Changing Times: Courts Rule Calling Somone Gay Is Not Slanderous

ALBANY, N.Y. (AP) — One by one, courts around the country are deciding it’s no longer slander to falsely call someone gay – a measure of how attitudes are changing in the era of same-sex marriage and gays in uniform.

While “gay” is still widely wielded as an insult, some judges have concluded that it is not damaging to anyone’s reputation, just as calling a white man black is no longer grounds for legal action as it was a generation ago.

The latest ruling came from a midlevel New York state appeals court Thursday and was hailed by gay-rights activists as a small but meaningful victory.

The case involved a woman who was sued for allegedly spreading a rumor that an upstate New York man was gay in the hope of breaking up his relationship with another woman. In a 4-0 decision, the New York Appellate Division’s Third Department threw out the lawsuit before it went to trial, noting changing attitudes about homosexuality.

Reversing decades of legal precedents, the court said the defamation claim was “based on a false premise that it is shameful and disgraceful to be described as lesbian, gay or bisexual.”

“This word has been sort of de-fanged in some ways,” said Curtis Houlihan, a consultant from New York City who is gay. “I suppose some would say this is empowering … but that is not going to change the level of bigotry and discrimination in this country.

“But we’ll take every little victory,” Houlihan said Friday. “We can move slowly because the country is still filled with men living in the `50s.”

Legal experts and gay rights activists say judges in other parts of the country have made similar rulings over the past several years, but tracking them is difficult because there are relatively few slander or defamation lawsuits brought and laws vary from state to state.

In 1994, for example, North Carolina’s Court of Appeals said a person can sue over being called a homosexual only if he or she can prove actual damages. The court said the law cannot automatically assume such remarks inflict damage.

“The courts are all over the place on whether it is defamatory to refer to a person as gay,” said W. Wat Hopkins, a professor in Virginia Tech’s communications department. “In some jurisdictions, a court would hold that such a reference is defamatory, and in others courts would rule as you say the judge did in New York.”

He said judges would probably consider public opinion within their jurisdiction and other factors, such as whether the state has legalized gay marriage, something New York did last year.

In the past, being called gay could cost people their jobs. For decades, homosexuality was considered akin to having a loathsome disease or being a criminal, especially since sodomy was a crime in most places.

A decade ago, actor Tom Cruise successfully sued for millions of dollars in the U.S. and Britain over false claims he was gay, arguing that the story threatened his career playing straight leading men.

In the New York case, the plaintiff, Mark Yonaty, had argued he suffered real damage from the false rumor that he was gay or bisexual. He said it cost him his relationship with his longtime girlfriend and caused him emotional distress.

But much has changed in recent years. Six states, beginning with Massachusetts in 2004, allow gays to wed, President Barack Obama has endorsed gay marriage, the U.S. military now allows gays to serve openly, and most polls show growing acceptance of gay marriage and equality, especially among the young.

“At its core, defamation is about disgrace,” said Thomas W. Ude Jr., a staff attorney for the gay rights organization Lambda Legal, which submitted a friend-of-the-court brief asking that Yonaty’s lawsuit be thrown out. “Saying that someone is gay is not an insult.”

      I do not think there is a more vile group of people than the gay devient sodomites. they molest children at an alarming rate, they carry a high percentage of the nations STDs, and they are just a sick twisted bunch of evil folks.

      A very high percentage of the nations most notorious mass murderers and serial killers were gay. Go figure.

      Let me fill you in. First off, I did not grow up with the MTV, thus I did not get their pro homosexual indoctrination, along with the multicultural brain washing. Secondly, I did my first six years of education in a Christian School. I learned Bible early, and continued to study it. This would be the reason I was able to go to large intercity public school, and not fall victim to the evolution, political correctness, and peer pressure. When the rest of the crowd was cranking out the rock music, smoking weed, drinking their beer, wearing the latest Nikes, izod shirts, and designer jeans, Skippy here was going to church, doing construction work, and playing football and wrestling, all the while wearing Wranglers, flannel shirts, and work boots.

      After joining the Army, I found I did not fit in there either. I did not drink the beer, impregnate the strippers, or listen to the AC DC tunes. I was already used to not fitting in, so I was in my own. I did find that way above average physical fitness, mental hardness, and expert marksmanship will carry you a good way, and even if you do not fit in, you can sure excel.

      Now after 25 years of service, I still read the same bible, and still have the same morals. Unlike the leaders of this nation, my moral compass, values, ethics, still coincide with the founding fathers, George Marshall, COL Chamberlain, Gen Lee…. The new wave leader caved to the PC, and the magnet fell off the bottom of their moral compass. Like you, their values fall more in line with Lady Ga Ga and Madona.

      I aint changing. Sometimes doing what is right, is worth doing, even at the cost of unpopularity or death.

      This isn’t about insults, it’s about falsely asserting as a fact that someone is gay. I actually disagree with this ruling. When you go around claiming that a straight person is actually gay, you are by implication falsely telling people that he is a liar and a hypocrite, and as far as I’m concerned that is slanderous.

      The media has been getting away with slandering of individuals for years – they just add ‘allegedly’ so as not to end up in a court case being sued for defamation – and after they have printed the headline in big bold text on the front page of a newspaper (for example), which most literates instantly see , the damage is done (loss of career/investment business/family/divorce/financial debt fighting accusation et cetera).

