Caught on Video: News Cameraman Arrested For Filming Police Chase

A videographer responsible for capturing news footage became the news on Friday, when he filmed part of his own arrest while trying to capture video of a police crime scene. But was it fair?

Phil Datz works for a third-party news outlet that tapes footage for other stations. On Friday, he was sent to capture the tail end of a police chase in Suffolk County, NY. But when he got there, one officer who claimed to be a 30-year veteran of the force wasn’t happy with his presence across the street. So he confronted Datz, telling him that Datz couldn’t film because the crime scene was “active.” A confused Datz respectfully tried to reason with the officer, but that didn’t work.

“I’ve been doing this for 30 years and there’s nothing you can hold over my head; go away” the officer who Datze refers to as “sergeant” can be heard telling Datz, who then gets in his car and moves a block away.

But that still wasn’t good enough for the officer. In Datz’s video, the cop can be seen speeding up to Datz’s new location, leaping out of his cruiser, and then telling Datz he is under arrest. Datz can be heard saying that he called the “PIO” — or public information officer — and he told him to keep filming. Then the footage stops:

Datz, who works for Stringer News Service, was arrested and charged with obstruction of governmental administration. He was finger printed and released.

According to the Long Island Press, another officer apologized to Datz at the station, but said that since the arrest had already been made, nothing could be done.

Tony Ryan, who owns Stringer, said his company is considering a lawsuit. According to him, this is the third time in the last two three years that one of his employees has gotten arrested at the scene of a crime.

    Sounds like to me these idiot cops don‘t want to be recorded abusing someone they’ve elected to arrest. It’s clear the cameraman was way out of the way…and moved a block away..(zoom lenses are nice :) ) but still comes after him…I wonder if the guy would have gone home would the cop follow him there.. I can understand if the cameraman was “in the way” but across the street????? Looks like it’s time to SUE big time!

      im for ALL cop‘s having to wear POV camera’s….it will save the tax payers $ not only with Frivolous law suits but also with evidence collection and WEEDING OUT THE BAD COPS….which there are many…..

      A NEW NATIONAL POLICE POLICY

      The police will now beat people to a pulp if they try to photo police activity. This policy must have be decided on by Department of Homeland Security. The COPs do not want any verifiable prof that they have committed a crime. It appears that two COPs at the accident were instructed to chase away anyone taking videos or watching. That reported even had a press pass but the cop still threatened him and bragged about being immune from braking any law. I seriously believe that COP would have shot the report dead if he wanted to do it.

      Maybe that reporter was a Jew. 1930s German police would act like this towards Jews. American COPs have sided with criminals and law breakers just like the German police did in the 1930s.       1st Amendment Freedom of the Press? Then we have the TSA and DHS blatantly defying the 4th Amendment at our airports. Where are Congress and the Supreme Court protecting our rights against a tyrannical executive branch and out-of-control police forces? Where’s the Left decrying the Nazi police state now?       I can see a lawsuit coming here! Can you say FREEDOM OF THE PRESS? This cameraman was not impeding this arrest in any way, shape or form, all the parties involved were blotted out, so what is the problem with this officer? Wake up on the wrong side of the bed that morning? I don’t get it.

      before cops had car mounted cameras it was routine to beat to a pulp to anybody that spoke of disrespect to them or resisted. Rodney king was not only guy beat by a cop or the only race. There are plenty of good cops, but they have a rule they can’t go after the bad ones. This sargeant was trying to prevent any recording of misconduct by his fellow officers. he is a sargeant for a reason.

      You are not free, get used to it. It is illegal to film cops in many states, but they can film you and ticket you for texting while walking in Philly. Red light cameras, speeding cameras, aggressive driving cameras, cameras that look through walls, into your home, cameras that look through your clothes at the airport.

      This obsurdity will only end with the end of the Republic.

      This bald-headed punk doesn’t want to be video-taped, because he knows he does illegal things all the time and would be revealed doing so, if his actions were recorded. He knows he could not stand up to the scrutiny of an objective evaluation.

      This is what police departments are turning into, Gestapo perpetrators who think their jobs are to lord over the public instead of serving them.

      Many of these “public servants” are getting their lucrative pensions halved or eliminated altogether due to budget shortfalls, and that will continue on for the foreseeable future. Since most of them retire after 20 or 30 years they love to “double dip” which allows them to work another job, draw their bloated pensions and earn as much as they like. Nowhere in private enterprise can that be done.

      And for every cop or citizen that thinks this action is okay, for whatever inane reason, I just want 5 minutes alone with ya, minus the badges of course, teach ya the lesson about poking the bear through the cage with a stick…when the bears grabs and mauls does that make the bear in the wrong? Such is the infringement on our Constitutional rights, and the erosion of those rights by the non-brain using masses and not just the power-tripping police. Glenn Beck is wrong on his blanket support of the police. Support for the ideal, support for the institution and for which it once stood, support for ‘FAIR’ constitutional laws..?       I will again point out that this police officer is demonstrating a level of authority, superiority, and personal entitlement bestowed by the uniform, that those of us from other countries know all to well. It is very upsetting to see the country – that my family chose to live in, a country that accepted us as citizens, turning into a corrupt police state. I fear we we will not be among the fortunate to escape here if this trend continues, because there really is no place left where a person can be free and in harmony with the government. From the left or in this case from the reactionary right, there is a total disregard for right and an insitutional embrace of that which is wrong.

