Cheating Arizona Wife Could Face Jail Time Under States Anti Adultery Law

An Arizona woman who cheated on her estranged husband was very surprised to receive a phone call about her extramarital affairs…from the cops.

That’s because her fed-up husband used a little-known state law to report her cheating ways to the police. That’s right: Under Arizona Revised Statute 13-1408, adultery is actually illegal.

Dave Banks told Phoenix CBS affiliate KPHO-TV his wife started cheating on him more than 10 years ago.

“She’s had seven or eight affairs that I know of,” he said.

But he stayed with her, he said, because of their two sons. Now, he thinks the archaic law should be enforced and used as a way to save families.

“If they used it all the time, maybe women or men would think twice about going and jumping in the sack and throwing away their marriage,” he told the station.

And what does such a law actually look like? The Arizona State Legislature’s website reveals cheating on your spouse is in fact illegal:

A. A married person who has sexual intercourse with another than his or her spouse, and an unmarried person who has sexual intercourse with a married person not his or her spouse, commits adultery and is guilty of a class 3 misdemeanor. When the act is committed between parties only one of whom is married, both shall be punished.

B. No prosecution for adultery shall be commenced except upon complaint of the husband or wife.

Banks said it took years for police to take his report, but they finally gave his wife of 17 years a call.

Traci Banks said she was amused she first heard from the police detective.

“Everybody thinks it’s funny, everybody,” she told KPHO.

She admits to having two affairs, but told the station she and her husband are living separately and only remain legally married because she can’t afford a divorce.

“It’s been over,” she said of their marriage. “Did I feel bad or guilty? No.”

It’s unlikely prosecutors will actually pursue the case, but if they did, Traci Banks could face a month in jail or a hefty fine from the class-three misdemeanor, the Daily Mail reported.

Dave Banks said he‘s frustrated the case probably won’t be seen through.

“How do they get to pick and choose which laws they can and can’t enforce?” he said. “They got somebody readily admitting guilt. Seems to me that’s a rubber stamp right through the court system.”

He said the detective on the case gave him a piece of advice: “It’s about time she got on with her life and you get on with yours.”

    Though it does seem odd to call marriage legal but have no way to enforce it. Why have a marriage license at all if law means nothing. Those that cheat should pay a price in public court. This alone would discourage many such acts. I think of all the small laws that keep people from doing things that injure others that we dont complain about, and adultery is a very serious act. At the least the guilty party should not be given anything of the family wealth, car, house and sent away with only his/her clothes. States can have the laws they want or not but not the Feds, its truly a State issue. I agree laws should be enforced or abolished.

      Laws do not change hearts. I for one dont want money spent on the court costs of prosecuting her and then if she is convicted we have to house her and feed her. Why? Because some dumba@@ couldnt keep his wife happy. Stupid!

      Setting aside the spiritual aspects marriage has for many people, marriage is a contract between individuals. As such, breaking of the contract is resolved in civil, not criminal, court. One’s behavior is assessed in the court and, had we not abandoned the concept of ‘courts of justice’ long ago, violators of the marriage contract would by the price financially through reduced (or eliminated) alimony, denial of rights to the partner’s retirement fund, etc. Of course, like everything else we have gone more and more to a ‘no fault’ resolution in divorce courts with few, if any, penalties for bad behavior. Of course, if we no longer enforce contract law (ref: ‘renegotiation’ of home loans, etc.), how can we expect the marriage contract to be enforced?

      With that said, we must be careful not to give the Government the ability to criminally prosecute people on the basis of their perceived immorality. Criminal codes based on puritanical Christian beliefs would be only slightly better than Islamic Sharia Law.

      the way you fix that problem is D-I-V-O-R-C-E, you can still be a parent to your children. Also it might take a lot of stress off of the kids, don’t think that because you stay together it benefits the kids

      My question is this…
      Why is the Government involved in any aspect of marriage?
      Let the Churches tak care of marraige. PERIOD. If you can find a church that will allow you to marry your goat, what difference is it of mine? That way companies are not forced to recognize what they consider a sham marraige and can do what they want to do as far as selling to you…I am sure if someone showed up with a goat as a wife, the insurance company would say…you wont be covered by us.

      I‘m not sure how many of you have ever been through a divorce but it’s pretty nasty. Could he have stayed because a divorce would have cost him his children? Do any of you know how hard it is for a Father to get even shared custody? Unless the Mother agrees to it, it’s very hard and very expensive. If you can’t afford a good Lawyer your S.O.L. You also have to keep in mind that even if he bought and paid for the house, cars, toys and all bills, she gets half of everything and if the kids are still young she gets the whole house. Then Dad gets to pay Spousal Support and or Child Support after losing half of everything. I have spent tens of thousands of dollars and despite an Ex that keeps getting ordered into Rehab, she still has shared custody. Lastly, would you jerks be so glib if this story were about a man cheating? You’d be saying “she should take every thing he owns and teach him a lesson.” If men were able to get joint custody unless they were PROVEN to be bad Fathers, you would see divorce go from 70% started by women to closer to 50%

      That’s what I was thinking! Evidently he could not fulfill her desires sexually or along the same lines or another. Maybe counseling to find out what is really the problem or problems in their marriage could be the answer??? When patterns arise and / or there is a lacking, then I say you need to take a good look at what is really the problem in satisfying each other. I believe the law is right in not getting involved in this, but allowing the divorce to go through. There should never be anyone (including the law) that comes between to bonds regardless!

