D.O.J. Revises Americans with Disabilities Act With Changes Effective This ThursdayLast year, the Department of Justice (DOJ) announced major revisions were being made to the Americans with Disabilities Act’s (ADA) guidelines on accessibility. All entities covered by the ADA have until Thursday, March 15, to comply with these new standards.

“The new rules usher in a new day for the more than 50 million individuals with disabilities in this country,” said Thomas E. Perez, Assistant Attorney General for Civil Rights. “The rules will expand accessibility in a number of areas and, for the first time, provide detailed guidance on how to make recreation facilities, including parks and swimming pools, accessible.”

Under the guidance of Attorney General Eric Holder, the new ADA rules were signed on July 23, 2010, the official text was published in the Federal Register on September 15, 2010, the regulations went into effect March 15, 2011, and the compliance deadline is set for this Thursday.

“The new ADA rules adopt the 2010 ADA Standards for Accessible Design, which have been retooled to be more user-friendly for building code officials, builders, and architects, and have been harmonized with state and local accessibility codes,” the DOJ explained last year.

The revisions will affect “more than 80,000 units” of state and local government and “more than seven million places of public accommodation,” according the DOJ’s news release.

The “units” and businesses affected by new ADA rules include: stores, restaurants, shopping malls, libraries, museums, sporting arenas, movie theaters, doctors’ and dentists’ offices, hotels, jails and prisons, polling places, and emergency preparedness shelters.

“Fortunately, the new provisions allow for ‘safe harbor’ for elements that were required under and comply with the old 1991 Standards for Accessible Design,” Patrick Mayock of HotelNewsNow.com explains.

He continues:

If a hotelier previously moved the light switch in a single-user, lobby bathroom down to 52 inches above the finished floor in order to comply with the original ADA regulations for Title III, for example, that hotelier would not have to then move the switch down to the revised 48-inch requirement as under the more stringent 2010 standards, he said.

“If you comply with the 1991 standard, which might be slightly different, that would qualify for this safe harbor,” said Doug Anderson, a partner with LCM Architects.

The new regulations signed off by Eric Holder will apply only to, say, hoteliers who modify or renovate after 15 March 2012 — the deadline for the new ADA regulations.D.O.J. Revises Americans with Disabilities Act With Changes Effective This Thursday

The DOJ’s revisions include new standards on making swimming pools, parks, golf courses, boating facilities, exercise clubs, and other recreation facilities more “accessible for individuals with disabilities.”

For instance, according to the 2010 ADA Standards for Accessible Design, all swimming pools must have at least two accessible means of entry for individuals with disabilities and all wading pools and spas must have one. And by “accessible means,” the DOJ includes swimming pool lifts, sloped entries, transfer walls, transfer systems, and/or pool stairs.

The 2010 ADA rules stipulate that swimming pools must have a lift or a slope, wading pools must have a slope, and spas must have a pool lift, a transfer wall or a transfer system. The 2010 ADA standards are actually quite detailed.

EXCEPTIONS:

1. Where a swimming pool has less than 300 linear feet (91 m) of swimming pool wall, no more than one accessible means of entry shall be required provided that the accessible means of entry is a swimming pool lift complying with 1009.2 or sloped entry complying with 1009.3.

2. Wave action pools, leisure rivers, sand bottom pools, and other pools where user access is limited to one area shall not be required to provide more than one accessible means of entry provided that the accessible means of entry is a swimming pool lift complying with 1009.2, a sloped entry complying with 1009.3, or a transfer system complying with 1009.5.

3. Catch pools shall not be required to provide an accessible means of entry provided that the catch pool edge is on an accessible route.

In addition to adopting the 2010 ADA standards, the revised regulations contain several new or expanded provisions on “general nondiscrimination policies” including:

  • The use of service animals
  • The use of wheelchairs and other power-driven mobility devices
  • Selling tickets for wheelchair-accessible seating at sports and performance venues
  • Reserving and guaranteeing accessible rooms at hotels
  • Providing interpreter services through video conferencing
  • The effect of the new regulations on existing facilities

To assist government units and private businesses in meeting the requirements of the amended regulations (and understanding what’s all included in the changes) the DOJ has released two documents that can be viewed here:  “ADA Update: A Primer for Small Business and ADA 2010 Revised Requirements: Effective Date/Compliance Date.

