Christians Face Misdemeanor Charges After Arrest for Reading Bible Outside of DMV Last Year

Men Face Charges for Preaching From Bible Outside of California DMVIn February 2011, Mark Mackey, a member of a local Calvary Chapel in Hemet, California and Pastor Bret Coronado — a faith leader at the church – were arrested after they showed up at a DMV office to read and preach from the Bible.

After Mackey began preaching, it only took about 15 minutes before a California Highway Patrolman grabbed the Bible and arrested him. His crime? Preaching to a “captive audience.” Now, more than a year later, the case has made its way to court.

The men and their church, of course, disagree with the arrest and believe that it showcases “religious bigotry.” According to a press release distributed today by Advocates for Faith & Freedom, the non-profit law firm representing Mackey and Pastor Bret Coronado in the legal battle, the incident was unfounded:

[On Wednesday], a trial court in Riverside County, California, heard arguments why the prosecution’s case should be dismissed in the case of People v. Brett Coronado.  Advocates for Faith & Freedom are defending Pastor Bret Coronado and Mark Mackey on misdemeanor charges after they were arrested in front of a California DMV while Mr. Mackey was reading the Bible out loud.  The incident took place on February 2, 2011, in front of a group waiting for the DMV to open for business.  [...]

Initially, when Mr. Mackey was arrested, the CHP officer stated that it was illegal to “preach to a captive audience.“ After the defendants were placed in jail and upon learning that no such penal code prohibits preaching to a ”captive audience,“ the officer issued a citation for ”impeding an open business” with threats or intimidation under Penal Code Section 602.1(b). However, the district attorney again changed the charges claiming trespass after the government realized the business was not actually open and, presumably, saw the video showing no threats or intimidation.

According to the press release, the church had negative run-ins in the past, so they frequently videotaped their evangelistic outreaches. Thus, the arrest was captured on film. Here’s video of the incident, below:

“This is an abuse of power on the part of the CHP,” proclaimed Robert Tyler, Associate General Counsel for Advocates for Faith & Freedom. “The arresting officer could find no appropriate penal/code to use when arresting these men. The purpose of the arrests appears to have been to censor them.”

According to FOX News, though, constitutional attorney Dan Conaway agreed with the cop who arrested the men.

“[Mackey's] creating an intimidating situation for people who simply want to get their drivers licenses renewed,” Conaway explains. “He does not have the right to intimidate others and force them to listen and impede their ability to do normal business activities such as going to the DMV.”

Advocates for Faith & Freedom filed a lawsuit on behalf of the Christian men claiming free-speech violations and unlawful arrest. At the moment, the case has been stayed until the state court prosecution is concluded, the press release explains.

In the end, the men may, indeed, be found guilty on misdemeanor charges. There’s no telling what will happen in terms of lawsuits and subsequent battles.

      A Muslim can beat up an atheist at dressed up at a Halloween parade because the Muslim didn‘t like the guy’s costume and get off scott free!       Anyone of color would have been warned first if not allowed to persue under free speech.
      Mr. bad azz cop Al mighty could have been a little more professional in explaining his actions but since there was no recourse for being labled racist, he display of power was exercised to the fullest. A Black or Hispanic man would have been asked to leave instead of being arrested.

      1st ammendment is for burning flags, burning bibles, occupying, throwing bricks at cops and dumping condoms on school girls at a Catholic pro-life rally. It is illegal to read the Bible, proterst civily with a permit, or voice an opinion against communism. I have read quotes from the left calling for the Bible readers heads cut off for all to see as an example. Strange days

      Or is it the state who is forcing people to stand in line to be robbed of their money for the “privilege” of driving their own cars?

      Get rid of driver licences and privatize the roads (and replace traffic laws with the requirement of actually having to be proven guilty of a crime); Problem solved.

      If a person preaches with a “in your face” style, then the message is perceived to be irritating and the Christian’s reputation is going to be disrespected. On the other hand people respond well to a respectful stance. I’m sorry you do not understand “nice”.

      Jesus’ actions against the money changers and religious leaders was a judgement against their hypocrisy, he was not preaching to them.

