City Mandates Small Restaurants Hire Armed Guards…or They Must Close Down Early

A new Newark, New Jersey, city council law will require small restaurants to have an armed security guard posted at night. The move — which is already yielding controversy — comes after William, Johnson, an off-duty police officer was killed in a drive-by shooting at the Texas Fried Chicken and Pizza restaurant back in May. Mail Online writes:

Mr Johnson, 45, a single father raising two daughters, was off-duty and unarmed when a pair of assailants fired into the Lyons Avenue restaurant from a slow-rolling car.

He was apparently caught in the crossfire of a gang dispute.

This new regulation, which passed unanimously, says that any restaurant that serves 15 or fewer people must hire an armed guard after 9 p.m. If they do not comply or if paying someone to stand guard is not a financial possibility, food establishments must close by 10 p.m. each evening. Reuters has more:

“If they want to stay open that late, they should provide security. If not, they should close,” said Councilman Ras Baraka, who wrote the bill, in a telephone interview.

“These restaurants who serve 15 or less people, walk-in eateries where you get your food and you leave, they are havens for criminal activity,” said Keith Hamilton, an aide to Baraka.

While this ordinance was clearly passed to keep citizens safe, it is surely a burden on small businesses who may not have the funds to pay a non-service related staff member. Larger, sit-down establishments likely have more funds and would more readily be able to make such hires. But, they are exempt from the law. Some business owners are already responding — and quite negatively. New York City’s ABC affiliate reports:

“With this order, he’ll take us out of business, that‘s what he’s doing,” said Jamil Nahiam, owner of two late-night eating establishments [one of which the shooting took place outside of].

“It would cost me, I can’t afford it,” he added.

The controversial measure is set to go into effect in 30 days. Newark Mayor Cory Booker has no plans to veto the council’s measure.

    I’ve been to Newark many times and it seems all that you hear are sirens wailing in the city streets. Death thru gun violence is a way of life here. But what really gets me New Jersey has some of the nations strictest gun laws. An they want to invoke more? Give me a break! The last time I was in Jersey I made a stop at a Home Depot, and was greeted by and Armed Guard. This alone ought to tell you something. Your not even safe to shop at a home improvement store let alone walk the streets. This law is nothing more than ” You have a nice place here and I’d hate to see something bad happen.” This is nothing more than the Ole Mob protection racket gone to the back room at city hall. If you really want to solve the problem make it easier for eligible citizens to carry a conceled weapon. Then every time a bad guy pulls a gun he’ll be faced with the fact that he may be turning himself into a bullet catcher. Hence problem solved at little or no cost to the government.

      All those sirens you hear are symbolic cries from the victims of a debased black culture in our inner cities where human life is meaningless and the rule of law just words. My heart aches for the innocent people who wake up everyday wondering if they are going to be victims of the senseless random violence occurring around them. Now, this is a crime against humanity and we are allowing this to occur. Heck, soldiers in war zones are safer than citizens in many large cities.

      Pass a Conceal Carry Law Now, before more violence from Criminals escalates.
      It is a Proven fact, that Crime goes down when Conceal Carry Laws are enacted and Law Abiding Citizens are allowed to Carry Conceal Weapons. An unarmed citizen is a Victim.

      I suggest these eateries move to Texas or Oklahoma. If this had happened in either state folks would have pulled out their guns and fired back. Both states are right to carry. You never know who is armed in both states. Here in Oklahoma unemployment is 5.6%. The article didn‘t state it but I’m sure these people have to be union policeman. The off duty policman would have been #1 target if he had been in uniform.

      Many high crime cities across the country with large black populations are experiencing police layoffs, besides Newark and Camden. It will get far worse.

      A friend of mine who lives in Newark said the trend now is for private security, paid for by associations formed by people of means. In other words, private police forces, similar to our private armies who are operating in Iraq and Afghanistan.

      The vast majority of experts are warning that the situation will accelerate, in the next three years, to the point where the only really safe areas are rural areas where people are armed to the teeth and have been all their lives, and they know how to use their weapons very well.

      Newark, Camden, Philly, New York, Los Angeles, Detroit, Cincinnati, Atlanta, Miami, Chicago, East St Louis, Houston, are only a few of the urban areas that will soon resemble war zones.

      As the economy continues to worsen, I look for the situation to reach a Katrina-like point in the urban areas. Vigilanteism will be commonplace, also. Eventually, a large segment of the inner city population will venture into the rural areas, with looting and robberies in mind.

      At some point, very likely the grocery store shelves will be emptied and supply trucks will be hijacked en route to their destinations so often suppliers will either be in armed convoys or they’ll stop shipments altogether. Water will be turned off or contaminated so badly cholera epidemics will be common.

      B.S. The law targets only ONE kind of business, and it is going to fail. Regardless of crime in the city, you can’t target such small businesses for a huge burden and ONLY those businesses.

      Good points made here regarding concealed carry or the right to own a firearm. Question is that I am sure the council has not looked fully at or at least not reported. Where are the armed guards going to come from, what is their level of training and responsability to carry and protect in this case. Who is then responsable when the guard has to use his/her weapon in a response? Does it fall on the owner? The Guard? The Insurance company? The city because they mandated it? So many questions and no answers, the liberal way???? Just a thought posted here

      If you really want to solve the problem, just start enforcing the natural rights that the second amendment was written to guarantee. It says Arms. It doesn’t specify what type of arms, be it a firearm, sword, knife, your teeth, or a grenade. The people have the right to keep and bear any arms that they wish because that right shall not be infringed upon. Of course, people like my grandparents and great-granparents screwed up this whole country to the point where we can’t even be free enough to protect ourselves from violent criminals. Thank Grandpa. Thanks a freaking lot!

