(UPDATED WITH VIDEO) Congresswoman: People Are Planning to Die Soon to Avoid New Estate Taxes

CHEYENNE, Wyo. (AP) — U.S. Rep. Cynthia Lummis says some of her Wyoming constituents are so worried about the reinstatement of federal estate taxes that they plan to discontinue dialysis and other life-extending medical treatments so they can die before Dec. 31.

Congresswoman Cynthia Lummis (R-WY)

Lummis, a Republican who holds Wyoming’s lone seat in the U.S. House, declined to name any of the people who have made the comments.

But she says many ranchers and farmers in the state would rather pass along their businesses to their children and grandchildren than see the federal government take a large chunk.

Lummis and other Republicans are fighting to renew the Bush-era tax cuts, which expire at the end of the year. The cuts exempt large inheritances as well as certain wage income, interest, dividends and capital gains.

    I am encouraged by the number of people who understand the effect on farm and ranch families. You can‘t just sell off the equipment to pay the taxes or you can’t run the business. If you chop up the land, you disturb the delicate balance of machinery/land size which makes it cost effective to make any kind of profit. After all the hard labor, huge risk management, and sometimes generations of investment, the government just takes it away. Don’t be surprised at how much of the progressive agenda is aimed at harming agriculture. We can’t have private ownership of something as important as our food. Do a little research and you will find how deeply embeded George Soros is in the ownership of grain elevators and facilities. Be worried, be very worried.

    I’m not for folks dying to save money. The estate tax, though, is unfair. Someone earlier posted a comment about rich kids inheriting money tax free. Let’s not forget, this money has already been taxed. It was taxed when it was earned. Just because it wasn’t spent, but rather passed on to family, the good ol’ government taxes it a second time at an even higher rate. The estate tax should be abolished entirely.

    The Federal Estate tax is the most aggregious tax ever imposed. It is an outright example of double taxation, which we should never have. When a person gets a good education, works hard, builds a business or an agritulture operation, he or she has already paid income taxes on any earnings they have made. The rest after taxes is theirs.

    The Estate tax re-taxes the same earnings already taxed once. It destroys family farms, especially those near urban areas where land prices are high. This tax should never have been started in the first place. It is just another form of COMMUNISM!

      Alan is a good friend of mine. He told me a month ago when he was home that Demos were lying about Social Security Benefits being cut, I told him I know that. He says there is no intent to cut any benefits.
      Reform, maybe, like the demos putting all the money back that they stole out of the SS trust fund.
      They need to go to jail just for doing that.

    It’s so sad. I’m sure the survivors would rather have their family with them. I sure would like my father-in-law back. But, I’m hearing, that Washington could still make the death tax next year retro- active, and that those of us who paid nothing this year, might get slapped with the 55% anyway.       This is what I fine so funny about the “Bush Tax Cuts of 2001-2003″ The Democrats claim it will cost The Federal Government $700 billion if they dont allow them to expire…..hmmmm think about it If they didnt spend so dayum much they wouldnt have to worry about extending the cuts. Plus my personal take if they allow the tax cuts to expire the Democrats wont use it to pay down the debt they will use it as another slush fund just like TARP and Stimulas bills.

    I can understand that comment. Sad but I can. The Death Tax is so high most would have to sell in order to pay it. That is absolutely not acceptable. Some of these farms and businesses have been in these people’s families for generations and they could lose it all and for what.       DEAD PEOPLE CAN”T PAY TAXES. THE’RE DEAD! The heirs who may have done nothing to earn a penny of the dead person’s wealth pay the taxes. The estate tax affect less than 2% of all estates. Is it fair for some rich kid to get a billion dollars tax free because they had successful parents while working people pay 30-40% of their earned income in taxes, including Social Security, income, sales, property and many others. Sorry if these fools are so greedy that they would rather die sooner than pay taxes good riddance to them. Besides most of them have been using lawyers and CPAs to avoid paying their taxes anyway. Also what does that say about their children? Would they sit by and watch their parents die so that they could get more money from the dead mother or father. That’s pretty selfish and sick.

