Could George Zimmerman Get the Case Against Him Thrown Out?

MIAMI (AP) — George Zimmerman will seek to have second-degree murder charges dismissed under Florida’s “stand your ground” law in the shooting death of 17-year-old Trayvon Martin, his attorney said Thursday.

The hearing, which likely won’t take place for several months, will amount to a mini-trial involving much of the evidence collected by prosecutors as well as expert testimony from both sides.

“Most of the arguments, witnesses, experts and evidence that the defense would muster in a criminal trial will be presented in the ‘stand your ground’ hearing,” said the statement posted by Zimmerman attorney Mark O‘Mara on Zimmerman’s official defense website.

Although the posting did not say so, legal experts say it’s likely that Zimmerman himself would testify since he is the sole survivor of the Feb. 26 confrontation.

Under the “stand your ground” law, Circuit Judge Kenneth Lester can dismiss the charges if Zimmerman conclusively shows he fatally shot Martin because he “reasonably believed” he might be killed or suffer “great bodily harm” at the hands of the unarmed teenager. The law also says a person has no duty to retreat in the face of such a threat.

Janet Johnson, a Jacksonville defense attorney who has represented defendants in other “stand your ground” cases, said Zimmerman has a good chance to win his claim if he can also show he was in a place where he had a legal right to be and that he didn’t create the danger.

“Or, if he did, he had abandoned that activity when Mr. Martin ‘attacked’ him,” Johnson said in an email. “There‘s only one side since Trayvon Martin can’t testify.”

Zimmerman, a neighborhood watch volunteer, shot Martin after a confrontation in Zimmerman’s gated community in the central Florida town of Sanford, where Martin was visiting. The case drew local and nationwide protests because Zimmerman was not arrested for weeks after the shooting. Zimmerman claims Martin punched him and slammed his head against a sidewalk.

Evidence released by prosecutors, the website statement said, shows “clear support for a strong claim of self-defense.“ The statement urged ”everyone to be patient during this process and to reserve judgment until the evidence is presented in the ‘stand your ground’ hearing.”

Martin‘s parents have contended that Zimmerman singled out their son as he was returning from a convenience store because he was black and that it was Zimmerman’s aggression that led to his death. Zimmerman, who is free on $1 million bail, faces a possible life prison sentence if convicted of second-degree murder.

If his “stand your ground” claim succeeds, however, the criminal charges would be dismissed and Zimmerman could not be held liable in any civil action such as a wrongful-death lawsuit. Prosecutors would likely appeal a successful self-defense claim.

A spokeswoman for special prosecutor Angela Corey declined to comment Thursday. Benjamin Crump, attorney for Martin’s parents, said in an email he believes the “stand your ground” claim will be denied and that Zimmerman’s guilt or innocence will ultimately be decided by a jury.

“Trayvon’s parents do not feel that this is a man that feared for his life the night he shot and killed their child, this is a man whose only fear is spending his life in prison,” Crump said.

Legal experts have said that Zimmerman’s credibility is crucial to his claim and that he undermined his own cause by deceiving the judge about his finances during an April bond hearing. That alleged deception led to perjury charges against Zimmerman’s wife, Shellie. She has pleaded not guilty.

Lester remarked that Zimmerman “flaunted the system” by making misleading statements about how much money the couple had raised through online contributions from supporters. The judge, who will also rule on the “stand your ground” claim, revoked Zimmerman’s initial $150,000 bond and had him returned to jail. He later llowed him to be released on the higher $1 million figure with additional restrictions.

“His credibility in asserting that he lawfully ‘stood his ground’ is key and he has been proven to be less than credible in prior dealings with the court,” said Johnson, the Jacksonville defense attorney. “The defense will try to limit how much of this comes in.”

    It’s beyond Zimmerman. Why DOJ and its courts around the country are not prosecuting the black mobs that kick and kill white people? Not even the media mention what blacks are doing against whites (of all origins). But it’s a huge story when a white man (and Hispanic) kills a black man. It‘s a tragedy for Trayvon’s parents, but it’s a tragedy for America to have a blind eye to the reality of racism coming from the black side of America… beginning with Obama.

      I don’t like Dershowitz, but he’s right on this one. Any respectable, honest judge would throw this case out at the hearing. But there’s nothing honest about this kangaroo court set up SPECIFICALLY to keep the black mobs from rioting.

      It not only is an open and shut case of Stand Your Ground, it could be won in a jury trial under ordinary self defense laws.

