More Democrats Call on Obama to Ignore Congress on Debt, Invoke 14th Amendment

WASHINGTON (The Blaze/AP) — House Democrats said Wednesday that President Barack Obama should invoke a little-known constitutional provision to prevent the nation from going into default if Congress fails to come up with a plan to raise the debt ceiling.
Rep. James Clyburn of South Carolina, a member of the Democratic leadership, said he told fellow Democrats that Obama should both veto any House GOP plan for a short-term extension of the debt ceiling and invoke the 14th amendment, which says that the validity of the nation’s public debt “shall not be questioned.”
The White House has rejected resorting to this tactic to keep the nation from defaulting, questioning its legality.
Just yesterday, White House Press Secretary Jay Carney said that 14th Amendment option was “not available:”
Still, Rep. John Larson of Connecticut, who chairs the Democratic caucus, said “we’re getting down to decision time“ and ”we have to have a failsafe mechanism and we believe that failsafe mechanism is the 14th Amendment and the president of the United States.”
Larson said Clyburn’s proposal on the 14th Amendment was met with applause by other Democrats at their meeting.

Senator Barbara Boxer echoed that sentiment to MSNBC:
The Democratic leaders said the vast majority in their party still support a plan for raising the debt ceiling and cutting spending put forth by Senate Majority Leader Harry Reid. But they said the inability of the government to pay its debts could drive up interest rates and affect millions of Americans forced to pay higher mortgages and higher interest on student loans.
Rep. Xavier Becerra of California, the assistant caucus chair, said Democrats are telling Obama, “Mr. President, Republicans through their failure have given you license to do whatever it takes to not let the American family go down into that abyss with House Republicans.”
The post-Civil War 14th Amendment guaranteeing citizenship to all people born or naturalized in the United States contains a provision that “the validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned.”
Some legal scholars have said the president can invoke that clause to keep the nation from defaulting on the debt, although there is no legal precedent for such an action.

If the United States defaults on it’s creditors, it will be because Obama chose to default. If the elderly do not receive their SS, Medicare/aid it will be because Obama chose to default on them.
…and no matter what happens, unless spending cuts take effect immediately, more credit rating agencies will downgrade our ratings and interest rates will skyrocket.

And agreed, congress should all be fired if they vote for this, because they are supposed to enforce it. Obama is just trying to blame someone else again. “SECTION 5. The CONGRESS shall have the power to enforce, by appropriate legislation, the provisions of this article.”
What this means is CONGRESS has the enforcement power of the “public debt” not the president.
It does not say anything about the President at all. Seems “the Marxist” and his minions…ooops, I mean Czars, dont have a leg to stand on!

I don’t think him trying it would be a basis for impeachment. This whole budget/debt ceiling debate is a big distraction from the dirt being dug up on Operation Fast and the Furious. One of the primary people involved in that little operation sent an e-mail on its details to the WH so I wonder where that will lead. Also new information is coming out regarding similar operations in Florida which sent guns to Central American gangs. No coverage on this from the MSM.

Sadly, our other federal courts may not be so scholared on the actual law and choose to rule from the bench. Negative precedent should not be sought. We began an Imperial Presidency with Truman and the Korean “War”. We haven’t had a declarationof war since have we. If Obama does use the bogus 14th Amendment argument and gets away with it, it could be the last time we ever have this discussion either. Congress is becoming irrelevent. Obama should be impeached immediately if he attempts the 14th Amendment end run but the Senate will never remove him from office, so the Birth Certificate issue again must be raised. It doesn‘t need Reid’s socialist Senate’s approval to get Obama out. Biden woul dbe far mor timid after that.

Obama will try to gin-up public support for him to somehow, again, bypass Congress and the Constitution in order to finish his goal of “fundamental change”. Some are waking up to what he meant by this but if we do not get rid of him in 2012 I think the Republic is in almost non-reverse-able trouble.

Saying “shall not be questioned” does not mean “thus we grant the President the ability to control the purse strings whenever it so suits him”. This call isn’t even good sophistry.

4. But neither the United States nor any State shall assume or pay any debt or obligation incurred in aid of insurrection or rebellion against the United States, or any claim for the loss or emancipation of any slave; but all such debts, obligations and claims shall be held illegal and void.
Call me crazy but there seems to be an underlining theme to how this was written, and I don’t think it was in the spirit of crazy spending in Washington. Seems more like selective editing to make it say what you want. Or is the insurrection and slavery stuff in there for kicks.

Including the requirements for citizenship that they have ignored and continue to ignore. Now we see why the requirements for citizenship are in place in our Constitution.

I am beginning to feel they are poking and prodding to see what kind of reaction they get. In Obama’s speech we need to understand that he was speaking from a prepared speech.