      I would like to educate you. Please try to keep up. No rancher or farmer out there made their money without using their family as workers. Period. Yes, their sons and daughters worked as hard as grown adults when they were children and helped earn every penny on that farm/ranch. That is how it works. Obviously you were raised as a city slicker and can’t fathom the concept of being woke up at 4:30 am to tend to chores before going to school and then as you took that long bus ride on gravel roads back home after school knowing you had much more work to do before sitting down for the evening meal. I speak from experience and I lothe people like you who form uninformed opinions so quickly, with your nose in the air, confident you are so knowledgeable. You don’t know jack sh@#

      The people that get hurt are that farmers and small businesses that have a lot of value in their assets (land, machinery etc) that get caught up in the death tax. Around here, it only takes 200 acres of land, not a large farm by any stretch, before they are in that “rich” class, not even counting the hundreds of thousands of dollars they have invested in the tractors etc to work the farm. That is the biggest reason family farms and businesses go away.

      These people worked their whole lives and built this wealth. They have already paid higher tax rates on it than any other class of people pay on their’s. It is there right to pass on this pretaxed wealth to anyone they please. Estate taxes are nothing more than an attempt at stealing another man or woman’s property to spread it around. It is time to do away with The Death Tax for all people.

      This is family wealth. A man or woman has the right to work all his life and save his money with the intent to pass it on to his children. That is what parents do. They try to make life better for their children.

The estate taxes affect them to the point of everything that the entire family (I do mean the WHOLE family from children all the way up) has worked for will likey have to be sold just to pay the estate taxes. There goes the family farm or ranch…. good move. I am sorry that it offends you that rich brats get to benefit from this too, but you cannot give it to some and not others. Too many people would lose what has taken generations to achieve because the gvmt has become so bloated and greedy! Now who are the Greedy whores?

So what is your point? That it’s selfish to want to pass on something to your heirs? That’s the kind of progressive, wealth distribution nonsense that we’re trying to stop. The people who EARNED the money also EARNED the right to pass on the fruits of their hard efforts and smart decisions to their heirs. I don‘t give a rat’s ass whether the heirs earned it or not. Because you know what? The eventual recipients of it, if it’s confiscated by the government, won’t have earned it either. Unless you consider remaining on the public dole “earning” it.

      Dead people are DEAD. Seems like they don’t need to have any money now. Get it? 95% of family farms pay no estate tax. For those that do the first several million dollars od value is exempt. The whole family farm argument is total BS. How about the children of hedge fund managers who are taxed only 15% on their earning while alive. Should their heirs get a few billion tax free while the rest of us who work pay taxes? You people simply don’t get it. So call me names and spew your hate but the reality is that a very small percentage of estates are actually taxed and even those get several million tax free before the tax triggers. It is very unlikely any of you here will ever be affected but you will pay taxes on mostly everything you earn and then will be “double” taxed when you purchase goods or services. After all wasn’t all of your income subject to taxation and the money removed before you all even got your Walmart paychecks?

      Let’s see… My life is close to the end and I own a family business or family ranch. The value on Dec. 31 is 100% my family”s. The value on Jan 1st is 45% my family’s and 55% the government. If we are talking about my family having to sell the family ranch in order to give the government over half then I may have to save my heritage by exiting a little early. The real question is why anyone needs to even think this way? Explain how my ranch belongs to the government?

      More sad commentary about the devastating effects of the Dems actions on tax increases. Also some interesting remarks by Dem bloggers here…. I say that a person works all his/her life to build a ranch or other business (which serves all of us btw) and he/she is suddenly faced with the reality that Obama’s government is going to screw their children by forcing a sale of their property is b.s. All this because there are a bunch of greedy people of all stripes in Washington supported by a bunch of jealous Dems. The love of money may be a great evil but unbridled jealousy and the love of power is far worse.

      The bottom 50% pay 14% Social Security on 100% of their income vs the less than 0.1% the very high earners pay, 7-10% sales taxes, state and local taxes, Medicare taxes plus numerous other taxes. They probably pay an effective rate of over 25%. Besides even if they did pay 0% on their $35,000 income I’d rather be the guy making a billion a year paying 95%. You see I’d still have $50 million after taxes vs the other guys 35 grand. That is why we have a progressive tax system. Those who can afford it pay more.

