Conservative Victory? Vote Counting Error Rocks Wisconsin Court RaceWAUKESHA, Wis. (AP) — A stunning discovery of votes in Wisconsin could give the state’s hotly contested Supreme Court race to the conservative incumbent in an election largely seen as a referendum on Republican Gov. Scott Walker’s explosive union rights law.

Adding another twist, the county clerk who said she incorrectly entered vote totals in the race has faced criticism before for her handling of elections and previously worked for a state GOP caucus when it was controlled by the candidate who stands to benefit from Thursday’s revelation.

The corrected totals gave Justice David Prosser a 7,500-vote lead over little-known liberal assistant state attorney general JoAnne Kloppenburg, according to unofficial tallies. Before the announcement, it was assumed the race was headed for a recount. The difference between the two had fluctuated throughout the day Thursday as counties began verifying votes, but at one point was as close as 11.

Opponents of the law that takes away nearly all public employee collective bargaining rights had hoped a Kloppenburg victory would set the stage for the high court to strike it down.

Kloppenburg’s campaign manager Melissa Mulliken demanded a full explanation of how the error occurred and said an open records requests for all relevant documents would be filed.

Waukesha County Clerk Kathy Nickolaus said it was “human error” that resulted in more than 14,000 votes from her predominantly GOP county not being reported to The Associated Press on Tuesday. She said the most significant error occurred when she entered but did not save totals from the city of Brookfield, a suburb of Milwaukee.

“This is not a case of extra votes or extra ballots being found,” Nickolaus said. “This is human error, which I apologize for.”

Nickolaus worked for 13 years for a Republican caucus that was controlled by Prosser when he was Assembly speaker in 1995 and 1996. She was given immunity from prosecution in a 2002 criminal investigation into illegal activity by members of the caucus where she worked as a data analyst and computer specialist.

The corruption probe took down five legislative leaders, all of whom reached plea deals. Nickolaus resigned from her state job in 2002 just before launching her county clerk campaign.

Nickolaus also has been criticized by the Waukesha County Board for her handling of past elections and lack of oversight in her operations.

An audit of Nickolaus’ handling of the 2010 election found she needed to take steps to improve security and backup procedures, including by not sharing passwords. The audit was requested after the county’s director of administration said Nickolaus had been uncooperative with attempts to have county experts review her systems and confirm backups were in place.

The surprise discovery of votes that could give Prosser the win had liberal groups crying foul.

“There is a history of secrecy and partisanship surrounding the Waukesha County Clerk and there remain unanswered questions,” Scot Ross, director of the liberal group One Wisconsin Now, said in a statement.

Rep. Peter Barca, Democratic Assembly minority leader, said the mistake raises significant suspicion that could warrant an investigation.

“It doesn’t instill confidence in her competence or integrity,” Barca said.

Prosser issued a statement saying he was encouraged by various reports from counties as they began verifying the votes. He did not specifically mention the Waukesha County change.

“Our confidence is high, and we will continue to monitor with optimism, and believe that the positive results will hold. We‘ve always maintained faith in the voters and trust the election officials involved in the canvasing will reaffirm the lead we’ve taken.”

The race was so close, despite 1.5 million votes being cast, that the lead flipped back and forth repeatedly on Election Day and in the days after as preliminary totals were checked and updated.

The Government Accountability Board, which is in charge of overseeing Wisconsin’s elections, will review Waukesha County’s numbers to verify the totals, said agency director Kevin Kennedy.

Kennedy said it was unfortunate the clerk didn’t double-check the data before releasing it to the media. Kennedy also said such mistakes are known to happen but that “we just don’t see them of this magnitude.”

Nickolaus said she didn’t notice an absence of votes because her figures showed a 42 percent voter turnout, which exceeded the 30 percent turnout the county typically sees in spring elections.

“That was an amazing amount of votes,” she said. “So I had no reason to believe I was missing anything.”

    It was a great day for Wisconsin. Prosser should have won by a much wider margin, but his campaign was terribly run and, as always, the Dems pulled out all the stops and threw slime. We dodged a bullet on this one, The Klopp is a bad cookie. I got to sit in court and watch her argue to the judge that my in-law’s house should be torn down because it was built on a “wetland” (i.e. the ground gets wet when it rains). The Milwaukee Journal Sentinel, a pretty blatantly Democrat-leaning newspaper, even blasted The Klopp, saying:

    “She has shown toward Wisconsinites all the humanity of the Terminator.”

    What is truly amazing is the fact that the Democrat backed candidate, Kloppenburg doesn’t have the experience to be a judge.She couldn’t get a judgeship for a dog contest, with a Democrat Governor in power, much less a Supreme Court judgeship. It was very clear to everyone in the state, her ONLY goal as judge, was to shift the balance in the court to liberal, and legally defeat Walkers legislation.
    The unions invested millions and millions of getting her elected. There’s word of shredded ballots in conservative Ozaukee County too.

      I’ve often argued that liberals always seem to be very unattractive, be it cosmetically or personally.