      I wish the lady good luck in finding someone that will give her the pleasure in life that she needs and I hope the man takes a good look at what he got himself into and will learn how to satisfy his relationships (kinky or otherwise) in finding a way to enjoy life with his next relationship!

      The common law tort of “criminal conversation” (suit brought by cuckolded husband against the guy who cheated with the cheating wife) is no longer recognized in any state that I know of. Bringing THAT back could put a damper on some cheating — plus, it would be a civil matter, not a criminal matter (despite the name of the tort).

    Frankly, for ______ and grins, I’d like to see it enforced. It might put the fear in cheating men knowing their wife could file charges.

    Note the second part of the law specifically says the wife or husband has to file a complaint. He filed, the police must arrest her whether they agree with the law or not.

      I won full custody of my kids when they were three and six! Now they are 22 and 19… I have to admit grinding my ex legally into the floor was pure enjoyment! It could only be equaled by news of her contracting the slowest, most devastating painful, fatal disease known to man.

      WorkForIt – I understand your feelings. I too was cheated on by my husband. I have forgiven, but I have not forgotten. I did what any good soon to be ex-wife would do; I left him with the house and the payment that went along with it. We had no kids. He had this grand idea that he would move into his girlfriends house that she just bought a block away and I’d pay for the house we bought together. I said no, I did not want the house. Besides he bought it under VA, so technically it was his. I did take all the furniture though, since I was starting over I needed it more than he did. She ended up selling her house at a loss; bless her little heart and moving into Rob’s house.

      @ Workforit… Your one of the very few. It doesn’t work that way in about 89% of the cases. I saw a study back in 2005 that showed that nationwide averages for contested custody cases were 89% granted to the Mother. Only 11% were given to the Father. I have heard it is slowly changing as more of the older Judges are retiring. I was actually told by a Family Court Judge (off the record of course) that unless she was injecting drugs IN THE COURTROOM that I had no shot of getting my (then) 5 and 6 year old children. She has since been ordered into rehab 3 or 4 times due to “Driving while Intoxicated”, “Child endangerment”, “Violating an Order of Protection” that barred her from drinking or using drugs while in possession of the children, and those are just the ones in the last 2 years.

This woman had no respect for her husband or for herself ,so how good of a mother could she have been ,totally self indulgent . If you can’t show respect for your spouse in a loving home your children will still grow up in dysfunctional family ,your children don’t live in a vacuum . BTW I’ve been married to my first love for 23 years.

      You’re probably right.

      I myself am a very staunch MRA (Men’s Rights Activist) and hate the legal leverage that women are able to use against the men in their lives and I admit that hearing about the courts coming back around to bite abusing women in the rear gives me a little thrill.

      However, I am also a Libertarian and do believe in personal freedom and government non-intervention in personal lives. So I cannot support laws like these. The ends do not justify the means.

      Then don’t get a State Marrage License that is enforcible in other States.

      Then do not seek a Legal Status.

      There are trade offs to everything.

      Then get the State out of Marriage and reall separate the Church function regarding Marriage and Family from the State.

      Oh that is right, it really cannot be done, as the State comes from Family.

      So, the State will have to be Chrisitian to some degree to serve the function fo protecting the Chrisitian Family, sinc ethe Common Law comes from THE BOOK, the KJB.

    Adultery is awful but it is no place for government to have their already over intrusive noses.

    The only good use for a law like this would be to enforce it in DC and we could throw 80% of the politicians in jail. Or 98% of NBA players…..

    Astonishing and terribly sad to hear that this mans wife “did not feel bad or guilty” Her dead conscience will be awakened eventually, but then it will be too late. Maybe she will open the scriptures and heed the warnings. This is common in the apostate “church”, and the sin of the age. If Gods threatenings no longer alarm the conscience, then I must affirm the words of Isaiah;

    I guess I am shocked. While I believe that adultery is wrong I think this could cause an awful lot of overcrowding in the jails. How many people would be serving time if this were a nationwide law . It seems extreme to me. Sort of Sharia like but less violent. Unless you walk in someones shoes, it is hard to judge.

      Susanna, with Divorce v. 2.0, you can force him into indentured servitude. A lot of women are doing just that. Ain’t no-fault divorces grand?

      Of course, it has a severe impact on daughters. Not many young men want to marry, seeing that the end result is to be taken to cleaners. There is simply nothing compelling in the institution of marriage any more, for young men. The primary reason why the institution of marriage existed was to guarantee that then offspring is his (and the breach of paternity guarantee was subject to wide range of sanctions, while philandering by men also was subject to sanctions as well) . With that removed, what on earth would be the reason to sign the dotted line?

      Yes, we’re heading for a crash, because the framework that worked successfully for more than a millennium and was responsible for the rise of western civilization has been corroded away in 3 generations. Two more, and there won’t be anything but rust and a slightest disturbance will make all the scaffolding crashing down.

      Ohsundevil, it’s not matter of legislating morality. The laws were intended to uphold the contractual framework of marriage, because that was the basic foundation of civilized society. Adultery is a serious breach of contract. But since not many people take the marriage as a binding contract seriously today (especially them wenches, as they have all the privileges these days and can do as they please), these laws belong to another era.

      Actually, adultery is illegal in a lot of states, it is just one of the many laws they don’t enforce. Our legal system is bloated and useless. The laws need to be updated once in a while and they should either enforce the law or repeal the law.
