Cease and Desist, ‘American Girl’: Tom Petty Allegedly Upset Over Bachmann’s Use of Song

She is a darling of the Tea Party, but if Tom Petty has his way when it comes to music at her campaign events, Michele Bachmann may have to back down.
It seems Tom Petty objects to her usage of his popular song “American Girl” at rallies and events. Petty’s management team is apparently getting ready to send a cease-and-desist letter to the Bachmann campaign regarding the tune.
The video below shows Bachmann using the song during the tail end of her presidential announcement on Monday:
This is not a new problem for Republican hopefuls. Back in 2008, Bon Jovi publicly decried the usage of his band’s song “Who Says You Can’t Go Home” at rallies for Sarah Palin. Likewise, the Foo Fighters came out that same year against John McCain’s usage of their song “My Hero, “ ditto for Van Halen and the song ”Right Now.”
The Talking Heads took it a step further, suing candidate Charlie Crist in 2010 for a cool million after his campaign used the song “Road to Nowhere” in a commercial. Crist recently settled, apparently on friendly terms.
But the most ironic point of all? As Hot Air Pundit NBC notes, (via Hot Air Pundit), Petty never said a word when Hillary Clinton used the same “American Girl” song during her 2008 campaign.

Report Post »Besides, there’s an Urban Legend of “American Girl” being about a suicide. I’d rather pass on that song, to be honest. I like the song, but the title may not be the meaning. I’m not sure, you’d have to ask Petty.
There’s always going to be a problem with conservative candidates using music. An artist can’t control who their fans are. Petty probably cringed at the idea of a woman who washes her hair using his music, but frankly, I cringe whenever I have to look at Petty.

The question becomes whether they can deny anyone willing to pay for the use or not. The most ironic thing about this statement is that there is absolutely nothing ironic about the situation. Clearly he disapproves of Bachmann so he does not want to be associated with her; perhaps he did not mind being associated with Clinton.
Not ironic and this is not news. When she refuses to remove it and blows her campaign budget on legal fees because she’s too stubborn to back down – that’s a news worthy story.

Who’s stopping them? Trust me, Hollywood sin’t about liberalism, it’s about money. Conservative movies and music gets made in direct proportion to generate revenue. “Atlas Shrugged” got made. It was healed as the first salvo of a conservative trilogy that would change the landscape of American media. Well, the movie sucked. It came in 14th on its opening weekend and spiraled down from there. That’s why you will never see the next two installment.
By the way, you don’t need Hollywood or moguls anymore to make movies or music. Digital technology, self publishing, you know, progress, changed all that.
I suggest you spend less time making excuses and playing the victim and spend a little more time actually creating something.

You‘re supposed to get permission to use someone’s intellectual property, and the whole thing with the Clinton campaign – it’s up to the owner of the rights to press charges. That‘s also assuming that the Clintons’ didn’t ask permission. Which to be fair is more than likely that they did not ask.
Secondly, there seem to be a lot of people who are swearing off Petty because of this, and of a couple of them even saying that they had liked him. Wow, that is almost the definition of an ideologue. Do you like the product? If yes, then why wouldn’t you get it – particularly if you’re a staunch capitalist?

Posted on June 29, 2011 at 11:41amIt is my understanding that up to 10% of a work, not to exceed 30 seconds, is protected usage, considered, “FAIR USE” – This is commonly referred to as “bumper music” on radio shows, etc.
As long as they purchased a copy of the work, it is my understanding that they are completely within their legal rights to play up to 10% of the music, not to exceed 30 seconds.
Otherwise, I WOULD be standing up for capitalism – it is when he selectively tries to reach beyond his legal rights that I begin to have issues.

American Girl is his property. It’s the product of his heart and mind. He has the legal right to say who may use it, for what purpose and for how much. If he wants to allow one person to use it for free and prohibit another from using it at all, he gets to because HE OWNS IT.
The Republicans are either about the rule of law or they aren’t. This article would tend to show that, when it comes to the work of musicians, writers, and other artists, they’re about taking what they can get and hoping nobody calls them on it.

Posted on June 29, 2011 at 12:23pmMaybe I missed a post, but I didn’t see the words “copyright protection” anywhere. Bachmann is, in fact, stealing from Petty. That’s theft.
The other issue is that if you have a copyright on music (or whatever) and someone violates your copyright, you HAVE to defend your copyright, the government doesn’t do that. If you knowingly let someone use your song, and do not defend your copyright, then you lose it.
I’m amazed that politics on this website always trumps religion, the Constitution, the law and morality. If Bachmann steals someone’s song, that’s fine according to you. Interesting.

No, sorry. Copyright does NOT allow you to control public performance of a recording. That is part of statutory licensing, which only requires payment of standard licensing fees, and that the work in question is not wrongly credited to another. This is and has been part of US Copyright Law for decades.
If this were not the case, then every single radio station would need to individually license and obtain performance permissions for each song. As long as the standard statutory licensing fees are paid, artists like Petty and Springsteen can go suck eggs.
There’s nothing they can realistically do except file frivolous lawsuits that will get thrown out. Just look at the legal circus that surrounded Rush Limbaugh and his go-around with The Pretenders for using one of their songs as his radio shows’ theme song. Rush sure didn’t have to “change his tune”, so to speak.
So Ms. Bachmann, “D@mn the Torpedoes”!! LMAO!

No, he may not. Copyright determines what he may or may not do with it concerning it’s use by others. Specifically, in this case it is determined by statutory or compulsory licensing.