      I don’t have a problem with the cameraman filming. But when you are told by a cop to do something then do it. Just because you don‘t agree with it doesn’t give you ther right to disobey. There are other avenues to resolve the issues. You people who come on here and bad mouth cops don’t know anything about the real world or what a cop has to deal with trying to do his job. When your house gets broken into and your hiding in the closet behind your kids calling 911 remember it’s those so called crooked idiot cops that are coming to take car of the bad guys for you. Because you guys can’t do it your to busy pis…. In your pants. If wasn’t for the cops out there protecting people like you, you would last 5 minutes. The wolves would eat you alive. So make sure and stay hidden in your basements commenting on things you know nothing about. While the cops put their lives on the line protecting your sorry hides from the real bad guys.       Right or wrong the officer gave a police order and the camera man disobeyed it. For that alone you can be arrested. That is part of Police Powers. Laws are different in states right or wrong. The news director needs to talk to the‘re lawyer and find out what they can and can’t do.

It is now ok film everyday citizens walking on the streets,driving in their cars or going about their own business and keep that information as long as the police department/government decides to. It is to keep you safe, so they tell us. Yet we can not film the police. It now appears that this is becoming an issue for many police across the country. I guess we should offer to put them on their own reality show then it will be ok to film them in the course of their work. This seems to be a growing problem and an continued infringement of our right to free speech and freedom of the press.

      They already do have cop reality shows. Growing problem. LOL Do the numbers of the total busts and compare them to those that the police got hot, then conduct an annalysis of those that got fired, lost their job.

      You folks really have no data to debate with…just incidents here and there. Any of you know how many busts are made in a day? How many traffic tickets are made in a day? How about how many cops have been shot and killed this year as compared to last year and the previous year?

      When you need them, don’t call them, rely on your own skills. LOL

      Don’t worry the press is wussifing the police one state at a time…and with the judicial system, why should the bust anyone. Hell everyone is getting off with hardly any hard time…feel free to move about the nation but be prepared to protect yourself first if you don’t trust the police.

      Ok do the numbers of traffic stops, drug busts and other arrests and compare them to say 50 bad incidents. I betcha it is is 1 tenth of 1 percent that acted out…and if you slice and dice it as to the reasons why and whether or not they lost their jobs, lost a court case and whatnot, I bet the number is further reduced.

      In other words what you see and hear in the media is not representative of all coppers.

      Rogue cops, more training how about just enforcing the law. It is illegal to make a false arrest, put the rogue cop in jail lose his job and make an example of him. After 30 years this is not a training issue this is a “above the law” issue. They will be in masks soon to protect there identity then even a camera will be useless as they will say it was not them.

      This is just another example of an officer that believes he is above the law and knowing a rotten and corrupt Police Chief will not discipline him as urges him to continue doing this. I have seen police that are excellent and those who had no business being where they were at. I got attacked from behind one day by the San Diego police while I was visiting there and they handcuffed me and then attempted to kill me by strangling me. Someone stopped it and the police got away with it. I had a camera at my side in J.C., MO and an officer showed up and when he saw my camera at my side he threatened to go bouncing me off the pavement if I were even pointing the camera at him. The Chief (Shroeder), wouldn’t do a thing about the officer that made the threat. What we really need is someone to police the Police, prosecuting attorneys, and judges to make sure they follow rules and laws both. Right now they get away with everything because they police themselves, which is bad as letting the criminals police themselves.

      There was a court case a while back where the police dept. turned down an applicant with a college degree, the applicant file suit, the court held that the police dept. put a limit on the intelligence of recruits.

    That is why I cheer in So. Fl. when a cop gets shot. I used to care. Not anymore. May they all get shot in the head by crack addicts. I don’t care. They have abused their so called “authority” too many times directly at me or in my presence. To hell with all of them.       I realize that each one that makes the news makes others look bad. But there are a lot more than one making the news. I think it’s probably been going on for quite a while, just no one filmed it. That‘s probably why they’re so upset with being filmed. I worked as a 911 dispatcher about 17 years ago, and it wasn’t near this frequent. We had one cop get accused of being rough, and it was because he lost his temper in an interrogation room and slammed something down on the table. They are supposed to be trained in how to deal with the public. I think they assume if the person applying is ex-military they already know how to deal with the public and just skip that training. Military Police is different than civilian. You aren‘t really under the constitution when you’re protecting it.

