CNN Legal Expert on Today’s Hearing: Obama Admin a ‘Train Wreck,‘ Obamacare Likely Will be ’Struck Down’

As Tuesday‘s hearing in front of the Supreme Court on Obamacare’s individual mandate wraps up for the day, the buzz is that things are not looking good for the Obama administration.

“This was a train wreck for the Obama administration. This law looks like it’s going to be struck down,” Jeffrey Toobin said on CNN. “All of the predictions including mine that the justices would not have a problem with this law were wrong.”

He continued: “The only conservative justice who looked like he might uphold the law was Chief Justice Roberts who asked hard questions of both sides, all four liberal justices tried as hard as they could to make the arguments in favor of the law, but they were — they did not meet with their success with their colleagues.”

He wasn’t the only one. NBC’s Pete Williams echoed that sentiment when he said the law was “in trouble”:

“Sharp questioning by the Supreme Court‘s conservative justices has cast serious doubt on the survival of the individual insurance requirement at the heart of President Barack Obama’s historic health care overhaul,” the Associated Press concludes.

The L.A. Times has some of the questions from inside the courtroom:

Even before the administration’s top lawyer could get three minutes into his defense of the mandate, some justices accused the government of pushing for excessive authority to require Americans to buy anything.

“Are there any limits,” asked Justice Anthony Kennedy, one of three conservative justices whose votes are seen as crucial to the fate of the unprecedented insurance mandate.

Chief Justice John G. Roberts Jr. suggested that the government might require Americans to buy cellphones to be ready for emergencies. And Justice Antonin Scalia asked if the government might require Americans to buy broccoli or automobiles.

“If the government can do this, what else can it … do?” Scalia asked.

Much of the focus has been on Justice Anthony Kennedy, long considered the swing vote between the liberal and conservative factions on the bench. On Tuesday, he questioned whether the insurance requirement “is a step beyond what our cases allow.” Still, while showing initial skepticism of the law, he later seemed to back down from that. Here’s how the respected Supreme Court outlet SCOTUSblog puts it:

If Justice Anthony M. Kennedy can locate a limiting principle in the federal government’s defense of the new individual health insurance mandate, or can think of one on his own, the mandate may well survive.  If he does, he may take Chief Justice John G. Roberts, Jr., and a majority along with him.  But if he does not, the mandate is gone.  That is where Tuesday’s argument wound up — with Kennedy, after first displaying a very deep skepticism, leaving the impression that he might yet be the mandate’s savior.

He and Chief Justice John Roberts are emerging as the seemingly pivotal votes.

Justices Antonin Scalia and Samuel Alito appeared likely to join with Justice Clarence Thomas to vote to strike down the key provision. The four Democratic appointees seemed ready to vote to uphold it.

      If Obama, Nancy and Harry had spent as much time on jobs as they did this he would have an automatic renewal of the Presidency. Instead Nancy got her favorite plastice toy out of her purse and used it on everyone including this Democrat who voted for Obama. I know of 8 votes he won’t get this round. When you feel the effects it makes you think. We don’t like the change and there is no hope.

      UNIX, Wolf Blitzer has been the funniest one that I have seen so far. He tore into the Solicitor General generally referring to him as an awful attorney. I’m looking forward to spot checking BSNBC tonight and frankly I wish I had the time tomorrow morning to check Morning Joe and Mika. I bet they will have their crying clown faces on.

      Their seems to be our problem in this country!
      People make up stuff or language to try and re-write the Constitution with their interpretations!
      The commerce act regulates action that is across state lines only, not action within the state.
      If I wish to buy something made in another state and that product is transported through other states or is electronically passed thru servers outside my state, then it can be regulated by the ICA.
      Not purchases that are only available in my state because no other stat sovereignty is involved.
      The insurance I can purchase in Calif. is regulated by Calif. not the Fed’s.
      So how can health insurance which can not be purchased across state lines fall under the interstate commerce act when no interstate commerce is involved?
      This bill is about taking over commerce in any form!
      This sounds like double talk to me and this song will help you understand.

      A REAL Leader, knowing that HEALTH CARE costs were outrageous, compared to 10-20 years ago would have said: “First we tackle FRAUD and ACCESS. (open up sales across state lines)”

      IF they had a panel, it would be a panel that individuals would appeal to if dropped by their ins. cos.

      ONE SIZE DOES NOT FIT ALL. INS. CO’s are within their rights to charge more for obese people, for smokers, drinkers, druggies.

      Then the next thing would be showing kids that INSURANCE is a foundation block for building good financial future. (47M non-insured – 12M illegals = 35 Non-insured – 25 M kids who don’t see value in getting ins. “now” = 10M who really need but cannot afford ins. )

      The money this GOV has spent trying to get this bogus bill rammed down our throats could have built a clinic in every town with a population over 2000 people in the USA (underwritten loans for local Doctors to build their own clinics).

      That money could have established state of the art processes for record keeping, sharing.

      THEN THE GOV . needs to get rid of the OPPRESSIVE regulations they have on everything. THERE WAS (and still is) a way to FIX MEDICARE but no…Obama wanted it his way or nothing…he’s going to get …NOTHING.

      yea, the supreme court is a joke. imagine if the democrats had control of president & congress for 25 years straight…The entire supreme court would be packed with progressives – and they would tear apart the constitution.

