Dem Rep: ‘We’re Not Looking to the Constitution’ on the Contraceptive Mandate

Rep. Kathy Hochul: Were Not Looking to the Constitution on Contraception Mandate

Rep. Kathy Hochul (AP)

In what can only be described as a deer-in-the-headlights question-and-answer session during a town hall event on Friday, Rep. Kathy Hochul (D-NY) uttered some bizarre statements about the Obama administration’s contraceptive mandate. The Lancaster, New York, event led to both boos and jeers for the congresswoman, but her statements also rised more serious questions regarding how the administration — and the Democratic Party — views the U.S. Constitution.

Video taken of the exchange is telling.

“Under what portion of the constitution is the government allowed to require a private or a religious organization to pay for anything for free,” asked one of her constituents.

Hochul’s response was more than stunning.

“Well, basically, we’re not looking to the Constitution on that aspect,” Hochul said, with her comment being followed by cheers, applause — even gasps.

But the situation only became more contentious from there. As if this comment weren’t startling enough (after all, the constitution is the blueprint for American governance), she continued.

“What I’m trying to say is — basically, the decision has been made by this congress that American citizens are entitled to healthcare, because the teachings that I was raised under — we take care of the…sick –”

Before she could finish her statement, her questioner interrupted, saying, ”We are also entitled to the freedoms under the First Amendment of the Constitution. That comes before any other freedoms. So, then we have to look at the Constitutions.”

“And I agree with you sir,” she said, as he was still explaining his take on religious freedom.

“I will stand and protect religious freedoms…,” Hochul continued. “But I don’t see a conflict here when Catholic Churches are exempted from this…requirement. I treasure religious freedom in this country — we all do.”

It was then that the man doing the questioning pointed out that hospitals and colleges that are attached to churches are also considered religious institutions and that they, too, should be protected. But it was his next question that left the congresswoman speechless.

“So why don’t we provide free access to band-aids or cancer screenings…?,” he asked. “Aren’t those more important to health care than contraception?”

After a long pause, Hochul said, ”Well, clearly more work needs to be done. You’re raising excellent points.”

Watch the bizarre and epic exchange take form, below:

WGRZ-TV caught up with the congresswoman following the town hall. During the interview, Hochul dismissed the concern over her stance on the contraceptive mandate:

Here’s more on the incident:

The Constitution is what governs government so what she‘s saying is that Democrats weren’t even thinking about the restrictions that govern THEM. What she’s describing is a governmental attitude that has devolved into plutocracy and fascism. That she says restrictions don’t apply to her – and she says it so freely – highlights how little accountability there is in Washington because they know we have no immediate recourse She can trample the Constitution during her entire tenure and the best we can do in response is “hope” that she gets voted out. There‘s apparently nothing we can do if those in office decide during their tenure that the rules don’t apply to them short of a federal tax strike or labor strike.

“Dem Rep: ‘We’re Not Looking to the Constitution’ on the Contraceptive Mandate”

Of course they’re not!!! The Constitution means NOTHING to them AND THEY WANT IT DESTROYED so they can institute Marxism. The moment they tell America literally, that the Constitution is no longer valid, is when I get my guns out and a new Revolution begins. There are various groups out there (good groups who are peaceful patriots – not zealots) who can take a lot, but coming out and literally trying to get rid of the Constitution will not be tolerated by them. They have a contingency plan that if this happens, then those liberal politicians and/or Judges HAVE BEEN MARKED. They will be eliminated. I hope it does not come to that. I really do. BUT, TRUST ME ON THIS, IT WILL HAPPEN……….they are getting prepared even as I write this.
Good luck trying to find me, as this IP jumps all over the world…….;-)))

The sad thing thing is that some people are going to be stupid enough to believe that 20-30 years from now, they will get their “benefits”. We’re already 100 trillion in unfunded debt, and the union won’t be around by then, in the same form it is now.

The oath of the constitution and swearing one will uphold it means nothing to these people. First, they haven’t read it. Second, they don’t care even if they have read it. Both parties of this government have been getting rich on the back of her citizens. Just look at the insider trading information they have, and it wasn’t illegal for them to take advantage of it. Is it any wonder that some in the govt. are fighting so hard against religion in the public square? Pesky little thing called G-d’s law and my rights that come from it, and be darn if it isn’t embedded in the constitution! Anyone who is jumping up and down for joy about the healthcare law should be asking themselves just why the government wants control of their healthcare! Once they control that, they own everything and anything that may be important to us. Whether it’s our life, our bank account, property, etc. that can be seized to pay for all this “free” healthcare by all those extra IRS agents they will be hiring to see if one can “pay” for it. After all, the government must cut back if one wants a family for themselves! That will be because one may want to spend money on their own “family,” instead of these control freaks.