      Of all the things this DOJ could be doing, they spent a considerable amount of time and money on this ? I bet this legislation has all kinds of traps in it that will fit, hand in glove, with Obamacare regs. I do not trust anything this Admin does…..none of it is as it seems on the surface. As GB once said Cass Sunstien ( Regulations Czar ) is the most dangerous man in America….I wonder what, ruinous to private enterprise, regs he has woven into this “benevolent” law. Since when has an appointed official had the power to write law regulations anyway ? Nothing written by a Czar ( an unelected position in an office not recognized by the constitution) should be allowed to stand anyway ? Am I missing something here ?

      Where does Holder get the authority to make changes to existing law? Congress had to approve this law and the president had to sign it.

      If you want to change it, wouldn’t it have to go before congress again?

      ProbIemSoIver – I went to the Link you posted on Manta – I noticed that Holder did not claim the listing – therefore any one can log in to Manta and Claim this site as the owner – this would give that person the ability to change anything on the site.

      Maybe change Holders photo – add a few comments – maybe a comment from Holder saying that he admits to knowing about Fast and Furious and Obama knew about it as well.

      That is always my first response. I am old enough to remember life BEFORE all these regulations, and mobility of handicapped is better now than then, with scooters and electric wheelchairs and modern engineering of such thing. Yet I see small places well accessible by any handicapped standards having to build special parking and ramps for totally non-existent excuses, i.e. where the sidewalk is NOT an impediment – ALREADY! Some of those places didn’t have the money to make expensive and insignificant changes when smaller and less expensive modifications would have served as well. And they had no customers who were handicapped at all in many instances. Really insane. It is one thing to do this in new buildings – I’ve seen stories where ramps costing several thousand dollars were required for as little as 8 running feet and less expensive changes ELIMINATING A NEED FOR ANY RAMP were REFUSED by Govt regulators.

      Government is the kind of idiocy that requires a dozen UNION workers to change a lightbulb to a table lamp. At Hazard pay.

      Handicapped people pay the same taxes as everyone else, money that goes into the parks, libraries, schools and other public facilities, and well as paying taxes to protect those buildings, such as when fire department has respond to a fire or medical emergency there. This is the United States. We accommodate our own even if it costs money. In this country we take care of our own, like family, even if or maybe especially if they are handicapped.

      Hey this should put 3 or 4 million folks to work. In our town of 20,000 they have nearly finished all intersections in town after two years for wheel chair axcess. There are two people that ride those little electric wheel chairs. I don‘t know why they don’t pay $.25 for callaride.

Once they, the overly fat ones, get on food stamps and welfare they suck off the progressive breast. The last time I went to renew my driver’s license I saw the line of really fat people applying for handicapped parking. Every one of them was so fat because they are eating hi-on-the-hog off of food stamps. I went over and talked with several of them. They remind me of you. You are no William Wallace. You are a pig. You can suffer or you can call out…. FREEDOM!

      I am with those who point out that Eric Holder has no Constitutional right to change/pass a law! This country’s rulings are turning into insanity upon insanity, and unGodliness upon unGodliness. I am disabled, and yes, I have a hard time walking at times. (My condition varies, and is still being studied by doctors…but, it hurts.) But, thew thought of having any kind of accessable pools, etc, is ridiculous. I enjoy walking in the woods on my “good” days: will they make nature trails accessable, too? How about “Rock Walls”? I used to love the challenge of such things. That I cannot enjoy them now, does NOT mean I want it to be changed for others. Silly, illegal, unConstitutional Law. Kick Holder out….NOW, please!

