Chicago Police Arrest WGN Reporter:Your First Amendment Rights Can Be Terminated

Chicago police arrested WGN reporter Dan Ponce and WMAQ photographer Donte Williams Saturday, saying that they were “creating a scene” outside of Mount Sinai hospital.

The two were covering the fatal shooting of a six-year old girl and, though they were already across the street, the officer demanded they go another street over.

“F*** news affairs, I don’t care about news affairs.  Forget news affairs,” he said.

When the journalists spoke to their rights, the officer replied, “Your first amendment rights can be terminated, if you’re creating a scene, or whatever.  Your first amendment rights have limitations.”

After the journalists responded, “how have we created a scene?  This is what we do for a living,” the officer replied, “Your presence is creating a scene.”

Ponce and Williams maintain that they never went into the hospital.  Ponce elaborated on Sunday, saying, “What upset me about last night was this was not an active crime scene…This is in front of a hospital. The reporters and photographers were standing on the median sidewalk when the officer started yelling at us, telling us to get further away. We decided to take a stand.”

A police report says otherwise.  “We removed two individuals from the hospital at the request of hospital security guards, who asserted that the individuals had tried to go past them into secure and private areas of the hospital. The security guards declined to press charges and the individuals were released.”

Though it is very possible that the journalists attempted to enter the hospital— their video appears to be edited— does that warrant the police officer’s graphic response, and his threat to “terminate” the first amendment rights of the journalists?

      I‘ve been a cop a long time and all I can say is that we’re not all like this. Unfortunately thare are some cops who don’t know the law well, don’t understand The Constitution at all, and don’t handle adversity in a mature and intelligent way. But I hope you and others on The Blaze realize that there are many, many outstanding police officers who handle themselves much better than the ones that show up on the internet in stories like this.

      Here is a prior police thought. It wasn’t like this 35 years ago. Then the politically correct started getting promoted in order to fill quotas. Things changed slowly at first, until the special interest supervisors started voiding citations and releasing suspects on the premise of claiming racist. Release the minority violators or suffer department wrath. Don’t complain!!! Your job is on the line. END of STORY!!!

      I agree there are good cops, but most are running amuck.
      They are not patrolling the streets getting real criminals for the most part. 95% of the time they are generating revenue for their city (Corporation) by bullying good citizens for trivial statutory Infractions of ordinances and codes. Want an example?
      The City (corporation) in which I live can fine a person 100 dollars a day for surface rust on a fence.
      A person painting a fence or installing a mailbox for a neighbor and being financially compensated
      can be jailed for up to a year for “contracting without a license”. The person hiring the contractor can be fined up to 5000 dollars.
      I was riding by bike on the sidewalk the other night to get some groceries.
      A man with a gun stopped me and demanded 62.50. He called a friend. His
      friend arrived to help mug me.
      Want a description? They Drove Sheriffs Cars. They Wore Sheriffs Uniforms.
      Treated me Like a criminal in a condescending manner.
      Stopped me because I had no Light on my bike.
      I am 46 years old with a 168 I.Q. I was no threat to anyone’s wellbeing or safety much less my own.
      I was accosted, Imprisoned and mugged, all under the BS guise of “safety”.
      You call as you will. I call a spade a spade.
      I see you either understand the importance of 1933 when we lost our Country or you were born at that time, either of which would show a semblance of wisdom.

      I hear you, and I understand completely. Outrageous behaviour by cops is probably as prevalent on the internet as pornography. It disgusts me and I wish I could say that it’s rare in comparison to good police work, but there is obviously an abundance of on-line video evidence against police.
      All I can say in our defense is that you very rarely hear of the good that police do every day. I personally know many police officers who are outstanding, honest, courageous, decent human beings who want nothing more than to remove those who harm others from society according to the law and without breaking the oath we swore to the Constitution. You may not believe me but we do exist.
      You would be hard pressed to find a bigger proponent of the second amendment than me and whenever I encounter a cop on my department who has the mindset that only cops should carry guns, I’m very quick to give them a harsh lesson on how ignorant and immoral that position is and how they are breaking the oath. It has worked many times (to varying degrees) and I will not quit.

      I can promise you that I dislike corrupt cops as much, if not more than any of you. They embarass and tarnish the entire profession. I only ask that good people like yourselves don’t make the mistake of thinking, in a collectivist manner, that we’re all the same. The honesty and professionalism of police officers runs the entire gamut from criminal to saint.

      Without knowing more information. It depends a lot on the local laws and who property they were on. No matter what the use of that terminology is extremely stupid. However, nearly every jurisdiction has a creating a scene/disturbance/failure to obey catch all type law.

      I agree about the city ordanances…however you spell that, bad day due to the lowered barometric pressure… I got hit for a “vermin hazard” because I had stored planks of wood FLAT ON THE GROUND next to cinder blocks, also stacked so there were no crevices. I was supposed to get everything up off the ground at least 6 inches…so, what, the vermin can hide in the space created? I have more problems with rats now than I did before. I have to have the trees that are planted on the other side of the side walk trimmed to 15 feet overhang of the sidewalk or road (meaning there has to be 15 feet clearance). I can’t fix my own curb, I have to hire a city worker to do it, but they don’t do it for free, I have to pay for half. Trust me, the curb is going to remain broken. I have to have everything stored on “improved pavement” but I can’t pour my own concrete slab, I have to hire a contractor. I took split half cinder blocks and put them on the ground to make paving stones. FIND FAULT IN THAT! BUT, that said, it isn’t a cop who goes around and finds all the violations, it’s a city worker hired for just that. Ordinance compliance officer.

