Caught on Video: Calif. Cops Open Fire on Vandal Outside Carl’s Jr. Restaurant

He was wielding a metal bar that almost appeared to be an ice ax and tearing up a restaurant. And when cops told him to drop it, he refused. That’s when the shots rang out.
“He” is a vandal. And it all went down on Monday outside a Carl’s Jr. in Monterey Park, CA. And we know about it because bystanders caught it all on video and posted it to YouTube.
KTLA-TV reports on the incident that left the assailant dead, even after being tasered:
The shooting happened about 9:30 a.m. at Carl’s Jr. restaurant near the intersection of Cesar Chavez Boulevard and Atlantic Avenue.
Officers responded to a report that a man was breaking windows at the restaurant.
When the officers arrived, they saw people running out of the restaurant, according to a news release issued by the Los Angeles County Sheriff’s Department.
A man walked out of the restaurant holding a three-foot-long metal bar, police said.
Officers ordered the man to drop the bar and he refused. One of the officers shocked the man with a Taser, to little effect.
The man then came toward the officers and swung the bar twice, according to the news release.
That’s when the officers shot the man.
One officers shot the man five times, and a second officer shot the man five more times after he fell to the pavement.
Paramedics rushed him to a hospital, where he was later pronounced dead.
However, despite the department’s claims, the video doesn’t appear to show the man swinging the bar at the officers. Still, that doesn‘t mean he wasn’t threatening them. You can see for yourself, but again there are graphic images and language:
The shooting is now under investigation. Another woman was injured in the incident, according to KTLA. She was reportedly hurt by shattering glass from a stray bullet.

They want to see more and more, you can hear it in their voices. Our society is sick and full of voyuers! As for the kid, he threw his life away for no good reason, nothing he was going threw was worth his life being tossed away like this. I am sure we will hear about what made this kid mad enough to tear up the restuarant….maybe he worked there and got fired, maybe he didn’t like the way staff treated his order?

You could provide a one of the stories cops are told during training where some cop facing a nut with a weapon tried to be understanding and now his kids are taking donations from other cops to pay for college since daddy got killed trying to play footsies with an armed nutcase.

Strange how no one was hurt until the cops opened fire and a stray bullet shattered glass, striking a woman.

No other cop could have popped him again with two tasers? Where was the pepper spray? I know it happend so fast, but, swinging a metal bar deserves 10 shots point blank? Many Lives are destroyed now because of this unprofessional mishandling (the suspect, the cop, both families). Why couldnt they have whooped his @ss wtih a nightstick?

What’s the point in spending all that money on training and non-lethal equipment if it’s not going to be used? Biggest issue I have – They had a K-9 unit there. The guy had a hold of the dog. What is the dog there for? It’s not a freaking pet!
One guy is dead and others could easily have been killed or wounded because of the trigger happy L.A. police. Nothing new there.

Today, kids have Call of Duty MW3, Grand Theft Auto, and Lil Wayne/Young Jeezy. Im a fan of MW3, but little kids shouldnt be allowed to play “M” rated games and listen to adult music, thats a parental thing. But you cant fully escape it, today even Nickeloden and Disney ALL have adult themes within their entertainment. Its all apart of the plan for a “Brave New World.”

Also just recently a skinny teenage girl took police on a 10mi wild goose chase. At least 10 cops jumped on her for arrest, when she finally pulled over. Across NC, we‘ve had at least 7 instances of ’gunman on campuses’ since November. Some cops are good and some do want to help, the unnesscary excessive force is one reason why cops get a bad rep. Another reason is that some are power-tripping above the law adrenaline jockeys. They’re on the front lines infringing our God given rights, ironically, they’re also the ones who are suppose to protect our civil liberties. SMH