      I’m glad your not my leader. If I were there at the time of your koran scenario there would be alot of swearing going on and yes he would have been arrested and maybe even beaten. The majority of people do not want to hear religous rants when they have no choice but to listen to whatever crazy point you are trying to make reguardless of the religon. There are things called churches that have been built specificly for this kind of thing where people can choose to go there on Sun. and listen., NOT HAVE IT SHOVED DOWN OUR THROATS!!

      This is a plain and clear violation of 1st amendment rights and an attack on Christianity.
      1) The DMV was closed.
      2) He was not restraining anyone, so he was not forcing anyone to listen, all someone had to do was keep walking.
      3) He was nowhere near the entrance to the CLOSED DMV, so he was not hindering daily operations, again the DMV was CLOSED.
      4) If he was a mussie reading the Koran or an atheist bad mouthing religion nothing would have happened.

      @WhiteFang Did you see the video? How was that intimidating what so ever? That was not a “in your face” and even if it was, the 1st amendment protects that. Look at these anti-war movements on public property, look at OWS, again, on public property using cuss words and threatening violence vs CEOS. The police said “if you preach you will be arrested” So that means if they started talking about how great it feels to be penetrated by men, the cop would have had no problem with this. This cop and that state are obviously anti christian, and only anti christian. Hopefully this cop will be in jail , and the state sued for millions.

      Would you LIKE a Muslim to sit outside of the DMV when you have no other choice but to be there on that day and read from the Koran to YOU? My guess is, no. If not, what makes you think these people welcome this?

      I agree with Whitefang. If someone asks if they can read the Bible to me, I‘d more than likely allow it provided I get to pick apart what they read and show why I don’t agree. All this did was make this man and his church look like raving lunatics and distance all of us even further from what he thinks we need to hear.

      As the incident seems to be caught on tape, it does seem like the preacher went there knowing exactly what he was getting into. I don’t have all that much sympathy; when I preached on street corners in college, I checked with the authorities first to make sure it was all right to do so. I didn’t set up a situation to make myself into a martyr.

      That said, I hope the court throws out the case; as the place was closed at the time, and the charges repeatedly changed, it sounds bogus.

      Regardless of how this winds up, how is this Christianity under attack? Churches were not closed, prayer wasn’t interrupted, signs not covered. It was a guy displaying boorish behavior, though I would agree that it probably ought not to be criminal.

      There are definitely instances of Christianity under attack – in Egypt, Jerusalem, Iran, Egypt … it would cheapen what those people are going through to call this incident an “attack”.

      @Locked: Where were you a street preacher? Certainly not in the US. You don‘t need anyone’s permission in this country to do that kind of thing so there’s no need to “check with the authority’s”. Maybe you thought you needed to, but the reality is that no one needs to “check with the authority’s”. As long as you’re in the public right of way, anyone can say just about anything they want. The only time you’d need permission is if you planned to block off portions or setup a sound system and expected a large crowd. Otherwise, anyone can stand on a corner and speak their mind as much as they want.

      To the rest of you claiming christianity isn’t under attack, this is the exact kind of thing the first amendment protects. Whether you or anyone else wants to hear it doesn’t matter. The first amendment protects it. I pray to God this gets tossed. If it doesn’t, I will go to the nearest DMV and videotape myself doing the same thing. These men were simply exercising their first amendment rights. I encourage anyone else that believes in the first amendment to do the same thing.

    You’re missing the point. You honestly think someone should be charged with a “crime” for free speech?? Don’t like it?? ok…?? Getting annoyed is part of life, so unless someone was in your face then there is no valid cause of action and any judge with half a brain and any prosecutor that’s not a power hunger control freak would not even look at this case. The cop who actually arrested this person should never ever be allowed to wear a badge.

    I am an atheist and I think that this action is appalling. Everybody, it seems has the right to demonstrate, blockade, or spew vile racist comments in public, but when a couple of christians start preaching from the bible they are arrested.

    Muslims do it, hell even the KKK does it and those groups get police protection.

    There is something terribly wrong with this.

      Of course they are afraid! The only weapon the devil has to stop the power of the spoken Word is to yell for the christian to shut up. We as believers are, however, told to pray for those to despitefully use us. There is a time and place to ‘take a stand’; not sure these guys were all that wise in choosing were they did it though. Pray for the snarky cop; he needs it badly and pray for the guys preaching that they allow the Lord to lead them where there are people who want to listen. I wonder what the authorities would have done if someone from the alleged crowd doing business had said “wait! I want to hear what these men are saying”… just a thought.

