Couple Wins $4.5 Million in ‘Wrongful Birth’ Lawsuit After Claiming They Would Have Aborted Disabled Son

Many times, “wrongful death” is at the root cause of a lawsuit, but what happens in the case of a “wrongful birth” charge?

In West Palm Beach, Florida, a couple sued a doctor and an ultrasound technician for negligence. The two claimed that they would have aborted their son, who was born with no arms and only one leg, had they known about his disabilities beforehand. PalmBeachPost.com’s Jane Musgrave writes:

[The parents] claimed they would have never have brought Bryan into the world had they known about his horrific disabilities. Had Morel and technicians at OB/GYN Specialists of the Palm Beaches and Perinatal Specialists of the Palm Beaches properly administered two ultrasounds and seen he was missing three limbs, the West Palm Beach couple said they would have terminated the pregnancy.

As a result of what some are calling a “wrongful birth,” Ana Mejia and Rodolfo Santana sued Dr. Marie Morel and an ultrasound technician for $9 million — a figure that was estimated to cover the child’s expenses for the next 70 years.

The couple believe that the doctor and his staff member should have noticed the baby’s issues before he was born. For what was apparently seen as a failure to properly read sonograms, a jury comprised of four men and two women sided with the couple, holding the doctor 85 percent negligent and the technician 15 percent negligent.

While the couple didn’t win the fill amount they wanted, they walked away with $4.5 million — half of the figure that was originally requested. Feeling overjoyed, they explained that the award would greatly assist their son Bryan.

Attorney Mark Rosen, who represents Morel and the responsible clinics, says that the losing party will appeal. According to Rosen, the couple had refused an amniocentesis, which may have helped to predict Bryan’s problems before his birth. According to LifeSiteNews.com, he said:

“There is nothing Dr. Morel wants more than for Bryan Santana to have a happy, healthy life. That doesn’t mean they’re responsible. Is it fair to blame physicians for acts of nature?”

The Palm Beach Post’s editorial board weighed in on this contentious battle, with Andrew Marra taking a stand against the parents’ lawsuit:

Bryan’s parents are understandably upset that they had no warning about the issues that awaited him. The problem with their lawsuit is its premise that their son is more flawed or somehow worse than a person with four fully formed limbs.

Despite his considerable deformities, there is no reason to assume that Bryan cannot lead a fulfilling and productive life…Certainly, Bryan will face challenges that few have to consider, and that is tragic. Whether these obstacles mean his life is not worth living should be up to him to decide, not to Ms. Mejia and a jury of her peers.

But Jac Wilder VerSteeg has a very different stance on the matter:

Ana Mejia absolutely is morally justified in suing health care providers who failed to warn her that her son, now 3 years old, would be born with three limbs missing. [...]

So how does a mother who would have terminated a pregnancy have any standing to argue on that child’s behalf? Isn’t there something inherently hypocritical about a “wrongful life” lawsuit?

Not at all.

      My thoughts exactly! That poor kid will probably do just fine physically as many with physical handicaps learn to adjust and grow and prosper. However he will probably need extensive emotional therapy after learning his parents were so burdened by him they actually wished they had aborted him. God bless him!

      And we wonder why our healthcare costs are so high, who exactly do they think is going to pay for this 4.5 mil? The doctor? The unltrasound tech? Or the malpractice insurance they are now forced to buy for this exact reason? And where are these people going to get that kind of money… oh yeah, these “rich” doctors and techs and hospitals have so much $ its no skin off their nose. Its not like it costs anything to RUN A HOSPITAL!!! Surely they won’t have to get it from the consumer/ patients with raised prices and insurance deductibles/ premiums.

But, I’ll bet the lawyer gets to live it up more than they will. Ok though. The boy will spend eternity in Heaven while the others burn forever in Hell.

      my question is…is there any reason to kill a baby…even in the case of rape or incest or even abnormal growth…I say HECK NO!!!!!!!!!!!!! God does not give us anything we can not handle, these parents are WEAK and selfish. ALL the money should be put in a trust fund of some kind and only pay for this little boy’s life…period!