Posted on January 25, 2012 at 12:41pmTo those that don’t get it – You’ve obviously never been around a training session for K-9 units. This is EXACTLY the type of situation that K-9 units are intended to handle. The dogs are trained to go after the arm that the perpetrator is wielding a weapon with. They spend hours and hours and hours with these dogs teaching them how to take down a perpetrator properly, and even how hard to bite down depending on the command. K-9 units happen to cost a LOT of money. When they aren’t used in a situation like this when they are right there, and when the alternative course of action leaves a dead person, another injured, and potential multiple lawsuits against the police… Yeah, that’s a pretty big freaking mistake.
Second guessing? You’re da** right I’m second guessing. Since when did scrutinizing events become inherently bad? There’s no room for criticism here? Get a grip.
I can’t stand idiots that bash the police no matter what they do. But, just as bad are the idiots that defend the police no matter what they do. This is an individual case that reflects a long history in the L.A. police. They’re trigger happy and they make far too many mistakes. The officers that opened fire on this guy are not criminals. The guy that was shot was the criminal. However, the police in this video screwed up royally. They did a poor job from beginning to end.

I doubt a second tasering would have had any effect either. As far as using a baton, the problem there is getting close enough to use it. That axe looking thing he was swinging had a pretty long reach. I wouldn’t expect anyone to expose themselves to potentially lethal injury I get that close. This gy was high, suicidal or both.

Posted on January 25, 2012 at 1:19pmi am realy sorry on this one…. i normaly side with the police…. this to me just looked like trigger happy officers. thier jobs should be to try and save lives! 10 shots?? dispicable. i work as a bouncer at a biker bar that at times gets a little rough to say the least, to myself and other bouncers that i work with we deal with worse than that with alot more tolerance than i saw in this video, all we are allowed to use is our hands (skin) arent these officers trained to thwart off a pysical attack? i am not impressed at all. the “officers” made themselves out to look like blood thirsty power mongers, and weaklings at that. maybe its just lazyness, i mean it is far easier to just blow five holes in someone than wrestle him to the ground and subdue him. and the officer that put 5 more in him while he was down should be thrown in prison! wonder why some people are seeing the police in general as just another tool of the“state” puts a nice public face out there for the rest of those who are really actually trying “to serve and protect” haha. nice job.

It wasn’t until politicians, concerned about the expenditures to train the dogs, granted protection status of a police officer (understandably backed by the dogs handlers) to the dogs above the unalienable right to life of a perp. If said perp attempted self-preservation against an animal attack (which is an instinctual reaction of any human being), the charge can range anywhere from assaulting a police officer to attempted murder. In addition, news videos of K9′s effectively being used in the field to defuse a volatile situation have been called into question from time to time, do to the apparent “viciousness” of the takedown. The end result being that the human counterpart of the team becomes disinclined to endanger their partner. In which case I argue, get rid of the K9 unit, save money, and shot to kill anyone perpetrating public disturbances of any kind, because to do so forfeits their unalienable right to life.

Third, he showed intent to harm an officer with a deadly weapon.
Fourth. Look up the Tueller drill. The guy was closer then 21 feet and could have killed the officers or anyone else nearby in less then 2 seconds.
So YES, the shooting was well justified.

The officer with the dog fears for his buddy and determines his bullets are faster than his dog. Watch the video, you will see all shots were fired while the threat was standing and percieved as dangerous; the officers stop when they feel safe. Thank you officers for adhering to the force continuum and risking yourselves in others stead.

We had an unarmed guy in my state who had ten cops empty their clips into him, 32 rounds in his corpse, and for what…? He was freaked out on drugs and didn’t “obey”. Or the guy in NYC who was basically machine-gunned by multiple cops using him for target practice. He was armed with… a cigarett lighter! These cops are not the people who would support or defend the Constitution. The victim should have been given an opportunity to calm down and realize what his situation was. At the very least they could have released the dog. One attempt with a taser shouldn’t be the last non lethal attempt to resolve that situation. And when a guy is walking towards you with a club, why not put a couple of rounds in his legs to see if that makes him rethink things? With a semi auto, it isn‘t like you can’t follow up in a hurry if needed. And on a call like that, shouldn’t it be procedure to come out of your unit with a shotgun and bean bag ammo? Having almost had my brains blown out by a twitchy cop many years ago who subsequently killed two more unarmed men on two separate occasions years later, I know that they are not infallible. That cop was found ‘justified’ first for shooting a sleeping man in his car and after being fired from that job, became a constable and killed another man who came to his door with a butter knife in one hand and a piece of toast in the other. He got fired again— don’t know where he is now. Didn’t recognize him in the video.

