Deportation Imminent? Gay Couple in San Fran Loses Immigration Battle

Remember Henry Velandia, the Venezuelan man who faced deportation, but successfully petitioned the U.S. government to remain in America as the legal spouse of American citizen Josh Vandiver?
While the Obama administration stepped in to halt Velandia’s deportation, another couple in a similar situation may not be so lucky.
Anthony Makk, an Australian citizen who married an American — Bradford Wells — seven years ago, also faces deportation. The couple got married in Massachusetts and have lived together for the past 19 years.
In a case that paints a stark contrast to Velandia’s, the U.S. Citizenship and Immigration Services has denied Makk’s request to be considered for permanent residency. The federal agency has apparently pointed to the Defense of Marriage Act, a 1996 law that defines marriage as an institution between one man and one woman. The San Francisco Chronicle reports:
The decision was issued July 26. Immigration Equality, a gay-rights group that is working with the couple, received the notice Friday and made it public Monday. Makk was ordered to depart the United States by Aug. 25. Makk is the sole caregiver for Wells, who has severe health problems.
One reason this case is intriguing stems back to the July decision that allowed Velandia to stay in the America. Attorney General Eric Holder has publicly stated that the Obama administration will no longer support the Defense of Marriage Act in court, yet the situation surrounding it is somewhat complicated.
Although the administration has decided that the law is unconstitutional, House Republicans have hired outside counsel to defend it. In response, the administration claims that it will continue to enforce the law, but will evaluate individual cases. Critics claim that this evaluation simply isn’t happening. The Chronicle continues:
The agency’s decision cited the Defense of Marriage Act as the reason for the denial of an I-130 visa, or spousal petition that could allow Makk to apply for permanent U.S. residency. “The claimed relationship between the petitioner and the beneficiary is not a petitionable relationship,” the decision said. “For a relationship to qualify as a marriage for purposes of federal law, one partner must be a man and the other a woman.”
Makk claims that he has never been in the country illegally. He gave up a career in Australia to be with Wells and then started a business in San Francisco, investing in rental property so that he would meet visa mandates. According to Democratic Rep. Nancy Pelosi’s office, the congresswoman has contacted immigration officials on the couple’s behalf.
It is likely that Makk and Wells will seek to employ last-ditch attempts to ensure that Makk can stay within U.S. borders. While moving to Australia is an option, doing to would cut Wells off from his health insurance, which he desperately needs as he struggles with AIDS and relies on Makk to provide him with care.

The Venezuelan on the other hand provided valuable press for them and will probably be grateful and dependent. I have a problem with the Dept of Injustice only applying the law where they see fit–between this, the NBPP case they let go and the instructions not to go after anyone black in voter fraud or intimidation, the ATF scandal, etc., and let‘s not forget Holder’s many offenses before serving under Obama—enough is enough. They have to go.

This idea goes back to 1992 or 93 when geneticist Dean Hamer proposed the idea of a gay gene. It was properly scrutinized until 1998 when he admitted that no such gene was found. We have a council for former gays known as “Exodus” or i believe the name is something like that. Basically it’s an org of former gays whom turned straight. Or went from straight to gay and then back to being straight. But all organism are born straight because of an instinctive need to reproduce.

I know of a man in Hawaii who died of AIDS and was drug addict. Before he died he had become friends with some christian teenagers who ministered to him. His death crushed these kids who cared about him so much they rushed the hospital is Honolulu to pray for him….God raised him from the dead….no longer a homosexual or addicted to drugs.
I say all of that to say this; there is a spiritual component to this life that liberals and most conservatives do not understand. If you could rip away the veil between here and the other side and see what was really happening in the spiritual realm it would change your view of things…unless you are a die hard liberal!

I think the term homophobic is misleading. A phobia means being afraid of something, but I on the other hand do not fear the gay. I JUST DON’T LIKE THE BEHAVIOR. I will always be civil to a known gay because no matter what, we are all God’s children. However, whether it’s a so-called choice or genetic defect, it’s creepy and unnatural period. “Don’t Ask, Don’t Tell” should have been a national policy and not just for the military.