      Screw you, many, many cops in Miami are criminal. For every one I’ve seen do good, I HAVE PERSONALLY WITNESSED OR BEEN THE TARGET OF MANY MORE THAT ARE CRIMINAL!!! AND THEY DO NOT CALL OUT THEIR CORRUPT UNION BROTHERS.

      I’ve lived in Miami all my life, 39 yrs, and let me say that it is a Banana Republic. Multiculturalism gone amok. A few years back I had a friend go into the Police Academy in Miami, he quit the academy soon after. His reason was that it was full of a bunch of gung-ho, formerly bullied guys that were foaming at the mouth, ready to beat people down. I am not exaggerating. My friend was a very nice and honest man and wanted nothing to do with those people. It’s not a myth. Many police officers are, or become blinded by power and abuse it. The Latin Machismo doesn’t help any either.

    Police should be careful not to offend and harass, and abuse the public they way they do. They may need us someday, and maybe on that day we’ll just turn around and walk away and let them fend for themselves. I commend the cameraman for standing up for his rights. The police work for us and I hope this BAD cop gets terminated for abuse of power.

    If he had nothing to fear or hide, he would not have abused the power given to him by the people he has sworn to serve and protect. But I guess he had something to hide.

    They must be afraid of being caught doing something wrong. They’ve been caught shooting an unarmed Airman who did exactly what they told him to do. They’ve tasered students asking sharp questions to John Kerry. They confiscate cameras from public citizens that film scenes from a distance. They get upset when they are told they must perform urinalysises. If you ask me these guys are getting out of control and need to be reined in. They have a tough job but they better do it right.

      There are too many of these incidents happening to say “rogue” cop. It is institutionalized corruption. The good cops are becoming fewer. The good cops who do not report the bad cops have allowed this state of affairs. You can’t trust the police anymore.

      Take a few minutes and google Erik Scott, who was gunned down while shopping at a Las Vegas Costco with his girlfriend. You will be horrified at what occurred, and he was not a thug– he was a graduate of West Point.

      But it is not just the shooting (murder) of this young man that is so awful– it is the seemingly endless series of brazenly illegal actions that occurred afterward that will make you ask yourself, “What country is this?”

    I am all for law enforcement and the job that they do, but many are getting way too far out of line. I do not think it is a power trip or ego thing as much as it is law enforcement wanting to make things as beneficial for themselves as possible in order to cope with their difficult jobs. I can understand this. But…The time has come for us to reinforce to them just WHO they are working for.

    We were in Applebees yesterday when we notice three plain clothes cars pull up outside. Three young men got out of the vehicles wearing plain black T-shirts and camo pants. They all had to be under 25, maybe they were war vets…Who knows…But all three had a BA attitude as they strutted in the restaurant talking on their walkie-talkies. We were right near the front and one of them started staring me down. I smiled at him and he did not like it one bit. I read into him that I was one short step away from him hassling me. I am guessing at this, these might have been fine, upstanding young men. I do not know. But their attitude spoke volumes. I am sure glad I do not live in that small town, these boys are trouble. Arrest people on whatever trumped up charges and nothing is ever done to reprimand the officer. Common sense has always dictated you do not F with a cop, but I think things are getting out of hand lately. Of course, so has society and the cops are mostly just ramping up to match the threat level.

      I hear ya loud and clear!! It used to be the police officers were here to protect us. Those days are over. My husband had an issue the other evening. He pulled on the shoulder to find his cd case, and a cop just had to harass him. It’s ridiculous!

      Same type of thing happened to a friend of mine 2 months ago. He received an important business call on his cell while driving (a marked company car). Believing it unsafe to drive & talk, he pulled over onto the shoulder (very wide and in no way obstructing other motorists). Trooper pulls up, approaches the car with his gun drawn, pointed it at him and shouted “what are you doing? Put that down. Give me your ID”. My friend complied and asked what the trouble was. Was told to shut up and stay in the vehicle. Cop checked ID, handed it back and told him to “get off the road” – and left in the patrol car. No explanation, no warning, no ticket, no nothing.

      Back at the office, my friend told his boss about the incident. Thinking there might have been a company car stolen or something…the boss called the regional VP. Nothing, nada, no problems that he knew of. Next morning the VP called the sheriff’s office asking about the incident. Was told the “traffic stop” was noted in their log but no other information could be released. Two days later the company‘s attorney requested a copy of the cop’s dash-cam tape. Funny thing….seems it was “malfunctioning” at the time and there was no footage.

      Folks this took place in a rural area of one of the so-called fly-over states…..not near a major city etc.

    The stupidity and ignorance displayed by many police when it comes to recording their actions is unbelieveable. Maybe journalists and other people recording police should carry copies of the laws with them and hope such police can actually read and interpet the law. Unfortunately these are the types of police who don’t seem to care about what is and is not legal.

      Legal gun owners, farmers, backyard gardners, dairy owners, media people…..getting to be quite a list isn’t it. The government already has all the general information about everyone but it sure seems like they’re focusing on getting more & more details on people who are involved in specific areas.