It looked exactly like my long handled paint roller with a fiberglass handle. He didn’t swing it at the cop, though he did act like he was warning the cop to back off. The cops could have easily kept their distance and waited for the guy to calm down. He didn’t run at them, they came towards him. What passes for justified is ridiculous. I was nearly shot by a twitchy cop for doing exactly what his partner told me to do– reached into my glove compartment for insurance proof. I have little doubt he would have shot me if his partner hadn’t intervened at that split second. I know his partner thought so,too. He was as shaken up and pissed off as I was. Two months later that cop shot a sleeping man in a car because he said the guy rolled over and his hand went towards the floor board. Justified! He got ‘released’. Went to the next county and became a constable. Two years later, he shoots a guy that came to his door carrying a butter knife in one hand and a piece of toast in the other. Justified! It’s all rah rah and attaboy until some twitchy coward with a badge and a gun shoots you or yours.

Posted on January 25, 2012 at 7:38pmThe first cop was fully justified in shooting. The criminal was pepper sprayed in the face and proceeded to swing his weapon (pick axe or similar) at the officer with no gun. He used necessary force defend his partner.
The second cop who pepper sprayed him probably did not need to shoot him 5 more times after the first cop shot him 5 times. That was a little excessive.
That being said you can not kill some one twice. So it did not matter if he shot him or not. ;)

Do you know what will happen if you point a toy gun at an officer? I imagine you and others would be just as upset as you are on this issue. We would probably have to hear something like, the cops weren’t in danger, it was only a toy. If they would have assumed it was fake when he pointed it at them, maybe the perp would still be alive.
If the guy wasn‘t breaking the law he wouldn’t have given himself the chance to get shot.

In most States where I have lived it’s illegal to “shoot to wound”. Imagine shooting someone in the leg to stop them; only to be arrested for not shooting to kill? On the contrary, we should watch very carefully. Cops should be held accountable for their actions, not given free reign to shoot who they please.
Clearly, he did not “swing at them twice.” I assume they said that before they realized they had been recorded. That shows you a dangerous mentality – “I can shoot without discretion, then simply say I was threatened later.”
This was clearly handled poorly. Our officers should be able to resolve a situation like that without resorting to deadly force. The officer who shot first may have been justified in shooting, to prevent harm to his partner, even though they put themselves in that position. The officer who shot him five more times in the back went way overboard and shouldn’t be wielding a gun and police authority at the same time.

Don’t get me wrong, the guy is at fault and the cops were justified in using force, but 10 bullets to stop a guy with a stick? The cops had a dog, likely nightsticks, tasers, pepper spray and body armor. He had a pick axe or something similar. A little restraint is warranted. I’m a defender of cops and support them in many ways, but this was over the top. The man clearly stepped toward the cop and raised his weapon, but one bullet clearly would have pushed him back and if it didn’t stop hiim, more could have been used. 10 shots!?! I realize adrenaline kicks in and they have little time to react, but isn’t that what training is for? And if the first cop shooting five rounds in 3 seconds wasn’t enough, the second cop opens fire. What danger was he in? The guy fell to the ground. I’m just appalled. There, that’s the right word. Appalled.

You my friend are mistaken. No police force in the nation teaches street cops to shoot people in the leg. Googl up some police targets that have scored points for leg shots on me. Military and police targets all give highest points for center mass and head shots. Cops do not intend to wound people. A center mass leg shot can also be one of the most lethal if you hit the femoral artery. Iraqi snipers were taking femoral shots because of the effectiveness of our body armor.
No street cops are trained to wound. If they shoot you, they are trying to take you out of the fight instantly.

