Congress Still Finding Ways to Pass Earmarks Despite Ban — Here’s How (And a List)

Citizens Against Government Waste Congressional Pig Book Report 2012The government watchdog group Citizens Against Government Waste (CAWG) has released the 21st edition of its Congressional Pig Book (an in-depth examination of pork-barrel spending) and it has some good news and some bad news.

The good news is that since the House voluntarily imposed a ban on pork-barrel spending in 2010 (the Senate in 2011), the number of earmarks has plummeted by 98.3 percent (from 9,129 to 152) and the cost has decreased by 80 percent (from $16.5 billion to $3.3 billion).

Wait. Although those numbers are good — quite good, actually — why isn’t the decrease in both the number and cost of earmarks 100 percent? We thought there was a voluntary moratorium on pork-barrel spending.

That’s where the bad news comes in.

“Congress has figured out ways to stuff earmarks into spending by calling them different names,” CAWG president Tom Schatz explains, according to CBS News.

The CAWG report explains one of the problems with the self-imposed moratorium:

The supposed lack of earmarks resulted in a completely opaque process. Since earmarks were deemed to be non-existent, there were no names of legislators, no information on where and why the money will be spent, and no list or chart of earmarks in the appropriations bills or reports.

Earmarks were scattered throughout the legislative and report language, requiring substantial detective work to unearth each project. While the lower number and cost of earmarks is a vast improvement over prior years, transparency and accountability have regressed immeasurably.

“The transparency is much more difficult and it will be hard to see where, exactly, the money is being spent as it goes out the door,” Schatz said.

“Since they‘re technically not called ’earmarks‘ under Congress’ definition, Congress doesn’t have to disclose details — including who requested the money to be spent,” he adds.

According to the CAWG report, anything that satisfies at least two the following criteria is considered an earmark:

  • Requested by only one chamber of Congress
  • Not specifically authorized
  • Not competitively awarded
  • Not requested by the president
  • Greatly exceeds the president‘s budget request or the previous year’s funding
  • Not the subject of congressional hearings
  • Serves only a local or special interest

And these are some of the projects CAWG found that violate the moratorium:

  • $120 million to the military to research alternative energy.
  • $255 million to upgrade the Army’s M1 Abrams tanks.
  • $14 million for hydropower construction (the report believes this earmark is meant to benefit New York based on Sen. Chuck Schumer [D-NY] past involvement in hydropower earmarks).
  • $10 million for the Chicago Sanitary and Ship Canal Dispersal Barrier.
  • $48 million for the National Domestic Preparedness Consortium.
  • $3.4 million for national fish hatchery system operations.
  • $15 million for Rural Hospital Flexibility Grants (Flex) through the Department of Health and Human Services.
  • $5 million for abstinence education.
  • $5.8 million for the East-West Center in Hawaii meant to improve relations among Pacific nations. The center‘s recent projects include an endowment to honor President Obama’s mother.

“Because a moratorium is not a permanent ban on earmarks, a bipartisan group of senators is proposing such a ban,” Schatz said. “Since that effort has been rejected so far, it is reasonable to conclude that a majority of senators would like to restore earmarks.”

“Such a decision would bring back a deceptive practice that encourages backroom deal-making, vote swapping, and other political gamesmanship. It would also reverse the substantial progress that has been made in reducing the number and cost of earmarks and outrage the vast majority of taxpayers who continue to oppose any earmarks,” he added.

    Half the story…

    Earmarks 101:

    First and least significant…earmarks are a way for our Congressmen to represent their constituents by getting ‘tax dollars’ back to them. In other words…they are doing what they were ELECTED to do.
    Secondly and most importantly earmarks are not all bad. Earmarks=TRANSPARENCY (for the money). Cutting earmarks will NOT cut spending/debt one IOTA; THAT money still gets SPENT regardless of the earmark outcome. IF an earmark is NOT placed in the bill, THAT money gets spent by the executive branch (i.e. OBAMA) with NO disclosure/transparency.
    So…if there were no earmarks then there would be NO transparency for that money, and THAT money still gets SPENT. The money that would have gone to the ‘earmark’ instead goes to the executive branch (i.e. Obama) and the executive branch would spend this money however it/he see’s fit without DISCLOSURE. By earmarking and then voting against the bill Ron represents his constituents and at the same time is making the money TRANSPARENT.
    AGAIN…If those bills are NOT earmarked, the money is still SPENT (with NO transparency by the executive branch). By earmarking the bills you are making the money TRANSPARENT.
    Ron Paul has NEVER voted for an earmark.
    Cutting the number of earmarks does NOT cut spending. Earmarks account for roughly 1% of federal spending FYI.
    It makes sense to earmark the alloted funds and KEEP transparency vs NOT earmark and still spend the money with NO transpar

