Canadian Mother Strangles Newborn, Gets No Jail Time and Judge Defends Infanticide By Comparing It to Abortion

In citing Canada’s abortion laws, an Edmonton appeal court ruled that an Alberta woman who strangled her son with her underwear after secretly giving birth in 2005, will face no guaranteed jail time.
Katrina Effert was sentenced Friday for killing her newborn and then throwing the body over a fence into the neighbor’s yard on April 13, 2005, when she was 19. She was given a three-year suspended sentence by Judge Joanne Veit wherein if she abides by the court’s conditions for the next three years, she will not spend time behind bars. CBC notes the justification given by the judge for such an astounding sentence:
“The fact that Canada has no abortion laws reflects that ‘while many Canadians undoubtedly view abortion as a less than ideal solution to unprotected sex and unwanted pregnancy, they generally understand, accept and sympathize with the onerous demands pregnancy and childrbirth exact from mothers, especially mothers without support,’ she writes.
The judge noted that infanticide laws and sentencing guidelines were not altered when the government made many changes to the Criminal Code in 2005, which she says shows that Canadians view the law as a ‘fair compromise of all the interests involved.’
‘Naturally, Canadians are grieved by an infant’s death, especially at the hands of the infant’s mother, but Canadians also grieve for the mother.”
The judge also rejected arguments that the single father and the grandparent also face “the same stresses of the mind” as a mother who kills her own baby.
Effert’s Defense Lawyer Peter Royal said it was “unjust” and “almost mean” to incarcerate her for the 16 days of jail time she must still serve for throwing her son’s body over a fence.
The Edmonton Journal reports that when questioned by police, Effert initially told them she was a virgin and later said she had given the newborn to her boyfriend. Her defense argued that those actions were evidence that Effert had a disturbed state of mind, which the judge argues validates infanticide being that she was disturbed at the time she killed her child.
In Canada, infanticide, is a lesser crime than homicide. The Criminal Code of Canada classifies infanticide as:
“A female person commits infanticide when by a wilful act or omission she causes the death of her newly-born child, if at the time of the act or omission she is not fully recovered from the effects of giving birth to the child and by reason thereof or of the effect of lactation consequent on the birth of the child her mind is then disturbed”
Punishment for a mother killing their newborn?
“Every female person who commits infanticide is guilty of an indictable offence and liable to imprisonment for a term not exceeding five years.”
Effert has been defending her actions in court for six years. Two years ago, for the second time, a jury found Effert guilty of second-degree murder, but last May the province’s highest court decided the jury made a mistake. According to the CBC, the Alberta Court of Appeal overturned the conviction, replacing it with the lesser one of infanticide.
The appeal court said Effert should have been given the benefit of the doubt based on psychiatric evidence.
The Crown, the federal prosecutor, has sought leave to appeal the case to the Supreme Court of Canada.
When leaving the court Friday Effert covered her face to cameras.

What are we going to do about it? How do we change it? Posting on a website is not going to get it done. The challenge is for all who believe these judges should be removed is how to effect that proposition. Now is the time to stand up. If you don’t in a real way….just keep posting and hope for the best…..Not being confrontational…trying to get myself included into being a person of action. Perhaps this is a start for many of us. Except they couldn’t kill the infant they would either take it to the highest wall in the village so its screams could not be heard and it would starve to death. In other cultures they would take the infant into the Forrest and let the beasts devour the child while it was still alive..
Now we’ve become more civilized. We strangle the child and throw it over the neighbors fences or in some states actually stick a needle in the head past the skull while he/she is still alive in the womb. and suck his/hers brains out thru a long plastic tube which will kill her/him and the skull will collapse the dead baby will come thru the birth canal and then the cord is snipped and thrown in a bag.

A baby who knew nothing else except it‘s instinctual need to cling to a mother at that early time of life for it’s nurturing, it‘s comfort and it’s needs is dead, murdered in the most callous and cold-blooded manner imaginable by it‘s own mother and thrown over the fence onto a neighbour’s property…and apparently it’s “almost mean” to hold this disgusting little woman responsible. Killing her baby and discarding it like it was a dead duckling or small animal is hard to swallow. I understand, with Canadian laws, how this occurred, but I do not approve of the mother’s state of mind. I feel there might be some mental defect behind it all, and not just the fear of facing the economic and emotional responsibilities of raising a child.
A woman, a while back, informed me that her eight-month-old prematurely born daughter was not a natural preemie. Apparently, she forced a knitting needle up her uterus in order to abort the fetus. The baby survived the ordeal, oddly enough, and is now in her forties. Because I could not handle her confession, I no longer associate with this woman.
I feel life is precious!
I am also an illegitimate child who was abandoned as a baby by my biological mother. I am very grateful she did not kill me!!!

Apparently, the lower courts did not agree with the defense but the upper courts eventually overturned the initial verdict and showed leniency. Post pardum depression is not a liberal concoction, it is an affliction proven by science. You can argue the merits of this defense and how it was applied in this particular case but the defense, generally, is legitimate.

If courts and legislatures decide that it should negate some portion of the culpability from the actor, then that is how it goes. I didn’t make up the affliction or the defense, I don’t run Canada or this country and my little nickname is not something you should dismiss until you attempt a critical thought…that does not mean that you merely criticize.

What are we going to do about it? How do we change it? Posting on a website is not going to get it done. The challenge is for all who believe these judges should be removed is how to effect that proposition. Now is the time to stand up. Each criminal pushing the limits a bit farther. “Well Ms Doe wasn’t charged when her baby was 24 hours old, my client’s baby was just 72 hours old.” Where do we draw the line?
DON’T for a minute think that the is NOT precisely the progressive game plan. Pushing an inch farther each time, and eventually getting their goal.
Every time we compromise our values just a little bit, they WIN and society loses. Next time they push for another inch. The time after that it’s another inch.

While on the whole, Canada’s policies are more socially liberal than the US, we’ve done better in the past 3 years thanks to our CONSERVATIVE prime minister. Our students score higher in standarized tests than yours, our unemployment rate is almost 2% lower and we have a lower percentage of people living below the poverty line.

If the father or his family didn’t want to take care of the child, there are so many couples in the world that would have gladly taken that child. In my opinion, the judge, the attorney and the woman are the epitome of evil and mentally defective humans. This was outright murder…no different than if she had strangled the child’s father. What a disturbing and horrible world this has become.
