 times the numbers in the streets and the agitators will trumpet up the chiding. Local law enforcement will not be able to handle the situation. ATMs, train stations, major intercections, airports, bus stops, restaurants, hotels and every other place of commercialism and capitalism will be brought closed. If you think we don’t have 1% to start it, just look at our unions and neighborhood outreach marches. We have the 1% already. We just need an excuse now to get 1% of our marchers out in mass nationwide. A summer of high food prices, high energy costs, and high inner city unemployment rates will do that for us.

The list goes on. They claim “It could have been much worse, but we were able to blunt the attack — you’re lucky we were there.” But that tactic does not hold water.
FEAR THE CONSOLIDATION OF THE GUN MANUFACTURE IN THIS NATION.

However, if they are caught in a foreign country and a U.S. citizen, then that country determines where they are tried or the U.S. negotiates for them. If a U.S. citizen is caught where we are in armed conflict, then the U.S. military has jurisdiction.

Congress has to pass any act of military force, period; whether it is a declaration of war or a letter of Marquee or Reprisal. Even non-citizens have the right to due process according to our constitution, it is why we do not assassinate (not supposed to). Read the 5th amendment it says “persons” not “citizens”.
In a declared battlefield, with a said enemy we can use force. The battlefield is not the world and anyone we see as “suspect” is not an enemy, plus it has not been declared. Until now.