      Paul’s strategy of stuffing legislation with earmarks that benefit his constituents and thus his reelection, and then vote against the overall bill knowing full well it will pass over his objections so he can claim to have opposed all the spending in the first place is nothing more than the same old same old game from a guy who say’s he a principled Washington outsider.       Earmarks are the same thing a bribery, you vote for mine and I’ll vote for yours. It needs to STOP to bring back some kind of sanity to government. Down size the Fed and the money can stay in the state and not have the Fed take 75% of it like they do with the education money. You have to do away with all corruption, just 1% or not, decay is decay and the Fed is 1% us into bankruptcy.

      Time_2, I just want to ask you if you think we are still a government of the people, by the people and for the people? If not, do you think that Obama and his administration are the sole perpetrator of this shift from our free society? In another post, you said that Paul was treasonous. That is a very strong accusation and should be thought out before being said. I believe that treason is when you subvert the Constitution, when you have given an oath to protect and defend it as a public official. Treason defined:

      1. the offense of acting to overthrow one’s government or to harm or kill its sovereign.
      2. a violation of allegiance to one‘s sovereign or to one’s state.
      3. the betrayal of a trust or confidence; breach of faith; treachery.
      If Paul were to turn his back on his constituents and not try to get their tax money back to their district, he would be committing an act of treason toward the people that elected him. He does the best job he can for them, but he still refuses to put his yes vote on any bill that is unconstitutional, a yes vote, on any bill that is unconstitutional, would be a type of treason.

      Ian is correct….. The language has been confused – earmarks are not the same as pork barrel spending (though some earmarks can turn into pork)

      It’s like this – you have a monthly budget of $1000. You earmark $100 for utilities, $100 for food…..pork would be $100 for your psychic to have a new tattoo done by your son the newly licensed tattoo artist while drinking champagne by the pool in your back yard

      If we were following the Constitution, we wouldn’t even be having this discussion.

      Under our current NON-CONSTITUTIONAL policy, the Executive Branch is the automatic allocator of appropriated funds; even though the Constitution says that it’s Congress who is supposed to allocate funds.

      So, the CLOSEST thing to doing what the Constitution says – apart from kicking out all the Marxists and educating the People as to what the Constitution says – is for Congress to go ahead and earmark (aka “allocate” – it does not mean to “stuff into”) the money that is being requested SO THAT THE EXECUTIVE BRANCH DOESN’T GET TO USE THE TREASURY AS A SLUSH FUND (any more than it already is, that is).

      If the Appropriations Bills amount to a waste of the people’s money, then vote against it – BUT THE REQUESTED FUNDS MUST STILL BE EARMARKED, IN CASE IT PASSES.

      On a related note, all funds which do get appropriated, and which have already been allocated to the states, should be kept by those states; Because if the states return the money, the Executive Branch will use it as a slush fund.

      This is why Ron Paul will fight to keep even that money which has been allocated for use as subsidies, which he opposes.

      More reason to have term limits! The government needs to fire all 200 of the lawyers working to screw the public. All laws need to be written by a non-lawyer with a provision that all loopholes are null and void. It’s like the 2000 + page Health Care law that was written to hide and deceive and most lawyers couldn’t even understand it. I could have covered the basics in about 10 to 15 pages.

    Just have the president pass a mandatory moratorium on any and all, he did it to to domestic oil drilling. Like that will happen, I think the stimulus bill had over 9,000.

    OK, here I go- military tank upgrade, Ok with that. Fish deal, OK with that. Don‘t know if any of you know but in the 1800’s a plan to save salmon on the river in Sacramento, when the dam went in, is very successfull and has done real good for fish and people. I also had the opportunity from water abatement in Lancaster, Ca, to get free mosquito fish, which is a blessing to farmers and cattlemen alike. This group does good work for everyday stuff to sport fishing, I like these folks a lot. Domestic preparedness, my question, who is getting prepared and for what? BIG question mark there. Money for rual hospital stuff, I am OK with that. If you live in the boonies it’s a matter of life and death-however, want to know how it will be spent.. Abstinance is counter terrorism as far as I am concerned, the rest is BS, with all capitols, especially the Hawiian thing. Mickgringo-you are a hoot!