This man from Australia has remained in the USA for the past several years legally, yet has now remained past his allotted visa time and has been instructed he needs to depart the USA by August 25, 2011. Though he has an alleged relationship with a second man, he has failed to meet the qualifications provided by the USA for a foreign national to maintain residence within the country.
Regardless of any other facts, these are the facts that require deportation. @IFTRUTHBEKNOWN, I don’t see how the fact that he is “gay via genetically mutation,” your words not mine, has anything to do with the law. I suggest you learn the legal system…in fact, I would love to help.

I actually had a bunch of parakeets, and Padget was the smartest of the bunch, so I REALLY wanted him to breed. But Padget paid zero attention to the girls and was constantly hitting on Abner Periwinkle, who was not only straight, but was, as most parakeets prefer to be, in a bonded relationship. Never did get him to breed, but he did eventually form a bond with a guy named Harvey so I gave him to Harvey, who lived in San Francisco.
No joke.
And, I’ve known a lot of gays since then, and while being gay is not so painful now as it was when I was growing up, I can not imagine anyone choosing it.
My two younger brothers were once having an argument about this issue. My youngest brother was saying it was a choice, a perversion, and my middle brother was saying no one would choose that. Youngest brother said, “God wouldn’t do that to someone!” Middle brother said, “God doesn’t micromanage.”
I wouldn’t ever be fool enough to participate in an argument with either of my younger brothers as both are ALWAYS right, so I was certainly doing my best to stay out of that one. In the end, I think it’s true that we are all given burdens in life. God does hear and answer prayers, but sometimes his answer is ‘no’ or ‘wait’ and I suspect my middle brother is right; God is no micromanager. He could… but sometimes things just happen, and those things become learning experiences, a part of Life.

These two men are in what appears to be a committed relationship that has lasted for 19 years. If they have been following the laws of this country there should be some way of working this out. My wife and I have just celebrated our 30th wedding anniversary. I do not understand why the gay community can’t enjoy the same benefits. They are out to seek to repeal the Defense of Marriage Act by using this situation to manipulate the general population and gain sympathy. No matter how you package Homosexuality the truth prevails. It is an abomination against God’s natural order for humans and is not biologically or genetically determined (See Romans 1:18-32).
The only thing you may be wrong on is, if your moniker stands for Romney in 2012, you have bet on the wrong horse. You might want to look up his record while Governor of Massachusetts.

Go ahead and love a greedy man, he may flip you a few pennies to appear less greedy but he will still try and take everything you have.
As far as “love your neighbor as yourself”, some would say the “self” is nothing more than a bunch of images and memories stored up in the brain. In order to love your neighbor AS YOURSELF, your body has to give up the images and exist as a physical presence living in the physical world. See if your body can experience thought as just sound, it’s not “yourself thinking” it’s just sound in the head, not your sound, not you, not the spirit, just sound, no different than sound in the environment.

First of all, there are no perfect people. Where in the Bible did you find that? And just because I love my neighbor doesn’t mean that I must accept his or her sinful behavior as normal and ok. I can offer my neighbor help to repent from his sinful ways (after all it’s my Christan duty to HELP, not force, people to free themselves from thier bondage to sin, which, by the way, is what Jesus meant by, “love one another as I have loved you”). He offered them repentance from thier sin then forgave those who did repent. But the final decision to repent from that sin is ultimately up to the individual. Everyone is born a sinner. You, me, EVERYONE! Since you‘re trying to quote the Bible to use it against us believers then here’s one for you, “EVERY KNEE SHALL BOW” !!! Including yours! I hope you can ultimately find your way home. JESUS LOVES YOU and so do I !!!

This is a fallacy, we are not born sinners or sinful. Sin is taught to children out of ignorance or through deceit or by the example of those that surround them. We are all born sinless, sin only creeps it dirt head in when were are able to distinguish the truth of what is right or wrong and chose the wrong. Christ taught that we should be more like children especially when it comes to faith…Why is that? Are they just more gullible or just more pure of hearts?

I don’t want illegals here no matter what color they are, but obviously, this racist administration only wants to enforce those laws on white people.
