Legal Expert Dershowitz Tells Beck: Zimmerman Charges ‘Unethical’ and ‘About Politics’

During Tuesday morning’s radio broadcast, renown legal professor Alan Dershowitz joined Glenn Beck and his co-hosts to discuss the legal intricacies of second degree murder charges, particularly as they relate to George Zimmerman in the Trayvon Martin case. The veteran law expert asserted unequivocally that the evidence in the case does not support the charge of second degree murder and that it is “unethical” behavior, “not incompetence,” on the part of the prosecution to have pursed such a charge.
Dershowitz explained that in order to substantiate second degree murder, pure malice and “extreme disregard” for human life must be evident and that nothing present in the affidavit submitted met those elements. He added that the prosecution would have had to show Zimmerman made a conscious decision “to kill the young man because he hated him.. or didn’t value his life.”
The legal professor also explained that, given the pictures of Zimmerman’s bloodied head and the facts of the case known thus far, a second degree murder charge is nearly impossible to prosecute. With this in mind, Dershowitz concluded that the prosecution must have purposely withheld evidence for political purposes in order to pursue a second degree murder charge.
“The blood is a smoking gun,” he stated emphatically.
According to Dershowitz, in Florida, a second degree murder charge is the same as first degree murder except for the fact that it does not carry the death penalty. This is not the kind of case where second degree murder “is charged by ethical and rational prosecutors based on the evidence.“ He added that withholding evidence is unlawful and reminded that ”this is not a poker game.”
In exploring the reasons why the prosecution might have withheld evidence, Dershowitz said that the prosecutor was politically elected and likely seeks to avoid riots and other forms of backlash through “over-charging.” He said that while a charge of manslaughter would have been a reasonable point of debate among people, a second degree murder charge shows the prosecutor’s motives were not about justice “but about politics.” Dershowitz explained to Beck that if he were a judge, under Stand Your Ground laws, he would undoubtedly throw out the charge of second degree murder but said even if Stand Your Ground were not applicable, Zimmerman could still be legally tried under the lens of self-defense.
In analyzing where he sees the case leading, Dershowitz said he could perhaps envision a plea bargain, but definitely not a second degree murder conviction. He pointed out, however, that to ensure a fair trial, the case will have to be moved to a different county so that jurors will not feel threatened by agitators and can comfortably and fairly weigh their verdict without risking harm to themselves or their families.
Dershowtiz was also quick to note that people’s political leanings should not factor into this case as it is not about politics, but instead “about justice.” He noted that, per the core principles of America’s justice system, it is better to “err on the side of acquitting the possibly guilty” rather than err on the side of “convicting the possibly innocent.”

So IF Martin was actually grasping and beating Zimmerman’s head against a section of the walkway, that concrete IS A WEAPON, and constitutes aggravated assault with intent to commit bodily harm. Which IF that occured there is evidence of ACTUAL body harm. IF Zimmerman was assaulted in that manner with Martin on top of him, Zimmerman had every right to defend himself. IF that is what happened and Zimmerman not protected himself we would likely have a dead or severely injured Zimmerman with likely an unknown assailant.

He said that on his 9-11 call, something Zimmerman seemed to do a lot, like 50 times over a couple of year. Zimmerman was definitely a strange guy, and saw lots of imaginary threats. What made the other 50 people he called 9-11 for suspicious? I don’t know.
So did Trayvon have an inclination to simply fight someone for pleasure? No, I don’t think so, he didn’t have a history of that kind of thing. However he was probably street-wise, and knew that when someone is following you for no evident reason, there is no reason for that other than to rob you or do you harm.
Now you, RJJinGadsden, would run away, as would everyone is taking up for Zimmerman, run away as fast as you could, and forever in the future also run away from this neighborhood bully. But Travon didn’t. He stood his ground rather than be bullied forever or be robbed or beaten. You can stand in Florida, that’s the law.
So Travon probably did stand his ground and go after what he saw as a bully or a stalker or someone trying to rob him. You wouldn‘t have done the same because you’re a sissy. But Travon did, he stood his ground. So the guy following him, the stalker, the potential robber, the bully, killed him. That’s only okay if your instinct is to run away and hide from the neighorhood bully and let someone intimidate you.