      This leads me to question whether being unattractive makes you easier prey for progressives. Is it the attitude that you‘ve finally realized you’re no prize, so you focus your attention on destroying the lives of people that are actually attractive (in any way)? I believe so.

      Take a look at any high-ranking liberal woman in this country and if she ain’t at least a “12-pack” material, I‘m a monkey’s uncle.

    I’m originally from what some would call a third world country (in Central America). I grew up in the States, but would spend my summers there with my grandparents. I saw a lot of things as a kid and had the opportunity to compare and contrast between the US and there. For years I thought election fraud and cries of election fraud were only something that happened in a 3rd world country. The left is going to have a field day with this one, but I hope Prosser does win in the end. The part that really bothers me is that since the Bush/Gore debacle, this is becoming more and more of an issue. Is the US becoming a 3rd world nation? I say yes.. That’s why we need to fight to restore what we have already lost. The budget battles that are going on right now are extremely critical. The politicians are playing it like a game, but it is no game. I heard a Democrat on Greta, last night, say “if the government shuts down, people won’t get the services that they are already paying for…”. The thing that just made me boil is “why are we paying for services we don’t want or use?”. This is the main point. The left is spending us to bankruptcy and spending us into becoming a 3rd world nation. Eventually, we won’t be able to borrow anymore and then all those lovely services like Planned parenthood, NPR, welfare, food stamps, social security, medicare, medicaid, etc. etc. will disappear overnight. People will really die in the streets, there will be chaos, and our future will be uncertain. AMERICA, WAKE UP!

The U.S.A. has grown into a major world power, It is possible the U.S.A. will become a third world country, which will hurt many all over the world, but I believe the U.S.A. can rise again and hopefully learn from previous mistakes.

    I am a conservative but I strongly believe that this and all questionable votes need to be investigated. Regardless of who is running there should be little if any doubts as to the legitimacy of the elected official. I think that this is more of a case of incompetence then dishonesty.

    Ha! I was soooo………overjoyed when I heard this. I was upset when I heard that lady announce her “win”. But I kept praying specifically that any “shenanigans” the Dems would pull would be exposed and found — that he would win (if ok with God of course). So then I heard about this!!!! YES!!!! I know – can’t prove anythig — but I’ll credit answered prayer for that. Funny & humiliating for the Dem too – exposing their ways. More Lord!!!!!!!!

      Madison canvass is now complete. Prosser lost less than 100 votes. Getting close, though, to the margin where the taxpayers will have to fund the recount instead of the losing candidate. Milwaukee is worse than Madison when it comes to fraud. I heard a first-hand account of a guy seeing someone register, vote, then get back in line to register again. He pointed it out to the poll workers and was told to mind his own business. We’ve GOT to get rid of same-day registration!

      Its amazing to me. When this happened in Minnesota to elect Al Franken, some “uncounted” votes were found in a car trunk, and a closet. That should have had SOMEBODY in State Prison for vote tampering. Nobody seemed to care much less the press.

      It is sort of weird as well. The law of averages would have this very thing happen sooner or later. It always seems that the “FOUND” votes almost always (about 99% of the time) put the democratic candidate ahead. And now that the count goes the other way it is suddenly a tragedy and can’t possibly be correct.

    As a poll judge myself, it‘s not unusual to find clerical errors or to have vote tally’s updated after the polls close. It’s a relatively simple process to match the numbers of votes cast, by candidate, with the total number of ballots issued to any precinct, and to account for any unused ballots. In the case of electronic voting, the process is faster (but a bit more complicated…the paper records of votes cast on a machine needs to be reconciled with both the voter sign-in sheets, as well as the electronic vote tallies).

    Bottom line (unlike what would be the case if the final tally had shown the Democrat to have won) it is safe to assume there is no “fraud” taking place here.

      Most of them are impossible to throw out. You can prove, for instance, that a college student voted absentee with his home address and then again on election day at school, but you can’t prove HOW he voted.

      Honest poll watchers will be needed at every precinct in the country. Volunteer to be a poll watcher in 2012. Especially in MN, CA, NY, and other heavy unionzed states. Fraud is part of the liberal loonie’s agenda. The ends justify the means. In 2012, we will see some of the most outrageous fraud attempts in the history of this country.

      This “mistake” huh? Hate to through someone under the bus, but who is this clerk that “forgot” to save the numbers on her computer? They already said this district is a heavily favored conservative district, whos to say they didn’t just “OOooops”. And claim forgiveness cause they got caught?

      This was a great joke. Pull out the real votes after Dems determined they only need to make up some hundreds of fake union votes to make it so close and then “Whamo” someone finds 7500 RINO votes. He He He …The dems do not have the time to stuff the ballot box a second time. Ha Ha Ha

      I have noticed that many of those who post in this room are very sensitive about any criticism of obvious grammar and spelling errors that are occasionally pointed out on the Blaze. Many of these indignant reactions are way too ugly and violent-sounding than would seem appropriate! But the best part is, the most virulent responses have twice as many errors as the original postings! Looks like a nerve is being hit.
      So, I am curious — are people who know how to speak and write US English well, supposed “elistists?” Are they “enemies of the state” like I have seen them called, because the write well?