    At the heart of the incident are people in a vehicle with guns firing at innocent people, so the answer is clear: ban people from riding in cars with guns after 6PM. Seriously, reactionary tactics as this one will not stem or solve the problem. Increase the violator’s risk of being captured, injured, or killed will prevent this nonsense – put guns back in the hands of citizens.

      Do you read the paper? Do you listen to the news? I know you see it online. I’m talking of the stories of home break-ins and the like. Do you really think it is confined to the cities?
      People already have their guns. They will use them when things get out of hand in the countryside as well as in the city, and they will get out of hand, won’t they.
      That’s when the government will step in and start taking guns. Its all by design, my friends, and it was all planned long ago.

      I lived in Queens, NY for a short time, and I was shocked at the number of stores that sold lunch boxes, jackets, posters, and other trinkets to CHILDREN from the Al Pacino movie “Scarface.” Walking down the main strip of Jamaica, Queens, was a trip back to the 1970s. The PARENTS of the kids that this crap was marketed to had to have been children themselves when this movie came out (heck, I wasn’t even born then), and it turned my stomach that a movie glorifying violence, cocaine, sex, and destruction was being marketed at children. I was utterly aghast.

      Well its like this. It is very seldom I hear stories about crimes being interupted while in process and the bad guys being taken into immediate custody without harming anyone. I never hear the story about the guy who seen starting to climb into a house in the early hours of the morning with a kinfe in his hand planning on murdering all 4 people inside. Recieving protection like that would be priceless. Most of the stories I hear about are usually that a family of 4 was murdered in thier home with the killer at large. Anymore I hear to many stories of this nature and I do realise that the police cant be every where all the time. Generally the police dont know to go after you until after you have commited a crime. That means there is a victim,,,of a murder,,,,of a rape,,,,,assault,,,,,,,robbery etc. If the police could actually protect us from such horrible crimes phrases like serial killer would never exsist. The police come along to find out who killed you and act as a tool of our societies organised vengence system. All societies have them, some one has to make sure others play by the rules and when violations occurr, there are certain penalty that apply. We entrust in them the ability to apply our collective vengence against the transgressor. Soooo, police dont show up to stop you from being murdered, they show up and start collecting evidence to try to figure out who murdered you. Then they try to catch them and bring them before a judge. WE get protected from your killer!

      I went to Newark to take classes on several occasions back in the late 60′s for NJ Bell. There were iron grates for downtown businesses back then. Decades later, the Liberal programs designed to make inner-city blacks dependent on gov. for their existence have proven correct. Any city with a black population is infested with crime. Dysfunctional families are the norm. School drop-out rates continue to grow, while we are told that our schools are the cause. The cause, as anyone with a functioning brain would know, is the socialist programs which have evolved into what we see in Newark today. Let us vote the Marxists back in for 4 more years.

      Yeah, somebody found a use for TSA when they are disbanded! Let’s go back to the Air Marshall program, AND arm the flight crews! The airport can be patrolled by the local police, or private security if a large complex, probably with dogs! Dump the TSA, get rid of the screening machines and let’s get back to the sane use of air travel!

    My first thought is why was a off duty cop going around unarmed. Where I live cops are supposed to carry a backup style gun even if they are not on duty so if they see a crime happening they can intervien. I guess this state wants their cops to be as defensless as the rest of their people?? How dumb is that. Here in Mi the cop might have been killed but at least he would have had a chance to shoot back and there might have been an armed citizen there to help too. G.

    From a Constitutional standpoint, I would say the city is well within its rights. I hope their business tax revenues vanish and their citizens vote the bums out of office that made just a boneheaded law, but I think this country was founded on the principle that laws should come from the local area far more than from the top-down.

    I think that is the way it should be. Is it more likely that these people in the city council will hear from the voters or D.C. bureaucrats will hear from all the voters that suffer under their laws?

      Constitutionally speaking they cannot dictate security policy for private businesses. They can dictate when businesses can be open, but they cannot dictate that a private business must have a certain kind of employee in order to remain open during certain hours. That is completely not constitutional.

    If the timing & requirements are backed by hard data showing this increase in security is tied to crime statistics &:

    a) the option to put more cops on the street at least partially paid for by fee for service business taxes is off the table, then I’m not ideologically opposed to :

    b) requiring more security during certain hours as long as the City sets the goal & min standards of the nature of the extra security: what generally needs done versus HOW to do it.

    Businesses can & should have the dominant vote on how to implement a valid requirement regarding free enterprise.

      City of Newark has absolutely failed to keep its citizens safe.
      They are collecting taxes from locals, and taking money from State and Feds too, but they just want to spend it on their salaries and their cronies.
      So instead of finding some shame and start performing their duties,
      they are mandating the taxpaying citizens to pay for their own safety.
      I’m betting the City of Newark officials have some favorite “ Security ” companies ( owned by their spouses/siblings/ kids /cousins)just waiting to be hired by business owners .
      Its a typical 3rd world corruption tactic.

      I think this is ludicrous !!!!! I think they should be checking out the law enforcement.They should be keeping the streets safe for the citizens and the businesses.If the problem is drive by shootings by gangs, go after the gangs. Go after the problem. They obviously are a bunch of chicken Sh…..s Why not be brave enough to do the job or fire the ones there and hire someone who can do the job.

      How stupid is that! They did say “drive by”! So they have an armed guard, a car drives by and shoots the armed guard, or shoots a customer opening the door to go in or out. So they close earlier and the “drive by’s” start earlier. If there is intent, they will find a way.