      The fact that they won is a travesty. Most parents are only offered amniocentesis if they are at high risk for children with genetic abnormalities, or if they have an abnormal ultrasound. The fact that this couple was even offered the opportunity to have this test done, shows that the doctors found something in their medical history, or saw something wrong on the ultrasound, and wanted to do some more definitive testing. These parents were essentially warned that something could be wrong with their baby, but they chose not to look into it.

      …and now they blaming the doctors for not foreseeing these problems, even though they refused to let the doctors do the necessary testing to discover such problems. This absolutely ludicrous.

      what horrible people, I am not even going to call them parents. Give Bryan up for adoption if they are so burdened! I do know a hundred people who would love to adopt a baby, even with his disabilities. Nothing was said about his mental developement so I am assuming that everything is physically there as far as brain structure, Bryan needs what every other person needs at this stage of life, unlimited love and I am sad to say that I don’t think he will get it with these two people raising him.

      My mom was an OB/GYN nurse. She had a case (and didn’t share the names with me, of course) where the woman had her tubes cut, the man had a vasectomy. They then got pregnant. They sued for a failed surgery. She later lost the child and tried to sue for wrongful death. She didn’t win the second one.

      Today‘s society has told everyone if you don’t get what you want, sue. They wanted a healthy child, and they want their money back. It doesn’t work that way. I wanted a healthy child the first time, over 21 years ago. I got what God considered perfect for me. He has Down Syndrome and autism, a heart condition, hyperthyroidism, celiac disease, and he’s taught me more about unconditional love than anyone else in my life had. He’s my angel. It‘s a shame that they can’t look at this child as a child and not a hinderance. They’re missing out on a lot.

      Does this address the idea it may have been something the mother did or used that caused this deformity? I agree he will not be happy when he learns they would have killed him if they knew he was not perfect. This is a case of parent guilt and they have found a way to blame someone else. They don’t deserve this child and certainly could have placed him up for adoption when he was born. I know, I have adopted these kids and I am so blessed.

      How different this mother is compared to the mother in Australia that adopted two brothers born without arms or legs and raised them to be incredible boys with the world by the tail, one of which has an extraordinary voice. Saw him on a YouTube video on the Australian version of Am. Idol. The biggest deficiency that child in this article inherited and must endure is the abject poverty of spirit of his parents. I feel sooo sorry for him.

      Acording to Obama they are LUCKY and FORTUNATE ones since they are really wealthy now guess they’ll have to pay huge taxes for being able to live in this country which allowed them to become so weathy.

      I was in nursing school 5 years ago and in my clinical rotation with the OBGYN dr. and tech they told us that no one wants to become a OBGYN because they can be sued by the parents until the kids are 18 y.o. for anything going on at all. Whats next, my kid got chicken pox, I’m sueing for 10 million. Really! this is crazy.

      I saw Nick Vujicic‘s speak live in 2010. Very inspiring,

      My wife and I spent a week at a Haiti orphanage in 2007 where they took in the physically deformed / disabled. At least the Haitian parents gave their kids a chance. And families do come in to adopt. The flight back was full of new / growing adoptive families.

      These new millionares are undeserving parents. Beyond 2 more ultrasounds from the doctor and technician, they should only receive adoption placement services, and nothing monetizable.

      The article did not place any future restrictions on the new millionare parents. This is not China, so we can assume they will attempt to multiply again.

      This million dollar payout from the medical profession to so-called caretakers sets up another Terri Schiavo incident before the child can reach majority. Assuming they stay together (likelier now with millions at stake) then this baby becomes totally unneccessary as soon as these parents get another healthier child.

      I won’t say that they will “burn in hell” but it is quite likely if we were to go with what the Bible says (which I do)! Jesus is quite specific on treating children and God is quite specific about murder. These “people” not only wanted to MURDER their child, when they didn’t get to, they sued the doctor that didn’t let them murder him. On top of that, basically the jury paid them money for wanting to murder their son. Based on that, not only do I have much doubt that they will “burn in hell”, I have a STRONG feeling that the jury will be right there alongside of them in hell. The couple, their lawyer and the jury are despicable lowlifes, and all we can do is love them. For as God says that we are to love the unlovable (the parents, lawyer and the jury) because the child is definitely not unlovable. We will just have to let God handle the rest of, I can just pray for all of them so that God does not hold me accountable for not doing what He says to do. I would also be willing to bet that Bryan will turn out to be a better person than all of those lowlifes ever would combined.