What is clear in the grainy video is he reared back to swing and logical people see it as justified. So in the end you can get as upset as you want. You don’t even have to shut up about it. If the suspect had a gun out, I would sympathize a little more with their decision, but given the weapon and the distance maintained (not to mention he was totally outnumbered, 4+ cops with guns drawn and a dog) I think this was blatant overkill (no pun intended).
Yes, this is not TV, but these are experienced and trained officers who should know how to handle a situation like this by means OTHER than riddling him with bullets, even after he is down.

I was under the impression that one of the jobs of police dogs is to subdue criminals while minimizing danger to officers. All he needed to do was let go of the dog’s collar and problem solved. The only thing left for us to do is weight the difference in cost for imprisoning someone versus potential wrongful death law-suits and/or settlements.

Are you willing to get a broken arm, ribs, head or dead? I’m not getting a career ending injury trying to arrest someone swinging a metal bar at me. Same goes for the police dog. They take thousands or dollars and months to train. They are not a disposable resource. Do you really thing a dog would not be hurt getting hit with the same pole? They did pepper spray him. Big deal, it stings. It only deters unwilling subjects. If you are focused, it’s easy to fight through it. Tasers require TWO good probe hits to work. The guy was wearing a thick jacket. Must not have been good hits. They are less lethal weapons, not Buck Rogers ray guns. Sometimes they don’t work. Clearly the guy went after the cop. All bets are off at that point. No more pepper spray, no more Taser. Now you do what you have to to ensure you go home in one piece at the end of your shift.

I love to watch civilians go through FATS training. They always get killed or end up killing an innocent, yet these same people criticize us when we do what we are trained to do. I realize they are (and properly so) viewed as actual officers and they worry for their safety, especially with a guy with a metal pole in his hands…but human life must come first.
I have no problem with the shooting (other than the dog not being deployed) because he did rear back the pole and hop towards the officer as if he was getting ready to put his full weight behind the swing.
If two armed bystanders had done this, would they be in trouble. Probably…the man did not appear to be more than a vandal until police tried to apprehend him. Civilians would have been told to leave him alone and wait for the police since he was no danger to anyone. If they tried a citizens arrest and had to shoot as the officers did…they would have been fried.
You pull your weapon to protect life…not windows. Having to protect your life with deadly force because you inserted yourself into the situation will not fly.

The first cop had every right and the responsibility to stop the threat with deadly force, but the second cop who decided to make sure the job was complete has a good chance of looking at prison time.

I think all law-abiding citizens should be requred to be trained in the use of a firearm and have the option of carrying it concealed. How many mass shootings would have been avoided if just a few people there were armed? As it is now, cops can’t protect us; they are only there to take pictures of victims after the fact.

Watch it again carefully.
That being said, it was pretty stupid to walk up within a few feet of the guy to try and get a taze. He’s holding an axe! It looks like they didn‘t have alot of officers there when the guy walked out so I can understand that they didn’t have alot of time to plan a containment. Still, the cops are lucky they didn’t get hurt because they were too close for comfort!

On top of that he waddled dangerously too close to the guy when he should have been staying out of range of this supposed “armed” perp. OBVIOUSLY he has NO to POOR training in how to deal with an “armed” perp.
Most of you completely ignored the second question, which is if my friend and I came upon this scene and tried to get the guy to stop and he wouldn’t, is it OK for me to unload 5 rounds into him? We’re not agents of the State, just armed citizens. If you believe it is NOT OK for citizens to use deadly force to stop window-beaking, why is it OK for cops to use same?
I truly believe if this exact same thing happened and instead of cops it was two armed citizens, the DA would be arguing that the when the perp turned and raised the ax he did it in bluff and neither citizen was close enough to the guy to have been hit anyway. Further the DA would say unless the guy actually charged there was no credible threat and deadly force was not justified. Finally the two would be portrayed as two itchy-trigger finger cowboys looking to shoot the first jaywalker they encountered. You know it—I know it.

