Denver Woman Not Allowed to Fly Because There Was No Female TSA Agent to Pat Her Down

When Jennifer Winning arrived at the small airport in Rock Spring, Wyoming, she didn‘t expect she’d be turned away. But that’s exactly what happened earlier this moth. And if that wasn’t frustrating enough, it’s the reason why that really has her scratching her head: there wasn’t a female TSA on duty to giver her an enhanced pat down.
“They asked if I was on the flight to Denver, I said yes, they said that they couldn`t screen me because they sent all the female TSA agents home,” Winning told KDVR-TV.
She said she even offered to sign a waiver allowing a male agent to pat her down, but the TSA declined.
That left her asking the question many more are echoing: “If you can’t clear it without a female, why would you send them home?”
The TSA, however, is blaming the airline and Winning. It claims the airline wasn’t supposed to accept any more passengers, and it was Winning, not the TSA, that eventually turned her away.
Here’s its statement to KDVR:
“In small airports, TSA works closely with the airlines and airport to keep the security checkpoints open to ensure that all passengers are screened appropriately.
Once TSA is informed by the airline that our screening services are no longer needed, the security checkpoint is closed. In this instance, SkyWest made final boarding announcements and notified TSA that no additional passengers would be accepted.
In addition, a TSA officer also made two public announcements asking any remaining passengers to report to the security checkpoint for screening.
After both the flight and checkpoint were closed, a female passenger requested screening. While there were no female officers present at the time, ultimately the passenger was not screened by TSA because the airline was no longer accepting passengers for the flight.”

Posted on February 10, 2012 at 4:30pmHey @LIBERALSLAYER – the TSA doesn’t grope you. Groping requires sexual intent. I assure you that, despite a few bad apples, the military veterans, moms and dads, grandparents, and other ordinary people just like you who make up the TSA have no such intent. Your choice of words is inflammatory and inaccurate. Also, TSA agents don’t wear brown shirts and do not resemble the Gestapo in any way. Go ask someone who actually knows what the Gestapo really did, someone who’s loved one was murdered or tortured or raped by that group of people or others like it, and see how much sympathy they have for you because you have to take your entitled shoes off and get a pat down from time to time. Gestapo. Another example of your ignorance and inflammatory language. Finally, the TSA is not unconstitutional. The U.S. Constitution tasks the federal government to provide for the common defense. This includes the defense of innocent people like you from people who like to blow things up because they hate the shining city on a hill. As a result, the U.S. Dept of Homeland Security was created along with the TSA, authorized by 49 CFR 44901 and 44903, which was enacted into law by elected officials of our glorious constitutional republic, pursuant to the U.S. Constitution. The 4th Amendment protects us from UNREASONABLE search and seizure. Preventing all of your body parts from being scattered by an explosion seems fairly reasonable. Posted on February 10, 2012 at 4:55pmIt is an unreasonable search because they have no indication or probable cause that you are attempting to commit a crime. The amount of intrusion is not justified by the statistical chances of said bomb. The TSA has not stopped any actual terrorists with these methods and in fact have let multiple person through with explosives and guns. Any ex military working for the TSA is a traitor to the country and violator of the oath they swore when they enlisted.
Report Post »Conservative_Fed
Posted on February 10, 2012 at 6:07pmIf you would take some time to research the 4th amendment before you make comments that have no factual value, you would know that administrative searches do not require probable cause. To pass constitutional muster, the administrative search must be: “conducted in good faith;” “as limited in its intrusiveness as is consistent with satisfaction of the administrative need that justifies it;“ and ”passengers must have notice of their susceptibility to the search.” Let’s address each of these areas. First, the search must be conducted in good faith. No person in their right mind believes that the TSA conducts the searches pursuant to some sort of evil intention or for any reason other than to ensure the safety of human beings on the airplane. If you disagree, then your reasoning skills have been overridden by your anger that someone once took your bottle of pepsi away. Second, in regard to intrusiveness consistent with the threat: I am a TSA official in a position that requires a hefty security clearance. I look at intelligence reports each day and am terrified by how real and close the threats are. Anyone with the right information has concluded that the intrusiveness is justified by the threat. This includes your elected representatives and the courts (The Supreme Court has on many occasions upheld that the TSA is acting constitutionally). Third, everybody knows that they will be searched at a TSA checkpoint. The TSA hasn’t stopped any actual terrorists because

Posted on February 10, 2012 at 9:25pmWhen I was a federal employee and my wife was one as well, our entire family would get sent to secondary screening every time we flew. I would routinely see groups of Muslims wearing their garb and they never went to secondary. Once i was on official business and missed the early flight out. I waited 8 hours in the airport and watched the TSA. Once again no Muslims were sent to secondary. I am convinced that the screen us because they knew we were govt employees and thought it would make a good dog and pony show. I had one agent tell me if I didn’t like it I should walk home. Now I don’t fly, at all.
Report Post »The TSA should be disbanded. Work should be done by Government employees only in instances in which the work is inherently governmental in its nature, the government has a vested interest ( monitoring govt contractors, cant have the fox watching the hen house) or involves secure information.
Security checkpoints would be best served by contractors. Contractors could then be sued if they show a pattern of sexual abuse or of slacking off on the job. Airlines are the least likely to allow another hijacking because it would kill their companies image and income.