In the book “Ameritopia” by Mark Levin, he describes these people to a “t”. They are called “utopian masterminds” – believing in that “utopia” thing (statists):
“Utopianism is incompatible w/constitutionalism…requires power to be concentrated in a central authority w/maximum latitude to transform and control. Oppositely, a constitution establishes parameters that define the form & limits of govn’t..The Constitution reflects the Founders’ repudiation of utopianism…For the mastermind, where the Constitution is believed useful to utopian ends, it will be invoked. Where it is not, under the pretense of legitimate differences of interpretation it will be abandoned or remade through various doctrinal schemes & admin. evasions….the Constitituon’s words are as undeserving of respect as the rest of history. They will be used to muddle & disarrange, not inform & clarify…the authors..and proponents will be dismissed as throwbacks. To follow them will be to renounce modernity and progress. And yet to follow the mastermind is to renounce the American founding & heritage…
The mastermind relies on uniform standards born of insufficient knowledge & info, which are crafted from his own predilections, values, sterotypes, experiences, idiosyncrasies, desires, prejudices and of course, fantasy….over time, the misery & corrosiveness from their effects spread through the whole of society.”

      Bingo!! Bingo!!!
      We have a winner!!
The population IQ is a treacherous road. The founders didn’t trust them entirely either and that is the reason we are a Representative Republic and not a true Democracy. Not sure if it was Jefferson or Franklin who said a Democracy will only last until the population realizes they can vote themselves all of the money. Up until the last 30 years or so our population, our elected representatives and importantly appointed judges could be trusted with doing what was best for a freedom loving, god fearing, capitalistic America.
IMO the Viet Nam war and the lies we were told about it damaged America deeply. The offspring of the Greatest Generation rebelled against all of our traditional institutions which in their opinion let them down and in many ways I agree with them. The kids are not alright.
They became the “me” generation and now they are still pissed off but organized and hold political and judicial powers. Between the immigrants, the slackers and the homegrown commies we are doomed. Too many votes. Better have a plan outside of the cities. This is not going to end well.

The population IQ has been on a downhill slide ever since the federal government took over the educational system. I wondered how it could keep getting worse, year after year, after all the money that was infested into it. No, that’s not misspelled. Seems this money went for the govt. to hire the most progressive people they could find, to revamp our education system each year, and damage it even further! Our children must be taught to conform to the new socialist thoughts that are quickly becoming a reality in this country. If we dare to try and stop it, they will not ALLOW us to have children. That‘s another reason why it’s not a question of the constitution regarding birth control mandates. It’s not just population control, it’s control over everything!

Americans had better wake up from this bad dream and act before it is too late or these bad dreams will become never ending nightmares.

Although America declared ‘life, liberty and the pursuit of happiness’ for its citizenry in the Declaration of Independence, it is the Bill of Rights in the US Constitution that ensure such freedoms.

What if America were to abolish the US Constitution (which Obama and many others are in the process of doing)? You would abolish the very mechanisms found in the Bill of Rights that promise citizens freedom of religion, freedom of speech, the right to bear arms, the right to property ownership, etc.

If we don’t act, then maybe we don’t deserve to be free.

The issue is should the immoral church be allowed to dictate and force their religion on their employees. This is no different than a muslim company forcing its female employees to wear burkas, would the folks on the blaze stand for that one?

That‘s a pretty weak patch of ice you’re standing on Encinom.

      1) There was nothing to take out of context. There were no edits, no clips, no muted sections. Complete question, complete answer. Your fallback of “it was taken out of context” is a worthless knee-jerk reaction. You have nothing.

      2) Universities and hospitals owned by churches are still religious institutions by definition. The ownership of a company, in this case a church, is allowed to dictate the terms and conditions of employment.

      3) Many churches employ non-members, even to perform worship aspects such as music. Those employees understand and acknowledge the wishes of their employers. That’s kind of what having a job requires. You don’t like the situation, you can leave.

      4) Forcing their religion on employees? Stupidest argument you have ever made. When a doctor, who is Methodist, shows up for work at the Catholic hospital, he is not required to take sacrament, he is not given a test to see if he is canonically pure, he is not shunned. He enters into an agreement with his employer when he starts working, and if he decides to rail against that agreement he should expect to be dismissed.

      5) If a non-muslim woman decides to work for a muslim-owned company, and part of the employment agreement calls for the woman to wear a burqa at work, and she then takes the job – really, she has no room for complaint. She took the job.