At that range, using a standard issue 9 mm or 10 mm handgun with standard rounds, 5 shots in center massive would/ should put down/ killed the target. What I found amazing is that none of the police showed any attempt to ensure the backgrounds behind the target were clear. The additional 5 shots were overkill and an endangerment to all bystanders and the police themselves. Has no one heard of ricohets? In my opinon the first officer, needs to be retrained in proper tactical combat shooting. The second officer needs to be disarmed and taken of the street since he has demonstrated that he is a danger to himself and the citizenry. Finally, whoever is in charge of training police officers in this department should be admonished/ fired if this is the level of mayhem that is acceptable from the force. A last observation – those filming and commenting on the shooting; how detached from humanity they are. I have not seen such behavior accepted in the aftermath of combat from the combatants. What is happening to our humanity?

Posted on January 25, 2012 at 10:16amThe initial 5 rounds were justified. The 5 rounds fired while the suspect was already down was not. Had a civilian did that, he’d go to jail for a long time. If the suspect actually had some fight left in him once he hit the ground, eliminate the threat. But 5 rounds to the chest point blank range, I doubt he had any fight left in him when he hit the ground.
However, with adrenaline pumping and your life possibly in the balance, I can understand firing some extra rounds.

However, understand that I do think that the 5 well-placed shots that found their target while the joker was on the ground were uncalled for unless the guy put his hands in his pockets/behind his back, etc. and caused them to believe he was reaching for a firearm. In these situations, training kicks in but I have to say that deploying the K9 would have been much better for everyone if that would have happened vs. the 2nd round of five shots being fired. The thing to remember is this: We can all sit here comfortably this morning and make all the comments we want about how this was right/wrong, etc. but unless YOU ARE THERE, then you really dont understand all the dynamics involved in the situation.

It‘s not like tv and you just don’t know until you have been there. Police are taught to stop the threat and if the threat is still a threat than you don’t stop shooting. There are graveyards full of police who died in the line of duty that did not do this and we learned by their sacrifice. But we learned and survive these assaults by the grace of God and good training.

Once the shooting starts you keep shooting until there is no doubt the theat is over…NO doubt. Those officers probably carry 9mm pistols. They carry up to 17 rounds per clip. Three to five tounds is considered a “burst”. That gives time to re-sight, since recoil moves the sights off target after the burst. The burst also insures that you don’t have to reload after the initial engagement. Contrary to the genius who posted about training, these officers were WELL trained and that training probably saved the lives of innocent citizens.
This will probably start some hispanic riots and one of these officers will be scapegoated to pacify the illegals. THAT’s the only thing wrong with this justified police action.

This is why police officers are correctly trained to fire center mass until the threat is down, which is exactly what happened here. Look at the video again. No shots were fired after the perp was down. Should the cops have stayed further away? Probably, but there could be a dozen valid reasons why they chose not to (afraid of the perp attacking a bystander, another perp coming out the door, etc., crossfire). Should the dog have been released? In hindsight, yes. But up until the point where he made a quick motion to attack the officer, the perp was acting casual. And you people would be the same ones to claim it was police brutality sicking the dog on the poor guy doing nothing but walking around.

For those that think the cop was out of line, I put you in that situation and see if you want to deal with pepper spray, a taser, and a gun and see which you choose if your partner was close to getting hit, or if you were the one being aimed for, which you’d want your partner to use.

This is way beyond what should be acceptable use of force, but cops play the ‘protecting you from them’ card as an excuse to do anything. Sort of like all forms of government. I’ve seen it before and nearly was the victim of this type of do no wrong mentality.

It was one of those poles that they use to put up the sticky window signs at fast food restaurants. He must’ve gotten it from the dining area when a worker left it there, or went behind the counter and got it.