      But the purpose of the supreme court is to uphold the constiution – not tweak it along party lines. This is just another example that this government is NOTHING what the founders envisioned.

      There’s new found excitement from the conservative ranks today. As the Supreme Court hears oral arguments there’s close observation of each justices response We hang on their every word excruciatingly squinting to read between their descriptive lines. If we listen closely and if we analyze critically we believe we can accurately predict how each justice will vote.

      We ask ourselves, do their responses give us legitimate insight into how they think? Absolutely! The words that spew from our mouths generally come from deep inside our heart. Generally, but not always! Can we assess their statements throughout the three or four days of oral arguments and then draw an accurate conclusion? By reading their actions and reactions can we accurately predict which side of the constitutional mandate they will fall?

      I would state a resounding “no way!” Just because Justice Roberts chose to go toe to toe with government council does not enable us clear vision as to how he will vote. Just because Justice Kennedy has offered descriptive and compelling arguments explaining the unconstitutionality of the individual mandate is not truly indicative of his innermost thoughts regarding the Accountable Care Act (ACA) and certainly does not provide us high predictive value into how he will vote. Especially knowing that Justice Kennedy purportedly holds the decisive swing vote.

Also, take with a grain of salt how the media are reporting that even the liberal justices are “questioning” the Constitutionality of MarxistCare. Don’t believe this for one second, or you could be disappointed yet again.

    This country is turning into a literal farce. I mean, this case – should have been decided within an hour of opening arguments, with a 9-0 vote striking MarxistCare unconstitutional. The fact that it will go on for months with the outcome clearly undecided until that time is really a shame. It’s an easy read: You may not coerce individuals into engaging in commerce by forcing those individuals into purchasing health insurance.

      Hold on a second, if they just did a 9-0 vote to strike it down, with no deliberation, it would seem to be more of a farce. They are going to put a bit of lipstick on the pig before they ROAST it. Give them the time, read make it look like it was a hard decision, then throw the thing out…it’s the American way, after all. Don’t lose hope people, once we get this obomination thrown out, we will throw out the obominator in the fall, it’s that simple. I just hope the left let’s us get there in peace, not in pieces!

      Why shouldn’t we be required to buy life insurance? Everyone is going to die. Someone is going to get stuck with all of your bills.
      If you are a pauper we get stuck with the cost of picking up the deceased, examining cause of death, trying to contact next of kin and burying the body on government property.
      Everyone is going to die, so we should have to purchase life insurance if not the cost gets spread around to everybody. By the way social security pays an amount when you die but it covers nothing

      SHERKHAN, I can only suggest that you dislodge your head from your fourth point of contact and try to read at some parts of the bill itself. Frankly, the medical part of the bill is just the camel’s nose under the tent. It is a power grab by the libs and will take right from everybody regardless of political views. This thing even has provisions for future regulation of gold in private ownership. It’s anything but something as simple as you want it to be.

      i dont think a state is authorized to violate our rights any more than the federal govt. i refer you to my post below. The constitution says that anything not mentioned is left to the states, so long as thos things are not unconstitutional.

    Romney needs to reject Romneycare sooner than later. Steve Forbes has discussed this a number of times and has good suggestions on a real positive, market based healthcare plan. Republicans need a solid, well thought out healthcare plan to run on that includes some of the things in Obamacare.

Our natural rights include things like freedom of speech, religion, press, gun ownership, and protection from searches. According to the 14 amendment and the incorporation doctrine, A STATE CANNOT VIOLATE OUR RIGHTS. If the individual mandate in obamacare is unconstitutional…..So is the individual mandate in romneycare

      Romney only needs to point out the differences between his plan and the one the democrats passed in the state legislature. He should also point out that all of his line item vetoes were overridden by the lopsided democrat majority in the State legislature. The Massachusetts health care law is not Romney care.

      Romney’s plan had no mandates. It required people who failed to pay for insurance to pay for their own medical bill (something every conservative should support). There was no penalty for not buying insurance (the Democrats put those in and Romney vetoed them). The plan set up a clearing house where people could buy any insurance plan they wanted from any provider, but the Democrats didn’t like a free market approach and limited it to 20. Romney’s plan would have stopped illegal aliens from get free health care.

      Romney’s plan was created with the help of the Heritage Foundation. It was a conservative’s plan. Hospitals are required by law to provide health care to everyone who shows up, but it would have stopped the current practice of forcing all of us to pay for free loaders who won’t buy insurance and refuse to pay their medical bills.

      What Romney needs to do is point out what his plan really was (too many conservatives don’t know), point out what the Democrats did to it, and then point out that you can’t trust Democrats, especially when they have an overwhelming majority in the legislature.

    It amazes me that proponents of personal responsibility like Republicans do not support a law that requires every human being to be responsible for their own health insurance.

    Everyone gets sick at one point or another, and if you don’t have health insurance you will go to the emergency room for treatment, which costs so much more than the cost of regular checkups and preventative care. For most uninsured, the cost of the emergenmcy visit gets spread among the taxpayers. The new law would ensure that everyone is covered, and spreads the cost.

