Bill Clinton: Obama Should Ignore Congress on Debt, Invoke 14th Amendment

Former Democratic President Bill Clinton has come out swinging at Congress, telling The National Memo’s Joe Conason that he would take decisive action if no debt deal is reached by the August 2 deadline. Clinton says that if he were in Obama’s situation, he’d invoke the Fourteenth Amendment to raise America’s debt ceiling “without hesitation, and force the courts to stop me.”
Clinton, who came out strongly against Republicans in an exclusive interview with The National Memo on Monday, said:
“I think the Constitution is clear and I think this idea that the Congress gets to vote twice on whether to pay for [expenditures] it has appropriated is crazy.
[Raising the ceiling] is necessary to pay for appropriations already made…so you can’t say, ‘Well, we won the last election and we didn’t vote for some of that stuff, so we’re going to throw the whole country’s credit into arrears.”
Clinton faced his own debt battles as president during two government shut downs. Back then, though, he didn’t consider utilizing the Fourteenth Amendment, because the debt ceiling was not brought in as part of the overall debate. The National Memo has more:
According to Clinton, the Gingrich Republicans thought about that tactic [using the debt ceiling] before rejecting it — and Treasury officials who served under Clinton commissioned legal research on the president’s power to raise the debt ceiling without congressional approval. While some legal scholars believe the Fourteenth Amendment requires Congress to fund the debt that results from its appropriations, and therefore empowers the president to raise the debt ceiling, others vehemently disagree.
The American Spectator takes issue with Clinton’s opinion on the matter, writing that the Fourteenth Amendment doe not call Congress to borrow monies whenever needed. Rather, the amendment instructs Congress to pay for what it spends:
Meaning it can choose to cut spending, raise taxes, or print more currency. Arguing as Clinton does would also license the president to print more currency in order to pay the bills, effectively running down the value of the dollar.
It‘s like saying that once you’ve maxed out all your credit cards, you have no choice but to transfer the balance to a new credit card.
Some say Clinton isn’t the only prominent individual speaking out in support of unilateral use of the Fourteenth Amendment. Treasury Secretary Timothy Geithner has also allegedly advocated its use. CNN Money has more:
Treasury Secretary Timothy Geithner has heightened the debate over the debt ceiling extension in recent weeks by implying that the President could simply push through an extension of the debt ceiling based on an interpretation of the Fourteenth Amendment of the United States Constitution.
While some believe Geithner has been clear in advocating for the president’s use of the Fourteenth Amendment, others — including legal representation at the Treasury, itself — claim this isn’t the case. In a release published on July 8, 2011, a lawyer for the Treasure Department denied this allegation, writing:
Secretary Geithner has never argued that the 14th Amendment to the U.S. Constitution allows the President to disregard the statutory debt limit.
According to the Treasury’s legal counsel, Geithner’s words thus far on the matter have been intended to compel Congress to take action on the debt limit. President Obama has avoided direct questioning on the matter, though, making it difficult to conclude exactly where he stands and what he will do if a plan is not reached.
Despite Clinton’s claims that Obama should invoke the Fourteenth Amendment if needed, he tells Conason that he believes the situation will be remedied by August 2. The former president says that it looks as though an agreement will be made, which he calls “smart.”

By the way if the funding problem came down to having the IRS, or the President getting his pay check – we would have a FLAT TAX tomorrow. Same with the Dept. of Education – it would be gone. Thank you so much for saying this – It is such an under-reported fact! Congress controls the purse-strings, not the President. Clinton’s economic successes were in spite of himself – The gingrich congress deserves the credit for the ‘surplus’… and likewise the Democratic Congress that came in under Reagan deserves the blame for raising the deficit under his term.
Clinton should shut his stupid mouth – we wouldn‘t be in this mess if he hadn’t vetoed the excellent plan that the Republican congress had come up with to avert the debt crisis faced under his sadministration. Now it is much worse because he prevented us from taking corrective actions back then.