      There is no justification for jumping a person, beating him viciously and trying to bash his brains out. And it is impossible to prove that he was not going for Zimmerman’s gun, and the prosecution CANNOT PROVE otherwise.

      But Zimmerman is not being tried in an honest court. It is a kangaroo court with lying vicious prosecutor….Angela Corey….. and a totally corrupt judge….Kenny “the boy” Lester….. known far and wide to be as crooked as they come.

      He lyingly said he thought Zimmerman was going to jump bail which prejudiced the case against Zimmerman, then refused to recuse hiself when challenged. His wife works as a prosecutor with Corey, which should disqualify him on that item alone.

      And the corrupt prosecutor argued to have Kenny Boy to stay on the case. Of course. He’ll back up her phony charges and go right along with railroading an innocent man.

      Wth this judge, Zimmerman will not get a fair hearing. With an honest one, he would be set free.

      Atty. Mara would be wise to continue to fight for another judge BEFORE any stand your ground hearing.

      You are correct! Zimmerman will be found guilty regardless of what the evidence shows in the trial. The only way I can see him being acquitted is if Obama needs race riots just before the election so he can declare Martial Law and suspend the November elections. If Zimmerman is found innocent make no mistake there will be riots all across the country.

The 911 operator is not a police officer and cannot order you to not follow someone, any citizen is allowed to investigate suspicious activity, no one is authorized to just jump on someone else and beat the tar out of him or her, if your life is threatened you are authorized to use lethal force, travon is not a twelve year old child he was a seventeen year old 190 lb male, the police is’nt authorized to racially profile but a private citizen can think anything is suspicious he feels is so, Zimmerman did have multiple wounds which were exactly as he said they were and I could go on and on.       The bigger question is where are Al Sharpton and Jesse Jackson on the 1200 plus black on black shootings in Chicago this year. The day Trayvon was shot there were more than a hundred shootings, including a 9 month old baby who had her life taken away, where is the outrage? No black leader cares about black on black crime or they would be marching in the streets like they did against Zimmerman.

      As, a Black Conservative. I do feel Zimmerman presumed the kid was guilty of a crime according to his initial 911 call. I do not know what the kid did that was illegal or what crimes were committed till this day. Finally at the Bond Hearing, does Zimmerman tell Trayvon family he was sorry for there lost. That’s pretty pathetic and sorry. I’m one of the biggest supporters of neighborhood Watch, but I don’t want people confronting or following me down the public street with weapons. I wouldn’t a man confronting my kids with a weapon walking the public streets. If 911 has already been called, Zimmerman did not need a gun for the young teen.

      Zimmerman not a cop, has no right to stop any person walking the public street. If Zimmerman represent the gated community, then they should also be held libel for this kid death if he is found guilty.

      Zimmerman was mentality unstable. Zimmerman with his aggressiveness and high temper, it was only a matter of time before he killed someone. The cops failed to do a drug test on the killer.

      Zimmerman claims he was attacked and ambushed, but from his 911 phone calls and Trayvon cellphone conversation, I have no reason to believe Trayvon track back and attacked Zimmerman a total stranger no knowing if he had a weapon.

      Trayvon was clearly being followed by his killer. Trayvon has every right to defend himself. As far as I know, Zimmerman never identified himself to the murder underage kid.

      Instead of listening to the “news”, why don’t you do your own research, namely the FL law? The stand your ground defense DOES NOT END even if he was the pursuer. There are two caveats to a pursuer able to use stand your ground. You know darn well you’d pursue a person if your neighborhood was burgled several times prior to this incident. If you don’t believe so, you’re probably kidding yourself.

This Amendment to the Constitution guarantees Democrats (only) the right to freedom from having to accept responsibility for their behavior. This Amendment was passed by far more than the two-thirds of the media required to adopt it.

    One idiot a rurally said that Zimmerman’s were severe enough to warrant killing his attacker. I guess according to this person logic one would have to wait until he was almost beaten to death before ending the attack. How is this possible? If he had waited much longer he would have been unconsious or dead. When all reasonable doubts have been exhausted the people that were not here nor saw what happened yell it was a racist attack. I’d the tables were turned would the black people say it was a racit attack? Don’t think so. I hate that their son died but it seems that it was justified. The only reason the case has not been dismissed is because of race and the politicans fear of race riots because the blacks disagreed with the ruling against their side of the case.