    Moreover, the new law makes it illegal to discriminate against pre-existing conditions and allows children to stay on their parents’ health insurance till they are 26. This is a huge benefit.

    For those of you who do not need this legislation because you do not have young adult children, pre-existing conditions, etc. and do not want to pay for it through your tax dollars–think long term. lPeople who do not have children still pay local taxes that go to education, and people who oppose war still pay federal taxes when 50% of the budget goes to fighting foreign wars.

      Your premise is entirely wrong BAIKONUR..but that‘s because you’re a blind, uninformed, robotic lefty. The expansion of Medicaid is what’s meant to be funded by the individual mandate. To dumb it down for you…WE now have to pay for an additional 30 million uninsured. So where you’re getting this “eveyone pays for their insurance” idiocy from is beyond me. Oh and BAIKONUR..the CBO just released new numbers on the cost of Obamacare. Obama crowed about Obamacare coming in under $1 trillion dollars (while not acknowledging the budget tricks, three card monty cost hiding and the doctor fix on another bill). The CBO now puts it’s cost at $1.76 trillion. In less than 3 years it’s nearly doubled in cost estimates. We’re not all as stupid as you are BAIKONUR.

      You contradict yourself in your own words. You want people to be responsible for themselves but in doing so through obamacare they share the costs. I am thinking long term. The issue with the individual mandate is that this would allow the government to require you to purchase a product based on the fact that you are alive and in the US. The argument that this is just like states requiring you to purchase auto insurance is an invalid argument. You buy auto insurance because you CHOOSE to operate a motor vehicle in those states. So what other things would the government be allowed to force you to buy or outlaw based upon this law? You laugh about it but think long and hard. This law came about because there were too many people not on health insurance. What if the government decides that too many people are dying from cigarette smoke or drinking alcohol? What if the government decids that too many people die in auto accidents and so you are required to buy a certain vehicle that is made by the government (or GM)? What if the government decides that the cost of raising kids is too high and decides to impose limits on the number of children that you can have like in China? When this law was created it opened a whole new can of worms…

      You show signs of intelligence, but I simply can’t understand which premises you live your life on.

      If the mandate goes down, while leaving the prohibition against denial of coverage for pre-existing conditions, expect the insurance companies to protest loudly! Obamacare is likely to be more popular in defeat than it was when it was on the books. Be careful what you wish for!

      USPatriot: Social Security is not doomed to failure. With a slight increase in the retirement age coupled with an increase in the cap on income taxable to fund it, it could easily operate into the foreseeable future.

      AvengerK: Medicare and Medicaid are another matter! Obamacare does not really solve the problem of sustaining these programs. My point, however, was not Obamacare’s desirability, affordability or sustainability, but rather its political popularity. If the court strikes it down, it will be a Pyrrhic victory for the right. The left will use its defeat to rally their troops. Moderates and ndependents will be horrified either to find insurance premiums skyrocketing, pre-existing conditions no longer covered, and assorted other goodies that were promised no longer in the goodie-bag.

      I still don’t agree LLOYD DRAKO. Once/if the individual mandate is gone Obamacare has no funding mechanism. It‘s just too difficult for the democrats or Obama to tell the American people we’ll be covering 30 million more people on a system that’s already looking at insolvency. It won’t fly no matter what heart strings Obama and the democrats choose to pull. Premiums appear to be going up now anyway and employers are already murmuring about cutting off benefits to pay the fines or take write downs (as Deere & Co has talked about). People understand the compassionate aspect of it but they don’t want a flawed monstrosity like Obamacare trying to address the problems with health care coverage. The biggest factor is cost and Obamacare doesnt’ address it.

      Your totally missing one fact. Over 60% of people Don’t want Obamacare and never did. If the individual mandate is struck down the funding is gone. Insurance companies will raise premiums on those with pre-exsisting conditions and the idiots who have their 26 year old (Children) adults on their insurance, as it should be and there will be nothing the liberals can do about it. You underestimate the intelligence of independents. They are already jumping the Obama ship in droves because for the most part they are tired of liberals telling them it’s raining out when actually they are being pi ssed on.

      True. They KNOW they have 4 votes because the liberal judges would vote in favor of the law even if they were on fire and they could only be put out by voting against it. We only can be certain of THREE votes at this point. So we’re behind 4 to 3 and have to get BOTH the other votes to retore sanity to this land. Either one of Kennedy or Roberts cracks, and he will be the justice that took down the greatest nation in the history of the world. I just hope that thought is enough to make them both err on the side of the American People.

      Guarded optimism is my tact today…we so need to hear legitimate moral boosting news from some corner of this Government.

      Something else to consider, Judge Andrew Napolitano, about an hour ago gave his prediction on how he believes the SCOTUS vote will go–he says, probably a 5 to 4 against Obamacare. Particularly because of the “exceedingly” stinging questions by a couple of the judges, especially from Kennedy. The Judge has not yet listened to recordings of today’s proceedings, but this is his impression of the mood of the Court so far.

      Could be happening. Fingers crossed. (Where is my hankie?)