      I don’t agree w/ what parents said, but with how the legal system works that is the argument that would get them the $$$. After ultrasounds this should have been told to them, easily there is NO excuse why they were not informed at the time( but saying that alone would not be a case according to law), the amnio argument is a red herring, as they say a picture is worth a thousand words. That being said, I’m understanding that this money was for their son. I do tend to look on the brightest side though.

      My first thought is for the child. So if they had a perfect baby with all parts there, nothing missing, nothing deformed, but the child was later in a horrible accident and had to have limbs amputated, would they have loved him any less? That is a scary thought.

      Let the parents decide,hopefully to do the right thing ( not likely ),but abortion is still legal.

      Perhaps the parents plan on using the cash for the child who will require lots of specialized care and therapy and not for partying as so many comments are claiming. Where would the poor boy be if the parents did not have the cash to help him? Who would pay for his specialized care? The taxpayers will pay when he goes on medicaid. If they chose to put him in some kind of medical facility they should pay for that cost until the 4.5mil runs dry.

      I don’t believe in abortion. But I do believe physicians should be held accountable for negligence. On the other hand if they had been told there might be a problem and needed an amniocentesis for further diagnosis and refused the test, who is held responsible? None of us are perfect. They must not have seen their newborn son as someone to love. I pray that this 3 yr. old hasn’t already felt that his parents wish he was dead :(

      Putting aside the fact the practice of medicine is not exact science. These people should not profit from this unfortunate situation. I am sure there are many couples who would Cherish, Love and raise this precious child of God. Golly… would they choose to abort him if they had wanted a little girl, and the ultrasound did not show specific male parts? Only they know the content of their hearts, not for me to judge. But, I hope they may find an appropriate explination when this child asks why they did not want him but received money for his birth.

    We just got screwed for $300k, and the guy who did it is gonna get away with it. The old story of a Dream home gone wrong. When we questioned the builder about where our money was going, and about the quality of his work, he walked. Called the bank one of the big ones with a shiny rock as its president. Oh did I mention they took $25 Billion in bailout money? When we asked for help, the bank said we cannot help you. You take $25 Billion of our tax dollars and when we ask for help over $300k you turn your back, but yet you want me to pay you back. Turned to local law enforcement, but in Texas the now defunct TRCC protect’s builders, making it impossible for us to recover. Called Texas State Sen. Mike Jackson and Con. Randy Webber, it’s been 3yrs I have never talked to either one of these men. If you live in Texas in their districts vote for a dead dog next time.

    This should not happen to anyone else……..

    So we are going to lose everything, I pray I don’t lose my wife of 22yrs. I believe it was their plan from the beginning to drag this out and bleed us slowly to death. Cause like a worker from that bailed out bank said to my wife “we have plenty of lawyers”. And like I told our lawyer “I’m supposed to trust a system that let the guy who beat our grandson over a French fry go free”…..

      Don’t worry folks. These sick people will take the money and farm out the kid in a kennel if they can.
      God doesn’t make mistakes. The lady wanted to abort him if he wasn’t perfect anyway, so she deserves not a dime. The State will end up taking care of the child anyway with their attitude against this baby.
      Some people will do or sue anything or anybody for a few bucks. Won’t make them happy in the end.

    Again another example of what happens when we take God out of society. Had this couple had one ounce of faith in Him they would have look at their child as a blessing rather than burden that should be destroyed. And what will this poor child feel when he finds out that his parents would rather kill him than take care of him? Also, how can they sleep at night knowing that they have ruined two peoples lives (the doctor and the technician) because of their own Godless, selfishness! It makes me want to cry.

      I fail to see what the typical Casey Anthony red herring has to do with this story.

      Whether you like it, or not, she was tried in a court of law and acquitted. I don’t like the verdict any more than you (I am sure she is guilty, but it can’t be proven beyond a REASONABLE doubt), but that doesn’t condemn the entire system.