    I am a great supporter of the “stand your ground law (SYG)” here in Florida. The law was not implemented to protect a person that made the conscious decision to follow a person. Now, understand, I am also not saying that just having somebody follow you is a premiss to attack that person either. What I am saying is I don‘t think this falls under the SYG law and his defense should succeed or fail on it’s own merits.

      As a neighborhood watchman Zimmerman is expected to follow anyone who appears to “slinking” in and amongst the homes, especially after the recent home invasion in that neighborhood. A hooded citizen wandering in and about the homes in a rain storm and NOT appearing to in in any particular hurry to arrive anywhere, is reason enough to suspect anyone. It just turned out to be a black man. A black man that confronted his follower and informed that watchman that he was going to die that night and eventually went for the gun exposed in the scuffle, according to Zimmerman. Also, people die falling and hitting their heads on a sidewalk and having your heads slammed against a sidewalk is reason enough to fear for your life, especially after hearing a verbal death threat.

      This is simply an opinion as your name states. The law is fairly clear and there are carve outs even for a pursuer. There is no evidence whatsoever that Zimmerman threatened Trevyon Martin with deadly force. Following someone isn’t illegal until it crosses the threshold into stalking, which this didn’t. Zimmerman had a good reason to keep eyes on the individual.

      FL Statute 776.041:

      To be considered an “aggressor” by law and not be able to use stand your ground, Zimmerman would have to:

      1. Be committing or attempting to commit a felony

      OR

      2. Provoke the use of force against himself–which we’ll take your case that he did “provoke”, even though that’s debatable.

      Now in case 2, there are two caveats–two of which MBRIZ doesn’t recognize, but rather substitutes his own judgement for the law of the land…I guess his “news” didn’t tell him about these.

      1. Such force is so great that a person reasonably believes that he or she is in imminent danger of death or great bodily harm

      2. He withdraws from contact in good fai

    Really? Deceptive? If I was asked about my income, I wouldn’t think to include $ that was actively being raised through online contributions while all of this was going on. It’s not really my $. I seriously doubt they intentionally tried to hide the $. It be different if he stated that there was only $10k in the account when there was $200k. If I was asked if I could afford bond, I’d immediately think of my personal monthly income, savings, etc.

      If this goes to trial, Zimmerman doesn’t have to say a word… The credibility thing is only for the initial immunity from prosecution under Stand-Your-Ground. Despite what Harry Reid says, the burden of proof is on the accuser. Zimmerman could be a racist, terrorist, or whatever adjective you want to throw at him–they still have to prove MURDER… All they really know is that Zimmerman did KILL Treyvon, but witness statements are so inaccurate they’re nearly unusable. Also, you would have to convince the jury Zimmerman gave himself the broken nose and cuts.

    This entire case was a sham aimed solely at focusing on the issues of race, crime , gun control , Stand Your Ground Laws, and Florida which is an important swing state in the upcoming election. The media circus created by Sharpton and Jackson’s “God Bless the Hoodie ” campaign and the photos of 10 year old Trayvon were proof of the manipulation and idiocy of this case. All aimed at stirring up the Democrats’ angry racial base. The “ white Hispanic” Zimmerman case was , perhaps, the height of judicial disgrace by the Obama Administration.

    I am so tired of the phrase “unarmed teenager”. Trayvon was armed — with double guns and a fist at each end. Zimmerman did the only thing he could do short of attending his own funeral as the guest of honor.

    Charges should have never been brought. Charges should be dropped, and the State of Florida should be sued.

    Regardless of the outcome of this trial, I will pray for Zimmerman and the Martin families. Such a tragedy to begin with. And to make matters worse, for it to be dragged out and displayed and scrutinized by the public.

    I hope each can come to terms with whatever the decision is. I hope we can heal as a nation and learn to forgive any and all parties once all the facts are brought forth. Whether we agree or disagree, we need to not let this come between how we treat and respect each other.

      Exactly, the prosecutors have no evidence except anecdotal evidence. Well, it SEEMS like a racially motivated crime….Zimmerman COULD HAVE pursued Treyvon and he MIGHT HAVE prevented the killing if he walked away. If the libbys want people to go to prison for this weak evidence, perhaps they should turn themselves JUST IN CASE they want to burn down a business or MAYBE IF they could have the opportunity to smoke a joint.

      He will never be convicted of second degree murder, manslaughter maybe but that is not the charge. Having said that, I do believe he and his wife are deviant liars and BOTH should be charged with misleading the Court.