I hope to see a completed investigation and the truth come out regardless who is determined to be right or wrong. Should Zimmerman be found guilty of the current charge or even a lesser I hope to see the book literally thrown at him. Report Post »Again, to correct you, I am not taking up for Zimmerman. I have looked at the information available and so far the prosecution has very little to go on to charge him. Evidence that has so far been revealed tends to favor his story…so far. I say that we, the public do not know the whole story yet though. Zimmerman’s wounds tend to illustrate he was on his back with Martin on top of him, at least for part of the struggle. Who attacked who? We still do not know and I will not speculate further.
JZS, I would figure you to be the type to run away at the first sight of Martin had you been in that position. I, like many here have been trained to run towards the danger, not away from it.

If that is the case, you are obligated to report your observations to the police…now if I am mistaken, and you weren’t there, well…then your opinion means absolutely squat, just all the other conjecture that is bandied about regarding this case. Frankly, everyone needs to get the facts straight but due to the political nightmare this has become, it is doubtful that will ever occur. If Zimmerman takes a plea deal he is a fool. No righteous jury will convict him on the evidence presented in the indictment. That said, when he is acquitted, the ‘92 riots are gonna look like a backyard barbecue in comparison to the chaos that will manifest itself in the streets of the big cities. To all the LEOs out there…stand-by for some serious stick time! And bring your A-game. This will be one for the ages.

But, old people will hurt you in a heart beat before letting you hurt us. I also carry a SIG P226 with a 20 round mag in a holster with another 20 round mag in it’s mag pouch. With one in the breech that makes 41 rounds of Federal Hydra-Shok Plus-P-Plus at the ready. My wife does not have the same background, but is well trained to use her Glock 17 with a spare mag that gives her 35 of the same rounds at the ready. Good point, but Z has a case against the pretentious mother as well for inciting riots and libeling him by callimg him a murderer “in cold blood,” if he can get a fair jury or judge. If honest, either one will clear him.
All the news orgs, certain members of the CBC, Al and Jesse, the NBPP, plus others, incited violence against Zimmerman, so he‘s likely to be a wealthy man if he doesn’t fall into the trap of accepting a plea bargain no matter how miniscule the sentence might be. Richard Jewel became wealthy for the same kind of hatred directed against him.
What concerns me is that the state of Florida could be sued as well, which could very well cause them to manufacture evidence or commit any number of devious manipulations to get him convicted of…or admit to…. culpability. The political macinery here is almost as corrupt as Chicago.
I don‘t trust Zimmerman’s lawyer. He’s either incompetent or just dying to make a deal so as not to be maligned by the same people he has to work with…….. and the government.

That is one of the most important features of the law: victims who are attacked (and have to shoot) are protected from legal persecution from the perpetrator’s family and the prosecutors. However, there as some prosecutors who skirt the edges of the law.

Zimmerman was at his truck fixing to get into it when Trevon sucker punched him. Still wondering if that Tea was in plastic or glass. There will not be a civil case either because he had a right to stand his ground according to Florida Law. They may try to sue Florida, but they will need some “luck” with that. This is a state thing and Obama and Holder needs to take a hike. Obama needs his citizenship to be President and we need someone in the Justice Department who is not a criminal running guns to Mexico. They need to be in jail themselves and stay out of everyones’ business.

Exactly right. Anyone out at 2 a.m. in the morning messing about the club house and residences needed to be monitored then, and they need to be monitored right now if it occurs again.
Note that most people and the MSM aren’t even considering that there are TWO eye witnesses who saw Martin on top of Zim beating him in the face, while he was screaming for help.
The perp was casing places to add to his jewelry connection and became enraged when he was spotted by Zim. He took off running, circled around, came back and blasted the watchman in the face.

So I cannot see the unethical part. That is something Zimmerman and God will have to work out and the U.S. Justice Department and Obama are not God. Obama is not even likely a citizen. He put Holder in that position for some reason. He knows something the general public does not. It is part of his agenda.