      It is already old, and reeks of the lack of any solid argument.

      However, this case is beyond the pale in terms of medical malpractice. These “lawyers” who pursue suits on absurd claims, hoping to enrich themselves at the expense of the doctor (and, by extension, the rest of us in the medical system), are the real issue with the cost of American health care. Clamp down on them (how you do that is probably complicated) and we can get back to a medical system that relies on the competence of our providers, and only punishes those who intentionally (or through sheer incompetence) make these kind of mistakes.

      Once again, I feel terrible and will pray for this family. If they lived in my community, I would offer help (time, help with transport, etc.) to them. They do not, so I leave that to their community. However, our system now has all of us offering help (at a hefty discount both to the government and the law group(s) involved), without our counsel, or our consent.

      How is that liberty? How is that freedom? Compassionate tyranny is still tyranny.

      If they won the case then the ultrasound had to be read by a medical professional (Radiologist, OBGYN MD, etc.) and plausibly refuted, altho a fetus missing arms and a leg, the ultrasound tech prob saw that. The fact that the doctor “failed to inform” is the issue here. Abortion is still legal here. It is still a decision that is afforded to the parents of the fetus. Don’t like it but there it is.

      Imagine going for a Heart Cath and the Cardiologist sees a big ol tumor on your spine and he comes and tells you that the heart cath was great everything looked fine…and that’s it. 3 months later you are paralyzed b/c the tumor is now so big it is putting pressure on your spinal cord. It’s the “failure to inform” that will get the Cardiologist in trouble.

      Same here, it is not upto the MD to decide if the parents need to know. It is the MD’s duty to inform. Good, bad or indifferent, esp if there is an abnormality. It is up to the parents to decide what to do with that information.

      Thats why I voted “middle of the road” on this one. MD failed to provide adequate services, but they shouldn’t consider abortion, altho in the legal sense that is still an available option.

    It would be interesting to know if that Bryan dies young–let’s say in his teens, that the amount the couple received would be prorated–the doctor and technician would get back the rest of the money they paid out in proportion to the years he lived. 70 yrs divided by 4.5 mil equals $64,285.71 per year to raise him. I hope their parenting and the care Bryan gets is worth $64K a year. Look for those trips to resorts and “medicinal retreats” in their palative care plans. Some one better watch Bryan’s back for him….
    Selfish, selfish people…those parents. Not enough mil stones available.

      Now, there’s an idea for the future as soon as the son is of age. Knowing how his parents were thinking, he would have had every right to sue them for having him, even though they would have killed him instead. But the real suit should be for the 4.5M award, especially if that award was used for the parents’ personal matters and not his.

    Thats got to be a huge self esteem message for the child…….If we had known you were going to turn out to be this pathetic excuse for a human being we never would have let you live….There should be a watchdog in this case to make sure the money gets spent on this child only but something tells me the lifestyle for these parents just rose dramatically.

    I know someone who adopts children with deformities, severel debilitating deformities, and child and parents each grow from their experiences with each other. This couple needs to see its not the end of the world for them or their son, challenging yes, yes, yes….but rewarding–yes, yes, yes, yes, yes.

    This mother should examine her own lifestyle. Did she take any medications and/or drugs that might have contributed to this child’s deformities? Is it possible that there are genetics involved? Abortion is the murder of an innocent life, IMO, and this child will be forever scarred if he knows that his Mother would have aborted him has she known beforehand of his disabilitiy. What a shame.

    If anybody ever tells you that money cannot buy happiness, DO NOT BELIEVE THEM. It is ALL about money now at all levels of everything. This is all due to progressives putting all their faith in money instead of people.

      I think the case was about negligence on the part of the Dr. and the radiologist. Perhaps the tech reading the sonogram was a prolifer who took it upon himself to lie to the parents so they could not make an informed decision regarding having this child. Parents have a right to choose abortion if that suits them before the fetus is viable. This is a sad and tragic situation and the parents should be pitied. Now that the boy is here he should be cared for with love. His care will cost a whole lot of cash so I doubt these parents will be out partying and spending the boy’s money. If they do then damn them.