Posted on July 19, 2011 at 10:18amThe 14th amendment part they quote is in part D…part E states simply that CONGRESS shall have the power to implement all previous sections (which would include D). The amendment strictly forbids the president to act on the amendment!! We cannot allow them to claim the 14th amendment. The key words they keep falling back to are “shall not” – they say these words give the president the power (again, see section E), but why are these words so powerful in amendment 14, and so worthless in amendment 2? Weird, isn’t it?!

They are damned if they do and damned if they don’t raise it. Either way they do it – straight up no cuts or with cuts (100 billion a year is a joke) and taxes (they could tax all of us 100% and not make a dent in the debt/deficits), it will not solve the problem, and there still will be deficits forever! Also to consider the ratings agencies, what they will do to us, if we raise the ceiling w/o cuts we get downgraded, if we raise it with the joke cuts, we get downgraded, if we don’t raise it we get downgraded. All of these outcomes are not good for the KING dollar, the Worlds Reserve Currency is in deep trouble my friends! No in the real world taxpayers in the private sector have to fund the government’s unsustainable out of control spending. Every in the private sector has felt the pinch of layoffs and downsizing . Every government employee is a negative drag on the taxpayer . Threatening to not pay SSI, Vets etc. is just a scare tactic, they do the same thing in local government; when ever budget cuts come up locally they threaten to quit paying firemen, police, teachers etc. They never mention the non essential programs.
As a nation we could save billions just if we just quit providing welfare, education and non-emergency health care to illegals.
and if we did that we would probably slow the influx of illegals considerably.

Posted on July 19, 2011 at 11:19amSwampy — I do not know if this is along the same lines of your posting; I used to have a major student loan that took quite a bit of time to pay off, along with a stupidly obtained credit card (my own stupidity in getting it in the first place). I did not run into the wall of having creditors come after me, yet I decided to finally tackel the monster and get it gone.
Almost two years, and it got gone into the history of my mistakes; I can see very easily how I could have gone so far and so fast overboard that the creditors would have been hounding me, and then the drastic cuts in my life would be needed worse than what I chose to make to pay it off.

Posted on July 19, 2011 at 12:55pmWhether by design or by accident, the tea-party republican controlled house is careening towards forcing the Presidents hand on the debt ceiling. Frankly, time is, or has run out. I haven’t checked today but if they pass the cut, cap, and balance bill I believe they will (and should) come out and say, “That’s it, that all we are willing to do.” They should then follow-up by passing a series of laws to send to the senate to deal with not raising the debt ceiling, laws that require the Executive Branch to use existing revenues to pay (1) debt, (2) military and (3) necessary social programs (SS and Medicare) in that order. This would limit the President‘s and senate’s options. They can accept cut, cap and balance or choose door number 2, no debt ceiling increase, which is, after all, just another form of balanced budget violently and immediately executed. The other door, the one Clinton recommends in this article and which the Obama administration has been floating for weeks is an impeachable offense and will, at its very least, flip the switch on who owns this debt, bully pulpit or not. As for the constitutionality of unilateral executive action given our roughly $200 billion in monthly revenue, only a fool would believe Obama has that option. Hope they try it.

You can’t pick and choose which ones you want to use when and only when they serve your purpose. You also can’t pick out just one part of an amendment and “invoke” that when it’s convenient either.
Take for example this snippet from Amendment 14, Section 4: “But neither the United States nor any state shall assume or pay any debt or obligation incurred in aid of insurrection or rebellion against the United States, or any claim for the loss or emancipation of any slave; but all such debts , obligations and claims shall be held illegal and void.”

Think about it this country is in a real mess and I am sure that at least since the 1980′s all of our elected officials did attend a higher education. So, it seams that smart people aren’t so smart after all. You see i make pretty good money when I work and when the money’s pouring in I tend to spend a little more freely, then comes the layoff and the money stops so I cut spending and sit back and wait for the next big job.

She keeps saying that I should work 2-3 more jobs and it is all my fault! If her credit limit is not raised our life will fall apart and it is my fault…