Report Post »Jeff Bassett
Posted on February 10, 2012 at 5:05pmAs long as she had a chance to get on the flight, there is no excuse to not allow her such a chance.
Report Post »To say that the constitution does note how you can travel is another way of giving the government the excuse to control such. If what you note is true, the government has the right at any time to say you cannot travel by car when they want, by bus when they want, by train when they want, by walking when they want.
ALL most all those means are by privately controlled businesses that are now bottlenecked by government control. There are talks of doing these inspections at train and bus terminals by the way.
Again, when the government takes control of such, they can take such away from the people. As Franklin noted: “Sell not virtue to purchase wealth, nor Liberty to purchase power.”
Or to put in clearly: “People willing to trade their freedom for temporary security deserve neither and will lose both.”

Posted on February 10, 2012 at 7:12pmJeff – if the founders wanted to limit the government’s authority in this area, they would have made those specifications when they drafted the constitution. Right or wrong in your opinion, it says what it says, and there was no denial of a constitutional right here. Having said that, maybe the woman deserves an apology from the airline for closing out the flight early, or maybe she should have arrived on time. Apology, maybe. Violation of constitutional rights, not by a long shot.

The fact of the matter is that both conservatives and liberals are taking away our rights presented by the constitution and the majority are too busy trying to just survive to fight it. More over many feel their votes just don’t count because both political parties ignore the constitution.
Its a shame we live in a post-constitutional country where our rights are being usurped constantly because fools like you feel it is not that important to worry about.

Can you tell me why pilots ( myself one) usually go through heck with TSA officers when going through security check points when we have already gone through extensive background checks and are trusted to fly passengers safely to their destinations.
Lets face it, the TSA along with the current administration is on a power trip and security is not the first priority, it power and intimidation power over the public. Regardless of what she says, if she was on time, the airline representatives would not have closed the doors to the airplane and decided that no more passengers were going to be processed for the flight.
“…please show me the language that gives the president the right to dictate how the TSA should work…”
The TSA is a component of the U.S. Department of Homeland Security which resides in the executive branch of government. Article 2 Section 1 of the U.S. constitution places the President of the United States in command of the executive branch.
“…or for that matter the law that states the government has the right to restrict travel in such a manner…”
49 CFR 44901
Google it.
“…having noted your other comments, can you tell me why the TSA has to follow such hard lined tactics that have been proven not to work well…”
An airplane originating from a U.S. airport has not been hijacked or blown up since 9/11. There have, however, been several interdicted attempts. There’s your proof.
“Can you tell me why pilots ( myself one) usually go through heck with TSA officers when going through security check points when we have already gone through extensive background checks and are trusted to fly passengers safely to their destinations…”

Posted on February 11, 2012 at 2:43pmAlso, Jeff, what is this “heck” that you have to go through as a pilot? You get to leave your shoes on and you get to bring all of the liquids you could ever desire. Seems like an easy process in comparison to the process for passengers. Look – the enemy has specifically expressed interest in exploiting the vulnerabilities associated with pilot screening. I’m sorry that you feel like you go through “heck,” but that is how this ridiculous game works. The enemy has all the time in the world to find vulnerabilities, we try to mitigate them as best we can. As technology improves and credentials become more secure (more difficult to exploit or counterfit) I’m sure that pilot screening will get easier. In the meantime, a little bit of support would be appreciated.

You can’t have too oppressive of a government. Their cause is your cause. They fight for you. They are not newcomers to this. They’ve been in the trenches fighting for you before YOU fought for you.
Sounds like Obama, don’t it?

Posted on February 10, 2012 at 3:12pmWHAT? Why did she require an enhanced pat down? Did she fail the Xray? The woman had a ticket for the flight and they announced FINAL boarding 35 minutes before the flight? Since when do they do that? I think the TSA was just covering it’s butt as usual,

Posted on February 10, 2012 at 3:25pmSounds like she missed her check in time. In small airports once the counter closes there is no more check in. If she was checked in but not cleared thru security by the time the flight boarded and the flight closed, she’s still too late. Happens often.

Posted on February 10, 2012 at 4:10pmAirport likely did not have one of those “see you naked” machines. A plain old metal detector no longer suffices for the grope and grab group we are paying to do this to our citizens.
Refuse to fly! Hit the airlines in the pocket and force a change to profiling like Israel does.
TSA is an expensive, nonfunctional bad joke.

Posted on February 10, 2012 at 3:05pmI was just wondering if your a lesbian, would you considerate sexual harrasement to be “patted down” by a female TSA agent?. Maybe the government should form a committee & make sure their not offending anyone!!!!!!!!!!!!!!!