      For real! One local DMV had propaganda videos running in the waiting area. I was a captive audience. What about my rights? I didn’t want to see it.

      Any of those people on line could have left and went back later or asked the Pastors to refrain from preaching. Big deal. I’ve been in public with my children while people were talking about their sexcapades in a graphic manner. I told them off and went elsewhere to protect my innocent children from hearing such stupidity. Big deal, I didn’t call the cops or a lawyer. People need to grow up and take responsibility for their own surroundings if it’s that bad.

      Is it your opinion that all the religious symbols in DC be removed? Those are etched in stone. Not just sound waves that exist for a brief moment in time and then vanish? If we can’t express free speech at a public building, are we then only allowed to do it in private or underground? Ah, maybe or maybe not. Where do we limit free speech? At the DMV? Public streets?     I never understood why religious people try to shove their religion down the throats of people. Not only Christians but all kinds of religious people do this in public. If anyone was interested then they would go to their nearest church to convert to Christianity. Would you be upset if I started preaching something outside your church? Like say I was reading Harry Potter out loud. Church goers would be upset and would have the right to tell me to leave. If I chose to not listen then I would be arrested because I refused to cooperate with orders.

      As long as they leave the area or asked people to step aside if their interested in Christianity. I have asked by Mormon Christians and Jehovah Witness to talk about their beliefs and I politely said no. But they weren’t showing out in from a place of business. That in my opinion is disrespectful to others who do not want to hear them. My friend and former youth pastor has invited me to attend Sunday Service this April 1. He asked me nicely and I accepted. I just feel many want to be heard and are obnoxious in public.

      Ok, I understand what you mean. However, they have a right to stand there, wanted or not, annoying or not, they can be there. Just as much as an atheist could stand there and say how much he doesn’t believe. If people became annoyed at me then out of respect, I probably would leave. Legally speaking however I can be there.

      I would be ..“Annoyed” if ..While I was doing my banking ..
      A bunch of people screaming…. “we are the 99%…“
      Because they didn’t read the fine print or to lazy to..
      on their student-loan ..bank mortgage
      or any other banking contract that requires a 6th grade education….

      And are screaming ..
      the NEW religion of… I’M A VICTIM.

      Since I’m annoyed does that mean ,they cant have free speech..?

      Unless you tell them what the Word of God is,they will have no clue that they should go to a church and convert. Why is it O.K. for people to demonstrate and intimidate people as long as they are not talking about the Christian God?

      We even have Imams going into local schools to lead prayers in the cafeteria. The girls have to sit at the back and if you have your period you have to sit at the very back and cannot pray because you are unclean.

      It’s illegal for a Christian to stand on a street and read the Bible because one person asks them to leave? The prosecutor had to keep changing the charge because the charge he was arrested for doesn’t exist,neither did the other charges. Took them a while to find one that would work. Definitely fishy business.

      Funny thing is that the Bible says that this very thing is a sign that the end of the age is near. It’s to be expected,but it does not make the arrest right. Actually, where the persecution is very bad, the number of converts is growing very fast. Same as in the beginning of the Church.

      If you stood outside my church, on public property (the sidewalk) and read some satanic bible out loud I would not tell you to stop unless the words were pornographic because that would be breaking a law. You are on public property. As long as you aren’t impeding traffic or touching anyone you are allowed to do that.

      I won’t like it, but you are allowed. WE may come over and circle around you and pray…..

      You don’t understand two things.

      1. We have free speech in our country. Even if it’s annoying. Everyone is entitled to it.

      2. It is not against the law for someone to annoy you by what they say. You will have people annoying you your entire life saying things you don’t want to hear. Sometimes it’s your own boss. You have to find a way to cope with annoying people. You can’t command them to stop or throw them in jail.

    But yet the OWS puppets can rampage and destroy {Oakland, San Fran, NYC} across the US basically unimpeded? Encouraged even, by elected officials and ‘celebrity idiots’…nothing suprises me anymore…funny thing is the ‘left’ will see nothing wrong with this action, yet scream for their ‘rights’ when the cops do this to them….

    Perhaps if the DMV had better customer service their customers would not be “captive”. California .. it figures but they are trying to expand to all 57 (Obama) states.