      The money that is taxed has been taxed when earned already. Why should it be taxed again when it is passed on to these people’s children. To say it only affects 2% of the people is like saying it’s okay to discriminate against only 2% of U.S. citizens. It is never okay no matter how few. As for the simplistic argument why should the heirs get allot of money for nothing the answer is that because their parents worked all of their lives for it at nearly 50% tax rates, saved the money to pass onto their children, and the government steps in and takes another 50% cut. The question should be why should they have to pay anything. This class warfare b.s. is getting old which is one of the reasons that the liberals are in trouble. Instead or worrying about anyone who makes more then you why don’t you worry about yourself. It you think that we aren’t taxed enough stop claiming exemptions on your tax returns and even send more money to the IRS then required. Jealousy is such an ugly animal.

      sorry gopatheist… we get it, you don’t. your premise is that when people die their money belongs to the government. sorry, but it doesn’t work that way. when you say, “Should their heirs get a few billion tax free while the rest of us who work pay taxes?” you are asking the wrong question. you should say, “How much money should the heirs be forced to forfeit to the government, after their parents have already paid taxes and obviously taken many risks that have SIGNIFICANTLY grown the economy?” how do you know the money the government confiscates wouldn’t have been used to build a successful business that would have provided desperately needed jobs?
      and yes, walkwithme, i am positive the death tax is scheduled to go back into effect on jan 1. i believe there was legislation offered by the democrats to put it at 45%… republicans wanted 35%. neither could get enough votes so we’re stuck with 55%. which is absurd, considering the gift tax equal to the highest individual tax rate. so people will now start gifting away their money to get under the estate tax threshold.

      USAMAMA, thank you, I loved your story. My step-father (more my real father) ‘s family came from Hungary – dad, mom and seven children. Dad died soon after and mom took in laundry (NYC) to support the family. They also came thru Ellis Island as most did back then, legally. All are dead now but they worked as soon as they could to help keep their family together. Dad ended up a stock broker in FL and very well respected. He started out as an elevator operator (read constantly) and then a runner on Wall Street, worked hard and made a great living. He didn’t have to adopt me but he did and taught me “hard work never killed anyone” (his favorite saying). God bless your family, they should be an inspiration to future generations.

      @ GRANDMAOF5, I love your story also! I think most Americans have stories like ours but we are being lied to by the progressive elites who want people to believe that you can’t make it without a hand out. I didn’t finish college, I took the other route and fell in love, married and started a family at a young age. My husband and I don’t own our home and have one car between us but in America thats OK. We get by just fine and I love our simple life. What we have is OURS and I am proud of that. My sister, like I said, spent 12 yrs after high school working to become a DO. She put her personal life on hold, she got married but has put off having kids despite wanting to because she wanted to get her career going and she also should be very proud of that. Is she making good money now, yes. Am I entitled to it? Heck no. I could not have done the things she has done or seen the things she has seen. But she has the determination, the will and the heart to do it, and she deserves every penny she gets.

      On another note, my husband didn’t finish college either, but he started his job 8 yrs ago as a line cook in a local restaraunt for minimum wage and is now the Executive Chef. God Bless America for giving him that opportunity. Hard work does pay off.

      And as for GOPatheist, you first need to explain what/who gives the “right” to take a US citizens money. And some 1000 page crappy document some bureaucrat wrote don’t count. All these “taxes” are really unconstitutional. There are only a few real taxes that need to be paid for the military, etc. This “general welfare” clause has been blown out of context. When you make someone pay a higher % of taxes than someone else that in itself is discriminatory. Where are the cries of fairness then?

      It’s only because there are fewer wealthier people so the “mob” of masses of poor people make the illegal law for the fewer to pay more. The fewer have no voice. I am in favor of cutting back on taxes in general and going with a flat tax. Everyone will pay the “same” percentage.

      Cut all the wasteful spending as well. Zero earmarks and congressional term limits.

      If you had a sizable estate .. are in ill health and knew that you could pass that money on to your family if you die before Dec 31st TAX FREE… who wouldn’t make that “happen” !

      Besides Obamacare will just keep you alive long enough to tax the heck out of you .. and then deny you treatment! I would stop treatment also and scr*w over the government .. that money was TAXED when you made it .. you should be able to pass it on!