She is a Republican though, and apparently one with little to no backbone. She certainly would have been better off to have allowed this to go to the Grand Jury. That would likely have brought what ever is going to happen to fruition even sooner. You beat someone who has a gun on them just for following you in the rain, you take your chances.
From what we’ve heard so far, Martin was a dropout druggie punk who, like many teenage males, likely had some kind of macho belief that he had to be an alpha-male, and picked the wrong person to act on that belief with.

There is ample evidence that Zimmerman isn’t a racist (Just search for “Zimmerman Defends Black Homeless Man”) – he pressed for prosecution of the son of a policeman for brutatlity against a black homeless man – The attacker was, in fact, the son of one of the policeman that let him go after he shot Martin.

Trevon was used to beebopping around in his own neighborhood and not getting stopped or asked anything. He thought he was too good to be questioned by authority. Having a LE background myself I would expect somebody acting in the capacity of a neighborhood watch especially after a number of suspicious recent break ins in the area to keep an eye on a suspicious looking person. Now before you attempt to tell me that the 911 operator “Ordered” him not to follow a suspect, they by Florida law do not have the capacity that a police officer does to order somebody to do or not do something. But, Zimmerman stated that he was on his way back to his vehicle when attacked. Do either of us know if that is the truth? No, neither of us actually do. You speak as though YOU want him to be guilty of a crime. I want the truth to come out if there is a crime, it should be dealt with correctly. Nobody needs to root for an outcome in a criminal proceeding as if you are rooting for a favorite football team.

If the black punk had not attacked Zim by blasting him in the face, he would be alive today. The job of a neighborhood watchman is to monotor suspicious activity. Following at a distance is “observing” and doesn’t justify attacking someone and smashing his head into concrete.

Even if it goes to trial I‘m certain there will never be a conviction – too much reasonable doubt & evidence supporting Zimmerman’s account.
This prosecutor didn’t let this go to a grand jury ‘cuz she knew they would not refer it for trial.
This is going to get ugly when Zimmerman is acquitted.

With that being said when you read stand your ground laws and selfdefense laws the only requirement to be justified is that you were in fear of your life being taken. I for one would be in fear of my life being taken if someone was smashing my head against the ground. I will say this too I read a couple of comments the other day where someone said that even if his head was being smashed against the ground TM was unarmed GZ overreacted. I have CWP and one thing that was drilled into me by my instructor was don’t put yourself in a situation to have your weapon taken from you by an assailant. I believe that is probably what GZ was thinking when he shot TM. He did not want to be knocked out and then have his own weapon used on him. Anyway thats is just my opinion.

Zimmerman should never have been charged with second degree murder. The state of Florida gave the “stand your ground law” and may not change the rules in the middle of the game. The man was on duty as a watch official going about his committment. He had a right to inquire, especially when he was there for that purpose. Trevon was likely trying to make a name for himself (he sure did that, didn’t he?) and proceeded to use the rhetoric he has heard down through the years to disrespect authority, especially someone a lighter shade than himself. Had Trevon answered a few questions instead of attacking Zimmerman, this mess would not have ever happened. Put the blame where it goes. Zimmerman was where he was doing a duty he was committed to. So who looks at fault here? Zimmerman has the law to back him up, so who is going to appease a bunch of lawless people because they mob up? Stand your own ground. If you need more help, call out the national guard. This is your state and the laws are your own. If you cannot stand behind them, then don’t make them.

Report Post »In an act of violence against one self the “stand your ground” law doesn’t even apply, in every state you have the right to defend oneself against death, with violence (not perceived , actual violence) Therefore, if Trayvon was shot after the start of the physical altercation (and not started by oneself) he has the right to defend himself. How some laws still pertain to how one does this but there are no limiting laws in FL. But the “stand your ground” law doesn’t even come to play in this case.

Is there any information about the actual arraignment, or has there even been one yet? That’s where the prosecution and defense present their initial evidence and the judge decides whether the evidence is sufficient for the case to go to trial and the defendant enters their plea. THAT is the stage where, if the evidence was insufficient, it should have been thrown out.