      Another good discussion! It looks as if SOME of the officers (and maybe entire agencies) are picking on law abiding citizens for revenue. I guess they think if they are otherwise law abiding there will not be any trouble. For the most part this is correct but I pray things change soon, I don’t want the wheels to fall off this thing but it looks like they are about to. Lord please help the USA!

      This chump is a total fool. He needs to go back to school and take a 6th grade civics class. It seems to me I remember some local thugs in police uniforms going around and confiscating fire arms from law abiding people after Huricane Katrina. I guess that they think that wearing a badge entitles them to make up the rules as they go along.

      This officer is a fool. If you watch the video you do not see the other officers on scene assisting him with the arrest, other than covering his back as he tries to load them into the wagon. That is a red flag to me…back away as quickly as possible and don’t become involved in this false arrest/detention. This guy does not know what he is doing.
      As far as standing in the median … that depends… it appeared wide enough to hold everyone so it probably was not a problem… I guess the City of Chicago has enough money that they wanted to give some of it to the news crew….

      Land of the free and the brave…until you run into a power tripper or a bully. There should be a way to screen out these type of individuals from any authority position. There are to many bullies and people on power trips. Freedom of the press is so very important and this ‘peace officer’ is nothing but a bully and should be re-trained and then put behind a desk.       Getting what we deserve? That’s like saying an innocent child that gets beat over and over gets what he deserves? We try to do what is right, abide by the law and support our families. These people are treasonous crooks that took over our government one step at a time. As US citizens we were brought up to trust, help and care for others.       Either way, the cop was just being an @ss (like usual for many officers…) I understand the un-easiness that many officers have. Most people dislike, and many people HATE police. For the most part we only care about the police when they are “helping” us.. But this shouldn‘t give the boy’s-n-blue the right to behave like petulant children…

      I am sure that may have been how it went… I doubt that cop cared about the law, only that people were following “HIS” law….

      This is why I respect police, but NEVER trust them….

      He may have been in the right, he may not have, but I can’t imagine this was the proper way to handle this… But who knows… Maybe the “reporters” are lying, and tried to “break-in” to the hospital after being told to leave… Only they know what really happened.

      Police academies should have a mandatory course based soley on the US CONSTITUTION. Taught by DVD’s from one source…DAVID BARTON of WALLBUILDERS. Police for most part, clear across the country are totally clueless about their role, and our rights. They (the ignorant ones) make it up as they go, and will go as far as you are ignorant enough, or afraid enough to let them go.

      I partly agree with you…accept I think a scenario with citizen unrest the military will arrest and shoot US citizens at first before many realize what they are doing is against the constitution. I believe that becasue they are so well trained to follow orders they will follow them to start with before it sinks in what they are doing. Then it will get really dangerous for the country’s survival pitting deserters against unyielding military purists believing they are upholding the constitution.

      My Theory: I was in Wash DC for the first 9/12 rally in 2010. Suddenly many heavily armed police dressed in black uniforms appeared in the streets on one side of the capital building where many Tea Party people were standing. My surprise at their appearance prompted me to go and ask one of the police why they were there. They said they were protecting the area. I looked him in the eye and asked if he and his fellow officers woud fire on peaceful protestors. He said they would fire if they believed they endangered the parameter they were protecting. Rumors grew that Obama was coming but he nor anyone ever showed up. I believe they were sent out in the streets to intimidate the Tea Partiers….but I could be worng. Maybe they just canceled Obama’s arrival due to the massive crowd that was present. Maybe they were in fear if someone did do something they would have to test whether their guards would fire into the crowds. Maybe they didn’t want to fin

      Yes – they have the best deep dish pizza! I love to go to Giordana’s when I am there, and maybe get a gooseneck to wash it down with.
      The real question is can anything from the government be good? You give them an inch and they will take a mile. Our representatives have been giving inch after inch for over 100 years, now they can do whatever they like to us.       Go Cubs. I love Chicago, just can’t stand what those idiots are doing to it politically. It’s a great city, but it’s been under the thug rule for way too long. People need to wake up before they lose it. How in the heck they let Rambone back in there is complete insanity. All the same, when the Cubs win the series this year, they’ll burn that city down.

    police state? this clearly fally into the “need more information” category. if they were trying to get into the hospital then the police were justified. if not then there is an issue. the video is edited and you dont know what really happened by watching it.

    i find the comments to be the most interesting. many who post on the stories on the occupy movement were defending the police, now on this story they are condemning them. little ironic, dont you think?

    How can executive orders like the one signed by Obama on Friday, of this magnitude not make headlines and where are the elected officials who are to protect us from tyranny! Here It Comes!!! What is stupid is this entire one sided media people are going to be in the same barrel! All great dictators have their own government ran tv and radio!!! They already control most of them and all they can do is grin and take it. Just one major media outlet; try and be negative and watch the results!       Beck is afraid to report on the EO signed by commrade Barry on Friday. He is afraid he’ll be shut down. Maybe he has been threatened? He needs to grow a pair. I personally am ready to get this thing started, time to eliminate some communist tyants!

      I disagree. How about; Beck is getting his ducks in a row so he doesn’t go of half-cocked and misreport the implications of the EO. If you watch the show he has stepped up his rhetoric in the past couple of weeks, he is far from acting afraid.