      Of course, the newspaper/media will later retract the statement and print an apology to the victim of the allegation (with one small filler paragraph), which will be barely noticeable and situated somewhere in the middle of a later edition. Unfortunately, too late for the target of the accusation – they‘ve been publicly humiliated with a falsehood and that’s what most who see the big headline will only recall – not the correction or apology and truth.

      And the moving finger writes, and having writ, moves on.

      I know all this to be true – I used to be a journo for a certain billionaire tyrant as featured in an episode of The Simpsons. I eventually resigned because they wouldn‘t let met write REAL NEWS and TRUTH articles which I thought were of more critical information to public than some ’off-beat’ yarn about a cat stuck up a tree or weight-loss diet or new bra).

      I found referring to the Macquarie Thesaurus [Australia] highly useful, during one’s high school days (and still, now, as an old fart), for slang terms with which to use pejoratively upon fellow students (usually friends, and bullies) – in jest, of course. Us kids could be very mean, but some of us grow up and mature and hopefully more wise.

      Back in the day, ‘gay’ meant brightly coloured; also, lighthearted, cheerful; careless, thoughtless.

      I surf and live near the beach so you may find me occasionally wearing brightly coloured ‘surfie’ clothes.
      I try to be lighthearted and cheerful – I live in Australia which is better than living in, say, Khabul (from what I can tell – any era, post 7th Century), and I wake up and thank God for a brand new day, every morning. That makes me happy.
      I believe HELL is for regret, however, I have made some careless and thoughtless decisions (like riding my motor-cycle too fast on an unfamiliar road – but it was so much fun, just before I crashed and wrote-off my Ducati).

      That is to say, I not a *turd-burglarising, *dung-punching, *poo-jabbing, *used sue, *nancy boy, *homosexual.

      Sure, I can take a joke when friends take the pi**, and vice-versa, but when it is a false statement uttered maliciously that damages a person’s reputation, then it is only slander.

    Someone I consider to be fairly well informed said one of the top five reasons teenage boys commit suicide is because they‘ve been accused of being homosexual when they weren’t.

    I’m sure anybody doing a little digging will be able to find the report, study, survey, or what ever you want to call it.

    If being called “gay” isn’t a problem, then what the heck was that “It Gets Better” campaign all about?

      Consider this: Most teenage boys don’t look at their friends and other men and think “He’s cute…“ ”He’s sexy, I’d like to get with him…”. Most teenage boys are more than likely to think like men: ogle and stare down women, both young and old, with a wandering eye towards things of interest, like breast, facial features, and nice hips.

      There! I said it!

      So if you call a straight male ‘gay’, he’ll more than likely handle the situation himself right then and there, or wait to prove his manhood to you by going after your sister or something similar (your mom, perhaps?). He’s not going to run off to his bedroom and cry his pitiful heart out under his pillow. So if your teenage son is thinking of Justin Beiber instead of checking out online porn or some girl that just walked by, you have a problem on your hands.

    Black is visible; gay is not. I can see where calling people gay could cause massive amounts for trouble for them, such as if they are married to a woman or if they are clergy or a politician. Interestingly, the only people I have ever seen call anyone else gay are the gays, who like to “out” people or who seem to think it is a massive insult to others. This ruling is to protect gays. I’m guessing it will probably cause trouble for other people. So watch out.

    Being PC in this country killed the word originally used to designate their status in society. Rude? Absolutely. But you know what? You didn’t have them pouring out of the woodworks constantly telling everyone within ear shot saying how gay and proud they were and with every few words they speak, they‘re constantly reminding you they’re gay and how proud they are to be gay and you should be happy for them to be gay, like we do know.

    Things are about to get worse before they get better…

      Do you even know the origins of the word you are so desperately foaming at the mouth to use? When people used to execute alleged witches, they thought that even witchcraft was a lesser crime than homosexuality. They used bundles of sticks as kindling for the fire to burn the witches, who were usually tied to a sturdy tree trunk. Homosexuals were thrown in with the kindling, since they were not worthy to die tied to something as strong as a tree. Can you guess what the bundles of sticks were called?

      So, before you voice your opinion that I deserve to be slowly and agonizingly burned to death for the awful crime of living my life with the partner of my choice, read up on what words mean. You can usually find such answers in a dictionary.

      Yes! Someone finally called my bluff and did some research! Notice how my comment stood for over two hours before someone finally researched the topic enough to know I was playing a hubris card. Nice job, Blaze. You argued with someone for over two hours before bothering to actually research your opponent’s evidence. Good job…. Although, the person responding with the research wasn’t the one I was talking to. And the person who responded had the express intent not to further the conversation, but to stop discussion with a takedown (discussion is meant to enrich others, not silence others with your power to wield Wikipedia articles). Also, using ****** as a perjorative can still be considered slander because slander is false claims used to tarnish one’s character. So, yeah, you’ve proven me wrong in the case of the definition of a word, but my point is still valid, especially considering that I only spread false information to get some of the lazier Blazers off their butts and on to actually researching the topic. And, hey, you cannot say that no one took my bait, hook, line, and sinker.

      Wiki is just the easiest to use. It no longer has the authority it did when it first came out & is showing systemic bias, but it still has its’ uses for a rough cut / 1st draft or a place to get other sources. What about the Ron Paul campaign back in Iowa touting the endorsement of Rearend Phillip G. Kayser a pastor at the Dominion Covenant Church in Nebraska who also draws members from Iowa, putting out a press release praising “the enlightening statements he makes on how Ron Paul’s approach to government is consistent with Christian beliefs.” But Kayser’s views on homosexuality go way beyond the bounds of typical anti-gay evangelical politics and into the violent fringe.