If you spent your life working on a farm for next to no money, and just the wholesome goodness of earning a living on the land, raising livestock & growing food, would you want to have your entire farm & land taken away from you because you died in 2011 instead of 2010? Your children, your family tossed out and thrown to the winds of fate?

      Estate taxes were designed 80 years ago, and there were no adjustments for inflation. Land value has grown so high in many markets. It has happened where to inherit the business, assets of your parents will generate hundreds of thousands of dollars in taxes. The only way the successors can pay for it, is to liquidate their entire estate. If was not supposed to rob families of their livelihoods, or prevent familys form inheiriting their lifeswork.

      Read up on it. It is grossly unfair. Imagine if your own parents died next year, and the government suddenly demanded you pay them millions of dollars because your parents just happened to own property in California or New York….

      A progressive tax system is either theft or favoritism (and therefore unconstitutional) because it treats one person different than another.

      A flat tax would bring in more tax dollars the more productive a person is.

      Also, I wanted to say to you that if someone earns a bajillion dollars, and he’s already paid his [flat] taxes on them, then the wealth that he created has already been taxed, and all the rest belongs to him, such that if he wants to give it all to someone else, that is his right, and it ought not be taxed again.

      Remember that fiat money is basically worthless, and that it merely REPRESENTS the wealth that someone CREATED. Once wealth is created, it shouldn’t be taxed more than once, because to do so means that we’re working for the government, rather than the government working to ensure that individuals can support themselves with the fruits of their own labor.

      This story and some of the responses here just sum up in a tidy little way what exactly is WRONG with this country today. How idiotic and foolish are you who say the government is entitled to someone’s wealth when they pass away. You say the dead person is dead and doesn’t need their wealth.. well, DUH.. ..but, that means that they aren’t entitled to leave it to whomever they please??? Their heirs or charity organization or pet hamster for that matter of the deceased person‘s choosing aren’t entitled to it because THEY didn’t work for it??? ….That‘s just the stupidest argument I’ve ever heard ..but just supposing for one second that your argument actually had any merit.. …and going with your own stream of logic here.. how exactly IS THE GOVERNMENT entitled to any of what this dead person worked to acquire while he was living?????? Did The GOVERNMENT work for it?? ..I‘m willing to bet you the heirs of this dead person did far more to ’deserve’ the inheritance than the government ever did!!! …The dead person in all liklihood paid the same overly burdensome amount of taxes that most hard working people pay while he was living. Taxed at every turn and any time the government could figure out another way to screw him. Most of those silver spoon brats your so jealous of start working with their parents as soon as they’re big enough to carry a milk pail. What do you do when the time comes, knowing your kids are going to have to pay 50% of their inheritance, i.e. THE FAMILY FARM in estate tax? Pray tell me douchebag, how do you pay 50% of a farm? I’ll tell you how, you have to sell half of it off. How is that a good thing?

Other posters have beat me to it already. But my question for you is this. Why do you call yourself GOP atheist when you are obviously a member of the un-American party of ENVY? Even if this was only affecting billionaire fund managers, what makes death a taxable event? Why does the government have the right to compensate and redistribute the assets of a family? Who gave government that power? We need either the flat tax or the Fair tax to wipe out all this nonsense. Governmental redistribution of wealth and a progressive income tax are MARXIST!

      Quite simply you have your head where the sun don’t shine. The wealth that individuals have accumulated over their lifetime has already been taxed. There is not a single item or service that can be purchased that isn’t taxed somewhere in the chain of production and delivery. Now the greedy government wants to tax it again when you die. This death tax is outrageous and amounts to double taxation. It has the biggest impact on the family’s of farmers and ranchers.
      You my friend are misinformed and quite simply not too bright.

      It is sad and true.
      A good friend of mine had a long and successful career working for an international company setting up factories all around the world. In May he was diagnosed with cancer that is not curable but with aggressive chemotherapy could have extended his life possibly to 2012. Instead in September, he went into his garage, started up his car, sat down next to the tailpipe and shot himself in the head. He left a note indicating that as long as his death was certain he preferred to leave more for his children and grandchildren without taxes and expressing his desire to not be a 2 year progressivly worse burden.

      I dont know that I would have done what he did, but I do understand.