      As Dems are used to thinking in the ‘ends justify the means’ mode, it is no surprise that they are shouting false accusations of fraud. After all, those tactics are part of the Dem playbook….just look at the results of any race in Chicago for an example. The number of deceased Dems voting there almost exceeds the number of live Republicans.

      There was no tampering with those votes we are keying on, it was human error. Even the Democrat who was watching her actions carefully verified she had done everything correctly. The only thing that she done wrong was releasing the wrong total to the press which isn’t a crime it is a courtesy for election officials to do that. Furthermore those votes had already been officially counted it is just when they were tallied up to give the press the numbers that is where the error happened and of course with the Liberal biased the Dem was prematurely declared the winner, until the press release count error was discovered.

      First off it was a mistake not “found votes. The votes were counted they just were never entered into the database. Its not the poll workers fault that Kloppenburg chose to jump the gun and declare victory. Also the head Democrat was right there and agreed that the votes are good.

      Mistakes happen, that’s all I know. To pretend like every one of us has never made a computer error before when importing and saving documents is absolutely unbelievable. Give the poor woman a break. Fact is, even if she would have figured in the last city before publishing her (oh, yeah, that’s right) *UNOFFICIAL* numbers, the left and it’s unions would not have taken this beating lying down. Wisconsin is sick of big unions calling the shots. I, as a resident of Wisconsin’s Capitol city, watched the unofficial numbers come in on election night and knew there was something going on. I figured it was the unions. There have been many firsthand accounts of voter fraud going on…people double registering, scamming names or utility bills off of others and using them to vote multiple times. Truth be told, if we had tighter voting laws in this state, Kloppenberg would have lost by a lot more than just 7,000 votes.

      There were no votes “found”. The community (the one I happen to WORK in) was told NOT to alter the spreadsheet in any manner. This town submitted a sheet with extra columns. This forced the vote total column out of the votes column FOR THE REPORT SHE TOSSED AT THE AP! Not for the one she actually submitted to the GAB! Geez! Don’t get all wet in your pants liberals…..why would she have done this? Pull Prosser votes so he loses the election? Um if anything she was aiding Kloppy supporters. Then she openly blames herself…..UNHEARD OF! She caught the error before the canvassing began and the accurate could was submitted to the GAB. These final tallies from the canvas are not due to the GAB until April 15th. If the Kloppy supporters are stupid enough to pay for and file for a recount……they will lose even more votes, because Dane county (the place where all the protesting was) had a VERY suspicious 10,000 “over vote” that will get dug through with a fine toothed comb. In that they will find out of staters who completed absentee ballots, double voting and maybe even Mickey Mouse. We are on the brink of a voter ID (pushed by the reps and hated by the left) bill and if they scream foul enough, that vote will go through……seriously they are between a rock and a hard place. I HEART BROOKFIELD WISCONSIN!

      Imagine if a liberal had “found” all these votes, how the right wing would be claiming foul and fraud. Hell, you were doing it yesterday when Prosser was behind.

      These were not “found” votes. The votes were legitimate votes out of 14*** votes 10*** (just a bit shy of 11000) and about 3400 votes for Kloppenburg. The votes were counted in Brookfield for their local races (Mayor, School Board, Etc) and sent to the County Clerks office. The County Clerks office only deals with the Statewide and County wide votes in that county. As she was entering in those results throughout the night she would save and the tallies were added to the spreadsheet given to the AP. For some reason she either did not enter in the votes from Brookfield into the spreadsheet by oversight, or she for some reason did not save after entering in the data from Brookfield. The votes were counted, the only thing they didn’t get applied to was the spreadsheet given to the media for their reports. So the AP quoted wrong numbers, and Kloppenburg with only a 204 vote lead before waiting for the official canvassing was complete declared herself winner press conference and all when no official deceleration was made by the election committee. Hell even the Democratic leader in Waukesha county said she double checked the new results herself and found that everything “jived” (her words not mine). So go troll elsewhere else be prepared to be made a fool over and over again.

      (“of those” should be replaced with “people” in the interest of brevity and contemporary usage . . . you are not “in this room” you are “on this blog . . . “very” and “any” and “obvious” are gratuitously adjectival . . . “occasionally” equally gratuitous . . . generally cumbersome construction . . . redundant use of “in this room” and “on the Blaze” . . . T in “The” Blaze should be capitalized.)

      It doesn’t make sense that anyone would purposely hold votes and then retrieve them later. She obviously would want the Republican to win, so why would she hold or hide votes? Dems are making waaaaayyyyyy too much of this. Was it an incompetent error? Yes. Is it worth getting all worked up about and saying something is foul? No. Now if she held Dem votes so that the Repubs would win, that would make more sense. This is just a stupid mistake.