      Some hotels have “spas” so small that a wheelchair lift would fill the whole hot-tub. Of course, to comply, most hotels will just raise rates and close these amenities while they are rebuilt. By the way, does the Caesar’s Palace lobby fountain need a retrofit? What if a drunk handicapped person wants to “go crazy” and get into the fountain? Must they be accommodated? How do you accomodate the handicapped on a treadmill or stepper?

      While time, money and energy are concentrated on a non-existing problem, gun runners, drug dealers and terrorists will have more cover. In the end, I doubt many will actually use the new features. I say keep hotel rates low. Empty all pools. Post a sign: “Compliments of your DOJ.”

      Have you noticed the parking for expectant mothers? When I was pregnant they told me it was good for me to walk. Apparently that is no longer true. It’s not like the lady has to carry the bags since she can use a cart. I don’t get this at all. I think we should have special “very tired today” parking spots or “sore feet” spots or “old and crabby” spots.

      I have seen soooo many people who are NOT handicapped, yet have the handicap parking tag, that are able to walk the distance. I have a brother who is disabled – in a wheelchair as a paraplegic – and when he goes to the store there are few if any spots left for him to park. I think that people who are able to walk should be grateful and willing to do so!!

      @angelcat What I‘ve seen recently that bothered me was ’green parking’, reserved parking spots closest to the store for hybrid cars only. AND it was one space closer to the door than the handicap reserved spots.
      My father is a double-leg amputee, and not in my entire 28 years have I seen him park in a handicapped space. He doesn’t even get a permit. To quote him when I asked why: “I’d rather leave that space open for someone who ACTUALLY needs it”
      Of course, he was a 101st Airborne Ranger, so that explains much of the ‘can’t keep ME down’ attitude.

      I used to go to a gym where I would swim laps and then one day this Lift Device showed up on one side of the pool with part of it reaching down into the water even when not in use. This hunk of metal was a hazard as far as I was concerned, I frequently came close to hitting it with my arm each time I went by it and with it there that particular lane could no longer accommodate two swimmers at one time if needed. If I had run into it and hurt myself nothing would have been done because I’m a healthy white male who is not only the only segment of the population who does not belong to a victim class, I am the cause of all wrongs in the world…..or so I’m told through the medias reeducation.

    I live in a so cal depressed desert town, besides the meth heads we lead the capital in Guvment funded huvarounds with a 500 lb fat ass on it? that is disabled? get up walk and you will start to feel better and lose wight and just maybe you can reverse your issues. Is it like 1/10 of 1% of actual disabled people? we are all disabled, watch TV they will be sure to tell you which disease you should ask your Dr about or which attorney to call to get your share of 5$ in a billion dollar law suit because you may or may not have taken a drug for the non disease you were told you have and now there are side affects.       I am disabled and run/own my own business, I have been sued by people with disabilities who call to apply for a job but are deaf and I do not have a phone system to handle it. My insurance settles, this has happened 4 times. my attorney checked the background of the first person who did this and they have won over 600k in 10 years by scamming businesses like mine. I am so frustrated by the rampant misuse of these laws. Once word got out about the lawsuit I get a ton of disabled applicants looking to trip me up and sue me. I now only hire ex military folks and don’t advertise for job openings. It is sad.

      @Horsecrazy….I shut down my business long ago because i saw what was coming down the pike. I refused to modify my building to code and just shut it down. That was in the 80s
      We all need to just go Galt and shut the whole damn country down….or go underground with your products…

      Maybe that is why so often you see job openings specifically stipulate “No phone calls”. I always thought it was to reduce unnecessary non-customer call volume, but now I‘m not so sure others haven’t gone through the same ordeal you have and said screw it.

    It looks like we have one more case of the ever encroaching fist of government; while it appears to be for the aid of the disabled I can easily see this being used by the Fed’s to coerce, intimidate and put pressure on any group that ‘steps the least bit out of line’ with threats of massive fines and jail time.

      It will also require restaurants/ public places to spend, spend, spend more money to comply. This administration is working as hard and fast as possible to put small businesses out of business and to regulate them into oblivion, not to mention creating more debt to have gov buildings, etc. comply.