And you are defining the church as immoral? Who died and bestowed that honor on you where you could declare a church’s doctrine, who members follow by their own choosing, as immoral? Who do the hell you think you are? Until you recognize you have no moral standing to tell a church what doctrines to follow or not follow, shut the hell up.

By your definition, I could declare that my mortgage company is immoral and I can demand they pay my mortgage off because I am unemployed as a full-time work. Hell I can demand that you pay my mortgage off. How about it Encinom. Pay my mortgage.

Until you can recognize the Constitution does exist and all politicians are required to follow the Constitution in their oath, when they don’t, they can be deemed traitors. If you do anything to bring down the U.S., we can declare you a traitor also.

      This isn’t a religious question.

Where is the President, or anybody in Congress, empowered Constitutionally to force ANYBODY to provide free goods and/or services to the public?

The religious angle is the one they want you to focus on, as if they remove it you will be satisfied that you accomplished something. What they don’t want you to notice is the government now dictating exactly what business will sell, not sell, or provide for free, just like in all command and control economies.

      Focus people.

      @ENCINOM
This is a free country; this does not mean everything is free. It means you have the freedom of choice. So if you as an employee do not like what the employer tells you to do or you do not like the health care they provide, you‘re free to leave and work somewhere else. The government does not have the right to tell companies how to run their business or that I have to buy health care if I do not want it. This is in the Constitution and this is why the liberals do not consult the Constitution, they don’t want it.

Exactly, Ghost. The religion thing is being presented as a smokescreen by the left to distract us from the executive removal of the first amendment. My response to Encinom was purely to refute the ridiculous distractions it threw up. In order to take down the argument, you gotta purge the flak.

Encinom “This is no different than a muslim company forcing its female employees to wear burkas, would the folks on the blaze stand for that one?”

Hello McFly! a Muslim company would most likely behead any woman who had the gall to dare think about working! So there is absolutely no basis for your comparison with a Muslim owned company requiring women to wear burqas. I mean seriously you dolt. That is akin to trying to say the KKK trying to force African American members to wear black sheets rather than white sheets to their meetings. Lay off the drugs and Daily Kos and go learn something.

My biggest problem with this mandate is not the religious aspect although I do agree with those who are taking that point of view. My issue that we keep skirting around is that somehow women are being denied contraception and that it should be free.

      1) Contraception is readily available to all women. Heck Planned Parenthood gives it out!
      2) Contraception is not a medical necessity! That is the purpose of medical insurance.

The idea that by denying women free contraception is somehow akin to going back to the stone age is ridiculous.

@ RAZORHUNTERS, Just when and where was President Nixon impeached? Apparently you were not there as I was. I voted for the man, and for good reason, his opponent George McGovern an Sargent Shriver who replaced Lawrence Eagleton. Yeah, it was one of those hold your nose and vote for the lesser of two evils moments. Yeah, he eventually was caught with the knowledge of some of his men doing the Watergate shuffle. When the threat of impeachment came up, Nixon resigned rather than put the country through more upheaval.
Now, Clinton was actually impeached, just not impeached out of office. He was impeached for committing perjury in federal court. Not sex, but telling an out and out lie in court.
Both were as wrong as the other, no doubt about it.

“I will stand and protect religious freedoms…,” Hochul continued. “But I don’t see a conflict here when Catholic Churches are exempted from this…requirement. I treasure religious freedom in this country — we all do.”

There it is. No conflict people, just typical snake oil from your attention-needing conservative icons. yuck they are despicable.

Sorry TOM but you are wrong. When you mandate that insurance companies or providers pay for free service and some of these religious institutions are self insured, you are forcing the religious groups to pay. Also when you mandate that anyone pay or buy a service you are violating the CONSTITUTION. You will see when the supreme court votes this mandate crap down that you and your lib friends were wrong.

Catholic churches are exempted. Catholic institutions are not. If the church is the owner and operator of a faith based institution it is still considered, for all intents and purposes, a church. Case in point, catholic schools are tax exempt, as are catholic hospitals, adoption service centers etc. These institutions will be shut down if this mandate stands. The influx of people who will have to seek these services in public institutions will overwhelm those institutions, not to mention the expense to the taxpayer to support them. You haven’t thought this through, and apparently neither has this administration. I find it amazing that I have more insight than all the “brilliant” people in the white house put together. Then again maybe not, common sense always prevails.

Quite frankly, none of those institutions should be tax exempt in my opinion, including churches. I think this is one of the biggest fundamental problems in our country.

@ Tomservo- What each of us thinks of any law is of no consequence. The law is the law. In this case these tax exempt institutions are classified as such due to their religious affiliation. To place federal mandates which are antithetical to the tenants of their faith is a gross violation of the first amendment and will surly be ruled as such in the event it is challenged in court.
