College Professor Arrested for Closing Student’s Laptop in Class

Professor Frank J. Rybicki teaches Mass Media at Valdosta State University. The other day, he was arrested for assaulting a student in his class and is now facing battery charges.
Did he punch the student? No.
Did he throw his chair across the room at the student? Definitely not.
Did he inappropriately get a bit too intimate with a student? Not even close.
He was arrested for shutting a student’s laptop in class. The student, the professor claims, was web-browsing on sites not related to the course, instead of taking notes. After he closed her laptop, an argument ensued between the professor and the 22-year-old girl. Then, soon after the argument, the professor dismissed class early because he was so upset.
That was Friday. The following Monday, when the students came to class, instead of being greeted by their professor, they were greeted by officers.
Inside Higher Ed has the story:
Frank J. Rybicki, assistant professor of mass media at Valdosta State University, did the equivalent last week when he shut the laptop of a student who was allegedly web surfing as opposed to taking notes. She filed a complaint (reportedly about a finger or fingers that were hurt when he shut the laptop) and the university’s police arrested him on a charge of battery. The Georgia institution suspended his teaching duties there, although not his pay.
The professor–and the students in the class–were asked by the University to not answer any questions relating to the incident. Still, Professor Rybicki did have a few words to say about this fiasco:
While he declined to discuss the incident specifically, Rybicki did answer a few questions. Asked if students shouldn’t look at non-class websites while in class, he said that was “pretty obvious.” Asked if he had ever caused physical harm to any student, he said “absolutely not, never.”
Many students have come to the defense of the professor. One said that his arrest was not justified “because he is a great teacher and she [the student with the laptop] was on Facebook, when we know not to be on other sites while the teacher is teaching.”

I am a young college student, but I am far from “spoiled and brattish.” I agree with you THIS girl is probably pretty bratty, but how dare anyone generalize college students for this one girl’s overreaction. Many of us have worked very hard to get into good schools, and I’ve had to work 2 jobs and go to school full-time to pay my own bills because I refuse to rely on my parents to reach my goals. And for the record, I know many fellow students that also hate it when a classmate is rude enough to be on Facebook or any other non-educational website during lecture. Don‘t judge today’s youth based on some “bad apples.” We’re just as frustrated as you are.

Many just have no respect for age, authority, or others. It is sad to me because it is a sign of the continued erosion of our foundations as a nation.

I agree with the student on this one. If this were YOUR child and a professor did this, you would NOT like it either. How ever, if a professor has rules in his or her class, then they can expect each student to obey them. Closing the computer when someone is typing, is not okay.

The young princess in this story had parents that did not do their jobs. Now society must suffer her lack of good manners for the rest of her crummy life. Pray she does not bear children to pass such disgrace on to a subsequent generation.

If the prof hurt her finger on purpose (I doubt it), that was a bad judgement call on his part but I would hardly consider it battery. Teachers need and deserve respect.
How stupid. She’s 22 years old and supposed to be there getting an education, not updating her status on Facebook. How rude. She’s embarrassed and seeking revenge.
I would love to have the opportunity to attend college and most certainly would not waste mine and my professor’s time by playing on the internet while in class.

I think he should argue that he was saving carbon credits for Al Gore! Maybe he was afraid she had a compromising picture of him on Facebook and was showing it to the students behind her? If she was ‘in the class’ how did he get close enough to shut the computer on her? He should use an electronic jamming device in his lecture hall–thus local notes entry is all that can be done? Maybe she was ‘researching’ an item he was trying to teach? If she was playing ‘Pong’ or another computer game, maybe the gongs and sploings were distracting other students? If she was watching a porn video, maybe the groaning and moaning was just too much? Maybe he saw a fly on her screen and was trying to squash it? I‘d bet she wouldn’t behave the same way in church, during the sermon! Maybe he should have just invited her to share with the class–and put it up on the video presentation?

Georgia defines simple battery (a misdemeanor) as (1) Intentionally makes physical contact of an insulting or provoking nature with the person of another; or (2) Intentionally causes physical harm to another.
Seems like he could conceivably be guilty. The professor probably did intend for his action to be insulting and perhaps provoking. This is a case where a prosecutor should exercise his or her discretion to dismiss the charges. That, however, does not mean the professor is not guilty of battery.

First, I agree that the student should have more respect for authority. If the professor has a rule against browsing the web in class, then the student should follow it. However, none of this would be an issue if the ridiculous rule was never there in the first place.
You all are so quick to point fingers. But you’ve pointed them at everyone except for the one person who needs to be called out. The professor! The professor works for the student. The student pays tuition, which pays his salary. The student is the customer. Explain to me why the student shouldn’t be allowed to browse the web in class? If she doesn’t need to listen to the lecture, why does she have to? As long as she’s not being disruptive, who is the professor to say what she can or can’t do with her own time?
College has turned into a daycare center. The curriculum has been dumbed-down. Why… because as more and more people attend college, the system needs to bring itself down to a low level so that those students who really don’t belong in college are able to pass the course. College is a joke. If the professor is rambling on and on about a subject that the student already fully understands, why can’t she just sit there and browse the web quietly? I know that the professor would say that having the student browsing the web in class is a distraction. Nonsense. If she’s quietly minding her own business, how is that a distraction? If other students are distracted by her, then in my opinion they have no business being in college at all. If that distracts them, then when they graduate and get a well paying job, they‘ll have so many distractions in front of them every day they’ll be fired within weeks.
I could go on forever. Was the student disrespectful? Yes. But the professor’s rule is absolute nonsense. Its college, not high school. In my experience in college, the professors who showed their students the most respect (ie. not micromanaging what the student did in class) were the ones who received the most respect from the students. Although I disagree with the student’s lack of respect here, I applaud her for bring this ridiculousness to light. The professor had this coming to him. Show your students more respect in the future and maybe they’ll actually want to listen to what you have to say.

This was an adult, who has paid money to be in that class, and as an adult can use that time any way she wants to – wisely or foolishly. Now if she’s wasting the time, and I was her dad paying the bill – I‘d definitely have a ’discussion’. I know that someone said that the student pays the teacher, but I actually think that’s not quite right. The student pays the college for the privilege of attending classes there and hearing the teacher deliver lectures and lessons. If the student was hiring the professor, it would be one on one or private lessons. If the girl didn’t want to pay attention to the lecture, why didn’t she just skip class and hang out in the snack bar or somewhere else? Yeah, the prof was a bit short, but having him arrested??? Well, she does have the right to do that, apparently. But I think she may regret her actions in the future because guess what, her future employers are going to Google her name.

Posted on April 6, 2011 at 3:41amMaybe, maybe….. but I doubt it. If the elements of the crime were not met, the officers would not have made an arrest. To even get in front of a judge, a state’s attorney would have to be convinced he would be able to prove his case. Then there is the matter of civil suit. The “bar” is much lower: “Preponderence of evidence”. This student is trying to make a case out of this: “don’t mess with me”, I was going to fail anyway, so now I have what I need to get that “A”. “I’m entitled”. I wonder what the back story is here. Prior history, shunned attention, previous comments that offended the student…. This just didn’t happen “out of the clear blue….” The truth will come out. We need much more information before we/I have enough to make an informed decision.
